ORDINANCE NO.
AN ORDINANCE AMENDING TABLE 13 OF CHAPTER VII,
OFF-STREET PARKING AND LOADING, IN THE CITY OF MCHENRY, ILLINOIS
ZONING ORDINANCE
WHEREAS, the Mayor and City Council have determined that amendments to the Zoning
Ordinance of the City of McHenry are necessary to adequately address the parking demands for restaurant
parking; and
WHEREAS, a public hearing was held before the Planning and Zoning Commission on February
2, 2006, in the manner prescribed by ordinance and statute, and as a result of said hearing, the Planning
and Zoning Commission did recommend to the City Council the granting of the requested zoning text
amendment; and
WHEREAS, the Mayor and City Council have determined that it is in the best interest of the
health, safety and general welfare of the citizens of McHenry to amend the parking requirements for
restaurant users.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That Table 13, Off -Street Parking and Loading Requirements for Non -Residential
and Non -Lodging Uses, of Chapter VII, shall be and hereby is amended as follows:
RESTAURANT
Carry -Out Only -- 10 --
Eat-In with Drive-thru -- 15 [m] -- [g]
Eat -In without Drive-thru -- 25 --
[m] Only 10 spaces per 1,000 sf. shall be required for initial construction, however, the site
shall have adequate area to accommodate 15 spaces per 1,000 sf. and shall be designed as
such. If, in the determination of the Zoning Administrator, additional parking area is
needed to meet site demands, the City shall notify the property owner that construction of
the full required 15 spaces per 1,000 sf. is required, weather permitting, within 90 days of
such notice.
SECTION 2. All Ordinances or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 3. This Ordinance shall be published in pamphlet form by and under the authority of
the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval,
and publication in pamphlet form as provided by law.
