AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Sections 11-130 and 11-131 of the Munici-
pal Code, City of McHenry, Illinois, be and the same are
hereby amended to read as follows:
Section 11-130. Smoking Declared Nuisance. It is
hereby found and declared that it shall be a
nusiance for any person to smoke or carry a lighted
cigarette, cigar or pipe in the Council Room of the
City Hall of the City of McHenry, Illinois and in
any grocery store, meat or fish market, delicates-
sen store or convenience food store in the City of
McHenry."
Section 11-131. Smoking Prohibited. No person
shall smoke or carry a lighted cigarette, cigar or
pipe in any grocery store, delicatessen store, meat
or fish market, or convenience food store in the
City of McHenry except in designated smoking areas,
restrooms, executive offices and other rooms or
areas where merchandise is not displayed for sale.
No person shall smoke or carry a lighted cigarette,
cigar or pipe in the Council Room of the City Hall
of the City of McHenry, Illinois."
SECTION 2. Any person, firm or corporation violating
any provision of this ordinance shall be fined not less
than Ten Dollars ($10.00) nor more than Five Hundred
Dollars ($500.00) for each offense committed on each day
during, or on which, a violation occurs or continues.
