HomeMy WebLinkAboutOrdinances - MC-74-73 - 01/07/1974 - regs for scavengersOrdinance No. 73 AN ORDINANCE REGULATING AND LICENSING Me -SCAVENGERS IN THE CITY OF Mc HENRY 73 BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McHENRY, Mc HENRY COUNTY, ILLINOIS, as follows: Section 1. Definition of "Scavenger". "Scavenger" as used herein, means anyone engaged in the business of collect- ing, carting, hauling, or transporting garbage, ashes, refuse of all kinds and any and all miscellaneous waste materials. Section 2. Scavenger License. a). License Required. No one shall engage in the business of scavenger in the City of McHenry without first having obtained an Annual Scavenger License from the City of McHenry. b). Applications For License. Applications for such Scavenger License shall be made to the City Clerk and re- ferred by him to the Mayor and City Council; no such Scavenger License shall be issued except on the direction and order of the Mayor and of the City Council. The Application for Scavenger License shall be signed, under oath, by the applicant and shall disclose the name, residence address and telephone number of the applicant, the business address and telephone number of the applicant, the make, model, year and serial number of each vehicle used and to be used by the applicant in the scavenger operations, and the total number of such vehicles. c). Bond. Each application for Scavenger License shall be accompanied by a Bond in the penal sum of $5,000.00 and shall be executed by the applicant as principal and also by two non - corporate sureties who shall be residents of the State of Illi- nois. The applicant, however, shall have the option of sub- stituting a corporate surety on said bond in lieu of the afore- said two non -corporate sureties. The aforesaid Bond shall be approved by the City Attorney CERT. OF pUSLICAT►ON ATTACHED TO ' 0PjC-Vi E and shall be conditioned upon the applicant complying fully with all of the provisions of the Ordinances of the City at all times and also complying fully with all of the provisions of the Statutes of the State of Illinois. d). Term of License. The term of the Annual Scavenger License shall be the same as the fiscal year of the City of McHenry, to -wit: May 1 of each year to April 30 of the follow- ing year. e). Revocation. The Mayor and City Council may revoke any Scavenger License issued hereunder where the Licensee has violated any of the regulations hereinafter prescribed. Notice of such revocation shall be given to the Licensee by personal delivery to the Licensee, or by Certified Mail ad- dressed to the Licensee. The Licensee shall be entitled to a Hearing before the Mayor and City Council in connection with such revocation, provided however, that the Licensee makes written demand for such Hearing within five (5) days after he has received Notice of such Revocation. The Hearing demanded by the Licensee shall take place within fifteen (15 ) days after the demand for the Hearing has been filed with the City Clerk by the Licensee. Whenever a demand has been made by a Licensee for a Hearing in connect- ion with the revocation of his license, the Licensee shall be permitted to continue scavenger operations in the City during the time that such hearing on the revocation is pending. Section 3. Regulations. under shall observe and at all regulations: The Scavenger Licensee here - times comply with the following a). All vehicles used by such Scavenger in his business shall be watertight and shall be equipped with airtight covers for such portions as are used for the transporation of the garbage, ashes, refuse of all kinds, or miscellaneous waste materials. -2- b). Each vehicle used in the scavenger operations hereunder shall be insured against public liability in the amount of $100,000 for each person injured and in the a- mount of $300,000 for each occurrence. c). The Licensee shall furnish a weekly curbside collection service for residences in the City of McHenry, said service to consist of a pick-up of four 32 gallon containers or equivalent, at the 4 mtn� q ^ y pick-up fee of $3.75 • d). The Licensee also shall provide a weekly back- door collection service for residences in the City of McHenry, said service to be contracted with the individual home owner at such monthly fee as the home owner and scavenger may agree upon. e). The Licensee may provide such other special type of collection service (such as the pick-up of household debris, construction material, junked appliances, discarded furniture or other miscellaneous materials) as the home owner may request at a collection fee to be agreed upon between the scavenger and the home owner. f). The Licensee may contract with each business, commercial and industrial establishment, individually, for scavenger service, at a monthly collection fee to be agreed upon between them. g). All vehicles, boxes or containers used by the Licensee or leased by the scavenger, shall be kept securely closed to prevent the contents from scattering. Section 4. Non -Applicability of Ordinance. This Ordinance shall not apply to persons or vehicles exclusively engaged in carrying or hauling brush, tree clippings, tree limbs, building debris or junk. Section 5. Scavenger License Fee. The Annual Fee for a Scavenger License shall be a sum of money equal to $25.00 for each vehicle that is to be used in the scavenger business in the City of McHenry. -3- Section 6. All Ordinances and parts thereof in con- flict with the terms and provisions of this Ordinance, be and the same are hereby repealed to the extent of such con- flict. Section 7. Any person, firm or corporation in vio- lation of the provisions of this Ordinance shall be fined not less than $25.00 nor more than $500.00. Each day that such violation exists shall be considered and penalized as a separate violation. Section 8. Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
