Chapter 13 of the Municipal Code, City of McHenry, Illi- nois be and the same is hereby amended to read as follows: CHAPTER 13 TRAFFIC AND MOTOR VEHICLES ARTICLE 1 Definitions 13-101 DEFINITIONS OF WORDS AND PHRASES. The following words and phrases when used in this Act shall, for the purpose of this Act, have the meanings respectively ascribed to them in this Chapter, except when the context otherwise requires and except where another definition set forth in another Chapter of this Act and applicable to that Chapter or a designated part there- of is applicable. 13-102 ABANDONED VEHICLE. A motor vehicle standing or parked on the public way which vehicle is either (a) in such state of disre- pair as to be incapable of being driven in its present condi- tion, or (b) has not been moved or used for more than seven (7) consecutive days and is apparently deserted. 13-103 ALLEY. A public way within a block, generally giving access to the rear of lots or buildings and not used for general traffic circulation. 13-104 ARTERIAL STREET. Any U.S. or State numbered route, control- led -access highway, or other major radial or circumferential street or highway designated by local authorities within their respective jurisdictions as part of a major arterial system of streets or highways. 13-105 AUTHORIZED EMERGENCY VEHICLE. Emergency vehicles of munici- pal departments or public service corporations as are designa- ted or authorized by proper local authorities; police vehicles; vehicles of the fire department and ambulances. 13-106 BICYCLE. Every device propelled by human power upon which any person may ride, having two tandem wheels either of which is more than 16 inches in diameter. 13-107 BUS. Every motor vehicle, other than a commuter van, designed for carrying more than 10 passengers and used for the trans- portation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensations. 13-108 BUS STOP. A fixed area in the roadway parallel and adjacent to the curb to be occupied exclusively by buses for lay -over in operating schedules or waiting for passengers. 13-129 MOTORIZED PEDALCYCLE. A bicycle type vehicle, which has tires with an overall inflated diameter of 19 inches or more, with fully operative pedals for propulsion by human power, equipped with a power drive system that functions directly or automatically only and not requiring clutching or shifting by the operator after the drive system is engaged, and a helper motor with a cylinder capacity not exceeding 50 cubic centi- meter piston displacement, which produces no more than 2.0 brake horsepower, and is capable of propelling the vehicle at a maximum speed of no more than 30 m.p.h. on level ground. 13-130 MULTIPURPOSE PASSENGER VEHICLE. A passenger -carrying vehicle which is constructed either on a truck chassis or with special features for occasional off -road operation. 13-131 NON-COMMERCIAL VEHICLE. Any vehicle that its not a commercial vehicle. 13-132 NOT -FOR -HIRE. Operation of a commercial vehicle in further- ance of any commercial or industrial enterprise but not For Hire. 13-133 OFFICIAL TIME STANDARD. Whenever certain hours are named herein they shall mean standard time or daylight-saving time as may be in current use in this City. 13-134 OFFICIAL TRAFFIC -CONTROL DEVICES. All signs, signals, mark- ings, and devices placed or erected by authority of a public body or official having jurisdiction, for the purpose of regu- lating, warning or guiding traffic.. 13-135 ONE-WAY STREET. A public way upon the roadway of which traf- fic is permitted to travel in only one direction. 13-136 PARK OR PARKING. Means the standing of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers. 13-137 PARKING METER. A mechanical device located upon a public street or sidewalk in a place regularly designed as a parking zone as defined herein, which device shall record a certain number of minutes by the use of a clock mechanism determining the period of time for which parking privileges may be extend- ed to the person depositing a coin into said device. 13-138 PARKING METER ZONE. A certain designated and marked -off sec- tion of the public street within the marked boundaries where the vehicle may be temporarily parked and allowed to remain for such period of time as the parking meter attached thereto may indicate. 13-139 PASSENGER CAR. A motor vehicle of the First Division includ- ing a multipurpose passenger vehicle, that is designed for carrying not more than 10 persons. 13-140 PEDESTRIAN. Any person afoot. 13-141 PERSON. Every natural person, firm copartnership, associa- tion or corporation. 13-142 PHYSICALLY HANDICAPPED PERSON. Every natural person who has permanently lost the use of a leg or both legs or an arm or both arms or any combination thereof or any person who is so severely disabled as to be unable to move without the aid of crutches or a wheelchair. -4- 13-109 BUSINESS DISTRICT. The territory contiguous to and including a highway when within any 600 feet along such highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, or office buildings, railroad stations and public buildings which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the highway. 13-110 CAMPER. A recreational motor vehicle of the Second Division converted or equipped and primarily used for living quarters or for human habitation, rather than for the transportation of freight, goods, wares, and merchandise and not used as a commer- cial vehicle. 13-111 CONTROLLED -ACCESS HIGHWAY. Every highway, street or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or- from the same except at such points only, and in such manner, as may be determined by the public authority having jurisdiction over such highway, street or roadway. 13-112 COMMERCIAL VEHICLE. Any vehicle operated for transportation of persons or property in the furtherance of any commercial or industrial enterprise, For -Hire or Not -for -Hire not including however a commuter van or a recreational vehicle not being used commercially. 13-113 CROSS WALK. (a) That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on oppo- site sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway; (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrial corssing by lines or other markings on the surface. 13-114 CURB LOADING ZONE. A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. 13-115 DEALER. Every person engaged in the business of buying, sell- ing or exchanging vehicles and who has an established place of business or such purpose in this City. 13-116 DRIVER. Every person who drives or is in actual physical con- trol of a vehicle. 13-117 FOR -HIRE. The operation of a vehicle for compensation and sub- ject to federal regulation by the Interstate Commerce Commission or to state regulation by the Illinois Commerce Commission. 13-118 GROSS WEIGHT. The weight of a vehicle whether operated singly or in combination without load, plus the weight of the load thereon. 13-119 HIGHWAY. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. 13-120 HOUSE CAR. A recreational motor vehicle of the First Division converted or equipped and primarily used for living quarters or for human habitation, rather than as a passenger car and not used as a commercial vehicle. -2- 13-121 HOUSE TRAILER. (a) A recreational trailer or semitrailer equipped and used for living quarters or for human habitation (temporarily or permanently) rather than for the transportation of freight, goods, wares, and merchandise; or (b) A house trailer or a semitrailer which is used commercial- ly (temporarily or permanently), that is, for the advertising, sales, display or promotion of merchandise or services, or for any other commercial purpose except the transportation of pro- perty for distribution by a private carrier. 13-122 INTERSECTION. (a) The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict. (b) Where a highway includes two roadways 30 or more feet apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. (c) The junction of an alley with a street or highway does not constitute an intersection. 13-123 LANED ROADWAY. A roadway which is divided into two or more clearly marked lanes for vehicular traffic. 13-124 LOCAL AUTHORITY. Every county, municipal and other local board or body having authority to enact laws relating to traf- fic under the Constitution and laws of this State. 13-125 MERGING TRAFFIC. A maneuver executed by the drivers of vehicles or converging roadways to permit entry into the junc- tion thereof, wherein the driver of each vehicle involved is required to adjust his vehicular speed and lateral position so as to avoid a collision with any other vehicle. 13-126 MOTOR VEHICLE. Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. For this Act motor vehicles are divided into two divisions: First Division: Those motor vehicles which are designed for the carrying of not more than 10 persons. Second Division: Those motor vehicles which are designed for carrying more than 10 persons, those designed or used for living quarters and those motor vehicles which are designed for pulling or carrying freight or cargo, and those motor vehicles of the First Division remodelled for use and used as motor vehicles of the Second Division. 13-127 MOTORCYCLE. Every motor vehicle having a seat or saddle for the use of the rider and designed to trave'I on nor more than 3 wheels in contact with the ground, but excluding a tractor. 13-128 MOTOR DRIVEN CYCLE. Every motorcycle and every motor scooter with less than 140 cubic centimeter piston displacement in- cluding motorized pedalcycles. -3- 13-143 POLICE OFFICER. Every officer authorized to direct or regu- late traffic or to make arrests for violations of traffic regulations. 13-144 PRINCIPAL PLACE OF BUSINESS. The place where any person transacts his principal business, or where he makes up and approves his payroll, maintains a central file of records and maintains his principal executive offices. In the event that not all of these functions are performed in one place, then that place where such person does in fact principally transact and control his business affairs. 13-145 PRIVATE LIVING COACH. A recreational motor vehicle of the Second Division equipped and primarily used for living quar- ters, human habitation or for mobile living, rather than for the transportation of persons, with direct access to the liv- ing quarters from the driver's seat and not used as a commer- cial vehicle. 13-146 PRIVATE ROAD OR DRIVEWAY. Every way or place in private own- ership and used for vehicular travel by the owner, but not by other persons. 13-147 RAILROAD A carrier of persons or property upon cars, other than streetcars, operated upon stationary rails. 13-148 RAILROAD SIGNS OR SIGNALS. Any sign, signal or device other than an official traffic -control device erected in accordance with the laws governing same and intended to give notice of the presence 'of railroad tracks or the approach of a railroad train. 13-149 RAILROAD TRAIN. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars. 13-150 RECREATIONAL VEHICLE. Every vehicle originally designed or permanently converted and primarily used for living quarters or for human habitation and not used as a commercial vehicle, including any house car, house trailer, camper or private liv- ing coach. 13-151 RESIDENCE DISTRICT. The territory contiguous to and includ- ing a highway not comprising a business district when the pro- perty on such highway for a distance of 300 feet or more is in the main improved with residence or residences and buildings in use for business. 13-152 RESIDENT. (a) Every natural person who resides in this City shall be deemed a resident of the City. (b) In the case of a firm, copartnership, association, or corporation, if the principal place of business of such firm, copartnership, association, or corporation is located in the City of McHenry, Illinois, then such firm, copartnership, association or corporation shall be deemed a resident of the City of McHenry, Illinois. 13-153 RIGHT-OF-WAY The right of one vehicle or pedestrian to pro- ceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed, and proximity as to give rise to danger of collision unless one grants precedence to the other. -5- 13-154 ROADWAY. That portion of a highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separ- ate roadways, the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways col- lectively. 13-155 SCHOOL BUS. (a) Every motor vehicle, except as provided in paragraph (b), owned or operated by or for any of the following entities for the transportation of persons regularly enrolled in any such entity as students in grade 12 or below in connection with any activity of the entity: a school operated by a religious in- stitution or a public or private nursery, primary or secondary school. (b) This definition does not include the following: (1) a bus operated by a public utility, municipal corporation or common carrier authorized to conduct local or interurban transporta- tion or passengers when the bus is on a regularly scheduled route for the transportation of other fare paying passengers or furnishing charter service for the transportation of groups on field trips or other special trips or in connection with special events or for shuttle service between attendance cen- ters or other educational facilities and not over a regular or customary school bus route; (2) A motor vehicle of the First Division. 13-156 SEMI -TRAILER. Every vehicle without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle. 13-157 SIDEWALK. That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use by pedestrians. 13-158 SITUS OR BASE OF VEHICLE. The place where a vehicle is prin- cipally garaged, or from whence it is principally dispatched, or where the movements of such vehicle usually originate. 13-159 STAND OR STANDING. The halting of a vehicle, whether occu- pied or not, otherwise than when temporarily and actually engaged in receiving or discharging passengers. 13-160 STOP. When required means complete cessation from movement. 13-161 STOP OR STOPPING. Any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid con- flict with other traffic or in compliance with the directions of a police officer or traffic -control sign or signal. 13-162 STREET. The entire width between boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. 13-163 TAXICAB STAND. A fixed area in the roadway alongside and parallel to the curb set aside for taxicabs to stand or wait for passengers. 13-164 THROUGH HIGHWAY. Every highway or portion thereof on which vehicular traffic is given preferential right-of-way, and at the entrances to which vehicular traffic: from intersecting highways is required by law to yield right: -of -way to vehicles on such through highway in obedience to either stop sign or a yield sign, when such signs are erected as provided in this Act. 13-165 TRAFFIC. Pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances either singly or together while using any highway for purposes of travel. 13-166 TRAFFIC -CONTROL SIGNAL. Any official traffic control device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed. 13-167 TRUCK. Every motor vehicle designed and used primarily for transportation of property. 13-168 TRUCK TRACTOR. Every motor vehicle designed and used primar- ily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn. 13-169 VEHICLE. Every device, in, upon or by which any person or property is or may be transported or drawn upon a highway, except devises moved by human power, devices used exclusively upon stationary rails or tracks and snowmobiles. For this Act vehicles are divided into 2 divisions: First Division: Those vehicles which are designed for the carrying of not more than 10 persons. Second Division: Those vehicles which are designed for carrying more than 10 persons, those designed or used for liv- ing quarters and those vehicles which are designed for pulling or carrying property, freight or cargo, those vehicles of the First Division remodelled for use and used as motor vehicles of the Second Division, and those vehicles of the First Divi- sion used and registered as school buses. 13-170 YIELD RIGHT-OF-WAY. When required by an official sign means the act of granting the privilege of the immediate use of the intersection roadway to traffic within the intersection and to vehicles approaching from the right or left, but when the roadway is clear may proceed into the intersection. -7- ARTICLE II Vehicle Licenses 13-201 LICENSE REQUIRED. It shall be unlawful for any resident of the City of McHenry or his agent to operate or to cause or to permit operation, for a longer period of time than 30 days after establishing residence, any motor vehicle which has as its situs or base in the City of McHenry unless such motor vehicle be licensed as hereinafter provided. 13-202 APPLICATION. Any resident of the City of McHenry desiring a license for any such motor vehicle, shall file an application therefor with the City Clerk, upon a form provided by her, setting forth the name and address of the applicant, the description of the motor vehicle, and the state license number thereof, and such information as may be prescribed. Such license shall issue upon the payment by the applicant of a license fee, as hereinafter provided, to the City Clerk, and shall authorize the use of such motor vehicle within the City until the expiration of such license. 13-203 FEES The license fee for each motor vehicle to be paid annually to the City Clerk shall be as follows: Passenger vehicles for private use and trucks bearing Illinois license plates aiffixed "A" or "B" . . . . . $ 6.00 Trucks and other freight and merchandise carrying vehicles bearing Illinois license plates suffixed "C" through "VDB" inclusive, and all trucks bearing Illinois plates with special designations . . . . . . $15.00 Motorcycles and motorized pedalcycles . . . . . . . . . $ 4.00 Public passenger vehicles and buses (except vehicles otherwise designated as school buses) with a capacity of over seven (7) persons . . . . . . . . . $20.00 Public passenger vehicles and buses (except vehicles otherwise designated as school buses) with a capacity of seven (7) persons or less. . . . . . . . . . . $17.00 Automobile dealer (for the first 5 vehicles). . . $30.00 Automobile dealer (for each vehicle in excess of 5) . . $ 6.00 School buses of all sizes and capacities. . . . . . . . $10.00 Replacement sticker _ . _ . . . . . . . $ 1.00 13-204 LICENSE YEAR. All licenses issued hereunder shall be annual licenses whose term shall run concurrent to the calendar year and shall expire at midnight on December 31 of each year. 13-205 TIME OF PAYMENT. (a) Payment of license fees for any calendar year shall be made from November 1 of the preceding year through January 31 of the license year and shall deemed to be past due on Febru- ary 1 of the license year. (b) All M censes purchased on or after February 1 of each year shall be subject to a late fee in addition to the applic- able fees as provided in Section 13-203. Such late fee shall be calculated at the rate of $2.00 per month for each month, or fraction thereof, and shall be based on the total number of months or fraction thereof, that said purchase is made after February 1 of each year. 13-206 REDUCTIONS. Vehicle license fees as prescribed in Section 13-203 shall be reduced by 50% if the vehicle is newly acquir- ed by a resident or becomes subject to 'license fees on or after July 1. 