AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, as follows:
Section 1: Chapter 2 of the Municipal Code, City of
McHenry, Illinois be and the same is hereby amended by
adding the following provision thereto as and for Article
VII thereof:
ARTICLE VII
MCHENRY HISTORIC LANDMARK COMMISSION
Section 2-186 - Creation; bomposition; qualifica-
tions and appointment of members. There is hereby created
a McHenry Historic Landmark Commission of the City of
McHenry. Said Commission shall consist of 12 members to
be appointed by the Mayor with the concurrence of the City
Council. In no event shall the Mayor appoint any member
to said Commission within the last thirty (30) days
immediately prior to the expiration of the Mayor's term of
office.
Section 2-187 - Terms of Office. The term of office
of each member of t e McHenry Historic Landmark Commission
shall be one (1) year, and until his successor is
appointed and qualified.
Section 2-188 - Initial meeting; officers; regulatory
authority. The first meeting ot the McHenry Historic
Landmark Commission shall be held on or before May 1,
1985. The Mayor shall appoint a Chairman. The Commission
may adopt such rules and regulations as may be necessary
to carry out its duties and functions, including the date
and time of its regularly scheduled meetings; provided,
however, such regularly scheduled meetings shall be held
at least four (4) times per year.
Section 2-189 - Quorum. Any 6 members of the ,
Commission shall constitute a quorum for the purposes of
transacting any business at any meeting of said
Commission, regular or special.
Section 2-190 - Functions; duties and powers. The
Commission shall a vise the mayor and Counciras to all
matters pertaining to the historic landmarks in the best
interests of the City of McHenry.
The Commission shall have the following powers and
duties:
(a) To foster and promote the development of
historic landmark preservation within the City
of McHenry; and
(b) To explore funding, both public and private, for
study or development of historic landmarks of`
McHenry; and
(c) To review all ordinances, laws, resolutions and
policies of the City which may have an impact
upon the development or maintenance of historic
landmarks within the City and to inform and
advise the City Council of their findings; and
(d) To recommend that certain buildings be
designated as historic landmarks by the City
Council.
Section 2-191 - Special meetings. The Chairman or
any two () members 7Df the Commission may call a special
meeting of the Commission upon notice delivered to every
member of the Commission at least 24 hours before the time
set for such meeting.
Section 2-192 -.Gifts and, donations. The Commission
shall have no authority o accept or to use gifts or
donations from any source, unless such gifts and donations
have been previously accepted by action of the City
Council. Legal title to all such gifts and donations
shall be held in the name of the City of McHenry,
Illinois.
Section 2-193 - Funds. All donations and gifts of
money shall be delivered to the City Clerk for deposit.
Section 2-194 - Removal of Members. The Mayor shall
have t e 'right to remove any mem er of the Commission
without notice and without hearing, at any time.
Section 2-195 - Corpoate authorities to authorize all
expenditures. The corporate authorities shall have the
sole power and discretion to authorize the expenditure of
any funds received for the purposes of the Landmark
Commission.
Section 2-196 - Definition of "_landmark". A City
landmark shall be defined as any structure, property or
artifact whose existence is recognized as having made an
historically significant contribution to the heritage,
character and flavor of the City of McHenry, Illinois.

SECTION 2: All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 3: This ordinance shall be published in
pamphlet orm y and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 4: This ordinance shall be in full force and
effect from and after its passage, approval and
publication as provided by law.
