MC-12-1048 An Ordinance Amending City of McHenry Municipal Code Chapter 7, Buildings and Building Regulations, Residential Rental Registration and Chapter 1, Settlement of Offenses WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. WHEREAS, the City of McHenry, in an effort to provide an efficient system of notifying property owners in the event of an emergency, code or ordinance violation and maintaining, in proper condition, rental property, the City recognizes the need for a residential rental registration program. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, as follows: SECTION 1: That Chapter 7 of the McHenry Municipal Code shall be amended by adding Sect. 7-28 to the code as follows: Sect. 7-28 Residential Rental Registration No person shall lease, rent, occupy or otherwise allow a rental unit within the City to be occupied unless the owner has registered the property on a form provided by Construction and Neighborhood Services of the City of McHenry. SECTION 2: That Section 1-12 be hereby amended to add Sect. 7-28 to the list of Settlement of Offences as follows: SECTION OFFENSE COLUMN A COLUMN B 7-28 Residential Rental Registration $100 $200 SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances or parts thereof in conflict are hereby repealed to the extent of such conflict. SECTION 5: This ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form as provided by law. Passed and Approved this 5th day of March, 2012.