13-207 LICENSE TAG. Upon the issuance of said license, the City Clerk shall deliver to the applicant a gummed sticker or metal tag upon which shall be shown the name of the class to which said motor vehicle belongs and the year for which the said license is issued, and it shall be the duty of the applicant to affix such gummed sticker or metal tag upon the motor vehicle for which it is issued as prescribed! in Section 13-208. 13-208 DISPLAY OF CITY LICENSE TAG. The City license tag shall be placed and positioned to be clearly visible and maintained in a clearly legible condition and shall be placed on the front windshield in the lower right hand corner farthest removed from the driver's position approximately one (1) inch from the right and lower edge of said windshield, except application of the metal tag issued to motorcycles, or motorized pedalcycles shall be made in a permanent manner to the rear license plate of such motorcycle or motorized pedalcycle so as not to ob- struct any part of the number of such license plate. 13-209 SALE OR TRANSFER. Immediately upon the sale or transfer of any motor vehicle which has been licensed as above, the vender shall remove the license sticker or tag from the motor vehicle sold or transferred, and the license so issued for such motor vehicle shall cease to apply to said motor vehicle from such date, and the purchaser or transferee thereof shall apply to the City Clerk for new license therefor as above provided. Upon a showing to the City Clerk that said sticker or tag has been removed from such sold or transferred motor vehicle, the City Clerk shall, upon payment of a replacement fee, issue a new sticker or tag bearing a new number, which shall apply to and be assigned to any other motor vehicle of the same class owned by said vendor or transferror; except as above provided, no sticker or tag issued for or assigned to any motor vehicle shall ever be used for or attached to or upon another and dif- ferent vehicle. 13-210 USE OF FUND. The proceeds of all license fees so collected shall be used for the purpose of improving, paving, repairing or maintaining the streets and other public roadways within the City, and shall never be devoted to any other use what- ever, provided that the actual cost of collection of such fees and the distribution thereof may be deducted from the total amount collected. -9- (The next page is 15) ARTICLE III Obedience to and Effect of Traffic Laws 13-301 AUTHORITY OF POLICE AND FIRE DEPARTMENT OFFICIALS. (a) It shall be the duty of the officers of. the police depart- ment or such officers as are assigned by -the Chief of Police to enforce all street traffic laws of this City and all of the State vehicle laws applicable to street traffic in this City. (b) Officers of the police department or such officers as are assigned by the Chief of Police are hereby authorized to direct all traffic by voice, hand, or signal in conformance with traffic laws, provided that, in the event of a fire or other emergency, or to expedite traffic or to safeguard pedes- trians, officers of the police department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws. (c) Officers of the fire department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. 13-302 REQUIRED OBEDIENCE TO TRAFFIC LAWS. It is; unlawful and, un- less otherwise declared in this Article with respect to par- ticular offenses, it shall be a misdemeanor for any person to do any act forbidden or fail to perform any act required in this Article. 13-303 OBEDIENCE TO POLICE OFFICERS. No person shall willfully fail or refuse to comply with any lawful order or direction of any police officer invested by law with authority to direct, con- trol or regulate traffic. 13-304 FLEEING OR ATTEMPTING TO ELUDE POLICE OFFICERS. It shall be unlawful for any driver or operator of a motor vehicle who, having been given a visible or audible signal by a peace offi- cer directing such driver or operator to bring his vehicle to a stop, to willfully fail or refuse to obey wuch direction, increase his speed, extinguish his lights, or otherwise flee or attempt to elude an officer. 13-305 PUBLIC OFFICERS AND EMPLOYEES TO OBEY ACT - EXCEPTIONS. (a) The provisions of this Article applicable to the drivers of vehicles upon the highways, streets or roads shall apply to the drivers of all vehicles owned or operated by the United States, this State or any county, city, town, district or any other political subdivision of the State, except as provided in this section and subject to such specific exceptions as set forth in this Article with reference to authorized emergency vehicles. (b) The driver of an authorized emergency vehicle, when re- sponding to an emergency call or when in the pursuit of an actual or suspected violator of the law or when responding but not upon returning from a fire alarm, may exercise the privi- leges set forth in this section, but subject to the conditions herein stated. -15- (c) The driver of an authorized emergency vehicle may: 1. Park or stand, irrespective of the provisions of this ordinance. 2. Proceed past a red or stop signal or stop sign, but only after slowing down as may be required and necessary for safe operation. 3. Exceed the maximum speed limits so 'long as he does not endanger life or property. 4. Disregard regulations governing direction of movement or turning in specified directions. (d) The exceptions herein granted to an authorized emergency vehicle, other than a police vehicle, shall apply only when the vehicle is making use of either an audible signal when in motion or visible signals meeting the requirements of the statutes. (e) The foregoing provisions do not relieve the driver of an authorized emergency vehicle from the duty of driving with due regard for the safety of all persons, nor do such provisions protect the driver from the consequences of his reckless dis- regard for the safety of others. 13-306 TRAFFIC LAWS APPLY TO PERSONS RIDING BICYCLES OR ANIMALS OR DRIVING ANIMAL -DRAWN VEHICLES. Every person riding a bicycle or an animal or driving any animal -drawn vehicle upon a road- way shall be subject to the provisions of this Article appli- cable to the driver of a vehicle, except those provisions of this Article which by their nature can have no application. -16- (The next page is 20) ARTICLE IV Traffic Signs, Signals and Markings 13-401 OBEDIENCE TO TRAFFIC -CONTROL DEVICE. (a) No driver of a vehicle shall disobey the instructions of any official traffic -control device placed in accordance with the provisions of this ARticle, unless at the time otherwise directed by a police officer. (b) It shall be unlawful for any person to leave the roadway and travel across private property to avoid an official traffic -control device. (c) No provision of this Article for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular Section does not state that signs are required, such Section shall be effective even though no signs are erected or in place. 13-402 OBEDIENCE TO TRAFFIC -CONTROL SIGNALS. Whenever traffic is controlled by traffic -control signals exhibiting different colored lights successively one at a time, or with lighted green arrows, only the following colors shall be used and such terms and lights and lighted green arrows shall indicate and apply to drivers of vehicles and pedestrians as follows: (a) Circular green (alone): 1. Vehicular traffic facing the signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic shall lyield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited. 2. Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk unless direct- ed otherwise by a pedestrian signal as provided under Section 13-403. (b) Steady 'yellow: 1. Vehicular traffic facing a steady yellow signal is thereby warned that the related green movement is being ter- minated or that a red indication will The exhibited immediate- ly thereafter when vehicular traffic may niot enter the inter- section. 2. Pedestrians facing a steady yellow signal unless otherwise directed by a pedestrian control signal, as provided in Section 13-403, are thereby advised that there is insuffi- cient time to cross the roadway, and no pedestrian shall start to cross. (c) Steady red indication. 1. Vehicular traffic facing a steady red signal alone must stop at a clearly marked stop line, but if none, before -20- entering the crosswalk on the near side of an intersection, or if none, then before entering the intersection and shall re- main standing until an indication to proceed is shown except as provided in paragraphs (c) 2 and (c) 3 of this Section. 2. Vehicular traffic facing a steady red signal at an intersection may turn right after stopping as required in paragraph (c) 1 of this Section but shall yield right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection. However, any such right turn against a steady red signal may be prohibited within the City when a sign is erected at such intersection giving notice of the ordinance or rule or regulation prohibit- ing the right turn. 3. Vehicular traffic on a one-way highway facing a steady red signal may, after stopping as required by paragraph (c) 1 of this Section, cautiously enter the intersection and make a left turn onto an intersecting one-way highway on which traf- fic travels to the left but shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection. However, local authorities may prohibit such left turn against a steady red signal at any intersection within the City. Such ordinance shall be effective when a sign is erected at such intersection giving notice of the ordinance prohibiting such left turn. 4. No pedestrian facing such signal shall enter the road- way unless a separate "Walk" indication is shown. (d) Green Straight -through arrow (alone): 1. Vehicular traffic facing the signal may proceed straight through but shall not turn right or left. Such vehicular traffic shall yeild the right-of-way to other vehicles and to pedestrians legally within the intersection or an adjacent crosswalk at the time such signal is exhibited. 2. Pedestrians facing the signal may proceed across the roadway within the appropriate marked or unmarked crosswalk unless directed otherwise by a pedestrian signal as provided in Section 13-403. (e) Green turn arrow (with circular green, with steady yellow, with steady red or with green straight through arrow): 1. Vehicular traffic facing the signal shall comply with the meaning of the circular green, steady, yellow, steady red or green straight -through arrow indication as if it were shown alone, except that such vehicular traffic may cautiously enter the intersection to make the movement indlicated by the green turn arrow. Vehicular traffic shall yield the right-of-way to pedestrians lawfully within a crosswalk and to other traffic lawfully using the intersection. 2. Pedestrians facing such signal shall comply with the meaning of the circular green, steady yellow, steady red or straight -through arrow indication as if it were shown alone, unless directed otherwise by a pedestrian signal as provided in Section 13-403. -21- (f) In the event an official traffic -control signal is erected and maintained at a place other than an intersection, the pro- visions of this Section shall be applicable except as to provisions which by their nature can have no application. Any stop required shall be at a traffic sign or a marking on the pavement indicating where the stop shall be made or, in the absence of such sign or marking, the stop shall be made at the signal. 13-403 PEDESTRIAN -CONTROL SIGNAL. Whenever special pedestrian control signals exhibiting the words "Walk" or "Don't Walk" are in place, such signals shall indicate as follows: (a) Walk. Pedestrians facing such signal may proceed across the roadway in the direction of the signal, and shall be given the right-of-way by the drivers of all vehicles. (b) Don't Walk. No pedestrian shall start to cross the road- way in the direction of such signal but any pedestrian who has partly completed his crossing on the Walk signal shall proceed to a sidewalk or safety island while the Don't Walk signal is illuminated, steady, or flashing. 13-404 FLASHING SIGNALS. Whenever an illuminated flashing red or yellow signal is used in conjunction with a traffic -control device it shall require obedience by vehicular traffic as follows: (a) Flashing red (stop signal). When a red lens is illuminat- ed with rapid intermittent flashes, drivers of vehicles shall stop at a clearly marked stop line, but if none, before enter- ing the crosswalk on the near side of the intersection, or if none, then at a point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersect- ing roadway before entering the intersection and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign. (b) Flashing yellow (caution signal). When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution. (c) This Section does not apply at railroad grade crossings. Conduct of drivers of vehicles approaching railroad grade crossings shall be governed by Section 13-1101. 13-405 DISPLAY OF UNAUTHORIZED SIGNS, SIGNALS OR MARKINGS. (a) No person shall place, maintain or display upon or in view of any highway an unauthorized sign, signal marking, or device which purports to be or is an imitation of or resembles an official traffic -control device or railraod sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the movement of traffic or the effectiveness of an official traffic -control device or any railroad sign or signal. (b) No person shall place or maintain nor shall any public authority permit upon any highway any traffic sign or signal bearing thereon any commercial advertising.. -22- 13-406 13-407 (c) Every such prohibited sign, signal or marking is hereby declared to be a public nuisance and the authority having jurisdiction over the highway is hereby empowered to remove the same or cause it to be removed without notice. (d) This Section shall not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional information and of a type that cannot be mistaken for official signs. INTERFERENCE WITH OFFICIAL TRAFFIC -CONTROL DEVICES OR RAILROAD SIGNS OR SIGNALS. No person shall without lawful authority attempt to or in fact alter, deface, injure, knock down or remove any, official traffic -control device, or any railroad sign or signal or any inscription, shield or insignia thereon, or any part thereof. UNLAWFUL USE OR DAMAGE TO HIGHWAYS, STREETS, ROADS, APPURTEN- ANCES AND STRUCTURES. It shall be unlawful for any person to willfully injure or damage any public highway or street or road or any bridge, culvert, sign, signpost, or structure upon or used or constructed in connection with any public highway or street or road for the protection thereof or for protection or regulation, of traffic thereon by any willfully unusual, improver or unreasonable use thereof, or by willfully careless driving or use of any vehicle thereon, or by willful mutila- tion, defacing or destruction thereof. -23- (The next page is 26) ARTICLE V. Driving While Under the Influence of Alcohol, Other Drugs or Combination Thereof, Transporting Alcoholic Liquor, Reckless Driving and Drag Racing 13-501.1 DRIVING WHILE UNDER THE INFLUENCE OF ALCOHOL, OTHER DRUGS OR COMBINATION THEREOF. (a) A person shall not drive or be in actual physical control of any vehicle within this City while: 1. The alcohol concentration in such person's blood or breath is 0.10 or more based on the definition of blood and breath units in Section 13-501.2; 2. Under the influence of alcohol; 3. Under the influence of any other drug or combination of drugs to a degree which renders such person incapable of safely driving; or 4. Under the combined influence of alcohol and any other drug or drugs to a degree which renders such person incapable of safely driving. (b) The fact that any person charged with violating this Sec- tion is or has been 'legally, entitled to use alcohol, or other drugs, or any combination of both, shall not constitute a de- fense against any charge of violating this Section. (c) Section 11-501.1 and 11-501.2 of the Illinois Revised Statutes, Chapter 95 1/2, shall apply in full force and effect to any person who shall drive a motor vehicle anywhere in the City of McHenry, Illinois. 1$-501.2 CHEMICALS OR OTHER TEST. (a) Upon the trial of any civil or criminal action or proceed- ing arising out of an arrest for an offense as defined in Sec- tion 501.1 evidence of the concentration of alcohol, other drug or combination thereof in a person's blood or breath at the time alleged, as determined by analysis of the person's blood, urine, breath or other bodily substance, shall be ad- missible. Where such test is made the following provisions shall apply: 1. Chemical analyses of the person's blood, urine, breath or other bodily substance to be considered valid under the provisions of this Section shall have been performed according to standards promulgated by the Department of Public Health in consultation with the Department of Law Enforcement by an in- dividual possessing a valid permit issued by that Department for this purpose. 2. When a person shall submit to a blood test at the request of a law enforcement officer only a physician author- ized to practice medicine, a registered nurse or other quali- fied person approved by the Department of Public Health may withdraw blood for the purpose of determining the alcohol, drug, or alcohol and drug content therein. This limitation shall not apply to the taking of breath or urine specimens. -26- 13-502 13-503 13-504 3. The person tested may have a physician or qualified technician, chemist, registered nurse, or other qualified per- son of their own choosing administer a chemical test or tests in addition to any administered at the direction of a law en- forcement officer. The failure or inability to obtain an additional test by a person shall not preclude the admission of evidence relating to the test or tests taken at the direc- tion of a law enforcement officer. 4. Upon the request of the person who shall submit to a chemical test or tests at the request of a law enforcement officer, full information concerning the test or tests shall be made available to the person or such person's attorney. 5. Alcohol concentration shall mean either grams of alco- hol per 100 milliliters of blood or grams of alcohol per 210 liters of breath. (b) Upon the trial of any civil or criminal action or proceed- ing arising out of acts alleged to have been committed by any person while driving or in actual physical control of a vehicle while under the influence of alcohol, the concentra- tion of alcohol in the person's blood or breath at the time alleged as shown by analysis of the person's blood, urine, breath, or other bodily substance shall give rise to the fol- lowing presumptions: 1. If there was at the time an alcohol concentration of 0.05 or less, it shall be presumed that the person was not under the influence of alcohol. 