AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS, as follows:
SECTION 1. That Section 92 of Article IX of Chapter
11 of the Municipal Code of the City of McHenry, Illinois,
be and 'the same is hereby amended to read as follows:
92. FENCES. All outdoor swimming pools shall
be completely enclosed by a fence, except as
might hereinafter otherwise be provided. All
fence openings or points of entry into pool
area enclosure shall be equipped with gates.
The fence and gates shall be four (4) feet
in height above the grade level and shall be
constructed of a minimum number 9 gauge woven
wire mesh corrosion -resistant material, or
similar material. All gates shall be equipped with
self -closing and self -latching devices placed at
the top of the gate. Fence posts shall be decay -
or corrosion -resistant and shall be set in concrete
base.
No outdoor swimming pool shall be required to be en-
closed by a separate fence where it is located in a
yard which is itself enclosed by a fence meeting the
requirements of Article IX of Chapter 14 of the
Municipal Code of the City of McHenry, Illinois,
and which is at least four feet in height.
SECTION 2. Any person, firm or corporation violating any
provision of this Ordinance shall be fined not less than Five
Dollar's ($ 5.00) nor more than Five Hundred Dollars ($ 500.00) for
each offence.
SECTION 3. All ordinances, or parts thereof, in conflict
herewith, be and the same are to the extent of such conflict
hereby repealed.
SECTION 4. Publication of this Ordinance in pamphlet form
by and under the authority of the Mayor and City Council, be and
the same is hereby authorized.
SECTION 5. This Ordinance shall be in full force and
effect after its passage, approval and publication as by law
provided.
