AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY,
COUNTY OF MCHENRY, STATE OF ILLINOIS, AS FOLLOWS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, ILLINOIS:
SECTION 1: That Article XV, Section A of the Zoning
Ordinance of the City of McHenry, County of McHenry and
State of Illinois, as passed, approved, and as subse-
quently amended, be and they hereby amended by adding
"adult congregate care facility" as an additional Special
Use.
SECTION 2: As to the Petitioner's request to the
City to grant an "adult congregate care facility" Special
Use to the Subject Property, legally described in the
attached Exhibit A, the City Council makes the following
express findings:
1. the Special Use will not cause substantial
injury to the value of other property in the
neighborhood in which it is to be located;
2. the location and size of the Special Use, the
nature and intensity of the operation involved
in or conducted in connection with it, the size
of the site in relation to it, and the location
of the site with respect to streets giving
access to it, shall be such that it will be in
harmony with the appropriate and orderly devel-
opment of the district in which it is to be
located;
3. the :Location, nature and height of buildings,
walls and fences, and the nature and extent of
the :Landscaping on the -site shall be such that
the use will not hinder or discourage the appro-
priate development and use of adjacent land and
buildings, or will not impair the value thereof;
4. Parking shall consist of a minimum of
118 spaces at the time Phase I is com-
pleted,and at such time as two additional
stories are added to the building and open
for occupancy, there shall be no less
than 178 parking spaces. All parking will
be properly located and suitably sdreened
from adjoining residential uses, and the
entrance and exit drives shall be laid out
so as to prevent traffic hazards and
nuisances.
SECTION 3: That all Ordinances, parts thereof, in
conflict herewith be, and the same are hereby repealed.
SECTION 4: That this Ordinance shall be in effect
from and after its passage as by law provided.
