Mayor Low asked to call the roll: COUNCIL MEMBERS PRESENT: Aldermen Geoff Blake, Geri Condon, Andy Glab, Robert Peterson, Victor Santi, Jeffrey Schaefer, Richard Wimmer, and Mayor Susan Low. COUNCIL MEMBERS ABSENT: None. STAFF PRESENT: City Administrator Derik Morefield, Deputy City Administrator Doug Martin, Deputy City Administrator Bill Hobson, Public Works Director Jon Schmitt, Finance Director Carolyn Lynch, City Attorney David McArdle, and Executive Assistant Marci Geraghty. PUBLIC HEARING: 2013/2014 APPROPRIATION ORDINANCE Mayor Low opened the Public Hearing for the consideration of the 2013/2014 Appropriation Ordinance at 7:31 PM. Mayor Low stated the proposed appropriation ordinance reflects the budget total of $37,104,087 approved by Council for the 2013/2014 Fiscal year. Notice of the Public Hearing was published in the Northwest Herald on June 19, 2013, and no written or verbal comments were submitted to the City Clerk's office. Following Council approval, a certified copy of the Appropriation Ordinance will be filed with the Office of the McHenry County Clerk within 30 days. Staff is requesting Council consideration of the Appropriation Ordinance following the close of the Public Hearing. In response to Mayor Low's inquiry, there were no public comments from the audience regarding this matter. Motion by V. Santi, second by G. Blake to close the Public Hearing for the 2013/2014 Appropriation Ordinance at 7:32 PM. McHenry City Council July 1, 2013 Page 2 of 13 PRESENTATION: CHARACTER COUNTS! RECOGNITION AWARD Alderman Condon, President of the CHARACTER COUNTS! Coalition presented Katelyn Sena with a CHARACTER COUNTS! Recognition Award. Alderman Condon announced she nominated Katelyn because of her efforts to collect donations for the FISH Food Pantry. Ms. Sena's school and work schedules did not permit her to work at the food pantry during regular hours so she took the initiative to collect over 500 food items at her church, school, and throughout the community. Alderman Condon said she recommended Ms. Sena for her citizenship, caring, respect, and responsibility. Mayor Low thanked Alderman Condon, the Coalition, and Ms. Sena stating the City Council is pleased to recognize citizens at our meetings who portray outstanding character. PUBLIC INPUT SESSION Mr. Richard McMahon of Buchanan Energy, 5412 Regents Parkway, Rockford, IL expressed his desire for the City of McHenry to formally support their opposition to the Illinois Department of Transportation's plan to install a median on Route 120 at Third Street, which would restrict full access to Third Street to and from Route 120. Buchanan Energy currently has a purchase contract for the Ponterelli and fonner Sullivan Foods property and plans to build a destination area that would include fall access to the Riverwalk, small stores, bike racks, outdoor restaurants, and a car wash. Mr. McMahon said they cannot achieve the proposed plan with the new configuration proposed by IDOT. CONSENT AGENDA A. Alderman Glab requested Item C be pulled from the Consent Agenda for further discussion. Motion by A. Glab, second by V. Santi to approve the Consent Agenda as amended. Mayor Low opened the floor for discussion: Alderman Condon asked for clarification on Item E, specifically why proposed alcohol sales end at 8:45 PM when band concerts end at 8:30 PM. Deputy City Administrator Hobson said it will allow people extra time to socialize after the concert and exit the park. Wimmer to approve Item C, Ordinance authorizing a multi -way stop at the intersection of Knox Drive and Municipal Drive. Mayor Low opened the floor for discussion: Alderman Glab said he is concerned the stop signs were not installed pursuant to the Uniform Traffic Control Device Code adding if the city does not meet the requirements as dictated in state statutes, we cannot properly enforce the signs. Alderman Glab added he does not disagree there is a need for the stop signs; he is concerned the city is not following the proper procedures according to state statute and said a similar situation happened in past years in the Lakeland Park subdivision. Attorney MCArdle said Home Rule may apply in this situation making the city exempt from the statute because this is a local issue adding dispute of the validity of the stop signs is a court matter, not a liability issue. Alderman Peterson said there is no need for stop signs on Knox Drive until the roadway is extended and stated if the signs are proposed for safety issues, there are many more deserving areas in the city where stop signs could be installed. Mayor Low noted children using the Skate Park frequently cross Knox Drive and she has witnessed several near misses with cars. Alderman Condon explained she would prefer to err on the side of safety and approve the ordinance tonight and requested clarification from Attorney McArdle regarding the Home Rule position. ' Alderman Santi suggested some type of caution sign be installed instead of a stop sign. He said he had concerns at the committee level about enforcement. A. Glab moved to amend his motion to add the phrase "pending verification from the city