September 16, 2013
Mayor Low called the regularly scheduled September 16, 2013 meeting of the McHenry City
Council to order at 7:30 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer,
Blake, Wimmer, Peterson and Condon. Absent: None. Also in attendance: City Administrator
Morefield, Deputy City Administrator Martin, Deputy City Administrator Hobson, Chief of Police
Jones, Director of Public Works Schmitt, Director of Finance Lynch, City Attorney McArdle and
City Clerk Jones. Absent: None.
Mayor Low announced that Item 7 on the Agenda, Ordinance amending Municipal Code
Chapter 14, Sec 64, Weapons, adding specific language to include the prohibition of hunting
with all types of bow devices in the City limits, has been pulled from the Agenda and will be
heard on a later date.

CLASS A LIQUOR LICENSE FOR BLAZIN WINGS, INC. D/B/A BUFFALO WILD WINGS. 3343
SHOPPERS DRIVE AND AN ORDINANCE INCREASING THE NUMBER OF CLASS A LIQUOR
LICENSES IN EFFECT FROM 23 TO 24.
Mayor Low informed the Council that Blazin Wings, Inc. d/b/a Buffalo Wild Wings is
constructing a restaurant at 3343 Shoppers Drive and is requesting a Class A liquor license to
serve alcohol at the bar and at tables.
Buffalo Wild Wings has submitted a complete application and has paid the license fee.
Mayor Low informed Council that she has met with Vincent Aurmann, general manager of
Buffalo Wild Wings. Mr. Aurmann has been fingerprinted by McHenry Police Department. Mr.
Aurmann intends to hire a local manager before, or soon after, the restaurant opens for
business. Mayor Low noted that Blazin Wings, Inc. owns restaurants throughout the State of

Illinois. Buffalo Wild Wings does in-house training and its employees are conversant with State
of Illinois liquor license regulations.
Motion by Schaefer, seconded by Condon, granting a Class A liquor license to Blazin
Wings, Inc. d/b/a Buffalo Wild Wings, located at 3343 Shoppers Drive, conditioned upon a
satisfactory fingerprint report and all employees involved in the service of alcohol obtain
BASSETT certification; and (2) approving an Ordinance increasing the number of Class A liquor
licenses from 23 to 24.

ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 14 SEC 64, WEAPONS, ADDING SPECIFIC
LANGUAGE TO INCLUDE THE PROHIBITION OF HUNTING WITH ALL TYPES OF BOW DEVICES IN THE
CITY LIMITS.
This item was pulled from the Agenda and will be heard on a later date.
ORDINANCE APPROVING TEXT AMENDMENTS TO THE ZONING ORDINANCE REGARDING
SURFACING OF PARKING AREAS AND DISPLAYING VEHICLES ON GRASS SURFACES AT
AUTOMOBILE DEALERSHIPS.
Alderman Santi departed Council Chambers at 7:42 pm.
Deputy City Administrator Martin informed Council that Gary Lang has requested the
City consider allowing vehicles to be displayed/parked on grass (on private property). The City's
Zoning Ordinance currently prohibits parking vehicles on grass (unapproved surfaces) and
requires vehicles to be parked on an approved surface. Deputy City Administrator Martin
provided Council with the language that is currently in the Ordinance.
It was noted that the City hosts several vehicle dealerships. Automobile dealerships are
not permitted to display vehicles on the grass or in City/State right-of-ways. However, several
used vehicle dealerships on Elm Street/State Route 120 are situated on lots that do not have a
large grass area, which could be utilized for the display of vehicles; however, all of these
dealerships are able to display vehicles adjacent to the roadway because the lots are generally
paved up to the property/right-of-way line. Gary Lang Auto Group and Buss Ford are the only
vehicle dealerships with large grass setbacks adjacent to State right-of-way.
With the exception of concrete vehicle display pads on his property, Gary Lang's paved
lot display area setback varies between 25 feet to 30 feet from the front property lines along
Route 31. The frontage of the property along Route 31 is approximately 1170 feet, which does
not include the two undeveloped lots. Buss Ford has a similar configuration; however, they do
not have concrete display pads. Additionally, Buss Ford is situated on a corner lot with a

