HomeMy WebLinkAboutMinutes - 05/20/2013 - City CouncilREGULAR MEETING May 20, 2013 Guest Mayor Archietta called the regularly scheduled May 20, 2013 meeting of the McHenry City Council to order at 7:30 p.m. In attendance were the following Aldermen: Santi, Glab, Schaefer, Blake, Wimmer, Peterson and Condon. Absent: None. Also in attendance were City Administrator Morefield, Director of Public Works Schmitt, Chief of Police Jones, City Attorney McArdle and City Clerk Jones. Absent: Deputy City Administrator Martin and Deputy City Administrator Hobson. PLEDGE OF ALLEGIANCE — DANNY ARCHIETTA MONTINI SCHOOL Mayor Low introduced Guest Mayor, Danny Archietta, of Montini School. Mayor Low announced that Danny is a 3rd grader at Montini School and he won the opportunity to visit Council and open the meeting as Guest Mayor. Guest Mayor Archietta led the Council and those in attendance in the Pledge of Allegiance and turned the meeting over the Mayor Low. RECOGNITION: CHARACTER COUNTS! Mayor Low introduced Alderman Condon, President of the Character Counts! Coalition. Alderman Condon presented awards to the following members of Gigi's Playhouse for outstanding character: • Michelle; • Chris; • Kathy; • Don; • Rusty; and • Michelle. Alderman Condon stated that Gigi's Playhouse was established in the City of McHenry in 2008 and Chris's daughter, Rebecca, has Down Syndrome and a number of medical issues. Gigi's Playhouse provides an environment enjoyable to persons with disabilities to socialize and interact. Creating this type of environment in the City of McHenry and volunteering at the venue embodies the six pillars of character indicative of citizens of character. REQUEST FOR WAIVER/REDUCTION OF FEES FROM HABITAT FOR HUMANITY TO CONSTRUCT A SINGLE-FAMILY HOME AT 1601 HILLSIDE LANE IN THE LINCOLN HILLS SUBDIVISION. City Administrator Morefield reiterated to Council that at the June 4, 2012 and September 24, 2012 Council meetings, in response to requests for fee waiver/reduction from Habitat to Humanity, fees for park donations, water and sewer tap on fees, plumbing inspection, water meter, building and annexation fees were waived. A request has been submitted for waiver/reduction of those same fees to construct a new single-family home located at 1601 Hillside Lane, McHenry, Illinois. City Administrator Morefield stated a total of $23,417.75 in fees is required to construct a new 1,135 square foot, three bedroom single-family home at 1601 Hillside Lane. Of the $23,417.75 total fees, $7,468.75 is for park donations, water and sewer tap, plumbing inspection, water meter, building and annexation fees. The remainder of the fees is allocated to the water and sewer capital development fund, as well as other taxing bodies. Habitat for Humanity is a reputable organization whose goal is to provide affordable quality housing for citizens who otherwise would likely never have the opportunity to own a home. Habitat does not profit for the construction of homes and relies heavily on donated materials and volunteers to construct a dwelling. Regular Meeting Page 5 May 20, 2013 Staff has always maintained a quality professional relationship with Habitat for Humanity, which is the only certified Community Housing Development Organization (CHDO) in McHenry County. This designation allows them to leverage additional funding through the United States Department of Housing and Urban Development. Staff supports the waiver of a portion of the permit fees previously outlined. Responding to Alderman Wimmer's inquiry regarding whether additional houses are planned in the City, City Administrator Morefield stated that he is unaware of additional houses planned in the City limits of McHenry. Alderman Condon stated it is important for the City to support this type and caliber of organization. Alderman Santi stated he is in favor of waiving the fees but has concerns regarding the planned location. Alderman Glab opined that consideration should be given to renovating distressed and foreclosed properties, rather than building new ones. He indicated he would support the motion tonight but would like to look at the structure of waiver of fees at a future Committee meeting. Responding to an inquiry from Alderman Schaefer regarding whether other taxing districts have waived fees, City Administrator Morefield advised that other taxing districts have waived 100% of their fees. He noted that Capital Development fees are not being waived by the City of McHenry. Alderman Blake concurred with Alderman Condon. He stated he would be interested in further discussions at the Committee level regarding the waiver of fees. Motion by Wimmer, seconded by Condon, approving the applicant's request to waive/reduce fees payable directly to the City of McHenry, for construction of a new Habitat for Humanity home at 1601 Hillside Lane in the Lincoln Hills Subdivision, in the amount of $7,468.75, for the following: • Park donation; • Water and sewer tap; • Plumbing inspection; • Water meter; • Building; and • Annexation; Regular Meeting Page 6 May 20, 2013 as well as authorize to reduce/waive fees due to other taxing districts, subject to receiving written approval from each taxing district. REQUEST FOR A TEMPORARY USE PERMIT FROM JEWEL/OSCO LOCATED AT 4222 WEST ELM STREET TO ALLOW AN OUTSIDE GARDEN DISPLAY UNTIL SEPTEMBER 30 2013 City Administrator Morefield informed Council that Jewel/Osco is requesting permission for an outside garden display, which is located under a canopy on the sidewalk along the west side of the front fagade of the building. The request is for the display to be out until September 30, 2013. The Zoning Ordinance only permits the outside display and sale of landscaping materials for 120 days, and Jewel/Osco is requesting permission to have their outside garden center display for approximately 165 days. Staff has no issue