attorney that because of Home Rule the city is not required to perform a traffic study prior to installation of stop signs" at the end of the motion. The amended motion received a second from R. Wimmer. AUTHORIZATION TO SEND A PROPOSAL TO PERMIT AUTOMOBILE DEALERSHIPS TO PARK VEHICLES ON AN UNAPPROVED SURFACE TO THE PLANNING AND ZONING COMMISSION. Deputy City Administrator Martin said Gary Lang, owner of Gary Lang Auto Group requested the city consider allowing him to display his vehicles on the grass in front of his dealership. Mr. Lang was in attendance to answer questions. With the exception of his concrete vehicle display pad, Gary Lang's paved parking lot display area setback varies between 25' and 30' from the front property line along Route 31. The frontage of the property along Route 31 is approximately 1,170-feet, which does not - include two undeveloped lots. Buss Ford has a similar property layout however it does not have display pads, the business is situated on a corner lot with a sidewalk along Route 31, and the bike path runs along Dartmoor Drive. The frontage of the Buss Ford lot is approximately 717' along Front Street and 685' McHenry City Council July 1, 2013 Page 6 of 13 along Dartmoor Drive. The paved display area setback varies between 25' and 35' from the front and corner side property lines. In contrast to Gary Lang and Buss Ford, vehicles are parked up to the property line at Sunnyside Dodge and other vehicle dealerships along Route 120. Deputy City Administrator Martin added the Community Development Committee considered this issue at their June 11t' meeting and a motion to forward the proposal to the Planning and Zoning Commission for consideration at a public hearing failed. The committee subsequently made a motion to send the matter to the full Council for consideration. It is now recommended a motion be made by the Council to forward the matter to the Planning and Zoning Commission for a public hearing. R. Wimmer made a motion, second by J. Schaefer to direct staff to send a proposal to permit automobile dealerships to park vehicles on an unapproved surface to the Planning and Zoning Commission for a public hearing. Mayor Low opened the floor for discussion: Alderman Wimmer said other communities allow parking on grass due to setback issues and he has no concerns supporting this request adding Mr. Lang maintains his property well. Alderman Peterson added he also supported this request and agrees Mr. Lang does a good job maintaining his property. Alderman Condon noted this was a unique situation. At the committee level she had concerns, however since that time she has had the opportunity to meet with Mr. Lang at his business and she agreed other types of businesses do not have the same setback issues. She noted she would suggest the Planning and Zoning Commission recommend pennitting this type of use for car dealerships only. Alderman Sand abstained from the discussion citing a conflict of interest. Alderman Glab said he would prefer the vehicles were moved off the grass at the end of the business day and recommended language be included in the Ordinance regulating the distance between the property and the roadway and designating a specific timeframe when this use would be permitted. He also said he supports sending this matter to the Planning and Zoning Commission. Alderman Schafer said he assumed the need for the large setback was for future road expansion and he supports parking on the grass only if the property is well maintained. Alderman Blake added he is not concerned with maintenance as Gary Lang and Buss Ford are well maintained properties. Mayor Low reported she spoke to Steve Buss owner of Buss Ford who told her he has no desire to park vehicles on the grass at his business. Mr. Buss also told the Mayor he has no concerns with Gary Lang doing it. McHenry City Council July 1, 2013 Page 7 of 13 ORDINANCE ANNEXING PROPERTY LOCATED AT THE SOUTHEAST CORNER OF RIDGE ROAD AND ILLINOIS ROUTE 120 Deputy City Administrator Martin informed the Council the applicants, Transitional Living Services, Inc. aka TLS Veterans are requesting to annex 2004 Ridge Road into the city. The subject property is a five - acre parcel located at the southeast corner of Ridge Road and Route 120. If annexed the property will automatically be zoned E-Estate Residential in accordance with city zoning ordinance. The applicant submitted a Planning and Zoning Commission application for a use variance, which includes conditions to develop three, eight -unit buildings for permanent housing for veterans. The proposed development requires review by the Planning and Zoning Commission and subsequent approval by the City Council. Deputy City Administrator Martin told the Council staff has no concerns with the request. Rev. Lori M Lowe and Attorney Mark Saladin were present at the meeting. G. Condon made a motion, second by R. Petersen to approve an Ordinance annexing property located at the southeast corner of Ridge Road and Illinois Route 120 as presented., Mayor Low opened the floor for discussion: Alderman Condon said the Community Development Committee gave their full support