HomeMy WebLinkAboutOrdinances - MC-64-11 - 02/24/1964 - AMEND MOTOR VEHICLE CODELOOZE' :[NNE ATT• =YS 112 E ELM STREET MCHENRY, ILLINOIS EVERGREEN 5.1580 /yC-Gy // MC - 11 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF McHENRY BE IT ORDAINED by the City Council of the City of McHenry, Illinois, that the Municipal Code of the said City be amended by the repeal of Articles VI, VII, VIII, IX and X of Chapter 13 in their entirety and by incorporating in the Municipal Code the following: Article VI, Chapter 13: 56. CERTAIN PROVISIONS OF THE UNIFORM ACT TO REGULATE TRAFFIC ON HIGHWAYS, as contained in Chapter 95-1/2 of the Illinois Revised Statutes, 1963. The following enumerated sections of Chapter 95-1/2, "Uniform Act Regulating Traffic on Highways", exclusive of any provisions thereof relating to the penalties or the punishment to be imposed for violation of such sections, are adopted and by reference made a part of this Code with the same force and effect as though set forth here verbatim; and the term "this Act" wherever used in any such section shall mean this chapter and article of the Municipal Code of the City of McHenry, whenever and wherever necessary to effectuate the meaning of the section: a. Article H - Sections 119, 120 and 121. b. Article III - Sections 128, 129, 130, 131 and 132. C. Article V - Sections 144, 145 and 145. 1. d. Article VII - Sections 151, 152, 153, 154 and 156. e. Article VIII- Sections 159, 161, 162, 163 and 164. f. Article IX - Sections 165, 166 and 169. g. Article X - Sections 170 and 171. h. Article XII - Sections 180, 181, 183, 184 and 188. i. Article XIV - Sections 189, 189a, 189b, 193, 194 and 195. j. Article XV - Sections 200, 211, 212, 213, 214, 215 and 216. k. Article XVI - Sections 222, 222a, 223, 224, 226, 227, 228 and 237. And in addition thereto, the traffic regulations of the Municipal Code are amended as follows in the same Article VI of Chapter 13: 57. ACCIDENTS. ILLINOIS EVERGREEN 5-1580 manner as to cause injury or damage, shall stop immediately, render such assistance as may be possible, and give his true name and residence to the injured person, or any other persons requesting the same on behalf of the injured person or the owner of the property damaged, and to a police officer if one is present. A report of such accident shall be given to the Chief of Police within 24 hours after the accident by the driver of each vehicle concerned. 58. SPEED REGULATIONS: a. State Routes. The maximum speed limit is hereby estab ishe at t irty (30) miles per hour on Illinois State Routes Numbers 120 and 31, through their entire traverse of the corporate limits of the City. b. Business Districts. The maximum speed limit is hereby established at twenty (20) miles per hour on the following streets: Riverside Drive from Broad Street to Boone Creek! Main Street from Crystal Lake Road to Front Street. Green Street from Pearl Street to Waukegan Road. Crystal Lake Road from Elm Street to Mill Street. C. Other Districts. The maximum speed limit is hereby established at twenty-five (25) miles per hour in all other areas within the city limits. d. The fact that the speed of a vehicle is lower than tfie foregoing limits shall not relieve the driver from the duty to decrease speed when approaching and crossing an intersection, when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway, or when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions, and speed shall be decreased as may be necessary to avoid colliding with any person or vehicle, or on entering a street in compliance with legal requirements and the duty of all persons to use due care. e. The speed of all vehicles of the second division (design'ed and used for pulling or carrying freight or for the carrying of more than seven persons) shall always be reasonable and safe and be governed, as near as may be, by the general requirements of paragraphs a, b, c and d of this section, but such speed shall not exceed the following: If equipped with pneumatic tires, 35 miles per hour; if equipped with two or more solid rubber tires, 10 miles per hour. 59. U-TURNS. The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a business district and shall not upon any other street so turn a vehicle unless such movement can be made in safety and without interfering with other traffic. 60. SIDEWALKS AND SAFETY ZONES. No driver of .a vehicle shall drive within any sidewalk area, except at a permanent or temporary driveway, nor into or upon any portion of a roadway marked as a safety zone. 61. DRIVING THROUGH PROCESSION: (a) No driver of a vehicle shall drive between the vehicles comprising a funeral or other authorized procession while they are in - 2 - LOOZE :[NNE ATT =Ys 112 E E-A STREET McHENRY, ILLINOIS EVERGREEN 5.1580 motion and when such vehicles are conspicuously designated as required in this section. This provision shall not apply at intersections where traffic is controlled by traffic control signals or police officers. (b) A funeral composed of a procession of vehicles shall be identified as such by the display upon the outside of each vehicle of a pennant of a type designated by the Police Department. (c) Each driver of a vehicle in a funeral or other pro- cession shall drive as near the right-hand edge of the roadway as practical and follow the vehicle ahead as close as is practical and safe. 62, WHEN PERMITS REQUIRED FOR PARADES AND PROCESSIONS. No funeral, procession, or parade containing 200 or more persons or 50 or more vehicles, excepting the forces of the United States Army or Navy, the military forces of this State, and the forces of the police and fire departments, shall occupy, march, or proceed along any street except in accordance with a permit issued by the Chief of Police and such other regulations as are set forth herein which may apply. 63. TRAFFIC NOT TO BE OBSTRUCTED. No vehicle shall be operated or allowed to remain upon any street in such a manner as to form an unreasonable obstruction to the traffic thereon. 64. STOPPING IN INTERSECTION. No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic control signal indication to proceed. 65. CLINGING TO MOVING VEHICLES. Any person riding upon any bicycle, motorcycle, coaster, sled, roller skates, or any toy vehicle shall not attach the same or himself to any moving vehicle upon any roadway. No person shall ride on the running board, fender, or outside step of any vehicle. 66. RIDING ON HANDLEBARS. The operator of a motorcycle when upon a street shall not carry any other person upon the handlebar, frame or tank of any such vehicle, nor shall any person so ride upon any such vehicle. 67. THROUGH STREETS DESIGNATED. The following streets are hereby declared to be "through streets" or "arterial highways" for the purposes of this section: Elm Street; Front Street; Richmond Road; Green Street; Waukegan Road; Pearl Street; Kane Avenue; John Street; Main Street; Washington Street; Riverside Drive; and Crystal Lake Road. 68. STOP BEFORE ENTERING A THROUGH STREET. Those streets and parts of streets as designated in para- graph 67 above are declared to be through streets for the purpose of this section. Stop signs shall be erected at all - 3 - intersections of all through streets with any other streets. When such signs are erected, the driver of a vehicle approaching any such stop sign shall stop as required by law. 69. ONE-WAY STREETS. Upon those streets and part of streets where signs are erected and maintained indicating the direction of traffic, vehicular traffic shall move only in the indicated direction. 70. PARKING FOR SALE OR REPAIR. No person shall stand or park a vehicle upon any roadway for the principal purpose of displaying it for sale, or washing, greasing or repairing such vehicle, except repairs necessitated by an emergency. 71. USING VEHICLE FOR ADVERTISING. No person shall operate or park a vehicle on any street for the primary purpose of advertising. 72. PENALTY. Any person, firm or corporation violating any of the provisions of this Article shall be fined not less than Five ($5. 00) Dollars nor more than One Hundred ($100. 00) Dollars for each offense. Those Sections of the Municipal Code repealed herein and those Ordinances adopted and enacted herein shall be, respectively, repealed j or in full force and effect from and after ten (10) days following; the j adoption and publication of this Ordinance, and parts thereof, as is by statute provided.
