STREET McHENRY, ILLINOIS /mod- a - a o i MC 23 AN ORDINANCE PROHIBITING PEDDLING ON j THE STREETS OF THE CITY OF McHENRY f WHEREAS, the City of McHenry, an Illinois municipal corpora- tion, has been delegated the power to adopt regulations as to use of the streets of the City of McHenry by Articles 11-80-1 to 11-80-22 of the Illinois Municipal Code, Illinois Revised Statutes 1965, Chapter 24; and WHEREAS, the City of McHenry has been given the power to prohibit peddlers within the corporate limits by Article 11-42-5 of the Illinois Municipal Code, Illinois Revised Statutes 1965, Chapter 24; and WHEREAS, the peddling of food, ice cream, merchandise, or similar products by vendors on the streets and sidewalks has created, and would continue to create, a traffic hazard and health problems; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry that the Municipal Code of the City of McHenry be, and hereby is, amended by the addition thereto of a new Article XVIII in Chapter 12, "Miscellaneous Provisions", as follows: Section 1. Finding of Facts. That all of the matters hereinbefore recited are hereby f ound to state true and correct facts. Section 2. Peddling Prohibited. It shall be unlawful to pe dle within the City of McHenry, McHenry County, Illinoi s. Section 3. Definition. Peddle shall mean the selling, artering or exchanging or the offering for sale, barter or exchange of any tangible personal property upon or along the streets, highways or public places of the City or from house to house, whether at one place thereon or from place to place, from any wagon, truck, pushcart or other vehicle or from movable receptacles of any kind, but shall not include the delivery of any item previously ordered or the sale of items along delivery routes where the purchaser has previously requested the seller to stop and exhibit his items. Nor shall peddle be taken to include the solicitation of orders by sample where the goods are not delivered at the time the order is taken. Section 4. Penalties. Any person, firm or corporation who is adjudged guilty of violating the provisions of this ordinance shall be fined not less than Ten Dollars ($1(100) - I - I nor more than Two Hundred Dollars ($200. 00) for each offense and each day that this offense. continues shall constitute a separate offense hereunder. Section 5. Validity. If any clause, sentence, paragraph, or part of this Ordinance is declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so declared to be invalid. Section 6. Ordinance. This Ordinance shall be known as Ordinance No. MC- 3. Section 7. When Effective - Repeal. This Ordinance shall be in full force and effect from and after its passage as required by law, and all parts of ordinances conflicting with the provisions hereof are hereby repealed.