for this project and asked if TLS would have onsite staff at the development to assist the veterans. Attorney Saladin said yes. Alderman Santi asked if this matter was required to go before the Planning and Zoning Commission; Deputy City Administrator Martin answered yes. Alderman Sand asked Attorney Mark Saladin if his client had previous discussions with the county about the project. Attorney Saladin said his clients TLS and St. Paul's Church Rev. Lori Lowe had briefly discussed the project with the county. TLS has always intended to bring this proposal to the city. Alderman Sand asked if TLS had other locations in the county. Attorney Saladin answered they have a smaller development in Hebron and their home office in McHenry, Mental Health & Counseling, is looking to expand. Attorney Saladin noted the development proposed tonight is a permanent housing site. Alderman Glab asked if the development would be tax exempt and Attorney Saladin answered yes. Alderman Glab stated in his opinion the property would be difficult to develop and noted the three, eight - unit apartment buildings would impact the city however there is no tax benefit. He added the city should have an annexation agreement and the Council could review the entire proposal. Alderman Saladin explained the proposal will return to the Council subsequent to the Planning Commission's review adding the project has charitable benefits to our community members who served in the armed forces. TLS went through the expense of obtaining a McHenry County Conservation waiver to disclaim any interest in the property as a charitable benefit to the community. Alderman Glab said he understands the project is charitable however he has reservations about drainage impacts should the property be developed. Attorney Saladin assured the Council the petitioner will develop a site plan that works and complies with the McHenry County Storm Water Ordinance. Alderman Glab asked how many cars will be parked at the development. Attorney Saladin answered many of the veterans who will live in the development do not drive. They will use public transportation or ride in the TLS van. Alderman Glab reiterated his opinion that the matter should be brought to the Council in the form of an annexation agreement. Alderman Peterson reported he is on the Community Development Committee and he endorsed the plan. Mayor Low added the city takes great pride in the fact the McHenry Community supports three active veteran organizations; a claim not many communities in the country can make. She is of the opinion this McHenry City Council July 1, 2013 Page 8 of 13 is a good location for this type of development as it is on a major route and near Woodstock where many veterans receive services. Mayor Low supports the project and is proud the applicants chose McHenry. TEMPORARY USE PERMIT FOR BUDDYZ MCHENRY, 1138 N. GREEN STREET TO ALLOW OUTDOOR ENTERTAINMENT THROUGH SEPTEMBER 14 2013. Deputy City Administrator Martin said Buddyz located at 1138 North Green Street submitted a temporary use permit application to allow concerts on an outdoor patio area until September 14, 2013. The concerts have been occurring over the past two years without a permit. The property currently holds a conditional use permit limiting entertainment to inside the restaurant. The temporary use is conditioned upon all concerts ending by 10:00 PM. The applicant has also agreed to ask entertainers to face west when performing to create less of an impact on the nearby residences. Staff has no concerns with the request. V. Santi made a motion, seconded by J. Schaefer to approve a temporary use permit for Buddyz McHenry, 1138 North Green Street to allow outdoor entertainment through September 14, 2013. Mayor Low opened the floor for discussion: Alderman Santi asked if a 10:00 PM limit was imposed last year and Deputy City Administrator Martin answered yes. He also clarified the permit before the Council was for this year only. Alderman Santi noted no residents were at the meeting to oppose the request. Alderman Schafer said he has been to some of the concerts at Buddyz and it is a nice setting. He agrees with the 10:00 PM time limit stating it was important to the neighborhood. Alderman Blake also agreed with the 10:00 PM time limit. Alderman Peterson asked if the use could be revoked if residents complain about the noise. Deputy City Administrator Martin explained if approved, the permit would be valid until September 14t'. Alderman Condon noted the business has been hosting outdoor concerts at this site all spring; the city is now regulating the use with conditions noting the Council should be informed if complaints are received. McHenry City Council July 1, 2013 Page 9 of 13 USE VARIANCE TO ALLOW TATTOOING AT 2906 WEST ROUTE 120 Deputy City Administrator Martin explained the applicant received an extension to an existing temporary use permit to allow tattooing until July 1, 2013, and is now seeking a use variance to allow tattooing permanently at 2906 West Route 120. The Planning and Zoning Commission unanimously recommended approval of a use variance with the condition the use shall