2. If there was at the time an alcohol concentration in excess of 0.05 but less than 0.10, such facts shall not give rise to any presumption that the person was or was not under the influence of alcohol, but such fact may be considered with other competent evidence in determining whether the person was under the influence of alcohol. 3. If there was at the time an alcohol concentration of 0.10 or more, it shall be presumed that the person was under the influence of alcohol. 4. The foregoing provisions of this Section shall not be construed as, limiting the introduction of any other relevant evidence bearing upon the question whether the person was under the influence of alcohol. TRANSPORTATION OF ALCOHOLIC LIQUOR. No person shall trans- port, carry, possess or have any alcoholic liquor within the passenger area of any motor vehicle except in the original container and with the seal unbroken. RECKLESS DRIVING. Any person who drives any vehicle with a willful or wanton disregard for the safety of persons or pro- perty is guilty of reckless driving. DRAG RACING. It is unlawful to be a participant in drag racing. "Drag Racing" means the act of 2 or more individuals competing or racing on any street or highway in this, City in a situation in which one of the motor vehicles is beside or to the rear of -27- a motor vehicle operated by a competing driver attempts to prevent the competing or overtaking him, either by acceleration or more individuals competing in a race street or highway in the City. MIT driver and the one driver from passing or manuever, or one against time on any (The next page is 33) 13-601 13-602 ARTICLE VI Speed Restrictions SPEED RESTRICTIONS. (a) It shall be unlawful for any person to operate a motor vehicle on any street or highway in the City of McHenry in ex- cess of the speed limit established for that street or highway in Section 13-602. (b) The Superintendent of Public Works shall erect or cause to be erected proper signs indicating the speed limit on the streets and highways of this City. (c) The fact that the speed of a vehicle is lower than the es- tablished limits shall not relieve the driver from the duty to decrease speed when approaching and crossing an intersection, when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway, or when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions, and speed shall be decreased as may be necessary to avoid colliding with any person or vehicle, or on entering a street in compliance with legal requirements and the duty of all per- sons to use due care. SPEED LIMITS ESTABLISHED. The speed limit, on all streets and highways within the corporate limits of the City of McHenry is hereby established at 25 miles per hour, with the following exceptions: 1. The speed limit in all alleys within the corporate limits of the City of McHenry is hereby established at 10 miles per hour. 2. A speed limit of 20 miles per hour is hereby establish- ed in the following areas: a. All park roads; b. Riverside Drive - from the north side of Boone Creek to a point 200 feet north of Pearl Street; c. Main Street - Crystal Lake Road to Front Street; d. Green Street - Pearl Street to Waukegan; e. Oak Drive - north from Orleans Street to Prairie Avenue. 3. A speed limit of 30 miles per hour is hereby establish- ed in the following areas. a. Green Street - Anne Street to the south City limits; b. Elm Street - East City limits to Front Royal Drive; c. Front Street - Elm Street to Kane Avenue; d. Crystal Lake Road - Illinois Route 120 to Lillian Street. e. Orleans Street - the entire length from Mc Cullom Lake Road to Industrial Drive. -33- 13-603 13-604 4. A speed limit of 35 miles per hour is hereby establish- ed in the following areas: a. Crystal Lake Road - Lillian Street to Dartmoor; b. Richmond Road - Elm Street to a point 500 feet north of Maple Avenue; c. Westbound Illinois Route 120 - Front Royal Drive to a point 500 feet west of Beach Avenue; d. Eastbound Illinois Route 120 - [leach Avenue to Front Royal Drive; e. Martin Road - Ringwood Road to Illinois Route 120; f. Ringwood Road - Illinois Route 120 to the north City limits. g. Draper Road - Illinois Route 120 to the south City limits; 5. A speed limit of 40 miles per hour is hereby establish- ed in the following areas: a. Front Street - Kane Avenue to Anne Street; b. Richmond Road - from a point 500 feet north of Maple Avenue to Mc Cullom Lake Road; c. Curran Road - entire length within the corporate limits of the City of McHenry; 6. A speed limit of 45 miles per hour is hereby establish- ed in the following areas: a. Mc Cullom Lake Road - from Illinois State Route 31 to the Chicago & Northwestern Railroad tracks; b. Crystal Lake Road - Dartmoor to south City limits; c. Front Street - Anne Street to 1000 feet south of High Street; d. Westbound Illinois Route 120 from a point 500 feet west of Park Street to Dot Street; e. Bull Valley Road from Lawrence Parkway to Illinois State Route 31. 7. A speed limit of 50 miles per hour is hereby establish- ed in the following areas: a. Front Street - 1000 feet south of High Street to south City limits. 8. A speed limit of 55 miles per hour is hereby establish- ed in the following areas: a. Illinois Route 120 - Dot Street to west City limits; b. Richmond Road - Mc Cullom Lake Road to north City limits; SCHOOL SPEED ZONES. No person shall drive a motor vehicle at a speed in excess of 20 miles per hour while passing a school zone or while traveling upon any public; thoroughfare on or across which children pass along to and from shhool during school days when school children are present. Provided, how- ever, such special speed limit warnings shall be evidenced by an appropriate and posted sign in each zone. SCHOOL SPEED ZOONES ESTABLISHED. School speed zones are hereby established in the following areas: 1. Crystal Lake Road - 300 feet north of Kensington Avenue to Royal Drive; 2. Front Street - 300 feet north of Kane Avenue to 300 feet south of Kane Avenue; -34- 13-605 13-606 3. Illinois State Route 120 - 300 feet east of Beach Avenue to 300 feet west of Beach Avenue; 4. Richmond Road - Maple Avenue to Elm Street; 5. Washington Street - Richmond Road to Park Street; 6. Green Street - Anne Street to 100 feet north of Kane Avenue; 7. Green Street - John Street to Waukegan Road; 8. Kane Avenue - Green Street to Front Street; 9. Waukegan Road - Third Street to the east boundary of McHenry High School east campus; 10. John Street - Green Street SPEED DETECTION. (a) The enforcement and imposition of the speed regulations as established in this paragraph shall be accomplished through the use of certified speedometer checks in police vehicle equipment and electronic devices, including, but not limited to, radar speed check. When any electronic device is utilized in establishing the rate of travel of any vehicle, such de- vice, or devices, shall not be used within 500 feet beyond any sign designating an official maximum speed, in the direction of travel. Nothing in this Chapter shall prohibit the use of electronic speed -detecting devices within 500 feet of signs within a special school speed zone indicating such zone, as established in Section 13-604, nor shall evidence obtained thereby be inadmissible in any prosecution for speeding pro- vided the use of such device shall apply only to the enforce- ment of the speed limit in such special school speed zone. MAXIMUM ATTAINABLE OPERATING SPEED. No person shall drive or operate any motor vehicle on any street or highway in this City where the minimum allowable speed on that street or high- way, as posted is greater than the maximum attainable speed of the vehicle. Maximum attainable operating speed shall be de- termined by the manufacturer of the vehicle and clearly pub- lished in the manual of specifications and operation, or it shall be determined by applicable rule and regulation promul- gated by the Secretary of State. -35- (The next page is 40) ARTICLE VII Driving on Right Side of Roadway Overtaking and Passing, etc. 13-701 DRIVE ON RIGHT SIDE OF ROADWAY - EXCEPTIONS. (a) Upon all roadways of sufficient width a vehicle shall be driven upon the right half of the roadway, except as follows: 1. When overtaking and passing another vehicle proceeding in the same direction under rules governing such movements: 2. When an obstruction exists making it necessary to drive to the left of the center of the roadway; provided, any person so doing shall yield the right-of-way to all vehicles travel- ing in the proper direction upon the unobstruced portion of the roadway within such distance as to constitute an immediate hazard. 3. Upon a roadway divided into three marked lanes for traffic under the rules applicable thereon; 4. Upon a roadway restricted to one-way traffic; 5. Whenever there is a single track paved road on one side of the public highway and 2 vehicles meet therein, the driver on whose right is the wider shoulder shall give the right-of- way on such pavement to the other vehicle. (b) Upon all roadways any vehicle proceeding at less than the normal speed of traffic at the time and place and under the conditions then existing shall be driven in the right-hand lane available for traffic, or as close as practicable to the right-hand curb or edge of the roadway, except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn at an intersection or into a private road or driveway. (c) Upon any roadway having 4 or more lanes for moving traffic and providing for 2-way movement of traffic, no vehicle shall be driven to the left of the center line of the roadway, ex- cept when authorized by official traffic -control devices designating certain lanes to the left side of the center of the roadway for use by traffic not otherwise permitted to use such lanes, or except as permitted under Subsection (a) 2. However, this Subsection shall not be construed as prohibiting the crossing of the center line in making a left turn into or from an alley, private road or driveway. 13-702 PASSING VEHICLES PROCEEDING IN OPPOSITE DIRECTIONS. Drivers of vehicles proceeding in opposite directions shall pass each other to the right, and upon roadways having width for not more than one line of traffic in each direction each driver shall give the other at least one-half of the main -traveled portion of the roadway as nearly as possible. 13-703 OVERTAKING A VEHICLE ON THE LEFT. The following rules govern the overtaking and passing of vehicles proceeding in the same direction, subject to those limitations, exceptions, and spe- cial rules otherwise stated in this Chapter: -40- (a) The driver of a vehicle overtaking another vehicle pro- ceeding in the same direction shall pass 'to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle. In no event shall such movement be made by driving off the pavement or the main -traveled portion of the roadway. (b) Except when overtaking and passing on the right is per- mitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on audible signal and shall not increase the speed of his vehicle until com- pletely passed by the overtaking vehicle. (c) The driver of a 2-wheeled vehicle may not, in passing upon the left of any vehicle proceeding in the same direction, pass upon the right of any vehicle proceeding in the same direction unless there is an unobstructed lane of traffic available to permit such passing maneuver safely. 13-704 WHEN OVERTAKING ON THE RIGHT IS PERMITTED. (a) The driver of a vehicle with 3 or more wheels may overtake and pass upon the right of another vehicle only under the fol- lowing conditions: 1. When the vehicle overtaken is making or about to make a left turn. 2. Upon a street or highway with unobstructed pavement not occupied by parked vehicles of sufficient width for 2 or more lines of moving vehicles in each direction. 3. Upon a one-way street, or upon any roadway on which traffic is restricted to one direction of movement, where the roadway is free from obstruction and of sufficient width for 2 or more lines of moving vehicles. (b) The driver of a 2-wheeled vehicle may not pass upon the right of any other vehicle proceeding in the same direction unless the unobstructed pavement to the right of the vehicle being passed is of a width of not less than 8 feet. (c) The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. In no event shall such movement be made by driving off the pavement or main -travelled portion of the roadway. 13-705 LIMITATIONS ON OVERTAKING ON THE LEFT. INo vehicle shall be driven to the left side of the center of the roadway in over- taking and passing another vehicle proceeding in the same direction unless authorized by the provisions of this Article and unless such left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be completely made without in- terfering with the safe operation of any vehicle approaching from the opposite direction or any vehicle overtaken. In every event the overtaking vehicle must return to an auhtoriz- ed lane of travel as soon as practicable and in the event the passing movement involves the use of a lane authorized for vehicles approaching from the opposite direction, before com- ing within 200 feet of any vehicle approaching from the oppo- site direction. -41- 13-706 FURTHER LIMITATIONS ON DRIVING TO THE LEFT OF CENTER OF ROADWAY. (a) No vehicle may, in overtaking and passing another vehicle, be driven to the left side of the roadway under the following conditions: 1. When approaching or upon the crest of a grade or curve in the highway where the driver's view is obstructed within such distance as to create a hazard in the event another vehicle might approach from the opposite direction. 2. When approaching within 100 feet of or traversing any intersection or railroad grade crossing. 3. When the view is obstructed upon approaching within 100 feet of any bridge, viaduct or tunnel. (b) The limitations in sub -paragraphs 1, 2 and 3 do not apply upon a one-way roadway nor upon a roadway with unobstructed pavement of sufficient width for 2 or more lanes of moving traffic in each direction nor to the driver of a vehicle turn- ing left into or from an alley, private road, or driveway when such movements can be made with safety. 13-707 NO -PASSING ZONES. (a) Local authorities shall determine those portions of any highways under their respective jurisdictions where overtaking and passing or driving on the left of the roadway would be especially dangerous and may, by appropriate signs or markings on the roadway, indicate the beginning and end of such zones, and when such signs or markings are in place and clearly visi- ble to an, ordinarily observant person, every driver of a vehicle shall obey the directions thereof. (b) Where signs or markings are in place to define a no -pass- ing zone as set forth in paragraph (a) no driver may at any time drive on the left side of the roadway within the no -pass- ing zone or on the left side of any pavement striping designed to mark such no -passing zone throughout its length. (c) This Section does not apply under the conditions described in Section 13-701 (a) 2, nor to the to the driver of a vehicle turning left into or from an alley, private road or driveway. The pavement striping designed to mark the no -passing zone may be crossed from the left hand lane for the purpose of complet- ing a pass that was begun prior to the beginning of the zone in the driver's direction of travel. (d) A solid yellow line to the immediate left of the driver shall indicate a no -passing zone. 13-708 ONE-WAY ROADWAYS AND ROTARY TRAFFIC ISLANDS„ (a) Local authorities, with respect to highways under their respective jurisdictions, may designate any highway, roadway, part of a roadway or specific lanes upon which vehicular traf- fic shall proceed in one direction at all or such times as shall be indicated by official traffic -control devices. (b) Upon a roadway so designated for one-way traffic, a vehicle shall be driven only in the direction designated at all or such times as shall be indicated by official traffic - control devices. (c) A vehicle passing around a rotary traffic island must be driven only to the right of such island. -42- (d) Whenever any highway has been divided into 2 or more road- ways by leaving an intervening space or by a physical barrier or a clearly indicated dividing section so constructed as to impede vehicular traffic, every vehicle must be driven only upon the right-hand roadway unless directed or permitted to use another roadway by official traffic -control devices, or police officers. No vehicle may be driven over, across or within any such dividing space, barrier, or section, except through an opening in the physical barrier, or dividing sec- tion, or space, or at a crossover or intersection as estab- lished by public authority. (e) It shall be unlawful for the operator of any vehicle being operated upon any of the streets or roadways hereinafter list- ed in the column designated "One -Way Street" to drive such vehicle in a direction different from the direction listed opposite such street in the column designated "Traffic Direction": One -Way Street Traffic Direction Roadway adjoining St. Regis -West Bound Pub between Green Street and Municipal Parking Lot 13-709 DRIVING ON ROADWAYS LANED FOR TRAFFIC. Whenever any roadway has been divided into 2 or more clearly marked lanes for traf- fic the following rules in addition to all others consistent herewith shall apply. (a) A vehicle shall be driven as nearly as practicable entire- ly within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety. (b) Upon a roadway which is divided into 3 lanes and provides for two-way movement of traffic, a vehicle shall not be driven in the center lane except when overtaking and passing another vehicle traveling in the same direction when such center lane is clear of traffic within a safe distance, or in preparation for making a left turn or where such center lane is at the time allocated exclusively to traffic moving in the same direction that the vehicle is proceeding and such allocation is designated by official traffic -control devices. (c) Official traffic -control devices may be erected directing specific traffic to use a designated lane or designating those lanes to be used be traffic moving in a particular direction regardless of the center of the roadway and drivers of vehi- cles shall obey the directions of every such sign. On multi- lane controlled -access highways with 3 or more lanes in one direction, the City may designate lanes of traffic to be used by different types of motor vehicles. (d) Official traffic -control devices may be installed prohib- iting the changing of lanes on sections of roadway and drivers of vehicles shall obey the diretions of every such device. 