AN ORDINANCE AMENDING CHAPTER 4
OF THE MUNICIPAL CODE, CITY OF McHENRY, ILLINOIS,
REGARDING LIQUOR LICENSE CLASSIFICATIONS
WHEREAS, the City Council of the City of McHenry, Illinois, has established
license classifications and fees for persons and premises that sell alcoholic beverages
at retail and has, from time to time, amended these license classifications and fees.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the CITY
OF MCHENRY, McHenry County, Illinois as follows:
SECTION 1: That paragraph (5) in Section 4-6, License classification and fees;
limitation on number of licenses, of the Municipal Code, City of McHenry, Illinois, shall
be amended to read as follows:
(5) Class G license shall authorize the sale of alcoholic and malt liquors for
consumption on the premises only. All consumption of alcoholic and malt
beverages shall be at tables. No bar sales shall be permitted, however, a
small service bar may be utilized in connection with the table service. The
annual fee for a Class G license shall be Seven Hundred Dollars
($700.00). No more than three (3) Class G licenses shall be in effect in the
City at any time.
Class G-1 license shall authorize the sale of alcoholic and malt Liquors for
consumption on the premises only, so long as more than fifty percent
(50%) of the annual gross revenue of the licensed premises is derived
from the sale of food or non-alcoholic beverages ("Annual Fifty Percent
Standard"). All consumption of alcoholic and malt beverages shall be at
tables. No bar sales shall be permitted, however, a small service bar may
be utilized in connection with the table service.
The determination of whether the Annual Fifty Percent Standard has been
met shall be made, at the time of license renewal, for the year just ended.
In the event a licensee has not possessed a Class G-1 license for a full
year, the determination of whether the Annual Fifty Percent Standard has
been met shall be deferred until the next license renewal period. To
determine whether the Annual Fifty Percent Standard has been met the
City staff shall be permitted to review and audit documents of the Licensee
including, but not be limited to, audited financial statements, corporate
financial reports, tax return information, state liquor license reports, and
any other relevant form of information deemed necessary by the City. The
annual fee for a Class G-1 license shall be Seven Hundred Dollars
($700.00). No more than one (1) Class G1 license shall be in effect in the
City at any time.
SECTION 2: If any section, paragraph, subdivision, clause, sentence, or
provision of this ordinance shall be adjudge by any court of competent jurisdiction to be
invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof,
which remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This ordinance shall be in full force and effect upon its passage,
approval, and publication in pamphlet form (which publication is hereby authorized) as
provided by the law.
