Director Polerecky has done some minor research over the years into creating a community involvement group that would bring staff, elected officials and residents together to address specific projects. During the investigative process we identified a potential obstacle regarding liability coverage of volunteers. Director Polerecky met with Mayor Jett, Officer Polidori (Public Relations Officer) and Attorney McArdle to discuss liability as it relates to having non -employee volunteers working on projects directed by City Staff, Attorney McArdle researched the liability and offered the following explanation in an email: All, 1 spoke with our insurance pool representative, Mike Nugent. He assured me that current liability coverage encompasses volunteers of the City so long as the volunteer is performing services, at the time of the incident, within the scope of their directions from the City; in the same fashion that a City employee is performing their work in the scope of their duties. For example the volunteer must be working on a project authorized by the City, as we discussed, and while performing their duties, they must not exceed their authority. So, again, for example, if we are using volunteers to control pedestrian traffic for an event, if the volunteer gets into a Fight, the volunteer may not have coverage if it is found that the fight was outside the scope of his authority.... Obviously, the most important part of the program is the identification of a methodology for implementing the program. This includes the following items for which staff is seeking input from the Community Development Committee. • Identifying projects, City projects vs private • Approval process of each project, CDC Committee? Organize a new committee? • Funding sources for projects • Project schedules? Quarterly? Monthly? • Advertising The request before the Community Development Committee is to brainstorm and collect ideas from all members and be able to start to establish the program guidelines. At this time, all information and suggestions are welcome. While researching other communities, the most involved community that was identified is in Longford, Colorado. The following link will direct you to the community involvement group website for this municipality. https://www.lon�montcolorado.�ov/i-want-to/community-involvement tiuwr or rww rox wrvsw Department of Community & Economic Development Ross Polerecky, Director McHenry Municipal Center 333 Green Street McHenry, Illinois 60050 Phone: (815) 363-2182 Fax: (815) 363-2173 rpolerecky@ci.mchenry.il.us R- - Resolution Establishing a City Volunteer Program and Authorizing Department Heads to Appoint Volunteers WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Resolution constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; WHEREAS, the City has determined that community involvement and volunteerism creates broad community support and promotes the public welfare; WHEREAS, the City benefits from residents who have a strong desire to volunteer and provide support to the City of McHenry and others; and WHEREAS, the City desires to create and market the City Volunteer Program, with rules that the City Administrator may from time to time establish. NOW, THEREFORE, be it resolved by the City Council of the City of McHenry as Follows: Section 1: The Department heads of the City, with prior written approval from the Mayor and City Administrator, are authorized to appoint volunteers to perform services for each respective Department of the City, subject to each volunteer completing the attached Waiver and Release of Liability form. Section 2: The ON Administrator is authorized to market and adopt such rules and regulations to properly implement the City Volunteer Program. In consideration of the promises and agreements made by the City of McHenry ("City") to permit the undersigned Volunteer to provide voluntary services to the City, the undersigned Volunteer hereby agrees as follows: 1. Compliance with Rules: I will participate in the City Volunteer Program at the direction of the City's department heads and elected officials and follow all applicable rules, regulations and laws. 2. Waiver and Release: I recognize that I am not required to participate in the City Volunteer Program, however, I chose to do so of my own free will, recognizing the inherent risks involved in my participation, including, but not limited to: (a) transportation to and from the City Volunteer Program; (b) risks associated with moving vehicles, machinery and boats; (c) misuse of City equipment, uniforms and personal protective equipment; (d) failure to follow required safety precautions; and (e) I acknowledge that my negligent conduct in the City Volunteer Program may make me liable for damages and injuries to others. I hereby release and forever discharge and hold harmless the City from any and all liability, claims, and demands of any nature, either in law or in equity, which arise or may hereafter arise from the services I provide to the City. I understand and acknowledge that this Release discharges the City from any liability or claim that I may have against it with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services I provide to the City occurring while I am providing volunteer services to the City. I further agree to indemnify and hold harmless the City, its officers, agents and employees, from any laws, liability, damages or costs, including court costs and attorney's fees, which they may incur do to my participation in the City Volunteer Program, whether due to my negligence or theirs. 3. Compensation and Insurance: I understand that my participation in the City Volunteer Program will not qualify me as a City employee or an independent contractor of the City. In addition, I understand that the City does not assume any responsibility for or obligation to provide me with compensation, financial or other assistance, including but not limited to medical, health, or disability benefits, workers compensation or other insurance. I expressly waive any such claim for compensation or liability on the part of the City beyond what may be offered freely by the City in the event of injury or medical expenses incurred by me. Should I require a need for medical attention, I give permission for the City to contact an emergency transport to take me to a doctor or medical facility. 4. Binding Release: I hereby bind my family members, my heirs and assigns to this Release. 5.