13-710 FOLLOWING TOO CLOSELY. (a) The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable ,and prudent, having due regard for the speed of such vehicles and the traffic upon and the conditions of the highway. -43- (b) The driver of any truck or motor vehicle drawing another vehicle when traveling upon a roadway outside of a business or residence district and which is following another truck or motor vehicle drawing another vehicle shall, whenever condi- tions permit, leave sufficient space so that an overtaking vehicle may enter and occupy such space without danger, except that this shall not prevent a truck or motorvehicle drawing another vehicle from overtaking and passing any vehicle or combination of vehicles. (c) Motor vehicles being driven upon any roadway outside of a business or residence district in a caravan or motorcade whether or not towing other such vehicles shall be so operated as to allow sufficient space between each such vehicle or com- bination of vehicles so as to enable any other vehicle to enter and occupy such space without danger•. This provision shall not apply to funeral processions. 13-711 RESTRICTIONS ON USE OF CONTROLLED -ACCESS HIGHWAY. (a) No person may drive a vehicle onto or from any controlled - access highway except at entrances and exits established by public authority. (b) The City with respect to any controlled -access highway under its jurisdiction may prohibit the use of any such high- ways by pedestrians (except in authorized areas or facili- ties), bicycles, farm tractors, implements of husbandry, funeral processions, and any vehicle unable to maintain the minimum speed for which the highway is posted, or other non - motorized traffic or by any person operating a motor -driven cycle. The City may also prohibit the use of such highway to school buses picking up chidlren and mail delivery vehicles picking up or delivering mail. The City shall erect and main- tain official signs on the controlled -access highway on which such prohibitions are applicable and when so erected no person may disobey the restrictions stated on such sign. -44- (The next page is 50) ARTICLE VIII Turning and Starting and Signals on Stopping and Turning 13-801 REQUIRED POSITION AND METHOD OF TURNING AT INTERSECTION. The driver of a vehicle intending to turn at an intersection shall do as follows: (a) Both the approach for a right turn and a right turn shall be made as close as practicable to the right-hand curb or edge of the roadway. (b) The driver of a vehicle intending to turn left at any intersection shall approach the intersection in the extreme left-hand lane lawfully available to traffic moving in the direction of travel of such vehicle, and after entering the intersection, the left turn shall be made so as to leave the intersection in a lane lawfully available to traffic moving in such direction upon the roadway being entered. Whenever prac- ticable, the left turn shall be made in that portion of the intersection to the left of the center of the intersection. (c) It shall be unlawful to violate or disregard any official temporary traffic -control device which may be placed within or adjacent to intersections which may require and direct that a different course from that specified in this Article be traveled by vehicles turning at an intersection. 13-802 LIMITATIONS ON U-TURNS. (a) The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction unless such movement can be made in safety and without interfering with other traf- fic. (b) No vehicle shall be turned so as to proceed in the oppo- site direction upon any curve, or upon the approach to or near the crest of a grade, where such vehicle cannot be seen by the driver of any other vehicle approaching from either direction within 500 feet. 13-803 STARTING A PARKED VEHICLE. No person shall start a vehicle which is stopped, standing, or parked unless and until such movement can be made with reasonable safety. 13-804 WHEN SIGNAL REQUIRED. (a) No person may turn a vehicle at an intersection unless the vehicle is in proper position upon the roadway as required in Section 13-801 or turn a vehicle to enter a private road or driveway, or otherwise turn a vehicle from a direct course or move right or left upon a roadway unless and until such move- ment can be made with reasonable safety. No person may so turn any vehicle without giving an appropriate signal in the manner hereinafter provided. (b) A signal of intention to turn right or left when required must be given continuously during not less than the last 100 feet traveled by the vehicle before turning within a business or residence district, and such signal must be given continu- ously during not less than the last 200 feet traveled by the vehicle before turning outside a business, or residence dis- trict. -50- 13-805 13-806 (c) No person may stop or suddenly decrease the speed of a vehicle without first giving an appropriate signal in the manner provided in this Chapter to the driver of any vehicle immediately,to the rear when, there is opportunity to give such a signal. (d) The electric turn signal device must be used to indicate an intention to turn, change lanes or start from a parallel - parked position but must not be flashed on one side only on a parked or disabled vehicle or flashed as a courtesy or "do pass" signal to operators of other vehicles approaching from the rear. SIGNAL BY HAND OR ARM OR SIGNAL DEVICE. (a) Any stop or turn signal when required herein shall be given either by means of the hand and arm or by an electric signal device conforming to the requirements provided in sub- paragraph (b) of this Section. (b) Turn signal lamps must be visible from a distance of not less than 300 feet in normal sunlight. METHOD OF GIVING HAND AND ARM SIGNALS. All signals herein required given by hand and arm shall be given from the left side of the vehicle in the following manner and such signals shall indicate as follows: (a) Left turn - hand and arm extended horizontally. (b) Right turn - hand and arm extended upward. (c) Stop or decrease of speed - hand and arm extended downward. -51- (The next page is 54) ARTICLE IX Right -of -Way 13-901 VEHICLES APPROACHING OR ENTERING INTERSECTION. (a) When 2 vehicles approach or enter an intersection from different roadways at approximately the same time, the driver of the vehicle on the left must yield the right-of-way to the vehicle on the right. (b) The right-of-way rule declared in paragraph (a) of this Section is modified at through highways and otherwise as stat- ed in this Chapter. 13-902 VEHICLES TURNING LEFT The driver of a vehicle intending to turn to the left within an intersection or into an alley, pri- vate road, or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction which is so close as to constitute an immediate hazard, but said driver, having so yielded may proceed at such time as a safe interval occurs. 13-903 VEHICLES ENTERING STOP CROSSWALK. Where stop signs or flash- ing red signals are in place at an intersection or flashing red signals are in place at a plainly marked crosswalk between intersections, drivers of vehicles shall stop before entering the nearest crosswalk and pedestrians within or entering the crosswalk at either edge of the roadway shall have the right- of-way over vehicles so stopped. Drivers of vehicles having so yielded the right-of-way to pedestrians entering or within the nearest crosswalk at an intersection shall also yield the right-of-way to pedestrians within any other crosswalk at the intersection. 13-904 VEHICLES ENTERING STOP OR YIELD INTERSECTION. (a) Preferential right-of-way at an intersection may be indi- cated by stop or yield signs as authorized in Section 13-1104 and 13-1105 of this Chapter. (b) Except when directed to proceed by a police officer or of- ficial traffic -control device, every driver of a vehicle ap- proaching a stop intersection indicated by a stop sign shall stop at a clearly marked stop line, but if none, before enter- ing the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersect- ing roadway before entering the intersection. After having stopped, the driver shall yield the right-of-way to any vehicle which has entered the intersection from another road- way or which is approaching so closely on the roadway as to constitute an immediate hazard during the time when the driver is moving across the intersecition, but said driver having so yielded may proceed at such time as a safe interval occurs. (c) The driver of a vehicle approaching a ;yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions and, if required for safety to stop, shall -54- 13-905 13-906 13-907 stop at a clearly marked stop line, but if none, before enter- ing the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic; on the intersect- ing roadway. After slowing or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection. (d) If a driver is involved in a collision at an intersection or interferes with the movement of other vehicles after driv- ing past a yield right-of-way sign, such collision or inter- ference shall be deemed prima facie evidence of the driver's failure to yield right-of-way. MERGING TRAFFIC At an intersection where traffic lanes are provided for merging traffic, the driver of each vehicle on the converging roadways is required to adjust his vehicular speed and lateral position so as to avoid a collision with another vehicle. VEHICLES ENTERING HIGHWAY FROM PRIVATE ROAD OR DRIVEWAY. The driver of a vehicle about to enter or cross a highway from an alley, building, private road or driveway shall yield the right-of-way to all vehicles approaching on, the highway to be entered. OPERATION OF VEHICLES ON APPROACH OF AUTHORIZED EMERGENCY VEHICLES. (a) Upon the immediate approach of an authorized emergency vehicle making use of audible and visible signals meeting the requirements of this Chapter or a police vehicle properly and lawfully making use of an audible or visible signal, the driver of every other vehicle on the same roadway shall yield the right-of-way and shall immediately drive to a position parallel to, and as close as possible to, the righthand edge or curb of the highway clear of any intersection and shall stop if possible and remain in such position until the author- ized emergency vehicle has passed, except when otherwise directed by a police officer. (b) This section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway. -55- (The next page is 57) ARTICLE X Pedestrians' Rights and Duties 13-1001 PEDESTRIAN OBEDIENCE TO TRAFFIC -CONTROL DEVICES AND TRAFFIC REGULATIONS. (a) A pedestrian shall obey the instructions of any official traffic -control device specifically applicable to him, unless otherwise directed by a police officer. (b) Pedestrians shall be subject to traffic and pedestrian - control signals provided in Section 13-1107 of this Chapter, but at all other places shall be accorded the privileges and shall be subject to the restrictions stated in this Article. 13-1002 PEDESTRIANS'S RIGHT-OF-WAY AT CROSSWALKS. (a) When traffic -control signals are not in place or not in operation the driver of a vehicle shall yield the right-of- way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. (b) No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a moving vehicle which is so close as to constitute an immediate hazard. (c) Paragraph (a) shall not apply under the condition stated in Section 13-1003. (d) Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehi- cle approaching from the rear shall not overtake and pass such stopped vehicle. (e) Whenever stop signs or flashing red signals are in place at an intersection or at a plainly marked crosswalk between intersections, drivers shall yield the right-of-way to pedes- trians as set forth in Section 13-904 of this Chapter. 13-1003 CROSSING AT OTHER THAN CROSSWALKS. (a) Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehi- cles upon the roadway. (b) Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right-of-way to all vehicles upon the roadway. (c) Between adjacent intersections at which traffic -control signals are in operation pedestrians shall not cross at any place except in a marked crosswalk. (d) No pedestrian shall cross a roadway intersection diagonal- ly unless authorized by official traffic -control devices; and, when authorized to cross diagonally, pedestrians shall cross only in accordance with the official traffic -control devices pertaining to such crossing movements. -57- 13-1004 DRIVERS TO AVOID COLLIDING WITH PEDESTRIANS. Notwithstanding other provisions of this Chapter, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person. 13-1005 BLIND PERSONS. (a) Any blind person who is carrying, in a raised or extended position, a cane or walking stick which is white in color or white tipped with red, or who is being guided by a dog shall have the right-of-way in crossing any roadway, whether or not traffic on such roadway is controlled by traffic signals, any- thing in this Chapter notwithstanding. (b) It shall be unlawful for any person, except persons wholly or partially blind, to carry or use on the public streets of this City any canes or walking sticks which are white in color or white with red ends or bottoms. 13-1006 PEDESTRIANS TO USE RIGHT HALF OF CROSSWALKS. Pedestrians shall move, whenever practicable, upon the right half of crosswalks. 13-1007 PEDESTRIANS SOLICITING RIDES OR BUSINESS. (a) No person shall stand in a roadway for the purpose of soliciting a ride from the driver of any vehicle. (b) No person shall stand on a highway for the purpose of soliciting employment, business, or contributions from the occupant of any vehicle. (c) No person shall stand on or in the proximity of a highway for the purpose of soliciting the watching or guarding of any vehicle while parked or about to be parked on a highway. 13-1008 PEDESTRIANS WALKING ON HIGHWAYS. (a) Where a sidewalk is provided and its use is practicable, it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway. (b) Where a sidewalk is not available, any, pedestrian walking upon a highway shall walk only on a shouldler, as far as prac- ticable from the edge of the roadway. (c) Where neither a sidewalk nor a shoulder is available, any pedestrian walking along and upon a highway shall walk as near as practicable to an outside edge of a roadway, and, if on a two-way roadway shall walk only on the left side of the road- way. (d) Except as otherwise provided in this Chapter, any pedestrian upon a roadway shall yield the right-of-way to all vehicles upon the roadway. 13-1009 PEDESTRIANS; RIGHT-OF-WAY ON SIDEWALKS. The driver of a vehicle emerging from or entering an alley, building, private road or driveway shall yield the right-of-way to any pedes- trian approaching on any sidewalk or any sidwalk area extend- ing across such alley, building entrance, road or driveway. 13-1010 PEDESTRIANS YIELD TO AUTHORIZED EMERGENCY 'VEHICLES. Upon the immediate approach of an authorized emergency vehicle making use of an audible signal and visible signals meeting the re quirements of Section 12-215 of Chapter 95 1/2 of the Illinois Vehicle Code, or of a police vehicle properly and lawfully making use of an audible signal only, every pedestrian shall yield the right-of-way to the authorized emergency vehicle. 13-1011 PEDESTRIAN UNDER INFLUENCE OF ALCOHOL OR DRUGS. A pedestrian who is under the influence of alcohol or any drug to a degree which renders himself a hazard shall not walk or be upon a highway except on a sidewalk. 13-1012 RAILROAD SIGNALS. No pedestrian shall pass through, around, over or under any crossing gate or barrier at a railroad grade crossing or bridge while such gate or barrier is closed or is being opened or closed. -59- (The next page is 62) ARTICLE XI Special Stops Required 13-1101 OBEDIENCE TO SIGNAL INDICATING APPROACH OF TRAIN. (a) Whenever any person driving a vehicle approaches a rail- road grade crossing such person must exercise due care and caution as to the existence of a railroad track across a high- way is a warning of danger, and under any of the circumstances stated in this Section, the driver shall stop within 50 feet but not less than 15 feet from the nearest rail of the rail- road and shall not proceed until he can do so safely. The foregoing requirements shall apply when: 1. A clearly visible electric or mechanical signal device gives warning of the immediate approach of a railroad train; 2. A crossing gate is lowered or a human flagman gives or continues to give a signal of the approach or passage of a railroad train; 3. A railroad train approaching a highway crossing emits a warning signal and such railroad train, by reason of its speed or nearness to such crossing, is an immediate hazard; 4. An approaching railroad train is plainly visible and is in hazardous proximity to such crossing; 5. A railroad train is approaching so closely that an immediate hazard is created. (b) No person shall drive any vehicle through, around or under any crossing gate or barrier at a railroad crossing while such gate or barrier is closed or is being opened or closed. (c) The City may designate particularly dangerous highway grade crossings and erect stop signs thereat. When such stop signs are erected the driver of any vehicle shall stop within 50 feet but not less than 15 feet from the nearest rail of such railroad and shall proceed only upon exercising due care. 13-1102 CERTAIN VEHICLES MUST STOP AT ALL RAILROAD GRADE CROSSINGS. (a) The driver of any motor vehicle carrying passengers for hire, or of any vehicle carrying liquid petroleum and liquid petroleum products, explosives, flammable or oxidizing liquids and solids, flammable or poisonous compressed gasses, volatile liquids and solids which emit poisonous fumes, corrosive liquids and radioactive materials as a cargo or part of a cargo, before crossing at grade any track or tracks of a rail- road, shall stop such vehicle within 50 feel: but not less than 15 feet from the nearest rail of such railroad and while so stopped shall listen and look in both directions along such track for any approaching train, and for signals indicating the approach of a•train, except as hereinafter provided, and shall not proceed until he can do so safely. After stopping as required in this Section, the driver shall proceed only in a gear not requiring a change of gears during the crossing, and the driver shall not shift gears while crossing the track or tracks. -62- 13-1103 13-1104 (b) This Section shall not apply at: 1. Any railroad grade crossing at which traffic is con- trolled by a police officer or human flagman; 2. Any railroad grade crossing at which traffic is regu- lated by a traffic -control signal; 3. Any railroad grade crossing protected by crossing gates or an alternately flashing light signal intended to give warn- ing of the approach of a railroad train; 4. Any railroad grade crossing at which an official traf- fic -control device gives notice that the stopping requirement imposed by this Section does not apply. (c) All school buses shall stop at all railroad crossings when carrying passengers, except at any railroad grade crossing located upon a 4-lane highway where the posted