with the request. Jewel/Osco has presented this seasonal display for several years. Alderman Condon opined that a nice display has always been presented by Jewel/Osco Alderman Santi concurred. City Administrator Morefield noted that Deputy City Administrator Martin will be contacting a representative of Jewel/Osco in February suggesting that Jewel/Osco might want to approach Council with their application early. Motion by Peterson, seconded by Blake, approving the request by Jewel/Osco, located at 4222 West Elm Street, McHenry, Illinois for a temporary use permit to allow for an outside garden display on the west side of the front building fagade until September 30, 2013, as presented. REQUEST FOR EXTENSION OF EXISTING TEMPORARY USE PERMIT TO ALLOW A TATTOO PARLOR AT 2906 WEST ROUTE 120, MCHENRY, ILLINOIS UNTIL JULY 1, 2013. City Administrator Morefield reiterated to Council that on March 4, 2013 applicant received a temporary use permit to allow a tattoo parlor at 2906 Illinois Route 120, McHenry, Illinois, from March 5 through May 31, 2013. Applicant, Ryan Lanning, is requesting a one- Regular Meeting Page 7 May 20, 2013 month extension for the temporary use due to inclement weather and flooding that has affected his business. A tattoo parlor is not currently permitted or conditional use in any zoning district. Applicant understands he is required to obtain a use variance to allow the tattoo use on a permanent basis; however, he needs additional time prior to appearing before the Planning and Zoning Commission. Applicant anticipates filing for the June 13, 2013 Planning and Zoning Commission meeting. Staff has previously verified that applicant has obtained the appropriate state and county licensing for tattooing. Staff supports applicant's request for a one -month extension. Motion by Santi, seconded by Blake, approving the one -month extension for an existing temporary use permit, expiring July 1, 2013, to allow a tattoo parlor at 2906 Illinois Route 120, McHenry, Illinois. ORDINANCE AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT TO BE PART OF THE NORTHERN ILLINOIS GOVERNMENTAL ENERGY COOPERATIVE (NIGEC). City Administrator Morefield informed Council that in 2006 the City of McHenry entered into an Intergovernmental Agreement, including several governmental agencies, which collectively formed the Northern Illinois Governmental Energy Cooperative ("NIGEC"), for purchasing electricity for street lighting, water and wastewater needs. The purpose of NIGEC is to negotiate the economical purchase of power supplied and other goods and services. Following the expiration of the 2006 Agreement the City of McHenry entered into a new five- year Intergovernmental Agreement for the purpose of purchasing electric power as a part of NIGEC. That Agreement expired in January of this year. The Agreement authorizes the City's continued participation in NIGEC, comprised of eleven governmental entities in McHenry, Kane and DeKalb counties. NIGEC will be soliciting proposals for a consultant to assist the consortium in the selection of cost -competitive energy supply contracts. Member communities participating in NIGEC will collaboratively pursue the joint purchase of electricity and natural gas for municipal needs utilizing economies of scale. The Agreement outlines the duties of the cooperative and appointment of one representative from each community who will act as the government's voting representative. Each member community is allowed one vote and a majority vote of the affected members is ___ required to enter into any power agreement. Approving the Agreement authorizes Staff to act Regular Meeting Page 8 May 20, 2013 as a voting member and permits the consortium to accept a winning bidder and for Staff to sign an energy supply contract. Responding to Alderman Schaefer's inquiry regarding a leading municipality, City Administrator Morefield stated that the McHenry County Council of Governments ("MCCOG") is the leading entity. Responding to Alderman Wimmer's inquiry regarding the risk of going this far out regarding a rate, City Administrator Morefield noted that Deputy City Administrator Martin and Anna in MCCOG are both knowledgeable about the program. The program has been going on for some time and members continue to join, which lends credibility. Alderman Condon inquired if the services relate to municipal services only, City Administrator Morefield responded affirmatively. Motion by Schaefer, seconded by Wimmer, approving the Ordinance authorizing the execution of the Northern Illinois Governmental Energy Cooperative ("NIGEC") 2013 Intergovernmental Agreement for the Purchase of Electricity and Other Goods and Services. Voting Aye: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. MAYOR STATEMENT AND REPORT AND PLANNING AND ZONING APPOINTMENT Mayor Low recommended the appointment of Michael Sobotta for a one year term on the Planning and Zoning Commission, expiring on April 30 2014. Mayor Low stated Mr. Sobotta would be filling a vacancy left by the recent resignation of Neal Schepler who was recently elected to the Township Board. Motion by Wimmer, seconded by Blake, approving the appointment of Michael Sobotta for a one year term on the Planning and Zoning Commission, expiring on April 30, 2014. Voting Aye: Santi, Glab, Schaefer, Blake, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. Mayor Low acknowledged that next Monday, May 27, 2013, is Memorial Day. She stated that a commemorative ceremony would take place in Veteran's Park beginning at 10:00 am. Regular Meeting Page 9 May 20, 2013 Mayor Low announced that the next concert in Veteran's Park would present the Martin Lopez Academy Violinists on Thursday, May 23, 2014, beginning at 7:00 pm. FUTURE AGENDA ITEMS Alderman Schaefer opined that the preliminary concerts at Veteran's Park have been well attended.