expire if tattooing ceases for a period of six consecutive months. V. Wimmer to approve a use variance to allow tattooing at 2906 West Route 120 with the condition the use shall expire if tattooing ceases for a period of six consecutive months. USE VARIANCE TO ALLOW TATTOOING AT 1210 NORTH GREEN STREET Deputy City Administrator Martin addressed the Council and stated the applicant relocated his business to 1210 North Green Street from Hi -Point Road in unincorporated McHenry County. The applicant does tattooing and various mediums of art including an art gallery, retail store, customizing furniture, and a clothing line. The applicant received a temporary use permit to allow tattooing that expired on March 1, 2013, and is now seeking a use variance to allow tattooing permanently at 1210 North Green Street. Staff supports this request on the condition the use will expire if tattooing ceases for a period of six consecutive months. G. Condon made a motion, seconded by V. Santi to approve a use variance to allow tattooing at 1210 North Green Street with the condition the use shall expire if tattooing ceases for a period of six consecutive months. Mayor Low opened the floor for discussion: Alderman Condon reported she visited the store and although she is not interested in tattoos, she thought it was unique and offered many types of interesting art mediums. McHenry City Council July 1, 2013 Page 10 of 13 TEMPORARY SIGN VARIANCE REQUEST FROM NORTHTOWN AUTO SERVICES & TIRE CENTER, 3800 MCCULLOM LAKE ROAD Deputy City Administrator Martin advised Northtown Auto is requesting a temporary sign variance to allow a five-foot diameter helium balloon with pennant streamers anchored to the east side of the building located at 3800 McCullom Lake Road. The sign would be displayed this year during Fiesta Days from July 12t' through July 21 ". Staff supports the request. J Schaefer made a motion, seconded by G. Condon to approve a temporary sign variance request from Northtown Auto Service & Tire Center located at 3800 McCullom Lake Road to display a temporary sign on the east side of the building during Fiesta Days, July 12t' through July 215Y Mayor Low opened the floor for discussion: Alderman Schaefer commented the request makes sense. Alderman Condon added the use is appropriate during Fiesta Days. Alderman Glab noted the sign will have low impact. AWARD OF BID TO SHORELINE CREATIONS, WONDER LAKE, IL IN THE AMOUNT OF $12,200 FOR BOARDWALK/PIER DEMOLITION AND REMOVAL AT 1202 NORTH RIVERSIDE DRIVE Deputy City Administrator Hobson reported on May 6, 2013, the City Council authorized staff to advertise for bids for demolition and removal of the boardwalk, decking, and pier structures on the former Dobyn's House property located at 1202 North Riverside Drive. Staff prepared specifications to meet all public requirements and to attain the best possible price for the project. Bids were opened June 25`h with Shoreline Creations of Wonder Lake, IL as the apparent low bidder at $12,200. J. Schaefer made a motion, second by V. Santi to approve the award of bid to Shoreline Creations, Wonder Lake, IL in the amount of $12,200 for Boardwalk/Pier Demolition and Removal at 1202 N. Riverside Drive. Mayor Low opened the floor for discussion: Alderman Schaefer asked if the project was budgeted through the Riverwalk Foundation. Deputy City Administrator Hobson answered project funding was obtained from TIF funds and the project cost was calculated into the total cost to purchase the property, which at that time was estimated at $20,000. Deputy City Administrator Hobson further stated piers and shore stations in usable condition will be salvaged. Alderman Wimmer asked when work will begin and Deputy City Administrator Hobson said as soon as possible adding the project should be completed in 2 to 2-1/2 weeks. Alderman Santi inquired about the fence; Deputy City Administrator Hobson said it will be removed when the project is completed. REQUEST FOR CLASS H LIQUOR LICENSE FROM STELLA'S MCHENRY PLAZA LLC d/b/a STELLA'S PLACE AND ORDINANCE INCREASING NUMBER OF CLASS H LIQUOR LICENSE IN EFFECT FORM THREE TO FOUR. Mayor Low acknowledged the presence of Mr. Gary Leff and Ms. Charity Johns representing Laredo Hospitality, parent company of Stella's — McHenry Plaza, LLC who submitted a liquor license application to the city. Stella's McHenry Plaza LLC is seeping a Class H license to sell beer and wine at tables in conjunction with a cafe at 1720 N. Richmond Road in the McHenry Plaza shopping center. Stella's Place is marketed as a cafe for adults over 21 years of age to enjoy breakfast, lunch, or dinner along with video gaming. Mayor Low said in her opinion, although video gaming is included in the proposal, this business is unique as it is a restaurant, not just a video gaming cafe. She noted the menu offers a variety of food, the business will be tastefully decorated, and she has no concerns with this request. R. Wimmer made a motion, seconded by J. Schaefer to approve a request for a) Class H liquor license from Stella's McHemy Plaza LLC d/b/a Stella's Place conditioned upon a satisfactory fingerprint report