An Ordinance Amending City of McHenry Municipal Code
Chapter 17 Sect 17-2 and Chapter 24 Article 1
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, as follows:
SECTION 1: That Chapter 17 Section 17-2 Subdivision Control and Development
Ordinance continued in effect of the City of McHenry Municipal Code, shall be amended as
follows:
Technical Specifications Manual and Standard Details:
T1I. shall be deleted in its entirety and replaced with the following:
1. Parkway Trees. A Parkway or Street Tree is defined herein so as to include trees
growing or to be planted between property lines on either side of all streets, avenues, boulevards,
alleys or other public ways within the City. Parkway trees shall be planted on both sides of all
streets, in accordance with the following requirements. The standards are expressed in terms of
shade trees required per lineal foot of roadway, easement, or buffer strip, and include the full
width of each. For determining numbers of conifers and ornamentals applicable to the standard, a
conifer at least ten (10) feet in height shall equal a shade tree and two (2) ornamentals as
specified above shall equal a shade tree.
1. Syacin Aocation: Trees shall be spaced at approximate 40-foot intervals,
except that no tree shall be planted closer than 35 feet from any street corner, measurer
from the point of the nearest intersecting curbs, curb lines, or pavement edges. No tree
may be placed in public right-of-way or upon adjoining private property closer than two
feet from any curb. All trees shall be planted in locations so as to avoid conflicts with
existing utility lines, b-boxes, and any other similar appurtenances, but no less than ten
feet from any fire hydrant.
a. Major Entry: Boulevards (first 400 lineal feet); One tree each side per
forty (40) lineal feet of roadway.
b. Median: Two (2) trees per forty )40) lineal feet of medium length plus
one (1) tree for each twenty-five (25) lineal feet of median where median is wider
than thirty (30) feet.
c. Parkway: Provide one (1) shade tree per forty (40) lineal feet of
frontage.
d. Street and Highway Perimeter Boundaries: Wherever perimeter
boundaries of a Business Park abut any street or highway, primary screening by
berm shall not be less than two (2) feet in height nor greater than eight (8) feet in
height, averaging four (4) feet in height.
2. Species. Specified varieties shall be specimen type trees and shall be first class
representatives of their normal species and varieties. The City shall have the right to
reject any tree not meeting this requirement.
a. Permitted Species; Only the species of trees listed in Table T-1.4 herein
shall be used to meet the requirements of this section.
b. Species Diversification. No fewer than four (4) species of approved
trees shall be planted with no more than 25% of any one species allowed on any
one block.
c. Overhead Utility Lines. Only Small Species, as specified herein, may be
planted under existing overhead utility lines. No trees shall be planted within
three (3) lateral feet of any underground water line, sewer line, transmission line,
or other utility.
3. Size. All new trees shall be balled and bagged and shall have a minimum
caliper of not less than four (4) inches, measured at breast height (dbh) above the soil
line.
4. Planting Requirements. Parkway trees shall be planted in accordance with the
requirements of the American Standards for Nursery Stock, current edition. A minimum
two -foot diameter mulched area shall be provided around the base of all parkway trees.
Trees shall be watered for a minimum of two (2) weeks following planting or until
sufficiently established.
SECTION 2: That Chapter 24 of the Municipal Code Section 24-1 shall be
deleted in its entirety and replaced with the following:
Sec. 24-1. Street Tree Defined. A "Street Tree/Parkway Tree? Is defined herein
so as to include trees growing or to be planted between property lines on either side of all
streets, avenues, boulevards, alleys or other public ways within the City.
SECTION 3: That Chapter 24 of the Municipal Code Section 24-3 shall be
deleted in its entirety and replaced with the following:
Sec. 24-3. Permitted street tree species. No tree species other than the small
tree, medium tree and large tree species listed in the Subdivision Control and
Development Ordinance Technical Specifications Manual and Standard Details T 1 Street
and Right -of Wax Improvements Section I. Parkway Trees may be planted as street
trees/parkway trees unless permission to do so has been previously given by the City
Council.
SECTION 4: That Chapter 24 of the Municipal Code Sections 24-5 through 24-8
shall be deleted in their entirety and replaced with the following:
Sec. 24-5. Spacing. Spacing of street trees shall be determined by the Subdivision
Control and Development Ordinance Technical Specifications Manual and Standard
Details T1-I Street and Roadway Improvements Parkway Trees.
Sec. 24-6. Planting distance from curb and sidewalk. As required by
Subdivision Control and Development Ordinance Technical Specifications Manual and
Standards Details T1-I Street and Roadway Improvements Parkway Trees.
Sec. 24-7. Distance from street corners and fire plugs. As required by
Subdivision Control and Development Ordinance Technical Specifications Manual and
Standards Details T1-I Street and Roadway Improvements Parkway Trees.
Sec. 24-8. Distance from utilities. As required by Subdivision Control and
Development Ordinance Technical Specifications Manual and Standards Details T1-I
Street and Roadway Improvements Parkway Trees.
SECTION 5: If any section, paragraph, subdivision, clause, sentence or provision
of this ordinance shall be adjudged by any Court of competent jurisdiction to be invalid,
such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which
remainder shall remain and continue in full force and effect.
SECTION 6: All ordinances or parts thereof in conflict are hereby repealed to
the extent of such conflict.
SECTION 7: This ordinance shall be in full force and effect upon its passage,
approval and publication in pamphlet form as provided by law.
