AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY,
McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. Section 11-19 of the Municipal Code of the City
of McHenry, Illinois, be and the same is hereby amended by chang-
ing the annual fee for a food dealer license from $1 to $15.
SECTION 2. Section 11-39 of the Municipal Code, City of McHenry,
Illinois, be and the same is hereby amended to read as follows:
"Section 11-39. Permit fees. Every applicant for a permit
to operate a restaurant or itinerant restaurant shall pay to
the City a fee or fees for each such establishment in accord-
ance with the following schedule:
Restaurants. . . . . . .
Itinerant restaurants. .
.$15.00 per annum.
.$50.00 for each period
of 5 days or 'less
("Itinerant restaurant" is hereby defined as a restaurant
operation which does not have a permanent business address
in the City of McHenry and which pays no sales tax to the
City".
The foregoing fees shall not be prorated.
SECTION 3. Section 11-51 of the Municipal Code, City of McHenry,
be and the same is hereby amended to read as follows:
"Section 11-51. License for milk vending machines, milk dealers,
milk delivery vehicles. It shall be unlawful for any person to
operate a milk vending machine within the City or to engage in
the business of a milk dealer within the City of McHenry or to
operate a milk delivery truck in the City of McHenry for delivery
of milk to any location within the City of McHenry, without first
securing an annual license to do so. The annual fee for such
license shall be $100 for each vending machine, delivery truck
and milk dealership. The application for such license shall
comply with the general regulations for license applications
as set forth in this code.
No annual license shall be required if the activity sought
hereunder to be licensed is subject to the City of McHenry sales
tax. "
SECTION 4. Any person, firm or corporation violating any pro-
vision of this ordinance shall be fined not less than Ten Dollars
($10.00) nor more than Five Hundred Dollars ($500.00) for each offense
committed on each day during, or on which, a violation occurs or
continues.
SECTION 5. All ordinances, or parts thereof, in conflict with
the terms and provisions hereof, be and the same are hereby repealed
to the extent of such conflict.
SECTION 6. This ordinance shall be published in pamphlet form
by and under the authority of the corporate authorities of the City
of McHenry, Illinois.
SECTION 7. This ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form, as provided by law.
