AN ORDINANCE ADOPTING VARIOUS TEXT AMENDMENTS TO THE
CITY OF MCHENRY, ILLINOIS ZONING ORDINANCE
WHEREAS, a petition has been filed by the City of McHenry requesting various text
amendments to the City of McHenry Zoning Ordinance; and
WHEREAS, a public hearing on said petition was held before the Zoning Board of
Appeals on April 11, 2002, in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Zoning Board of Appeals did recommend to the City Council the
granting of the requested zoning text amendments; and
WHEREAS, the City Council has considered the evidence and recommendation
from the Zoning Board of Appeals and finds that the approval of the zoning text
amendments currently requested and approved by this ordinance are consistent with the
objectives of the City of McHenry Zoning Ordinance to protect: the public health, safety,
morals and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That Article III, Section A, of the City of NlcHenry Zoning Ordinance
entitled "General District Regulations" is hereby amended by adding thereto the following
additional language:
"RS1-A-Medium-Low Density Single -Family Residential"
SECTION 2. That Article III, Section E, of the City of McHenry Zoning Ordinance
entitled "General District Regulations" is hereby amended by deleting all reference to the
following language "City of McHenry Flood Control Ordinance (Ordinance No. 0-81-254)"
and in lieu thereof the following language shall be substituted: "City's Municipal Code
Chapter 8, Development in Special Flood Hazard Areas"
SECTION 3. That Article VI, Section B, of the City of McHenry Zoning Ordinance
entitled "Office, Industrial, Business Park, Agriculture & Mining Overlay, and Health Care
Districts" is hereby amended by deleting all reference to the following language:
"1. Abattoirs or slaughterhouses
2. Acid manufacture
3. Air rights development
4. Creosote manufacture
5. Dumping or reduction of garbage, dead animals, offal, or refuse,
including recycling centers
6. Fat rendering
7. Feed, flour, and grain storage
8. Fertilizer manufacture
9. Ore reduction
10. Petroleum or coal oil processing or refining
11. Salt works
12. Sauerkraut manufacture
13. Smelters
14. Soap manufacture
15. Stock yards or slaughterhouses
16. Tallow, grease, or lard manufacture
17. Tanning, curing, or storage of rawhide or skins
18. Tar distillation
19. Transfer stations, solid
20. Utilization or storage of over 5 pounds of
provided under Performance Standards herein
21. Wrecking yards, as defined herein"

SECTION 4. That Article VII, Section 4, of the City of McHenry Zoning Ordinance
entitled "Surfacing of Parking Areas" shall be amended by deleting all reference to the
following language "...except that an approved crushed gravel base may also be used for
single-family detached dwellings"
SECTION 5. That Article X, Section 7, of the City of McHenry Zoning Ordinance
entitled "Decks, Patios, and Porches" shall be amended as follows:
By deleting all reference to the following language "accessory structures
rather than as" and all reference to the following language "Such decks shall
be subject to the requirements of Tables 19 and 20"
By deleting all reference to the following language: "No open porch shall
cover more than 20 percent of the required front yard, or of the actual front
yard if it is smaller than the required front yard"
By adding thereto the following additional language after'principal building':
"Such decks, patios and porches shall be subject to the requirements of the
zoning district in which they are located"
By adding thereto the following additional language: "Porches, as defined
herein, may protrude twenty-five percent (25%) into the required front yard"
SECTION 6. That Article X, Section B, entitled "Yards" (Table 19) is hereby
amended as follows:
By deleting all reference to the following language: "Lawn Furniture" and
Patios, enclosed"
By deleting the "X" from the column "All Yards"' for "Garages or carports"
By deleting all references to the word "open" following the word "Patios"

By adding thereto an "X" to the column "Court Yard" for "Patios"
By deleting the "X" from the column "All Yards" for
"Porches/breezeways,open"
By adding thereto an "X" to the column "Rear Yard" for
"Porches/breezeways, open"
SECTION 7. That Article X, Section B, entitled "Yards" (Table 20) is hereby
amended as follows:
By deleting all reference to the following language "Detached Garage -No
maximum" and in lieu thereof, the following language shall be substituted:
"Detached Garage-1"
SECTION 8. That Article XIX, entitled "Definitions" is hereby amended by adding
thereto the following additional language:
"DECK: A platform:
a) Open to the sky and attached to the wall of a building with direct access to
or from said building, or
b) With a roof or open to the sky, serving as a floor located above grade and
not attached to a building.
PATIO: An unenclosed, hard -surfaced area at the finished grade and located
directly adjacent or attached to a building.
PORCH: A platform having a roof that is attached to the wall of a building
with direct access to or from said building but is not enclosed with windows or
screens.
SECTION 9: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 10: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.

SECTION 11: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
