ORDINANCE NO. MC-04-846
AN ORDINANCE ADOPTING VARIOUS TEXT AMENDMENTS TO THE
CITY OF MCHENRY, ILLINOIS ZONING ORDINANCE
WHEREAS, a petition has been filed by the City of McHenry requesting various
text amendments to the City of McHenry Zoning Ordinance; and
WHEREAS, a public hearing on said petition was held before the Planning and
Zoning Commission on November 20, 2003, in the manner prescribed by ordinance and
statute, and as a result of said hearing, the Planning and Zoning Commission did
recommend to the City Council the granting of the requested zoning text amendments;
and
WHEREAS, the City Council has considered the evidence and recommendation
from the Planning and Zoning Commission and finds that the approval of the zoning text
amendments currently requested and approved by this ordinance are consistent with
the objectives of the City of McHenry Zoning Ordinance to protect the public health,
safety, morals and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That Article III, Section A, of the City of McHenry Zoning Ordinance
entitled "General District Regulations" is hereby amended by deleting all reference to
the following language:
"CO CONSERVANCY OVERLAY DISTRICT"
SECTION 2. That Article IV, Table 4, of the City of McHenry Zoning Ordinance
entitled "Residential District Requirements", including "Notes on Table 4", are hereby
amended by deleting all reference to the following language:
"{g} RM-2 lot area per dwelling unit minimums shown are a Conditional
Use in the District. Without a Conditional Use Permit, the minimums
applicable to the RM-1 District apply in the RM-2 District"
SECTION 3. That Article V, Table 7, Group N, of the City of McHenry Zoning
Ordinance entitled "ADDITIONAL PERMITTED USES IN C-5 DISTRICT" is hereby
amended by deleting all reference to the following language:
"Bottled gas dealers"
SECTION 4. That Article V, Table 7, Group O, of the City of McHenry Zoning
Ordinance entitled "ADDITIONAL CONDITIONAL USES IN C-5 DISTRICT" is hereby
amended by deleting all reference to the following language:

1. Fuel storage, bulk
2. Trailer parks
3. Wrecking yards"
SECTION 5. That Article V, Table 7, Group N, of the City of McHenry Zoning
Ordinance entitled "ADDITIONAL PERMITTED USES IN C-5 DISTRICT" is hereby
amended by adding thereto the following language:
"Fuel storage, bulk"
SECTION 6. That Article VI, Group U, of the City of McHenry Zoning Ordinance
entitled "CONDITIONAL USES IN 1-1 INDUSTRIAL DISTRICT" is hereby amended by
deleting all reference to the following language:
"Fuel storage, bulk"
SECTION 7. That Article VI, Group T, of the City of McHenry Zoning Ordinance
entitled "PERMITTED USES IN 1-1 INDUSTRIAL DISTRICT" is hereby amended by
adding thereto the following language:
"Fuel storage, bulk"
SECTION 8. That Article VII, Section 10, of the City of McHenry Zoning
Ordinance entitled "HANDICAPPED PARKING" is hereby deleted in its entirety and in
lieu thereof, the following language shall be substituted:
"10. HANDICAPPED PARKING: In accordance with current edition of
the Illinois Accessibility Code"
SECTION 9. That Article XIX, entitled "DEFINITIONS" is hereby amended by
deleting all reference to the following language:
"YARD: An open space on a lot other than a court that is required to
remain unoccupied and unobstructed above ground by any structure or
part or projection thereof from its lowest level to the sky, except as
otherwise permitted in this Ordinance. Yard requirements are as
measured horizontally irrespective of the slope of the land"
SECTION 10: All Ordinances or parts thereof in conflict with the terms and
provisions hereof are hereby repealed to the extent of such conflict.

SECTION 11: This Ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, McHenry County,
Illinois.
SECTION 12: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
