AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Section 2-76 of the Municipal Code, City
of McHenry, inois be and the same is hereby amended by
substituting and/or adding the following provisions as and
for paragraphs C, D, E, G, H, I, J, K and L thereof:
SECTION 2-76. SICKNESS; AND ACCIDENT BENEFITS
C. Amount and Method of Calculation
Full-time employees shall be entitled to 10 days,
consisting of 8 hours each, of sick leave with pay for
each 12 month period of employment, computed at the
regular rate of straight time pay received by the
employee in the last pay period immediately prior to
taking such sick leave. Sick leave shall be accounted
for or banked on a calendar year basis, with sick
leave for the employee's first and last year of
employment being prorated as hereinafter provided. If
an employee's employment began on or before the 15th
day of the month, the employee shall be entitled to
accumulate sick leave benefits for the entire month in
which such employment began. If an employee's
employment commenced after the 15th day of the month,
such employee's sick leave benefits shall not begin to
accumulate until the following month. An employee
shall not accumulate any sick leave benefits for the
last month of his employment unless such employment is
terminated after the 15th day of the month.
Unused sick leave may be accumulated on a year to
year basis up to a maximum of 90 days.
Newly hired employees may use sick leave when
necessary after the first full day of sick leave
credit is accrued. If an employee is sick more days
than either earned in any calendar year or available
from the accumulated sick leave for previous years,
such employee shall not be entitled to receive any
compensation for those excessive sick days.
D. Payment for Unused Days
An employee who uses less than three sick days
leave during any calendar year may elect to receive
payment of sick leave compensation for the difference
between three days and the number of sick leave days
actually used. The number of days for which such
employee elects compensation shall be deducted from
such employee's accumulated sick leave. Employees
who elect to receive such payment must notify the City
Clerk by January 31 of the following year with such
payment to be made by February 28th of such following
year.
Upon termination of employment, an employee with
less than 40 days of unused accumulated sick leave
shall not be entitled to receive any payments for such
accumulated sick leave. However, employees with more
than 40 days of unused sick leave accumulated on the
date of the termination of their employment, shall be
entitled to receive compensation for one-half of the
unused accumulated sick leave, provided such
termination of employment results from the employee's
retirement, voluntary resignation or death. For
purposes of this paragraph only, such retiree shall be
at least 55 years of age and shall have been employed
by the City for at least 10 years, or, in the case of
police officers, such employee shall have been
employed as a full time police officer by the City for
20 years. In the case of a voluntary resignation,
such payment shall be conditioned upon such employee
giving at least 10 working days prior notice in
writing to the department head of his resignation and
upon the return to the City of all City property, in
good condition.
E. Payment_for Days Used
Employees electing to use their sick leave shall
notify their supervisor thereof prior to the end of
the first pay period during which such sick leave is
taken. The employee's supervisor will thereupon
immediately notify the City Clerk's office of such
sick leave absence. Each department head shall be
responsible for notifying the City Clerk's office of
their own sick leave absence prior to the end of the
first pay period during which such sick leave is
taken.
G. Use of Sick Leave by Employee
Sick leave is provided solely for the illness of
the employee. For the illness of a dependent, the
employee must use personal days, vacation days, or
other accumulated time off. In addition to employee
illness, sick leave may be taken for up to three days
by a male employee upon the birth of his child.
In addition, in the event of a death in the
immediate family, an additional three days with pay
may be taken by an employee. This time off is
separate and distinct from regular sick leave. For