speed limit is in excess of 45 miles per hour or any railroad grade crossing at which traffic is controlled by a police officer or human flagman. STOP AND YIELD SIGNS. (a) Preferential right-of-way at an intersection may be indi- cated by stop signs or yield signs as authorized by Section 13-1104 and 13-1105 of this Article. (b) Except when directed to proceed by a police officer or traffic -control signal, every driver of a vehicle approaching a stop intersection indicated by a stop sign shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, shall stop at a clear- ly marked stop line, but if none, then at, the point nearest the intersecting roadway,where the driver has a view of ap- proaching traffic on the intersecting roadway before entering the intersection. (c) The driver of a vehicle approaching a yield sign if re- quired for safety shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. STOP STREETS ESTABLISHED. As provided in Section 13-1103, it shall be unlawful for the operator of any vehicle being oper- ated on any of the streets hereinafter listed in the column designated "Stop Street" to drive such vehicle into the inter- section with the street listed opoposite it in the column designated "Intersecting Street", without first bringing such vehicle to a full stop. (1) Riverside Drive at Elm Street (2) Green Street at Elm Street (3) Richmond Road at Elm Street (4) Front Street at Elm Street -72- (The next page is 77) ARTICLE XII Parking Regulations 13-1201 It shall be unlawful for the operator of any motor vehicle to park such vehicle for a period of time longer than 2 consecu- tive hours in'the following locations: (1) MAIN STREET from the easterly edge of the Chicago and Northwestern property to a point 150 feet east of Front Street on both sides of Main Street. (2) ELM STREET from the westerly edge of Riverside Drive to the easterly edge of Front Street on both sides of Elm Street. (3) PEARL STREET from Green Street to a point 150 feet east of Green Street on the south side only, and from Park Street to the Fox River on both sides. (4) RIVERSIDE DRIVE from Elm Street to a point 200 feet north of Pearl Street on both sides of Riverside Drive. (5) GREEN STREET from Pearl south to Waukegan Road on both sides of Green Street. (6) WAUKEGAN ROAD from Green Street to the westerly edge of the main entrance to the old McHenry Hospital on the north side of Waukegan Road. The Superintendent of Public Works shall erect or cause to be erected signs at the aforesaid locations indicating such loca- tions to be two hour parking areas only. 13-1202 to 13-1209 RESERVED (these sections repealed 2-2-81 MC-81-211) 13-1210 STOPPING, STANDING OR PARKING PROHIBITED IN SPECIFIED PLACES. (a) Except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or official traffic -control device, no person shall: 1. Stop, stand or park a vehicle: a. On the roadway side of any vehicle stopped or parked at the edge or curb of a street; b. On a sidewalk; c. Within an intersection; d. On a crosswalk; e. Between a safety zone and the adjacent curb or with- in 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings; f. Alongside or opposite any street excavation or obstructin in which stopping, standing or parking would obstruct traffic; g. Upon any bridge or other elevated structure upon a highway or within a highway tunnel; h. On any railroad tracks; i. At any place where official signs prohibit stopping; j. On any controlled -access highway; -77- k. In the area between roadways or a divided highway, including crossovers. 1. Between existing curb and gutter and existing side- walk on same side of street; m. Between existing curb and gutter and existing right- of-way boundary line on the same side of street, where there is no existing sidewalk. 2. Stand or park a vehicle, whether occupied or not, ex- cept momentarily to pick up or discharge passengers: a. In front of a public or private driveway; b. Within 15 feet of a fire hydrant; c. Within 20 feet of a crosswalk at an intersection; d. Within 30 feet upon the approach to any flashing signal, stop sign, yield sign, or traffic control signal located at the side of a roadway; e. Within 20 feet of the driveway entrance to any fire station, and on the side of a street opposite the entrance to any fire station within 75 feet of such entrance (when proper- ly sign -posted); f. At any place where official signs prohibit standing. 3. Park a vehicle whether occupied or not, except tempor- arily for the purpose of and while actually engaged in loading or unloading property or passengers: a. Within 50 feet of the nearest rail or a railroad crossing; b. At any place where official signs prohibit parking. 4. No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful. 13-1211 ADDITIONAL PARKING REGULATIONS. (a) Except as otherwise provided in this Section, every vehicle stopped or parked upon a two-way roadway shall be so stopped or parked with the right-hand wheels parallel to and within 12 inches of the right-hand curb or as close as prac- ticable to the right edge of the right-hand shoulder. (b) Except as otherwise provided by ordinance, every vehicle stopped or parked upon a one-way roadway shall be so stopped or parked parallel to the curb or edge of the roadway, in the direction of authorized traffic movement, with its right-hand wheels within 12 inches of the right-hand curb or as close as practicable to the right edge of the right-hand shoulder, or with its left-hand wheels within 12 inches of the left-hand curb or as close as practicable to the left edge of the left- hand shoulder. (c) Only angle parking shall be permitted in the following areas: 1. RIVERSIDE DRIVE - from Bonne Creek north to 200 feet north of Pearl Street; 2. MAIN STREET - from the easterly edge, of the Chicago and Northwestern Railroad property to 150 feet east of Front Street; 3. GREEN STREET - from Elm Street south to the northerly edge of the Green Street bridge over Boone Creek. (d) Only parallel parking is permitted on the west side of Park Street between Elm and Pearl Streets. (e) The City, with respect to highways and streets under its jurisdiction, may, by ordinance, place signs prohibiting, lim- iting, or restricting the stopping, standing or parking of vehicles on any highway where in its opinion such stopping, standing, or parking is dangerous to those using the highway or where the stopping, standing or parking of vehicles would unduly interfere with the free movement of traffic thereon. No person shall stop, stand or park any vehicle in violation of the restrictions indicated by such devices. 13-1212 PARKING NOT TO OBSTRUCT TRAFFIC. No person shall park any vehicle upon a street in such a manner or under such condi- tions as to leave available less than fifteen feet of the width of the roadway for free movement of vehicular traffic on a two-way street or less than ten feet of the width of the roadway for free movement of vehicular traffic on a one-way street. 13-1213 STOPPING, STANDING OR PARKING IN ALLEYS. (a) No person shall stop, stand or park any vehicle in any alley for a period of time longer than is necessary for the reasonable expeditious loading or unloading of such vehicles. (b) No person shall stop, stand or park a vehicle within an alley in such a manner or under such condlitions as to leave available less than ten feet of the width of the roadway for the free movement of vehicular traffic. (c) No person shall stop, stand or park a vehicle within an alley in such position as to block the driveway or entrance to any abutting property. 13-1314 PARKING LIMITED DURING SNOW REMOVAL. It is unlawful to park any vehicle for a period of time longer than three minutes for loading or unloading of passengers or thirty minutes for load- ing or unloading of property in any place, whether designated as a loading zone or not so designated on the paved portion of any roadway, at any time after snow begins, to fall and for a period of eight hours after snow stops falling, if the snow on the street exceeds two inches in depth, provided that said eight -hour parking restriction shall continue during snow -re- moval operations until completed. 13-1215 ALL NIGHT PARKING PROHIBITED. (a) To make possible the cleaning of streets and the removal of snow and ice, it shall be unlawful to park any motor vehi- cle on or upon the paved portion of any roadway within the corporate limits of the City, between the hours of 2:00 a.m and 6:00 a.m. at any time. (b) The Superintendent of Public Works shall erect or cause to be erected at all routes entering the City of McHenry signs stating: "NO PARKING ON ALL CITY STREETS 2 AM TO 6 AM." 13-1216 PARKING FOR CERTAIN PURPOSES PROHIBITED. No person shall park a vehicle upon any roadway for the principal purpose of: (a) Displaying such vehicle for sale; (b) Washing, greasing, or repairing such vehicle except such repairs necessitated by an emergency. -79- 13-1217 NO PARKING ZONES ESTABLISHED. (a) The Superintendent of Public Works shall erect or cause to be erected at all routes entering the City of McHenry signs prohibiting parking at any time in the following locations: (1) RAMBLE ROAD both sides of the street from Illinois Route 120 to Home Avenue. (2) MEADOW LANE both sides of the street from Illinois Route 120 to Home Avenue. (3) HIGHVIEW both sides of the street from Illinois Route 120 to Home Avenue. (4) INDUSTRIAL DRIVE the entire length of the street along both sides. (5) LILLIAN the entire length of the street along both sides. (6) CRYSTAL LAKE ROAD on both sides of the street from Illinois Route 120 to the northern line of Hanley, and along the west side of the street from Royal (Drive to the south boundary of McHenry West Campus High School. (7) FRONT ROYAL DRIVE on the east side of the street from Manchester Mall to Illinois Route 120. (8) FRONT STREET along the east side of the street from Elm Street to a point 300 feet north of Elm Street. (9) FREUND AVENUE along the east side of the street from Elm Street to a point 300 feet north of Elm Street. (10) PETERSEN PARK ROAD along both sides of the road for the entire length of the road, except in spaces provided. (11) RICHMOND ROAD on the east side of the road from Elm Street to Pearl Street. (12) PEARL STREET along the north side of the street be- tween Park Street and Green Street and along the south side of the street between Richmond Road and Court Street except in the spaces provided. (13) WASHINGTON STREET along the north side of the street from Richmond Road to Riverside Drive. (14) RIVERSIDE DRIVE along the east sidle of the street be- tween the north City limit and a point 200 feet south of Broad Street and along the east side from Elm Street to a point 100 feet north of Elm Street. (15) GREEN STREET along the west side of the street be- tween Washington Street and Pearl Street, and along the west side of the street from Waukegan Road to a point 300 feet north of Waukegan Road and on both sides of the street from Waukegan Road to John Street, and along the west side of the street from John Street to Kane Avenue and from Kane Avenue south for 500 feet on the east side of the street. (16) KANE AVENUE along the north side of the street from Green Street to a point 200 feet west of Green Street, and along the north side of the street from Center to a point 200 feet east of Center. (17) THIRD STREET on both sides of the street from Wauke- gan Road to Elm Street. W (18) WAUKEGAN ROAD along the south side of the street from a point 200 feet east of Front Street to the Fox River, and along the north side of the street from Green Street to Fourth Street, and from the east line of the entrance to the old McHenry Hospital to the Fox River on the north side of the street. (19) MAIN STREET along the south side of the street from a point 150 feet east of Front Street to Greer► Street. (20) JOHN STREET on both sides of the street from Green Street to the west boundary of the McHenry Country Club. (21) ELM STREET along the south side of the street from Richmond Road to Green Street. (22) The north side of Illinois State Route 120 in a northeasterly direction from the center -line of Front Street for a distance of 150 feet. (23) Illinois State Route 31, on both sides of the street, for a distance of 50 feet south from Main Street. (24) On the east side of Hanley Street between Main Street and Elm Street (Illinois Route 120). (25) On the north side of Commercial Avenue, from Highview Avenue east to Meadow Lane. (26) Along the east side of Front Street from the north driveway thereon of the First National Bank of McHenry to a point eighty feet north thereof. (27) On either side of the circular driveway at the Knox Park Swimming Pool. (28) Sunset Drive on the east side thereof from the creek bridge to the corner of Willow Lane. (29) On the south side of Elm Street, from Third Street to the Millstream Bridge. (30) Meadow Lane, on both sides of the street from Elm Street to Shore Drive. (31) On the West side of Riverside Drive between Elm and Pearl Streets on Thursdays from 6:30 A.M. to 7:30 A.M. (32) On the East side of Riverside Drive between Elm and Pearl Streets on Fridays from 6:30 A.M. to 7:30 A.M. (b) The Superintendent of Public Works shall erect or cause to be erected signs authorizing 2 hour parking between the hours of 8:00 A.M. and 6:00 P.M. except Sunday in the following locations: (1) FRONT STREET along the west side of the street from Elm Street to Main Street. (2) PEARL STREET on the north side of the street between Richmond Road and Green Street, and along the south side of the street from Court Street to Park Street„ (3) PARK STREET along both sides of the: street from Venice to Elm Street and from Elm Street to Pearl Street. (4) COURT STREET along both sides of the street from Venice to Elm Street, and from Elm Street to Pearl Street. (5) GREEN STREET along the east side of the street between Pearl Street and Broad Street, and along the west side of the street from Kane Avenue to a point 500 feet south of Kane Avenue. (6) KANE AVENUE along the south side of the street from Green Street to Center Street. -81- 13-1218 13-1219 13-1220 (7) Along the west side of Green Street north of Elm Street between Elm and the south entrance to McHenry State Bank parking lot. (c) The Superintendent of Public Works shall erect or cause to be erected signs indicating that no parking shall be allowed during any events along the north side of Kane Avenue in the area of the fenced portion of McCracken Field. (d) The maximum time for which any vehicle shall be allowed to park in the public parking lot on Main Street is hereby estab- lished at 4 hours between the hours of 8:00 A.M. and 6:00 P.M. except Sunday. (e) The Superintendent of Public Works shall erect or cause to be erected signs indicating no parking in the following areas which are designated as loading zones, provided however that the maximum time for which any vehicle shall be allowed to park for loading or unloading on any given occasion shall not exceed 15 minutes: (1) 3308 PEARL STREET (2) RIVERSIDE DRIVE along the west side from a point 39 feet south of Elm Street to 60 feet south of Elm Street. (f) The Superintendent of Public Works shall erect or cause to be erected signs prohibiting parking on school days between the hours of 8:00 A.M. and 4:00 P.M. in the following loca- tions: (1) ALLEN AVENUE for its entire length on both side of the street. (g) The Superintendent of Public Works shall erect or cause to be erected signs prohibiting parking from the hours of 6:00 A.M. to 6:00 P.M. in the following locations: (1) RIVERSIDE DRIVE, adjacent to 1312 N. Riverside Drive. (h) The maximum time for which any vehicle shall be allowed to park in the Green Street municipal parking lot areas that are not designated by signs for permit parking is hereby estab- lished at two hours between the hours of B:00 A.M. and 6:00 P.M., except Sunday. (i) Permit Parking only is permitted in the Green Street muni- cipal parking lot on a monthly permit or fee basis in the area designated by signs. (See Appendix "A") The: fee for such per- mit shall be $10.00 per calendar month, payable in advance. CURB MARKINGS. Any area in which the curb is painted yellow shall be designated a no -parking zone, whether or not signs are posted to that effect. FIRE LANES. It shall be unlawful for any vehicle to occupy an area set aside as a fire lane whether established on public property by ordinance or on private property by agreement. PARKING FOR'MEDICALLY HANDICAPPED PERSONS: (a) It shall be unlawful for any person, other than a medic- ally handicapped person, to park any motor vehicle in the following locations: (1) GREEN STREET - only the southern parking space on the west side of the Green Street Bridge. (2) GREEN STREET - one parking space abutting on the north and on the south of the no parking zone in front of the McHen- ry Medical Group entrance. NO (3) RIVERSIDE DRIVE - the northern most parking space on the west side of the street south of Pearl Street. (4) RIVERSIDE DRIVE - the parking space on the east side of the street in front of the entrance to 1314 North Riverside Drive. (5) ELM STREET - the westerly most parking space on the north side of Elm Street east of Front Street. (6) ELM STREET - the first parking space east of Green Street on the south side of Elm Street. ( 7 ) MAIN STREET - the parking space on the south side of the street abutting on the west side of the entrance to the City Parking -Lot (8) One parking space in front of 1228 North Green Street abutting the fire hydrant no parking area. (9) One parking space in front of 1301 N. Riverside Drive. The foregoing medically handicapped parking spaces shall be marked by appropriate signs. (b) Parking spaces set aside for medically handicapped persons may be occupied by motor vehicles displaying a State of Illi- nois Medically Handicapped license and registration, or a City of McHenry or other municipal medically handicapped person decal on the rear window thereof; such decals may be obtained, without charge, from the City Clerk upon request supported by written certification from a medical doctor addressed to the City of McHenry that the applicant for the decal is a medical- ly handicapped person. (c) Vehicles bearing the aforementioned decals when parked in other areas of the City, are exempt from any ordinance impos- ing time limitations on parking, but are subject to the provi- sions of all other parking ordinances. 