AN ORDINANCE AMENDING CHAPTER 12 ARTICLE II CURFEW FOR MINORS BE IT ORDAINED By the Mayor and the City Council of the City of McHenry, McHenry County, Illinois as follows: Section 1. That Chapter 12, Miscellaneous Provisions, Article II, Curfew for Minors, Sections 3, 4 and 5, be hereby amended as follows: Section 2. That Section 3, Loitering of Minors Prohibited, shall read as follows: 3. LOITERING OF MINORS PROHIBITED. It shall be unlawful for any minor under the age of eighteen (18) years to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, docks, or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the below mentioned hours; provided however, that the provisions of this section do not apply to a minor accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is upon an emer- gency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor. (a) Between 12:01 a. m. and 6:00 a. m. Saturday; (b) Between 12:01 a. m. and 6:00 a. m. Sunday; and (c) Between 11:00 p. m. on Sunday to Thursday, inclusive, and 6:00 a. m. on the following day. Each violation of the provisions of this Section shall constitute a separate offense. Section 3. That Section 4, Responsibility of Parents, shall read as follows: 4. RESPONSIBILITY OF PARENTS. It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of eighteen (18) years to knowingly permit CERT. OF PUBLICATION ATTACHED TO ORIGINAL such minor to loiter, idle, wander, stroll, or play in or -upon the public streets, highways, roads, alleys, parks, playgrounds, docks, or other public grounds, public places and public buildings, places of amuse- ment .and entertainment, vacant lots or other unsuper- vised places, between the above mentioned hours as specified in Section 3; provided, however, that the provisions of this Section do not apply when the minor is accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent:, guardian, or other person having the care and custody of the minor. Each violation of the provisions of this Section shall constitute a separate offense. Section 4. That Section 5, Penalties, shall read as follows: 5. PENALTIES. Any minor violating the provisions of Section 3 shall be dealt with in accordance with the Juvenile Court law and procedure. Any parent, guard- ian, or other adult person having the care and custody of a minor violating Section 4 shall be fined not less than ten dollars, nor more than one hundred dollars, or confined in the county jail not more than ten days, or punished by both said fine and imprisonment for each offense. Section 5. Conflicting Ordinance. All ordinances and parts of ordinances in conflict herewith, to the extent of such conflict are hereby repealed. Section 6. Validity. If any part or parts of this ordinance shall be held invalid for any reason whatsoever, such decision shall not affect the validity of the remaining part or parts of this ordinance. Section 7. When effective. This ordinance shall be in full force and effect from and after its passage as required by law. Section 8. This ordinance shall be known as Ordinance No. MC- 62 LOOZE :INNE ATTG ...