sidewalk along Route 31 and a bike path along Dartmoor Drive. Due to large green setbacks,
Buss Ford and Gary Lang do not have the same opportunity to display vehicles close to the road
right-of-way.
Staff believes the large green setbacks presents a hardship for both Gary Lang and Buss
Ford, by not providing the same opportunity to display vehicles close to the road right-of-way,
providing an unfair advantage the older/used car dealerships hold over newly constructed sites.
It is not uncommon to see vehicles displayed on the grass at automobile dealerships in other
communities. Staff believes allowing the display of vehicles on the grass at automobile
dealerships would be acceptable, with certain restrictions and recommends the following:
• One vehicle per 100 feet of property frontage may be displayed on grass;
• Grass underneath vehicles must be maintained in accordance with City ordinances;
• Vehicles cannot create any vision/line-of-sight problems;
• Vehicle lights shall remain off and doors and hoods must remain closed;
• Vehicles can be displayed on the grass between March 1 and November 1 only;
• Vehicles must be evenly spaced across full property frontage and cannot be clumped
together;
• Vehicles cannot be located in road right-of-way.
If the standard of one vehicle each 100 feet were utilized, Gary Lang would be allowed to
display 11 vehicles. Buss Ford would be permitted to display 7 vehicles along Front Street and 6 l
vehicles along Dartmoor Drive. An amendment to the Zoning Ordinance would be required to
make the proposed change.
Staff is recommending provisions for displaying/parking vehicles on the grass at
automobile dealerships be an exception to the prohibition of parking vehicles on an
unapproved surface for businesses with vehicle sales as their principal use only. Staff is also
suggesting the provision is clarified to make it clear parking vehicles on the grass is generally
prohibited.
Deputy City Administrator Martin informed Council that the Planning and Zoning
Commission discussed Mr. Lang's request at its meeting on August 15, 2013. Some concerns
were raised regarding the necessity of displaying vehicles on grass. In addition, safety concerns
were expressed about persons in traffic looking at displayed vehicles while driving and
potentially causing an accident.
The Planning and Zoning Commission approved a motion by a vote of 5-2, for text
amendments to allow the display of vehicles on grass at automobile dealerships, as well as the
proposed amendments to the surfacing of parking areas as proposed, with the addition that
vehicular ramps be prohibited on the grass, only vehicles shall be permitted to be displayed on
grass.

Alderman Condon informed Council that this matter came before the Community
Development Committee. She stated that initially she had some reservations, but has since had
the opportunity to speak with Mr. Lang regarding the disadvantages faced due to the location
of his property. Alderman Condon opined the property is well maintained and stated that she
believes it is appropriate to have vehicles parked on the grass at the premises.
Alderman Glab stated he has reservations about parking vehicles on the grass. He noted
that the facility is beautiful, but that he is unable to support displaying vehicles on the grass for
24-hour periods, days at a time. He opined that the need to display vehicles on the grass does
not appear evident.
Alderman Schaefer stated the topic has been discussed at length. He opined the
provisions of the Ordinance cover all concerns.
Responding to an inquiry from Alderman Peterson regarding penalties imposed should
the grass not be maintained, Deputy City Administrator Martin stated that if the grass is not
maintained it would be a violation of the Ordinance.
Motion by Condon, seconded by Wimmer, approving the Ordinance adopting text
amendments to the Zoning Ordinance regarding the surfacing of parking areas and displaying
vehicles on grass at automobile dealerships.

Abstain: Santi.

Alderman Santi returned to Council Chambers at 7:49 pm.
ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 10.5, GARAGE SALES.
Deputy City Administrator Martin informed Council that Staff has encountered problems
with one of the provisions included in the current Garage Sale Regulations. Specifically, the
provision in the Municipal Code allows residents to advertise and sell up to five items from their
residence at any one time.
Staff has encountered enforcement challenges where the homeowner is using the
current provision to their advantage to continually sell items from their residence. Specifically,
Staff has experienced instances where a homeowner was allegedly purchasing vehicles from
auctions and reselling them, up to five, from the residence. It was noted that the problem is not
a pervasive issue, but one worth evaluating.

The Community Development Committee, at its January 22, 2013 meeting discussed
amending the provision and unanimously recommended to direct Staff to forward a
recommendation to Council changing Item (c) in the Ordinance to read:
"Any persons selling or advertising for sale an item or items of personal property
which are specifically named or described in the advertisement and which
separate items do not exceed (3) in number, with only one each of any one type
of item permitted."
Staff is recommending the Ordinance amending Chapter 10.5, Garage Sales, in the
Municipal Code be approved.
Alderman Glab opined that he does not feel that the garage sale issue was discussed
adequately. He stated that the way the Ordinance is currently written is unenforceable.
Motion by Wimmer, seconded by Peterson, approving the Ordinance amending Chapter
10.5, Garage Sales, in the Municipal Code, as presented.
Voting Aye: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, Condon.
Voting Nay: None.
Absent: None.

MAYOR STATEMENT AND REPORTS
Mayor Low announced that there are a number of events taking place in town this
season.
Mayor Low stated the Montini Music Fest, held at Petersen Park on September 14,
2013, was successful.
Mayor Low stated the Family Camp Out, which took place the last weekend at Petersen
Farm was enjoyed by 15 families.
Mayor Low announced that McBark Dog Park opened on September 3, 2013. McBark
Park is located off Route 31, north of Kohl's department store. Annual passes are available at
the Municipal Center. More details are located on the City's web site www.ci.mchenry.il.us
under the Parks and Recreation Department.