13-1221 AUTHORITY TO IMPOUND VEHICLES. Members of the Police Depart- ment of the City of McHenry are hereby authorized to remove a vehicle from any street or highway to the City vehicle pound or authorized garage as determined and designated by the Chief of Police under the circumstances hereinafter enumerated: (1) When any vehicle is left unattended upon any bridge or upon any approach thereto, where such vehicle constitutes an obstruction to traffic. (2) When a vehicle upon any street or highway is so dis- abled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle or by reason of physical injury incapacitated to such an extent as to be un- able to provide for its custody or removal. (3) When any vehicle is left unattended upon any street or highway and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic. (4) When any abandoned vehicle is found on any street or highway. (5) When any vehicle is parked in violation of Section 13-1214 (snow removal) or 13-1219 (fire lanes). (6) When any vehicle is parked in violation of official signs indicating that parking, standing, or stopping is pro- hibited at all times or during designated hours or prohibited for a longer time than indicated on such sign. -83- (The next page is 88) ARTICLE XIII Miscellaneous Laws 13-1301 UNATTENDED MOTOR VEHICLES. No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition, removing the key from the ignition, effectively setting the brake thereon and, when standing upon any perceptible grade, turning the front wheels to the curb or side of the highway. 13-1302 LIMITATIONS ON BACKING. (a) The driver of a vehicle shall not back the same unless such movement can be made with safety and without interfering with other traffic. (b) The driver of a vehicle shall not back the same upon any shoulder or roadway of any controlled -access highway. 13-1303 RIDING ON MOTORCYCLES. The operator of it motorcycle shall ride only astride the permanent and regular seat or saddle attached thereto, and the operator shall not permit more than one other person to ride thereon nor shall such other person ride on the motorcycle unless it is designed to carry 2 people, in which event the passenger shall also ride astride the permanent and regular seat or saddle if it is designed for 2 persons, or astride another seat or saddle firmly attached to the rear of the operator; however, any seat or saddle designed for a passenger must be equipped with permanent hand - grips and, in addition, the motorcycle must be equipped with footrests adjusted to fit such passenger. A sidecar may be attached to a motorcycle in which additional persons may ride. 13-1304 RIDING ON MOTORIZED PEDALCYCLES. (a) The operator of a motorized pedalcycle shall ride only astride the permanent and regular seat attached thereto, and shall not permit 2 persons to ride thereon at the same time, unless the motorized pedalcycle is desinged to carry 2 per- sons; any motorized pedalcycle designed for 2 persons must be equipped with a passenger seat and permanent handgrips and footrests for use of a passenger. (b) Neither the operator nor any passenger on a motorized pedalcycle shall be required to wear any special goggles, shield, helmet or glasses. (c) The provisions of Article XIV (Bicycles) shall be appli- cable to the operation of motorized pedalcycles, except for those provisions which by their nature can have no application to motorized pedalcycles. 13-1305 SPECIAL EQUIPMENT FOR PERSONS RIDING MOTORCYCLES. The opera- tor of a motorcycle and every passenger thereon shall be pro- tected by glasses, goggles or a transparent shield. The Department of Public Safety shall determine the standard for this equipment. 13-1306 REQUIRED EQUIPMENT ON MOTORCYCLES. (a) No person shall operate any motorcycle with handlebars more than 15 inches in height above the portion of the seat or saddle occupied by the operator. Em (b) Any morotcycle carrying a passenger, other than in a side- car or enclosed cab, shall be equipped with permanent hand - grips on the seat or saddle carrying such passenger, and with footrests adjusted to fit such passenger. 13-1307 OBSTRUCTION OF DRIVER'S VIEW OR DRIVING MECHANISM. (a) No person shall drive a vehicle when it is so loaded, or when there are in the front seat such a number of persons, exceeding three, as to obstruct the view of the driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle. (b) No passenger in a vehicle shall ride in such position as to interfere with the driver's view ahead or to the sides, or interfere With his control over the driving mechanism of the vehicle. (c) No passenger on a school bus may ride or stand in a posi- tion as to interfere with the driver's view ahead or to the side or to the rear, or to interfere with his control of the driving mechanism of the bus. 13-1308 OPENING AND CLOSING VEHICLE DOORS. No person shall open the door of a vehicle on the side available to moving traffic un- less and until it is reasonably safe to do so, and can be done without interfering with the movement of other traffic, nor shall any person leave a door open on the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers. 13-1309 COASTING PROHIBITED. (a) The driver of any motor vehicle when traveling upon a down grade shall not coast with the gears or transmission of such vehicle in neutral. (b) The driver of a truck or bus when traveling upon a down grade shall not coast with the clutch disengaged. 13-1310 FOLLOWING OF FIRE APPARATUS PROHIBITED. The driver of any vehicle other than one on official business shall not follow any fire apparatus traveling in response to a fire alarm clos- er than 500 feet or stop such vehicle within 500 feet of any fire apparatus stopped in answer to a fire alarm. 13-1311 CROSSING FIRE HOSE. No vehicle shall be driven over any un- protected hose of a fire department when laid down on any street, private road or driveway to be used at any fire or alarm of fire, without the consent of the fire department of- ficial in command. 13-1312 DRIVING UPON SIDEWALK. No person shall drive any vehicle upon a sidewalk or sidewalk area except upon a permanent or duly authorized temporary driveway. 13-1313 DRIVING THROUGH SAFETY ZONE PROHIBITED No vehicle shall at any time be driven through or within a safety zone. 13-1314 PUTTING GLASS, ETC. ON HIGHWAY PROHIBITED. (a) No person shall throw or deposit upon any highway any glass bottle, glass, nails, tacks, wire, cans or any other substance likely to injure any person, animal or vehicle upon such highway. (b) Any person who drops or permits to be dropped or thrown, upon any hi hway, any destructive, dangerous, hazardous or injurious ma erial shall immediately remove! the same or cause it to be removed. (c) Any person removing a wrecked or damaged vehicle from a highway shall remove any glass or other injurious substance dropped upon the highway from such vehicle. 13-1315 APPROACHING, OVERTAKING AND PASSING SCHOOL BUIS. (a) The driver of a vehicle upon a highway upon meeting or overtaking from either direction, any school bus which has stopped on the highway for the purpose of receiving or dis- charging pupils shall stop the vehicle before reaching the school bus when there is in operation on the school bus the visual signals as specified in Section 12-804 and 12-805 of the Illinois Vehicle Code and the driver shall not proceed until the school bus has resumed motion or the driver of the vehicle is signalled by the shcool bus driver to proceed or the visual signals are no longer actuated. (b) The stop signal arm, required by Section 12-803 of the Illinois Vehicle Code, shall be extended after the school bus has come to a complete stop for the purpose of loading or discharging pupils and shall be closed before starting out again. The stop signal arm shall not be extended at any other time. (c) The alternately flashing red signal lamps of a 4-lamp or 8-lamp signal system required by Section 12-805 of the Illi- nois Vehicle Code shall be actuated after the school bus has come to a complete stop for the purpose of loading or dis- charging pupils and shall be turned off before starting out again. The red signal lamps shall not be actuated at any other time except as provided in subsection (d) of this Section. (d) The alternately flashing amber signal "lamps of an 8-lamp flashing signal system, required by Section 12-805 of the Illinois Vehicle Code, shall be acutated continuously during not less than the last 100 feet traveled by the bus before stopping for the purpose of loading or discharging pupils within a business or residential district and during not less than the last 200 feet traveled by the bus outside a business or residential district. The amber signal lamps shall not be actuated at any other time. (e) The driver of a vehicle upon a highway of which the road- ways for traffic moving in opposite directions are separated by a strip of ground which is not surfaced or suitable for vehicular traffic need not stop his vehicle upon meeting or passing a school bus which is on the opposite roadway; and need not stop his vehicle when driving upon a controlled - access highway when a school bus is stopped in a loading zone adjacent to the surfaced or improved part of the controlled - access highway where pedestrians are not permitted to cross such controlled -access highway. 13-1316 SCHOOL BUSES - STOPPING, LOADING AND DISCHARGING PASSENGERS ON HIGHWAYS HAVING FOUR OR MORE LANES. A school bus on a high- way having 4 or more lanes for vehicular traffic shall stop for the loading or discharging of passengers, only on the right side of the highway and when so stopped shall load or dis- charge only those passengers whose residences are located to the right of the highway. The routes of school buses shall be so arranged that no child shall be required to cross such a 4 or more lane highway to board a school bus or to reach his .o residence after leaving the bus. This Section does not apply when children are escorted by competent persons designated by school authorities or by law enforcement officers. 13-1317 OBSTRUCTING PERSON IN HIGHWAYS. No person shall willfully and unnecessarily hinder, obstruct or delay, or willfully and unnecessarily attempt to delay, hinder or obstruct any other person in lawfully driving or traveling along or upon any highway within this City or offer for barter or sale merchan- dise on said highway so as to interfere with the effective movement of traffic. 13-1318 FUNERAL PROCESSIONS (a) Funeral processions have the right-of-way at intersections when vehicles comprising such procession have their headlights lighted, subject to the following conditions and exceptions: (1) Operators of vehicles in a funeral procession shall yield the right-of-way upon the approach of an authorized emergency vehicle giving audible or visible signal; (2) Operators of vehicles in a funeral procession shall yield the right-of-way when directed to do so by a police officer; (3) The operator of the leading vehicle in a funeral pro- cession shall comply with stop signs and traffic -control sig- nals but when the leading vehicle has proceeded across an intersection in accordance with such signal or after stopping as required by the stop sign, all vehicles in such procession may proceed without stopping, regardless of the sign or signal and the leading vehicle and the vehicles in procession shall proceed with due caution. (b) The operator of a vehicle not in the funeral procession shall not drive his vehicle in the funeral procession except when authorized to do so by a police officer or when such vehicle is an authorized emergency vehicle giving audible or visible signal. (c) The operator of a vehicle not in a funeral procession may overtake and pass the vehicles in such procession if such overtaking and passing can be accomplished without causing a traffic hazard or interfering with or entering such procession. (d) Operators of vehicles not a part of a funeral procession may not form a procession or convoy and have their headlights lighted for the purpose of securing the right-of-way granted by this Section to funeral processions. (e) The lead vehicle in the funeral procession may be equipped with a flashing amber light which may be used only when such vehicle is used as a lead vehicle in such procession. Vehi- cles comprising a funeral procession may utilize funeral pen- nants, flags, or windshield stickers to identify the indivi- dual vehicles in such a procession. 13-1319 STOP WHEN TRAFFIC OBSTRUCTED. No driver shall enter an inter- section or a marked crosswalk or drive into any railroad grade crossing unless there is sufficient space on the other side of the intersection, crosswalk or railroad grade -crossing to ac- comodate the vehicle he is operating without obstructing the passage of other vehicles, pedestrians or railroad trains notwithstanding any traffic -control indica- tion to proceed. -91- 13-1320 TRAFFIC NOT TO BE OBSTRUCTED. No vehicle shall be operated or allowed to remain upon any street in such a manner as to form an unreasonable obstruction to the thaffic thereon. 13-1321 NEGLIGENT DRIVING. It shall be unlawful for any person to operate any vehicle upon a public way negligently, heedlessly and without due caution in a manner so as to endanger or be likely to endanger any person or property. 13-1322 OPERATION OF VEHICLES PROHIBITED IN CERTAIN AREAS. It shall be unlawful for any person to operate any motor vehicle in- cluding but not limited to, recreational vehicles, minibikes, motorbikes, motorcycles, snowmobiles, all -terrain vehicles, or similar motorized equipment, upon, within, or over any munici- pal park, playground, tennis area, or baseball field, or upon any high school, junior high school, or grade school property, except in areas designated for that purpose, at any time with- in the corporate limits of the City. 13-1323 COASTER, ROLLER SKATES, AND SIMILAR DEVICES. No person upon roller skates, or riding in, on, or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway ex- cept while crossing a street on a crosswalk and when so cross- ing such person shall be granted all the rights and shall be subject to all the duties applicable to pedestrians. This Section shall not apply upon any street while set aside as a play street as authorized by ordinance of this City. 13-1324 NOISES, EXCESSIVE FUMES, SMOKE. (a) Every motor vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smoke. (b) The engine and power mechanism of every motor vehicle shall be so equipped and adjusted as to prevent the escape of escessive fumes or smoke. (c) No motor vehicle shall be operated within the City of McHenry in such a manner as to cause the excessive noise and/or smoke commonly known as "peeling rubber". -92- (The next page is 96) ARTICLE XIV Bicycles 13-1401 4 APPLICATION OF RULES. (a) It is unlawful for any person to do any act forbidden or fail to perform any act required in this Article. (b) the parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this Act. (c) These regulations applicable to bicycles shall apply when- ever a bicycle is operated upon any highway or upon any path set aside for the exclusive use of bicycles subject to those exceptions stated herein. 13-1402 TRAFFIC LAWS APPLY TO PERSONS RIDING BICYCLES. Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by this Act, except as to special reg- ulations in this Article and except as to those provisions of this Act which by their nature can have no application. 13-1403 RIDING ON BICYCLES. (a) A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto. (b) No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. 13-1404 CLINGING TO VEHICLES. No person riding upon any bicycle, coaster, roller skates, sled or toy vehicle shall attach the same or himself to any vehicle upon a roadway. 13-1405 RIDING ON ROADWAYS AND BICYCLE PATHS. (a) Every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exer- cising due care when passing a standing vehicle or one pro- ceeding in the same direction. (b) Persons riding bicycles upon a roadway shall ride single file except on paths or parts of roadways set aside for the exclusive use of bicycles. (c) Whenever a usable path for bicycles has been provided for adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. 13-1406 CARRYING ARTICLES. No person operating a bicycle shall carry any package, bundle or article which prevents the driver from keeping both hands upon the handlebars. 13-1407 LAMPS AND OTHER EQUIPMENT ON BICYCLES. (a) Every bicycle when in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visi- ble from a distance of at least 500 feet to the front and with a red reflector on the rear of a type approved by the Depart- ment of Public Safety which shall be visible from all dis- tances from 100 feet to 600 feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector. EM 13-1408 13-1409 13-1410 (b) A bicycle shall not be equipped with nor shall any person use, upon a bicycle, any siren. (c) Every bicycle shall be equipped with a brake which will adequately control movement of and stop and hold such bicycle. (d) No person shall sell a new bicycle or pedal for use on a bicycle that is not equipped with a reflex reflector conform- ing to specifications prescribed by the Department of Public Safety, on each pedal, visible from the front and rear of the bicycle during darkness from a distance of 200 feet. (e) No person shall sell or offer for sale a new bicycle that is not equipped with side reflectors. Such reflectors shall be visible from each side of the bicycle from a distance of 500 feet and shall be essentially colorless or red to the rear of the center of the bicycle and essentially colorless or am- ber to the front of the center of the bicycle provided. The requirements of this paragraph may be met by reflective mater- ials which shall be at least 3/16 of an inch wide on each side of each tire or rim to indicate as clearly as possible the continuous circular shape and size of the tires or rims of such bicycle and which reflective materials may be of the same color on both the front and rear tire or rim,. Such reflectors shall conform to specifications prescribed by the Department of Public Safety. LAMPS ON MOTORIZED PEDALCYCLES. Every motorized pedalcycle, when in use at nighttime, shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front, and with a red reflector on the rear of a type approved by the Department of Public Safety which shall be visible from all distances from 100 feet to 600 feet to the rear when in front of lawful, low -powered beams of head lamps on a motor vehicle. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector. PARKING. No person shall park a bicycle upon a street other than upon a roadway against the curb or upon the sidewalk in a rack to support the bicycle or against a building or at the curb, in such manner as to afford the least obstruction to pedestrian traffic. RIDING ON SIDEWALKS. (a) No person shall ride a bicycle upon a sidewalk within a business district. (b) The Chief of Police is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person and when such signs are in place no person shall disobey the same. (c) Whenever any person is lawfully riding a bicycle upon a permitted sidewalk area, such person shall yield the right-of- way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian. -97- (The next page is 100) ARTICLE XV Equipment 13-1501 EQUIPMENT OF VEHICLES. It shall be unlawful for any person to drive or move, or for the owner to cause or knowingly per- mit to be driven or moved, on any roadway within the City, a vehicle or combination of vehicles which is in such unsafe condition as to endanger any person or property, or which does not contain those parts, or is not at all times equipped with, such lamps and other equipment in proper condition and adjust- ment as are required under the provisions of Chapter 12 of the Illinois Vehicle Code. -100- (The next page is 102) ARTICLE XVI Taxicabs 13-1601 LICENSE REQUIRED. It shall be unlawful to engage in the business of operating a taxicab in the City without first hav- ing secured a license therefor. Applications for such licens- es shall be made in wirting to the Clerk, and shall state thereon the name of the applicant, the intended place of busi- ness and the number of cabs to be operated. 