MC-07-942 AN ORDINANCE AMENDING CHAPTER 7 ARTICLE XI, FENCES OF THE CITY OF MCHENRY MUNICIPAL CODE WHEREAS, the Mayor and City Council have determined that it is in the best interest of the health, safety and general welfare of the citizens of McHenry to amend the Municipal Code to address fencing in the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE: CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1. That Chapter 7, Article XI, Section 7-144 of the Municipal Code shall be amended to read as follows: Sec. 7-144, Standards for residential fences. The following standards shall apply to any site used for residential purposes: (a) Front and Corner Side Yards. 1. No fence shall be installed closer than 30-feet from a road right-of-way, or at the property owner's option, closer that the existing building line of the premises, except as follows: a. Split rail fences may be installed in a front or corner side yard provided that the maximum height of said fence shall not exceed 42 inches. b. A fence in a corner side yard may be located no closer than fifteen (15) feet from a comer side lot line, except where a corner side yard abuts another corner side yard, the fence may be located no closer than five (5) feet from the corner side lot line. c. On a double frontage lot, a fence may be located in a yard abutting a street, provided: i) Said yard shall not provide a means of vehicular access to the site; ii) No chain link or wrought iron/aluminum fencing shall be: allowed; and iii) Maximum height of fencing shall not exceed six (6) feet. (b) Side and Rear Yards. Fences in side and rear yards shall not exceed six (6) feet in height, except that where a residential lot abuts any non-residential lot, a fence shall not exceed eight (8) feet in height. (c) Obstructions. No fence shall obstruct the clear view of vehicular traffic using any abutting streets or public ways. (d) Use of Barbed Wire Prohibited. The use of barbed wire in residential fencing is prohibited. SECTION 2. All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 3. This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
