AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Chapter 7 of the Municipal Code, City of
McHenry, Illinois be and the same is hereby amended by
adding thereto the following provision as and for Article
IX thereof:
ARTICLE IX.
PORTABLE SIGNS
Section 7-150. Portable Sign, Defined. Any
sign designed to be moved from place to place or
which is not securely or permanently attached to the
ground, building or any structure, which shall
include but not be limited to A -frame signs, trailer
signs, signs placed on vehicles or trailer and
beacon lights.
Section 7-151 Permits Required. (a) It
shall be unlawful for any person to erect, construct
or maintain any portable sign on any premises in the
City that are zoned for commercial or industrial
use, without first obtaining a portable sign permit
from the Building Officer of the City. No portable
sign permit shall be issued for a term in excess of
45 days. Additional portable sign permits for the
same premises may be issued by the Building Officer
of the City provided that at least 180 days has
transpired since the expiration date of the next
previous portable sign permit thereon. No more than
one portable sign may be used on any premises at any
time.
(b) Permit Fee. Every applicant, before
being granted a Portable Sign Permit hereunder,
shall pay to the City Clerk a permit fee in the
amount of $20.00 and, shall in addition to such
fee, pay to the City Clerk the sum of $20.00 as a
security deposit to guarantee the timely removal of
said portable sign. The security deposit shall be
refunded to the permit applicant provided that the
portable sign has been removed from the subject
premises no later than one day after the expiration
of said Portable Sign Permit; the aforesaid security
deposit shall be forefeited to the City in the event
that the portable sign has not been removed from the
subject premises on or before the day after the
permit has expired.
Section 7-152. Sign Specifications.
No portable sign permit shall be issued for any zoning
district unless it complies with the sign specifica-
tions for such zoning district as set forth in Article
XUIII of the City of McHenry Zoning Ordinance,
provided, however, that no portable sign shall extend
more than 10 feet above ground level at the place
located nor exceed 50 square feet per sign face.
Section 7-153. Prohibited Locations.
No portable sign may be placed upon or within any
public right-of-way or upon any property owned by the
City of McHenry unless prior written application
therefore has been made to, and permission has been
granted by, the City Council of the City of McHenry.
The Building Officer of the City shall remove, or
cause to be removed, any unpermitted sign located in a
public right-of-way or upon any property owned by the
City.
Section 154. Location of Portable Sign. The
specific location of a portable sign on any premises
must be approved by the Building Officer of the City.
No portable sign shall be so located as to constitute
a traffic hazard. The Building Officer of the City
shall have the right to change any previously
designated location of any portable sign if, in his
judgment, such change in location is required by the
public safety and welfare.
Section 7-155. Amortization Provisions. All
non -conforming portable signs shall be removed within
six months after the effective date of this
ordinance.

SECTION 2. Any person, firm or corporation violating
any provision of this ordinance shall be fined not less
than Ten Dollars ($10.00) nor more than Five Hundred
Dollars ($500.00) for each offense committed on each day
during, or on which, a violation occurs or continues.
SECTION 3. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
SECTION 4. This ordinance shall be published in
pamphlet form by and under the authority of the corporate
authorities of the City of McHenry, Illinois.
SECTION 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication
in pamphlet form, as provided by law.
