HomeMy WebLinkAboutOrdinances - MC-01-786 - 08/06/2001 - Create RS-1A zoning districtORDINANCE NO. p4r_ni _�Q6 AN ORDINANCE AMENDING THE CITY OF MCHENRY ZONING ORDINANCE TO CREATE THE RS-1A SINGLE FAMILY RESIDENTIAL ZONING DISTRICT WHEREAS, an amendment to the Zoning Ordinance of the City of McHenry to create a new single family residential zoning district was proposed by the Corporate Authorities; and WHEREAS, a public hearing on said amendment was held' before the Zoning Board of Appeals on June 11, 2001, in the manner prescribed by ordinance and statute; and WHEREAS, as a result of said public hearing, the Zoning Board of Appeals did recommend to the City Council that a text amendment creating iWo (2) new single family residential districts be approved; and WHEREAS, the City Council has considered the evidence and recommendation from the Zoning Board of Appeals and finds that approval of the proposed text amendment is consistent with the objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals and general welfare of its residents. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: That Section B, RESIDENTIAL ZONING DISTRICTS, of Chapter 4 of the Zoning Ordinance of the City of McHenry, shall be amended by adding the following subsection between the RS-1 Low -Density and RS-2 Medi u rn- Density Single Family Residential Districts: RS-1 a Medium -Low -Density Single -Family Residential District Purpose: This district is intended to provide in existing and newly developing outlying areas for a single-family detached residential environment characterized by medium - large sized lots. 1 SECTION 2: That Table 4, Residential District Requirements, of Chapter 4 of the Zoning Ordinance of the City of McHenry, shall be amended by adding the following column between the RS-1 and RS-2 Districts: RS-1 a Minimum Lot AREA per Dwelling unit in square feet (g)(1) and (4) Efficiency unit 18,000 1-bedroom unit 18,000 2-bedroom unit 18,000 3-bedroom unit 18,000 4-bedroom and larger 18,000 Minimum Lot WIDTH per Dwelling unit in feet 90 Abutting arterial street (b) 200 Minimum FRONT YARD depth in ft. (c)(2) and (3) 40 Minimum CORNER SIDE YARD Width in feet (c) 15 Minimum INTERIOR SIDE YARD Width in feet (c) (d) 10 Minimum REAR YARD depth in ft. (c) 35 Maximum building HEIGHT in feet For residential uses only 35 Minimum percent of net site area in: UNCOVERED space - NON -VEHICULAR space - RECREATION space - PERMITTED Use Groups (e) A CONDITIONAL Use Groups (f) B PARKING & LOADING As provided in Section VII. LANDSCAPING & SCREENING As provided in Section VIII. SIGNS As provided in Section IX. OTHER Requirements As provided in General Residential District Regulations And General District Regulations SECTION 3: All ordinances of parts thereof in conflict with the terms and provisions hereof are hereby repeales to the extent of such conflict. SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the Corporate Authorities of the City of McHenry, McHenry County, Illinois.
