AN ORDINANCE VACATING A PORTION OF BACK STREET
WHEREAS, a Petition has been presented to the City Council of
the City of McHenry, signed by all of the owners abutting a portion of
Back Street and a certain alley extending Northwesterly from the Westerly)
line of said Back Street, and
WHEREAS, it is the desire of the said Petitioners to vacate all
of that portion of Back Street and the said alley which abut the following
described premises:
Lots 2, 3, 6, 7, 10, and 11 in Block 11 of the original
Plat of McHenry on the West side of Fox River;
Lot 1 in Block 1 of M. Kelters' Addition to the Village
of McHenry, being a Subdivision of part of Block 12
of the original Plat of McHenry;
Lots 1 thru 9 in Michael Kelters' Second Subdivision,
being a Subdivision of Block 12 of the original Plat
of McHenry.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of McHenry that all of Back Street and the alley as platted
extending Northwesterly from the Westerly line thereof, as described
hereinabove, be and hereby are declared to be vacated and all right,
title and fee interest thereunder shall revert to the abutting property
owners, as bylaw provided.
This Ordinance shall be in full force and effect from and after
j its passage and approval.

CERTIFICATION
I, EARL R. WALSH, City Clerk of the City of McHenry, in the
County of McHenry and State of Illinois, DO HEREBY CERTIFY that the
annexed and foregoing is a true and correct copy of an Ordinance on file
in my office entitled, "An Ordinance Vacating a Portion of Back Street".
I DO FURTHER CERTIFY that the said Ordinance was passed by
the City Council of the City of McHenry at a regular meeting of said City
Council duly held on the 19th day of October, 1971; that at said meeting,
on motion duly made and seconded that said Ordinance do pass, the roll
of members of said City Council was called and the vote of each member
present on the question of the passage of said Ordinance was duly and
separately taken by ayes and nays, and his name and vote recorded in the
minutes of said City Council; that it appears from such record that the
result of said roll call vote so taken was as follows:
Ayes: 8
Nays: 0
and that the number of affirmative notes so cast constitutes at least a
majority of all the members of the City Council authorized by law to be
elected for said City.
I DO FURTHER CERTIFY that the said Ordinance was deposited
in my office on the 20th day of October, 1971.
I DO FURTHER CERTIFY that the said Ordinance, after passage
thereof by the said City Council, was approved by the Mayor of the City.
I DO FURTHER CERTIFY that the original Ordinance, of which
the foregoing is a true copy, is entrusted to my care for safe keeping,
and that I am the lawful keeper of the same.
IN WITNESS WHEREOF, I have hereunto set my hand and affixed
the corporate seal of the City of McHenry aforesaid, at the said City, in
the County and State aforesaid, this 20th day of October, 1971.
