AN ORDINANCE
WHEREAS, the corporate authorities are empowered by
Illinois Revised Statutes, Chapter 24, Section 11-84-1 et. seq.
to provide for the construction and repair of sidewalks in the
municipality and to provide for the payment of the whole or
any part thereof by special taxation of the property touching
upon the line where such sidewalk is ordered; and,
WHEREAS, said statute expressly provides that a part of
the cost of such sidewalk may be paid out of any fund of the
municipality raised by general taxation upon the property in
the municipality and not otherwise appropriated; and,
WHEREAS, the City desires to encourage individual owners
of property themselves to initiate the construction, reconstruc-
tion and repair of sidewalks touching upon their property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. If any owner of property,other than a subdivider,
desires to construct, reconstruct or repair a sidewalk in the public
right-of-way touching his property, the City will pay fifty percent ur
the actual or estimated cost thereof, whichever is lower, PROVIDED:
plans and specifications and estimate of costs, thereof, have been
filed with and approved by the Superintendent of Public Works and
Buildings, and (2) the City Council has authorized the expenditure
of City funds for such work. The provisions of the Subdivision Control
Ordinance requiring subdividers to install sidewalks at their sole
expense is not intended to be changed by this ordinance.
SECTION 2. This ordinance shall be published in pamphlet
form by and under the authority of the corporate authorities of
the City of McHenry.
SECTION 3. This ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form.
