ORDINANCE
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF McHENRY THAT THE MUNICIPAL CODE OF THE CITY OF
McHENRY BE AND HEREBY IS AMENDED BY ADDING THERETO THE
FOLLOWING, CHAPTER 13, ARTICLE XIII-A:
SECTION I: License required. It shall be unlawful to engage
in the business of operating a taxicab in the City without first having
secured a license therefor. Applications for such licenses shall be made
in writing to the Clerk, and shall state thereon the name of the applicant,
the intended place of business and the number of cabs to be operated.
SECTION II: Definition. The term "taxicab" as used in this
Ordinance shall mean and include any vehicle used to carry passengers
for hire but not operating on a fixed route.
SECTION III: Character of Applicant. No such license shall be
issued to or held by any person who is not a person of good character or
who has been convicted of a felony; nor shall such license be issued to or
held by any corporation if any officer thereof would be ineligible for a
license under the foregoing conditions.
SECTION IV: The annual fee payable in advance for such licenses
shall be $100.00 Dollars for each cab company or owner plus $20.00
Dollars for each taxicab operated. All such fees shall be paid to the Clerk
at the time application is made. In the event the license applied for has
been denied, the fete shall be returned to the applicant. If the license is
granted, then the fee shall be deposited in the general corporate fund or
such other fund as shall have been designated by the Council by proper
action. Whenever the number of cabs so operated shall be increased
during the license year the licensee shall notify the Clerk of such change
and shall pay the additional fee to the Clerk. Such fee shall be in lieu of
any other vehicle fee required by Ordinance and the Clerk shall issue
suitable tags or st-ickers for the number of cabs covered by each license.
Such tag or sticker shall be displayed in a prominent place on each taxicab
while it is in use. If a taxicab is withdrawn from service and another
taxicab replaces the one withdrawn, the licensee shall notify the Clerk
who shall issue a tag or sticker for such replacement taxicab without
additional charge to the licensee. The licensee shall notify the Clerk of
the motor number and of the license number of each cab operated and of
the corresponding city tag or sticker number. The annual fee shall include
the right to use one or more of the designated parking places for taxicabs
in each of the various locations throughout the City, known as "Cab Stands".
Said parking place or places shall be assigned by the Chief of Police and
no other licensee shall use that parking place or places. Each "Cab Stand"
shall be appropriately marked by signs erected under the supervision of
the Chief of Police. It shall be unlawful to park any vehicle other than a
taxicab in any "Cab Stand".
SECTION V: Vehicles. No taxicab shall be operated unless it
bears a state license duly issued; and no such cab shall be operated unless
it is equipped with proper brakes, lights, tires, horn, muffler, rear
vision mirror, and windshield wiper in good condition. All taxicabs under

this Ordinance shall be subjected to a safety test at an official State Police
testing station semi-annually in the months of March or April and Septembe
or October of each year, and a Certificate of safety, with a number on the
face indicating the month of the next inspection period the vehicle is subject
to inspection shall be displayed in a prominent place on each taxicab. If
the test shows the taxicab is not in a safe mechanical condition, it shall not
be operated on the streets of said City until it has been repaired, submitted
to a retest at an official testing station and a current certificate of safety
is issued. It shall be the duty of the Chief of Police to inspect every taxi-
cab so often as may be necessary to see to the enforcement of the provision
of this section.
Each taxicab, while operated, shall have on each side, in letters
readable from a distance of twenty feet, the name of the licensee operating
it. If more than one cab is operated by a licensee each cab shall be desig-
nated by a different number, and such number also shall so appear on each
side of such cab.
SECTION VI: Drivers. It shall be unlawful for any driver of a I
taxicab while on duty to drink any intoxicating liquor, or to use any profane
or obscene language, to shout or call to prospective passengers, or to
disturb the peace in any way.
The licensee shall submit a list of drivers to the City Clerk
semi-annually.
SECTION VII: Insurance. No taxicab shall be operated unless
it is covered by a bond or public liability policy as required by statute.
SECTION VIII: Traffic Rules. It shall be the duty of every
driver of a taxicab to obey all traffic rules established by statute or
ordinance.
SECTION IX: Unlawful Use. It shall be unlawful to knowingly
permit any taxicab to be used in the perpetration of a crime or misdemeano .
SECTION X: Passengers. It shall be the duty of the driver of
any taxicab to accept as a passenger any person who seeks to so use the
taxicab, provided such person is not intoxicated and conducts himself in
an orderly manner. No person shall be admitted to a taxicab occupied by
a passenger without the consent of the passenger.
The driver shall take his passenger to his destination by the
most direct available route from the place where the passenger enters the
cab.
SECTION XI: Limitations on Licenses. There shall be no more
than two taxicab licenses in the City of McHenry. No person or corporation
shall be issued more than one license, nor shall a license be issued unless
the licensee has taxicabs in service, except when the population of the
City of McHenry exceeds 15, 000, then the Mayor and City Council of the
City of McHenry shall be authorized to issue one additional license per
5, 000 people in the corporate limits of the City of McHenry.
SECTION XII: Taxicab Drivers. No person shall drive a taxi-
cab unless he shall have secured a license therefor, as provided by the
Statutes of the State: of Illinois. No person shall drive a taxicab until he

has exhibited such license to the Chief of Police who will issue a certificate)
that the applicant has complied with the provisions of this Ordinance.
SECTION XIII: Any person, firm or corporation who violates,
disobeys, omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this Ordinance shall be fined not
less than $25.00 no more than $200. 00 for each offense. Each and every
violation under this Ordinance shall be considered as a separate offense.
SECTION XIV: This Ordinance shall be in full force and effect
from and after its passage, approval and publication as provided by law.
SECTION XV: All Ordinances and parts of Ordinances in con-
flict herewith are hereby repealed.

PUBLIC NOTICE OF CORRECTION
Please take notice that Ordinance No. MC-55 of the City of
McHenry in regard to the establishment of taxicab franchises, as
published on the loth day of September, 1971, contained a typographical
error in SECTION XI thereof and that said SECTION should read as
follows:
SECTION XI: Limitations on Licenses. There shall be
no more than three taxicab licenses in the City of McHenry.
No person or corporation shall be issued more than one
license, nor shall a license be issued unless the licensee
has taxicabs in service, except when the population of the
City of McHenry exceed 15, 000, then the Mayor and City
Council of the City of McHenry shall be authorized to
issue one additional license per 5, 000 people in the
corporate limits of the City of McHenry.
The effective date of the said Ordinance shall be ten days from
and after this publication.
