HomeMy WebLinkAboutOrdinances - 0-71-45.5 - 03/01/1971 - REZONE R4 TO B1©' Ll 5 z- AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS AS FOLLOWS: SECTION 1: That the Comprehensive Zoning Ordinance of the City of McHenry, Illinois as passed, approved and as subsequently amended and as now in effect, and the zoning map of the City of. McHenry, Illinois adopted as a part of said Zoning Ordinance, and as amended, be and they are hereby amended as follows: A. That the West 157 feet of the following described property ' i the same is hereby reclassified from "R-4" Multi -Family Dis- trict to "B-l" Commercial Retail District: B. That the remainder of the said following described property (except the East 102 feet thereof) presently zoned "R-4" Multi - Family District in part and "R-l" Single -Family District in part, be and the same is hereby classified "R-4" Multi -Family District: That part of the Northwest Quarter of Section 35, Town- ship 45 North, Range 8 East of the Third Principal Mer- idian, described as follows: Commencing at the Southeast Corner of Out Lot 5, according to the original Plat of West McHenry; thence South 1 degree 15 minutes West, along the center line of Center Street, 351.78 feet, more less, to the North line of Wattle's Second Addition to :Henry; thence Westerly on said North line of Wattle's Second Addition, and said North line extended, 625.70 feet, more or less, to a point 40 feet East of the center line of State Route 31; thence Northerly along a line parallel and 40 feet distant from said center line, 352.44 feet; thence Easterly 632.28 feet, more or less, to the place of beginning, (except that part described as follows: Commencing at the Southeast Corner of Out Lot 5, according to the Original Plat of West McHenry; thence South 1 de- gree 15 minutes West along the center line of Center Street, 351.78 feet, more or less, to the North line of Wattle's Second Addition to McHenry for a place of beginning; thence Westerly on said North line of Wattle's Second Addition to McHenry and said North line extended 132 feet to a point; thence Northerly parallel to the center line of Center Street a distance of 108 feet to a point; thence Easterly varallel with the North line of Wattle's_ Second Addition McHenry a distance of 132 feet to the center line of enter Street; thence South 1 degree 15 minutes West along the center line of Center Street to the .place of beginning), in McHenry County, Illinois. SECTION 2: That the present "R-1" Single -Family District ification of Lot 3 in Block 2 in Wattle's Second Addition to McHenry, consisting of a 66-foot lot fronting on Kane Street, re- mains unchanged; provided, however, that the owner may use a portion thereof for the installation of water and sewer main connections, but the owner may not use said property for vehicular ingress or egress to or from the 11R-4" Multi -Family District property. SECTION 3: That such reclassification is made following hearing before and the affirmative recommendation of the__Zoning _Board_ of Appeals of the City of McHenry, following proper application therefor, 1 --ation of notice thereof, and public hearing, all in accordance with the -provisions of said Zoning Ordinance. SECTION 4: That all ordinances or parts thereof in conflict herewith be and the same are hereby repealed. SECTION 5:' That this ordinance shall be in effect from and after its passage and approval according to law.