and all employees involved in the sale and service of alcohol obtain BASSET certification condition; and, b) ordinance increasing the number of Class H liquor license in effect from three to four. Mayor Low opened the floor for discussion: Alderman Wimmer said the business plan is unique and he has no concerns with the request. Alderman Petersen asked where the business will be located. Deputy City Administrator Martin said the exact location is in the retail center on the south side of McHenry Plaza between McHenry Liquors and Harris Bank; Applebee's Restaurant is also nearby. Alderman Condon agreed the business plan is unique. Alderman Santi asked about the size of the business area; Mr. Neff answered approximately 1700 square feet. Alderman Glab asked about the size of the kitchen. Ms. Johns said the area where meals will be prepared is behind the counter. There will be no frying. A Turbo Chef Convection Oven will be purchased for the restaurant at a cost between $7-9,000. These types of ovens are not microwave ovens however they cook food quickly and cleanly. Alderman Glab noted it sounds like a snack bar. Mr. Neff said the menu is not prep intensive and they will outsource a fair amount of food, but the pizzas, egg omelets, and sandwiches are all fresh and cooked to order. Aldennan Glab asked if the menu would survive on its own without video gaming. Mr. Neff said the business plan states this is a 21 and over adult cafe offering the ability for its customers to plug in a phone or an Wad while they play free games or enjoy video gaming. It is a place for adults to socialize and enjoy a cup of coffee, glass of wine, or a full meal, and this business is L not intended for families. McHenry City Council July 1, 2013 Page 12 of 13 Alderman Schafer said the business is different than past video gaming caf6 proposals and he has no concerns. Alderman Schafer asked when the business would be open. Mr. Neff said they will follow hours permitted in the liquor ordinance. Alderman Schaefer asked how many people Stella's Place will employ. Mr. Neff said they will have a staff of six to eight people with one to three per shift; depending on the level of demand they may employ more. Alderman Schafer asked where the video games will be installed. Mr. Neff said they will offer a premium gaining experience. All gaming will be in a specified area located in the back of the business. It will be separated with a screen and bookcase. Extra seating and ottomans will be provided with space to plug in a phone or Wad. Alderman Schaefer noted it does not sound like a place for people to hangout and drink all day. Alderman Blake said the idea is unique and he wished the applicants good luck. Alderman Wimmer asked when work will begin on the space. Mr. Neff said most likely at the end of the summer as it now takes about eight months to receive a gaming license from the State of Illinois. MAYOR STATEMENT AND REPORTS Mayor Low announced the next City Band Concert is scheduled for July 4t' at Veterans Memorial Park. Patriotic Night is the theme of the concert. Jaycees Day Fireworks celebration will be held at Petersen Park on Saturday, July 6'11. The park opens at 4:00 PM and the fireworks show will begin at dusk. Rain date is Sunday, July 7th The Mayor reminded everyone Fiesta Days begins July 12`, and concludes with the parade on July 21" adding she hoped everyone in the community will enjoy summertime in McHenry. Mayor Low reported City Administrator Morefield attended a meeting on her behalf, with State Rep. Jack Franks and IDOT Secretary Ann Schneider. At the meeting, City Administrator Morefield expressed McHen y's transportation needs and concerns. COMMITTEE REPORTS G. Condon stated the June 1 lt' Community Development Committee minutes have been approved. The CDC will meet again on July 9t'. STAFF REPORTS City Administrator Morefield said in response to inquiries from Aldermen and the community, the city will perform citywide mosquito abatement. The city currently treats standing water and annually provides mosquito control for special events. Last year it was not necessary to perform abatement citywide due to dry conditions. Although abatement is not included in the budget, staff is obtaining a quote from Clarke. City Administrator Morefield will advise the Council if and when a citywide application will be contracted and said staff will contact Nunda and McHenry Township and ask if they want to participate in the abatement. McHenry City Council July 1, 2013 Page 13 of 13 FUTURE AGENDA ITEMS Alderman Santi thanked staff for providing him with the Boardwalk/Pier Demolition bid documentation. Alderman Glab suggested the city host additional information meetings and invite business owner to review plans for the IDOT's Route 31/Route 120 project. Director of Public Works Schmitt noted two public hearings have been held and business owners affected by the project were invited. At each hearing, attendance was low. Also, the city mailed over 100 invitations to business owners inviting them to a Public Works Committee meeting when the project was on the agenda and only five attended the meeting.