13-1602 DEFINITION. The term "taxicab" as used in this Ordinance shall mean and include any vehicle used to carry passengers for hire but not operating on a fixed route. 13-1603 CHARACTER OF APPLICANT. No such license shall be issued to or held by any person who is not a person of good character or who has been convicted of a felony, nor shall such license be issued to or held by any corporation if an, Officer thereof would be ineligble for a license under the foregoing condi- tions. 13-1604 The annual fee payable in advance for such license shall be One Hundred Dollars ($100.00) for each cab company or owner plus Twenty Dollars ($20.00) for each taxicab operated. All such fees shall be paid to the Clerk at the, time application is made. In the event the license applied for has been denied, the fee shall be returned to the applicant. If the license is granted, then the fee shall be deposited in the general corporate fund or such other fund as shall have been designated by the Council by proper action. Whenever the num- ber of cabs so operated shall be increased during the license year the licensee shall notify the Clerk of such change and shall pay the additional fee to the Clerk. Such fee shall be in lieu of any other vehicle fee required by Ordinance and the Clerk shall issue suitable tags or stickers for the number of cabs covered by each license. Such tag or sticker shall be displayed in a prominent place on each taxicab while it is in use. If a taxicab is withdrawn from service and another taxi- cab replaces the one withdrawn, the licensee shall notify the Clerk who shall issue a tag or sticker for such replacement taxicab without additional charge to the licensee. The licensee shall notify the Clerk of the motor number and of the license number of each cab operated and of the correspond- ing City tag or sticker number. The annual fee shall include the right to use one or more of the designated parking places for taxicabs in each of the various locations throughout the City, known as "Cab Stands". Said parking place or places shall be assigned by the Chief of Police and no other licensee shall use that parking place or places. Each "Cab Stand" shall be appropriately marked by signs erected under the supervision of the Chief of Police. It shall be unlawful to park any vehicle other than a taxicab in any "Cab Stand". -102- 13-1605 VEHICLES No taxicab shall be operated unless it bears a state license duly issued; and no such cab shall be operated unless it is equipped with proper brakes, lights, tires, horn, muffler, rear vision mirror, and windshield wipers in good condition. All taxicabs under this Ordinance shall be sub- jected to a safety test at an official State Police testing station semi-annually in the months of March or April and September or October of each year, and a Certificate of Safety, with a number on the face indicating the month of the next inspection period the vehicle is subject to inspection shall be displayed in a prominent place on each taxicab. If the test shows the taxicab is not in a safe mechanical condition, it shall not be operated on the streets of said City until it has been repaired, submitted to a retest at an official testing station and a current Certificate of Safety is issued. It shall be the duty of the Chief of Police to inspect every taxicab so often as may be necessary to see to the enforcement of the provisions of this section. Each taxicab, while operated, shall have on each side, in letters readable from a distance of twenty feet, the name of the licensee operating it. If more than one cab is operated by a licensee each cab shall be designated by a different num- ber, and such number also shall so appear on each side of such cab. 13-1606 DRIVERS. It shall be unlawful for any driver of a taxicab while on duty to drink any intoxicating liquor, or to use any profane or obscene language, to shout or call to prospective passengers, or to disturb the peace in any way. The licensee shall submit a list of drivers to the City Clerk semi-annually. 13-1607 INSURANCE. No taxicab shall be operated unless it is covered by a bond or public liability policy as required by statute. 13-1608 TRAFFIC RULES. It shall be the duty of every driver of a taxicab to obey all traffic rules established by statute or ordinance. 13-1609 UNLAWFUL USE. It shall be unlawful to knowlingly permit any taxicab to be used in the perpetration of a crime or misde- meanor. 13-1610 PASSENGERS. It shall be the duty of the driver of any taxi- cab to accept as a passenger any person who seeks to so use the taxicab, provided such person is not intoxicated and con- ducts himself in an orderly manner. No person shall be admit- ted to a taxicab occupied by a passenger without consent of the passenger. The driver shall take his passenger to his destination by the most direct available route from the place where the passenger enters the cab. 13-1611 LIMITATIONS ON LICENSE. There shall be no more than two taxicab licenses in the City of McHenry. No person or cor- poration shall be issued more than one license, nor shall a license be issued unless the licensee has taxicabs in service, -103- except when the population of the City of McHenry exceeds 15,000, then the Mayor and the City Council of the City of McHenry shall be authorized to issue one additional license per 5,000 people in the corporate limits of the City of Mc- Henry. 13-1612 TAXICAB DRIVERS. No person shall drive a taxicab unless he shall lhave secured a license therefor, as provided by the Statutes of the State of Illinois. No person shall drive a taxicab until he has exhibited such license to the Chief of Police who will issue a certificate that the applicant has complied with the provisions of this Ordinance. -104- (The next page is 107) ARTICLE XVII Size, Weight, Load and Permits 13-1701 SCOPE AND EFFECT OF THIS ARTICLE. (a) It is unlawful for any person to dirve or move on, upon or across or for the owner to cause or knowingly permit to be driven or moved on, upon or across any highway any vehicle or vehicles of a size and weight exceeding the "limitations stated in this Article or otherwise in violation of this Article. (b) The provisions of this Article governing size, weight and load do not apply to fire apparatus or equipment for snow and ice removal operations owned or operated by any government body, or to implements of husbandry temporarily operated or towed in a combination upon a highway provided such combina- tion does not consist of more than 3 vehicles or, in the case of hauling fresh, perishable fruits or vegetables from farm to the point of first processing, nor more than 3 wagons being towed by an implement of husbandry, or to a vehicle operated under the terms of a special permit issued under the Illinois Vehicle Code. 13-1702 WIDTH OF VEHICLES. The maximum width of any vehicle, except as provided in paragraph (b) of Article 13-1701 of this Ordin- ance, and wherever the provisions of this Ordinance regarding limitations concerning loads are applicable, and its load shall not exceed 8 feet with the following additional excep- tions: (a) Loads of unbaled hay or straw, or other similar farm pro- ducts or implements of husbandry being transported during the period from sunrise to sunset; (b) Portable building, not more than 14 feet wide, and with not more than 1 foot overhang along the left. side of the haul- ing vehicle designed and used for agricultural and livestock raising operations, which are being transported not more than 10 miles on any route not part of the National system of In- terstate and Defense Highways during the period from sunrise to sunset and on which are mounted at least 2 red cloth flags, at least 12 inches square; provided that a police officer shall escort the hauling vehicle when it is using any part of the left lane when crossing a two -.lane bridge; (c) Mirrors required by Article 13-1501 may project up to 6 inches beyond each side of a vehicle and such projection shall not be deemed a violation of the above width restriction in this Article. 13-1703 HEIGHT OF VEHICLES. The height of a vehicle from the under side of the tire to the top of the vehicle, inclusive of load, shall not exceed thirteen feet, six inches (13' 6"). 13-1704 SECOND DIVISION VEHICLES - NAME AND ADDRESS OF OWNER AND CER- TIFICATE OR PERMIT NUMBER. No second division vehicle, other than a second division vehicle having a gross weight of 8,000 pounds or less which is used by the owner or a member of his immediate family solely for personal use, other than farm tractors, farm machinery and implements, farm wagons, wagon- -107- 13-1705 13-1706 13-1707 trailers or like vehicles used primarily in agricultural pur- suits, vehicles licensed by the Secretary of State as a recre- ational vehicle and all vehicles registered in another State which, if titled in this State, would qualify for such recrea- tional plate, house trailers, trailers designed to carry a single watercraft or vehicles owned by licensed vehicle deal- ers and manufacturers while used for demonstration or delivery purposes, may be operated upon the highways of this City un- less there is painted or otherwise firmly affixed to the vehi- cle on both sides thereof, in a color or colors vividly con- trasting to the color of the vehicle, the name and address of the owner and the certificate or permit number of the vehicle, if any. PROJECTING LOADS ON PASSENGER VEHICLES. No passenger -type vehicle shall be operated on any street or highway with any load carried thereon extending beyond the line of the fenders on the left side of such vehicle nor extending more than 6 inches beyond the line of the fenders on the right side there- of. PROTRUDING MEMBERS OF VEHICLES. No vehicle with boom, arm, drill rig or other protruding component shall be operated upon any street or highway unless such protruding component is fastened so as to prevent shifting, bouncing, or moving in any manner. LENGTH OF VEHICLES. (a) No vehicle, unladen or with load, shall exceed a length of 42 feet extreme overall dimension, except 'that a semitrailer other than a house trailer within a combination shall not ex- ceed an overall length of 45 feet extreme overall dimension. (b) No truck tractor and semitrailer, unladen or with load, shall exceed a length of 55 feet overall extreme dimension, except that such combination when specially designed to trans- port motor vehicles may have a length of 60 feet extreme over- all dimension, subject to those exceptions and special rules otherwise stated in this Article. No other combination of vehicles, unladen or with load, shall exceed a length of 60 feet extreme overall dimension, except that a truck tractor with semitrailer drawing one trailer, unladen or with load, or a tractor and stinger -steered semitrailer, or any combination when specially designed to transport motor vehicles, with load, may have a length of 65 feet extreme overall dimension on any 4-lane highway and, in addition, upon request of any interested person, on any other highway, which is required by public necessity and on which such combination can be safely operated, designated by the Illinois Department of Transporta- tion. (c) A truck tractor semitrailer may draw one trailer, and a truck in transit may draw 3 trucks in transit coupled together by the triple saddle -mount method, except as otherwise provid- ed, no other combination of vehicles coupled together shall consist of more than 2 vehicles. Vehicle in combination, whether being operated intrastate or interstate, shall be oper- ated and towed in compliance with all requirements of Federal Highway Administration, Title 49, C.F.R. Motor Carrier Safety Regulations, pertaining to couling devices and towing methods and all other equipment safety requirements set forth in said regulations. (d) Length limitations shall not apply to vehicles operated in the daytime, except on Saturdays, Sundays or legal holidays, when transporting poles, pipe, machinery or other objects of a structural nature which cannot readily be dismembered, nor to vehicles transporting such objects operated on Saturdays, Sun- days, or legal holidays or at night time by a public utility when required for emergency repair of public service facili- ties or properties but in respect to such night operation every such vehicle and the load thereon shall be equipped with a sufficient number of clearance lamps on both sides and mark- er lamps upon the extreme ends of any projecting load to clearly mark the dimensions of such load, provided that no such object exceeding 80 feet in length shall be so transport- ed, except by a public utility when required for emergency re- pairs. Neither shall the length limitations apply to a com- bination of vehicles consisting of a towing vehicle and a dis- abled vehicle or vehicles when engaged in towing the disabled vehicle or vehicles from the highway to the nearest repair station. (e) The load upon any vehicle operated alone„ or the load upon the front vehicle of a combination of vehicles, shall not ex- tend more than 3 feet beyond the front wheel's of such vehicle or the front bumper of such vehicle if it is equipped with such a bumper. 13-1708 PLANKING EDGE OF A PAVEMENT. No tractor, traction engine or other metal -tired vehicle, weighing more than four tons, in- cluding the weight of the vehicle and its load, shall drive up onto, off or over the edge of any paved public highway or street in this City, without protecting such edge by putting down solid planks or other suitable device to prevent such vehicle from breaking off the edges of corner of such pave- ments. 13-1709 SPILLING LOADS ON HIGHWAYS PROHIBITED. (a) No vehicle shall be driven or moved on any street or high- way unless such vehicle is so constructed or loaded as to pre- vent any of its load from dropping, shifting, leaking or otherwise escaping therefrom, except that sand may be dropped for the purpose of securing traction, or water or other sub- stance may be sprinkled on a roadway in cleaning or maintain- ing such roadway. (b) No person shall operate on any street or, highway any vehi- cle with any load unless said load and any covering thereon is securely fastened so as to prevent said covering or load from becoming loose, detached, or in any manner a hazard to other users of the street or highway. 13-1710 TOWED VEHICLES. (a) When one vehicle is towing another, the drawbar or other connection shall be of sufficient strength to pull all the weight towed thereby and the drawbar or other connection shall not exceed 15 feet from one vehicle to the other, except for the connection between any 2 vehicles transporting poles, pipes, machinery or other objects of structural nature which cannot readily be dismembered. -109- (b) Outside a business or residential district or on any con- trolled -access highway, no vehicle other than a pole trailer or a semitrailer which is being towed by a truck tractor and is connected by the means of a fifth wheel shall be towed on a street or highway except by a drawbar and each such vehicle so towed shall, in addition, be coupled with 2 safety chains or cables to the towing vehicle. Such chains or cables shall be of sufficient size and strength to prevent the towed vehicle parting from the drawing vehicle in case the drawbar should break or become disengaged. (c) The provisions of this Article shall not apply to any second division vehicle owned, operated, or controlled by any person who is registered with the Bureau of Motor Carrier Safety of the Federal Highway Administration and has complied with the federal safety provisions of the Bureau of Motor Carrier Safety of the Federal Highway Administration and the rules and regulations of the Bureau. 