AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE CITY OF MCHENRY, ILLINOIS
BE IT ORDAINED, by the City Council of the City of McHenry,
Illinois, that the Municipal Code of the City of McHenry be and hereby is
amended to delete paragraph 12 of Article II of Chapter 7 of the Municipal
Code in its entirety,
BE IT FURTHER ORDAINED, that the Municipal Code of the
City of McHenry, Illinois, be and hereby is amended by adding thereto
the following:
Article TT_
12, a. Any territory annexed to the municipality under
any method provided under the statutes of the
State of Illinois shall be automatically classified
as "R-111 Single Family District, and shall be
bound by the regulations of such District as are
established and set forth in Article V of the
Zoning Ordinance of the City of McHenry, and
such Ordinance as amended.
b. Any territory, tract, plot or lot annexed to the
City of McHenry by petition of the owner or
owners of such land, and the said owners not
desiring to be classified "R-1" Single Family
District, or if the property annexed through
petition of its owner or owners shall not qualify
as "R-l" under the provisions of said Article
V of the Zoning Ordinance of the City of McHenry,
shall have the obligation of reclassifying the
property to the desired and legal classification
necessary.
C. Prior to the passage of the annexation Ordinance,
the owner or owners of the property sought to be
annexed shall deposit in the Office of the City
Clerk the sum of $350. 00 as a guarantee of the
bringing of a zoning petition covering the affected
premises. In the event a zoning petition shall
not have been filed within 90 days after the adoption
of the annexation Ordinance, the $350. 00 deposit
shall be forfeit to the City of McHenry. If the
proper zoning petition has been filed within the
said 90 days following the passage of the annexation
Ordinance, the $350. 00 deposit shall be returned
to the owner or owners making same.

BE IT FURTHER ORDAINED that a true and correct copy of
this amendment to the Municipal Code of the City of McHenry shall be
inserted and affixed on page 11 of all copies of the Amended Zoning
Ordinance of the City of McHenry which shall be distributed hereafter.
This Ordinance shall be in full force and effect from and after
its passage and approval, as by statute provided.