the purposes of this section, immediate family shall
mean the employees' mother, father, brother, sister,
spouse, or children.
H. Penalties for Abuse or Excessive Use
Excessive use or abuse of sick leave is a valid
criterion in employee evaluations and may be grounds
for disciplinary action or termination.
I. Need ,for Medical Statement
Whenev'er an employee elects to take sick leave
absence of more than three consecutive days on account
of illness, the City may require such employee to
furnish it with a written medical statement explaining
the nature and extent of the illness, surgery or
accident and the ability of the employee to return to
his work duties. In addition thereto, the City shall
have the right to require such employee to submit to a
medical examination by a doctor selected by the City
(but at no cost or obligation to the employee) for the
purpose of performing a diagnosis and a prognosis of
the employee's medical condition, determining duration
of the disability and the employee's ability to
perform suitable work.
J. Program Phase -In Period: January 1 1985 -
December ji.
In order to fully implement the sick leave bank
program, an allowance of twenty days will be placed in
the employees' sick day bank as of January 1, 1985 for
those employees with three years or more of prior
service to the City. These additional days will
remain in the employees' accumulated totals in
addition to days earned under the new ordinance.
These twenty days shall not be paid out upon
termination, retirement, or death of the employee and
will expire on December 31, 1987 without extension.
An employee having under three years of service
will accrue sick leave days from January 1, 1985 as
they are earned aforesaid.
K. Reimburseme.nt of Disability Pay
When an employee is receiving his full salary as
a result of using days from his sick leave bank, the
employee's $125.00 disability benefit shall be
retained by the City. When an employee's accumulated

sick leave days have been all used up, the employee
thereafter shall receive only the $125.00 per week
disability payment during the remainder of his illness
from the insurance company until such disability
insurance benefits expire.
L. Workers Temporary Compensation Benefits to be
upp emen e
Whenever an employee is entitled to receive
temporary compensation benefits under the Worker's
Compensation Act, the City shall pay such employee
such additional sums so that the total of such
benefits and such additional sums shall equal such
employee's full salary during the time that such
temporary Worker's Compensation benefits are being
received provided, however, that such supplementary
payments from the City shall be made according to the
following schedule:
(1) For employees having less than three (3)
years of service: Up to six (6) weeks full
pay.
(2) For employees having more than three or more
years of service: Up to thirteen (13) weeks
full pay.
Supplemental compensation to police officers who
are receiving temporary compensation under the
Worker's Compensation Act shall be governed by the
provisions of the Illinois Revised Statutes.
SECTION 2. The Municipal Code, City of McHenry,
Illinois be an-T the same is hereby amended by adding
thereto the following provisions as and for Sections
2-84.1, 2-84.2 and 2-86 respe,ctively:
2-84.1 Training an,d Education. It is the policy
of the City to encourage all employees to pursue
training and educational opportunities which will
improve the employee's ability to perform City duties
or to enhance his or her qualifications for promotion
or advancement within City opportunities. Employee
effort and progress in such training and/or education
will be one of the factors considered in reviewing
salary adjustment.
The following procedure shall be used to receive
tuition reimbursement:

A. The employee must submit a Tuition
Reimbursement Request form to the Department
Head prior to enrollment in the course.
Approval of a course is dependent upon: (1)
relevance of the course to the employee's
current job responsibilities, (2) the course
is offered by an accredited educational or
trade institution and taken for credit, and
(3) the course is related to realistically
projected future job responsibilities.
B. The Department Head will forward the Tuition
Reimbursement Request form to the City
Council with a recommendation for approval or
denial.
C. After completion of the approved course, the
employee will submit a copy of the course
grade slip and fee slip to the Department
Head. For reimbursement, a grade of "C" or
better is required. The Department Head will
forward the copy of the grade slip and fee
slip to the City Clerk for processing and
payment.
2-84.2 Mileage Reimbursement. If an employee
uses his/her own car on otticial Business, the City
will reimburse the employee at a rate of 204 per mile.
Supervisors and Department Heads will require prior
approval for any employee utilizing a personal vehicle
for City business.
2-85-1 Salary and Fr -Inge Benefits. Employees
having ques ions regarding sa I ary or ringe benefit
aspects of their employment, in particular, questions
related to potential changes in any such aspect,
should review the matter initially with their
department head. Non -supervisory employees may submit
written suggestions regarding salary and fringe
benefits to the Chairman of the Finance Committee not
later than February 1st of each year. A committee of
non -supervisory employees and/or a representative of
their choice may meet with the Finance Committee to
enter into discussion relative to their requests.
SECTION 3. This ordinance shall be published in
pamph a orm y and under the authority of the Corporate
Authorities of the City of McHenry, Illinois.
SECTION 4. This ordinance shall be in full force and
effect from an after its passage and approval according to
law; provided, however, that the benefits conferred

thereunder and thereby shall relate back to January 1,
1985.