13-1711 WHEEL AND AXLE LOADS AND GROSS WEIGHTS. (a) No vehicle or combination of vehicles equipped with pneu- matic tires shall be operated, unladen or with load, upon the streets and highways of this City when the gross weight on the road surface through any single axle thereof exceeds 18,000 pounds except that when operated upon flexible base county or township road such single axle shall not exceed 16,000 pounds unless a permit has been obtained for operation at such excess weight from the highway authority having jurisdiction over the road. No vehicle or combination of vehicles equipped with other than pneumatic tires shall be operated, unladen or with load, upon the streets and highways of this City when the gross weight on the road surface through any wheel thereof exceed 800 pounds per inch width of tire tread or when the gross wieght on the road surface through any axle thereof ex- ceeds 16,000 pounds. An axle load shall be defined as the total load transmitted to the road by all wheels whose centers may be included between 2 parallel transverse vertical planes 40 inches apart extending across the full width of the vehicle. Any 2 or more consecutive axles whose centers are more than 40 inches and not more than 72 inches apart, measured to the nearest inch between any 2 adjacent axles in the series, shall be defined as tandem axles, and the gross weight transmitted to the road surface through such series shall not exceed 32,000 pounds and no axle of the series shall exceed the maxi- mum weight permitted under this Article for a single axle. A truck especially equipped with a selfcompactor and used ex- clusively for garbage or refuse operations may, however, when laden with garbage or refuse, transmit upon the road surface of any highway except when part of the National System of In- terstate and Defense Highways, a gross weight upon a single axle not more than 22,000 pounds, and upon a tandem axle not more than 40,000 pounds. When unladen, however, such trucks shall comply with the axle limitations applicable to all other trucks. -110- (b) The gross weight of vehicles and combinations of vehicles including the weight of the vehicle or combination and its maximum load shall be subject to the foregoing limitations and further shall not exceed the following gross weights dependent upon the number of axles and distance between extreme axles of the vehicle or combination measured longitudinally to the nearest foot. However, nothing in this Ordinance shall prohibit a tow truck under instructions of a police officer from legally clearing a disabled vehicle, that may be in violation of weight limita- tions of this Article, from the roadway to the berm or shoul- der of the highway. (d) No vehicle or combination of vehicles equipped with pneu- matic tires shall be operated, unladen or with load, upon the streets and highways of the City of McHenry in violation of the provisions of any permit issued under the provisions of Section 15-301 through 15-319 of the Illinois Vehicle Code. -112- (e) Notwithstanding any other provisions in this Article, the weight limitations contained in this paragraph (e) shall apply to the National System of Interstate and Defense Highways and other highways in the system of State highways that have been designated by the Department. No vehicle shall be operated on said highways with a weight in excess of 20,000 pounds carried on any one axle or with a tandem axle weight in excess of 34,000 pounds, or a gross wieght in excess of 80,000 pounds for vehicle combinations of five axles or more, or a gross weight on a group of two or' more consecutive axles in excess of that weight produced by the application of the following formula: W=500 times the sum of (IN divide by N-1) + 12N + 36. Where "W" equals overall gross weight on any group of 2 or more con- secutive axles to the nearest 500 pounds; "i" equals the dis- tance measured to the nearest foot between extremes of any group of 2 or more consecutive axles; and "N" equals the num- ber of axles in the group under consideration, except that 2 consecutive sets of tandem axles may carry, a gross load of 34,000 pounds each, provided the overall distance between the first and last axles of such consecutive sets of tandem axles is 36 feet or more. Provided also that a 3-axle vehicle manu- factured prior to the model year of 1984, and first registered in Illinois on or before July 1, 1983, with a distance greater than 72 inches but not more than 96 inches between the 2 rear axles may transmit to the road surface a maximum weight of 18,000 pounds on each of the 2 rear axles. Any such vehicle manufactured in the model year of 1984 or thereafter or first registered in Illinois after July 1, 1983, may transmit to the road surface a maximum of 34,000 pounds through the 2 rear ax- les and neither of the rear axles shall exceed 20,000 pounds. Combinations of vehicles, which include a semitrailer manufac- tured prior to the model year of 1984, and first registered in Illinois on or before July 1, 1983, having 5 or more axles with a distance of less than 38 feet between extreme axles may have a gross weight on the National System of Interstate and Defense Highways and other highways in the system of State highways designated by the Department of 72,000 pounds provid- ed the weight shall not exceed 18,000 pounds on any single axle nor 32,000 pounds on any tandem axle. All such combina- tions of vehicles which include a semitrailer manufactured in the model year of 1984 or thereafter or first registered in Illinois after July 1, 1983, or which has had its cargo con- tainer replaced in its entirety after July 1, 1983, are limited to the gross weight allowed by the above formula. Vehicles operating under this paragraph (e) shall have access for a distance of 5 highway miles on a street or highway in- cluded in the system of State highways and upon any street or highway designated by the City to points of loading and un- loading and to facilities for food, fuel, repairs and rest. The provisions of this paragraph (e) shall only apply to the following designated roadways: (1) Elm Street, the entire length with the City. (2) Front Street, from Elm Street to the south limits of the City. (3) Richmond Road, from Elm Street to the north limits of the City. OFFICERS TO WEIGH VEHICLE AND REQUIRE REMOVAL OF EXCESS LOADS. (a) Any Police Officer having reason to believe that the weight of a vehicle and load is unlawful shall require the driver to stop and submit to a weighing of the same either by means of a'portable or stationary scale. If such scales are not available at the place where such vehicle is stopped, the Police Officer shall require that such vehicle be driven to the nearest available scale that has been tested and approved by the Illinois Department of Agriculture. (b) Whenever an Officer, upon weighing a vehicle and the load, determines that the weight is unlawful, such Officer shall re- quire the driver to stop the vehicle in a suitable place and remain standing until such portion of the load is removed as may be necessary to reduce the weight of -the vehicle to the limit permitted under this Article. (c) Whenever any axle load of a vehicle exceeds the axle or tandem weight limits permitted by paragraph (a) or (e) of Sec- tion 13-1711 of this Article by 2,000 pounds or less, the owner or operator of the vehicle must shift or remove the ex- cess so as to comply with paragraph (a) or (e) of Section 13-1711. No overweight arrest ticket shall be issued to the -115- 13-1713 owner or operator of the vehicle by any Officer if the gross weight is shifted or removed as required by this paragraph. (d) Whenever the gross weight of a vehicle with a registered gross weight of 73,280 pounds or less exceeds the weight limits of paragraph (b) or (e) of Section 13-1711 of this Article by 2,000 pounds or less, the owner or operator of the vehicle must remove the excess. Whenever the gross weight of a vehicle with a registered gross weight of 73,281 pounds or more exceeds the weight limits of paragraph (b) or (e) of Section 13-1711 of this Article by 1,000 pounds or less, the owner or operator of the vehicle must remove the excess. In either case, no arrest ticket shall be issued to the owner or operator of the vehicle by any Officer if the excess weight is removed as required by this paragraph. VIOLATIONS -PENALTIES. Whenever any vehicle is operated in violation of the provisions of Section 13-1711 of this Arti- cle, the owner or driver of such vehicle shall be deemed guil- ty of such violation and either the owner or the driver of such vehicle may be prosecuted for such violation. Any per- son, firm or corporation convicted of any violation of Section 13-1711 of this Article shall fe fined according to the fol- lowing schedule: Up to and including 2,000 pounds overweight = $50 unless the over- weight can be shifted or removed to conform to all legal weights; from 2001 2500 pounds overweight = the fine is $135 from 2501 3000 pounds overweight = the fine is $165 from 3001 through 3500 pounds overweight = the fine is $260 from 3501 through 4000 pounds overweight = the fine is $300 from 4001 through 4500 pounds overweight = the fine is $425 from 4501 through 5000 pounds overweight = the fine is $475 from 5001 or more pounds overweight = the fine shall be computed at the rate of $75 for each increment of 500 pounds overweight or fractions thereof. In addition, any person, firm or corporation convicted of 4 or more violations of Section 13-1711 of this Article within any 12 month period shall be fined an additional amount of $2,500 for the fourth and each subsequent conviction within the 12 month period. Provided, however, that with regard to a firm or corporation, a fourth or subsequent conviction shall mean a fourth or subsequent conviction attributable to any one em- ployee -driver. -116- 13-1714 PUSHING OF DISABLED VEHICLE. It is unlawful under any circumstances for any vehicle to push any other vehicle on or along any street or highway in this City, except in an extreme emergency and then the vehicle shall not be pushed farther than is reasonably necessary to remove it from the roadway or from the immediate hazard that exists. 13-1715 TRUCKS TO USE TRUCK ROUTES. (a) All trucks entering or passing through the City for the purpose of delivering or picking up materials or merchandise, are hereby designated through trucks, and shall use the through truck routes only. All trucks which are locally owned and operated are hereby designated local trucks, and shall use the through truck routes together with the local truck routes. Either through trucks or local trucks may use other City streets for the purpose only of arriving at or departing from a destination for loading or unloading which is not located on a through or local truck route, and such travel shall be limited to those portions of such streets which are the shortest distance between such destination and a through or local truck route. (b) No person shall operate or cause to be operated any truck upon any street with the City of McHenry that is posted "No Trucks", or that is not posted as a through or local truck route. (c) An operator of any truck stopped on a street which is posted as a "No Trucks" route, or is not posted as a through or local truck route, shall furnish documentation showing point or origin and destination for said truck. 17-1716 TRUCK ROUTES ESTABLISHED. (a) The following streets or highways are hereby designated as through truck routes: 1. Illinois State Route 120 - through its entire tra- verse of the City; 2. Illinois State Route 31 - through its entire traverse of the City; 3. Crystal Lake Road - between Illinois State Route 120 and the south City limits; 4. Ringwood Road - between Illinois State Route 120 and the north City limits; 5. Draper Road - between Illinois State Route 120 and the south City limits; (b) The following streets or highways are hereby designated as local truck routes: 1. Green Street - between Pearl Street and the south City limits; 2. John Street - between Front Street and Virginia Ave.; 3. Pearl Street - between the Fox River and Richmond Rd.; 4. Riverside Drive - between Elm Street and Pearl St.; 5. Waukegan Road - between Green Street and the Fox River; 6. Main Street - between Front Street and Crystal Lake Road; 7. Borden Street - between Main Street and West Street; 8. West Street - between Borden Street and North Dr.; -117- 9. North Drive - between West Street and Boone Creek; 10. Lillian Street - between Front Street: and Crystal Lake Road; 11. Front,Royal Drive - between Illinois :state Route 120 and Chesterfield Drive; 12. Royal Drive - between Chesterfield Drive and Crystal Lake Road; 13. Oakwood Drive - betwen Crystal Lake Road and Bonner Dr.; 14. Kensington Drive - between Crystal Lake Road and Oakwood Drive; 15. Waters Edge Drive - between Kensington Drive and Dart- moor Drive; 16. Dartmoor Drive - between Waters Edge Drive and Augusta Drive; 17. Greenbrier Drive - between Crystal Lake Road and Augusta Drive; 18. Augusta Drive - between Greenbrier Drive and Dartmoor Drive; 19. Meadow Lane - between Oakwood Drive and Shore Drive; 20. Beach Avenue - between Illinois State Route 120 and Shore Drive; 21. Industrial Drive - its entire length; 22. Home Avenue - between the rear of thie Market Place and Beach Avenue. 23. Ramble Road - between Illinois State Route 120 and Home Avenue; 24. Shore Drive - between Ringwood Road and Oak Drive; 25. Oak Drive - between Shore Drive and Prairie Avenue; 26. Prairie Avenue - between Oak Drive and Meadow Lane. -118- (The next page! is 125) ARTICLE XVIII Snowmobiles 13-1801 REQUIRED EQUIPMENT. All snowmobiles operating within the City shall be equipped with; (a) At least one white headlamp having a minimum candlepower of sufficient intensity to exhibit a white light plainly visi- ble from a distance of at least five hundred (500) feet ahead during hours of darkness under normal atmospheric conditions. (b) At least one red tail lamp having a minimum candlepower of sufficient intensity to exhibit a red light plainly visible from a distance of five hundred (500) feet to the rear during hours of darkness under normal atmospheric conditions. (c) A brake system in good mechanical condition. (d) Reflective material of a minimum area of sixteen (16) square inches mounted on each side of the cowling. Identify- ing numbers may be included in computing the required sixteen (16) square,inch area. (e) Adequate sound suppression equipment. No snowmobile manu- factured after June 1, 1972 shall be sold or offered for sale, unless it is equipped with sound suppression devices that lim- it total machine noise in accordance with noise pollution standards established pursuant to the Environmental Protection Act. 13-1802 OPERATION GENERALLY. It shall be unlawful for any person to drive or operate any snowmobile in the following ways. (a) At a rate of speed too fast for conditions and the fact that the speed of the snowmobile does not exceed the applica- ble maximum speed limit allowed does not relieve the driver from the duty to decrease speed as may be necessary to avoid colliding with any person or vehicle or object within legal requirements and the duty of all persons to use due care. (b) In a careless, reckless or negligent manner. (c) While under the influence of intoxicating beverages or narcotic or dangerous drugs. (d) At any time without at least one lighted headlamp and one lighted tail lamp on the snowmobile. (e) Within one mile of any nature preserve. (f) On the tracks or right-of-way of an operating railroad. (g) In any tree nursery or planting in a manner which damages or destroys growing stock, or creates a substantial risk thereto. 13-1803 OPERATION ON PRIVATE PROPERTY OF ANOTHER. (a) It shall be unlawful for any person to, drive or operate a snowmobile on private property, without the consent of the owner or lessee thereof. Any person operating a snowmobile upon lands of another shall stop and identify himself upon the request of the landowner or his duly authorized representa- tive, and if requested to do so by the landowner, shall promptly remove the snowmobile from the premises. (b) An owner, lessee or occupant of premises owes no duty to keep the premises safe for entry or use by others for snowmobiling, or to give warning of any unsafe condition or -125- use of or structure or activity on such premises. This sub- section does not apply where permission to snowmobile is given for a valuable consideration other than to this State or any political subdivision or municipality thereof. (c) An owner, lessee or occupant of premises who gives per- mission to another to snowmobile upon such premises does not thereby extend any assurance that the premises are safe for such purpose, or assume responsibility for or incur liability for any injury to person or property caused by any act of per- sons to whom the permission to snowmobile is given for a valu- able consideration other than to the State or any political subdivision or municipality thereof. 13-1804 OPERATION ON HIGHWAY, STREET, ALLEY OR SIDEWALK. It shall be unlawful for any person to drive or operate any snowmobile on any highway, street, alley or sidewalk in the City, except as follows: (a) To make a direct crossing over such highway, street, alley or sidewalk, provided: 1. The crossing is made at an angle of approximately ninety (90) degrees to the direction of the highway, street, alley or sidewalk, and at a place where no obstruction prevents a quick and safe crossing; and 2. The snowmobile is brought to a complete stop before crossing a highway, street, alley or sidewalk; and 3. the operator of the snowmobile yields the right-of-way to all pedestrians who may be upon a highway, street, alley or sidewalk. (b) to cross a bridge or culvert or when it is impractical to gain immediate access to an area adjacent to a highway, street, alley or sidewalk where a snowmobile is to be operated. 13-1805 OPERATION IN PARKS AND ON NATURE TRAILS. It shall be unlaw- ful for any person to operate any snowmobile in any City park, on any nature trail, in the City or in any area under the jurisdiction of the City. 13-1806 SPECIAL EVENTS. Nothing contained in this Article shall be construed to prohibit the City from designating a special snowmobile event. In such case, the provisions of this Arti- cle shall not apply to areas or highways, streets, alleys or sidewalks under the jurisdiction of the City. 13-1807 EMISSION OF POLLUTANTS. No person shall operate any snowmo- bile emitting pollutants in accordance with standards estab- lished pursuant to the Environmental Protection Act. 13-1808 OPERATORS OR RIDERS CARRYING FIREARMS OR BOWS. No person, except persons permitted by law, shall operate or ride any snowmobile with any firearm in his possession, unless it is unloaded and enclosed in a carrying case, or any bow, unless it is unstrung in a carrying case. 13-1809 LITTERING BY OPERATORS OR RIDERS. No person shall deposit from a snowmobile, on the snow, ice, or ground surface, any trash, glass, garbage, insoluble material or other offensive matter. 13-1810 LIABILITY FOR DAMAGES OCCASIONED BY OPERATOR. The owner and any operator of a snowmobile are jointly and severally liable for any injury or damage occasioned by the operation of such snowmobile. -126- (The next page is 130) ARTICLE XIX Penalty 13-1901 PENALTY. (a) Any person, firm, association, copartnership or corpora- tion violating any provision of this Ordinance for which another penalty is not provided, shall be fined not less than Twenty Five Dollars ($25) nor more than Five Hundred Dollars ($500) for each offense except as provided in Sections 13-1901.1 and 13-1902. (b) A judgment of a fine imposed upon an offender may be en- forced in the same manner as a judgment entered in a civil action; provided, however, that in such judgment imposing the fine the Court may further order that upon non-payment of such fine, the offender may be imprisoned until the fine is paid or satisfied at the rate of Five Dollars ($5,) per day or impris- onment; provided, further, however, that no persons shall be imprisoned under the first proviso hereof for a longer period than six (6) months. 13-1901.1 PENALTY FOR DRIVING WHILE UNDER THE INFLUENCE OF ALCOHOL, OTHER DRUG OR COMBINATION THEREOF. Every person convicted of the offense of driving while under the influence of alcohol, other drug or combination thereof, shall be guilty of a Class A misdemeanor and shall be punished either by a fine not to exceed One Thousand Dollars ($1,000) or by imprisonment for a term not to exceed one year, or both. 13-1902 PENALTY FOR ALL OTHER PARKING OFFENSES. The penalty for all other parking offenses, with the exception of violation of a fire lane, shall be $25.00. The fine for violation of a fire lane shall be $40.00. 13-1903 PRIMA FACIE PROOF. The fact that a motor vehicle which is illegally operated or parked is registered in the name of a person shall be considered prima facie proof that such person was in control of the motor vehicle at: the time of such violation. 13-1904 DEPOSITS. All penalty fees collected by the City Clerk, shall be deposited with the Treasurer of said City and credited to the General Fund. 13-1905 VOLUNTARY SETTLEMENTS REGARDING CERTAIN OIRDINANCE VIOLATIONS. ARTICLE XXI Prior Ordinances Repealed All ordinances -or parts of ordinances, heretofore passed and approved by the City Council of the City of McHenry which are in conflict with the provi- sions of this Ordinance, are hereby repealed insofar as such conflict is concerned. ARTICLE XXII Publication in Pamphlet Form This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of MlcHenry, Illinois. ARTICLE XXIII Effective Date This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form, as provided by law.
