AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY,
McHENRY COUNTY, ILLINOIS, as follows:
SECTION 1. Section 26-165(b)(1) and 26-165(b)(2) of
Article III of Chapter 26 of the Municipal Code, City of McHenry,
Illinois, be and the same is hereby amended to read as follows:
(1) Those nonresidential users not using city water
as a major part of their business operation, six
dollars (6.00) per month, provided such water use is
not metered.
(2) Those nonresidential users not using city water,
but using water as a major part of their business
operation (including, but not limited to car washes,
restaurants, laundries, schools, institutions, hotels
and motels capable of housing twenty (20) or more
people, beauty parlors with three (3) or more persons,
ten dollars($10.00) per month, provided such water
use is not metered.
SECTION 2. Section 26-165(b) of Article III of Chapter 26
of the Municipal Code, City of McHenry, Illinois, be and the same
is hereby amended by adding thereto the following paragraph as
and for paragraph six (6) thereof:
(6) A $2.50 surcharge per billing quarter shall be paid
by nonresidential users where water usage is metered,
although water is not furnished by the City.
SECTION 3. Penalty. Any person violating any provision
of this article shall be fined not less than twenty-five ($25.00)
dollars nor more than five hundred ($500.00) dollars. Each day
that such violation exists shall be considered and penalized as
a separate violation.
SECTION 4. This ordinance shall be published in pamphlet
form by and under the authority of the corporate authorities of
the Village.
SECTION 5. This ordinance shall be in full force from and
after its passage, approval and publication as required by law.
