The Regular Meeting of the McHenry City Council was called to order Council by Mayor Stanek on Monday, December 19, 1983 at 8:00 p.m. in city hall. At Mtgs. roll call the following aldermen were present: Serritella, Snell, Smith, Attendance McClatchey, Datz, Busse. Bolger arrived at 8:30 P.M. Absent: Nolan. City staff -in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Police Chief Pasenelli, Park Director Merkel. Motion by Datz, seconded by McClatchey, to accept the minutes of the December 5, 1983 meeting as presented. Voting Aye: Serritella, Snell, Smith, McClatchey, Datz, Busse. Voting Nay: None. Absent: Nolan, Bolger. Motion carried. Park Director Merkel presented awards from the Illinois Park and Recreation Association to Robert Swartzloff representing the McHenry Awards Rotary Club and Ronald Bierman and Raymond Low representing the McHenry Lions Club. The community services awards are presented to organizations who contribute to parks and recreation activities in their own communities. On behalf of the citizens of McHenry, the City Council expressed gratitude to the two organizations for the outstanding job they have done in the community over the years in providing park shelters and donating funds to- ward development of park facilities. Donald Gerstad, President of Residential Development Group, Annexations addressed the Council concerning a request for a two year extension of the Annexation Fee due on the Winding Creek Planned Unit Development in the amount of $25,000.00 plus $5,250.00 interest which was due under the Backhous Farm - Winding Creek Annexation Agreement. Motion by Smith, seconded by Snell, to grant a one year extension Annexa- on the $25,000.00 principal but require that the interest payment of $5,250.00 tions & be paid immediately. Failed Voting Aye: McClatchey, Smith, Snell, Serritella. Motion Voting Nay: Busse, Datz, Stanek. Absent: Bolger, Nolan. Motion did not carry. Motion by Serritella, seconded by Busse, to require payment of Annexation one-half of the principal in the amount of $12,500.00 and all of the interest Failed in the amount of $5,250.00 be paid by December 31, 1983 and the bal- Motion ance of the principal in the amount of $12,500.00 be granted a one year extension -to be paid in full by December 31, 1984. Voting Aye: Busse, Datz, Serritella, Stanek. Voting Nay: McClatchey, Smith, Snell. Absent: Bolger, Nolan. Motion did not carry. Motion by McClatchey, to table the request of RDG until the next Annexation meeting. Motion failed for lack of a second. Failed Motion Alderman Bolger arrived at 8:30 P.M. Motion by Smith, seconded by Snell, to require Residential Annexation Development Group to pay one-half of the principal in the amount of $12,500.00 and one-half of the interest in the amount of $2,625.00 before December 31, 1983 and to grant an 18 month extension for the remainder of the principal and the remainder of the interest with an interest rate on both balances of 10 percent perannum with payment in full to be made by June 30, 1985. Voting Aye: Serritella, Snell, Smith, Datz, Busse. Voting Nay: McClatchey, Bolger. Absent: Nolan. Motion carried. Monday, December 19, 1983 Page 2 Annexation Motion by Smith, seconded by Datz, to pass an ordinance annex- ing Lots 99, 100 and 101 in the Golf Course Subdivision owned by Edward Szamocki. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Parks, Auth. Motion by Busse, seconded by Datz, to approve the 1984 picnic Picnics permit reservation and deposit fee schedule as recommended by the Park jRegulations Committee. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Street Maint. & Motion by Snell, seconded by Bolger, to authorize and approve Repair the payment of $84,587.96 to Liberty Asphalt for the 1983 Summer Street Maintenance Proqram. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Bond Pymts. Motion by Busse, seconded by Snell, to authorize and approve payment to Home State Bank of Crystal Lake for the principal and interest payment due on the 1966 Storm Sewer Bond issue as follows: Principal $5,000.00, interest $578.15, paying agent fees $35.00 for a total of $5,613.15. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Bond Pymts. Motion by Bolger, seconded by McClatchey, to authorize and approve payment to First National Bank of Chicago for the final payment due on the 1969 Sewer Improvement Bonds as follows: Principal $65,000.00, interest $1,950.00, paying agent fee $50, for a total of $67,000.00. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Bull Valley Rd. Motion by Smith, seconded by Datz, to authorize and approve W/S Line payment to E.M. Melahn Construction Co., Inc. for the final payment Extension request on the Bull Valley Road water main and sanitary sewer extension in the amount of $34,521.43 as recommended by Baxter & Woodman. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Zoning Ord. Motion by Datz, seconded by Serritella, to concur with the recommendation of the Zoning Board of Appeals and pass an ordinance amending the City of McHenry Zoning Ordinance concerning paragraph C-5 of Article VIII. Motion carried. Mayor Stanek called for a recess at 9:11 P.M. The meeting reconvened at 9:22 P.M. with everyone still in attendance. Motion by Serritella, seconded by Snell, to authorize and approve the installation of three poles on Industrial Drive to provide for the installa- tion of a street light at the corner of Oak and Orleans with a cost of $22.82 per month for maintenance of the light and with the stipulation that when the title is cleared for the property the cost will be recaptured from the owners of the Industrial property along Orleans. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. A proposal from Iry Coppell of Hillcrest Apartments to extend the water main along McCullom Lake Road was referred to the Water and Sewer Committee for future recommendation. Discussion was held on the development of the proposed pond in Knox Park. It was the concensus of opinion that the price proposals should be obtained rather than going to bid with the work to be done between June 15 and July 15, 1984. Motion by Busse, seconded by Datz, to notify the Illinois Department of Labor that effective January 1, 1984 the City of McHenry will use the reimbursement method for payment of Unemployment Insurance costs. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Busse, seconded by Datz, to engage the Automatic Data Firm known as ADP to manage the City's Unemployment Insurance Compensation program effective January 1, 1984. Voting Aye: McClatchey, Smith, Shell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent:- Nolan. Motion carried. Street Maint . & Repair Committees, Auth. Instructions' Knox Park Development' Employees Employees Motion by Busse, seconded by Bolger, to engage the Firm of Robert F. White & Co. to process the City of McHenry payroll effective January 1, 1984. Employees Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Motion by McClatchey, seconded by Smith, to approve the revised rules Parks, Auth. and regulations for the City of McHenry Department of Parks & Recreation as Picnic, Reg. presented and amended. Motion by Snell, seconded by Busse, to authorize and approve the Purchases recommendation of the Purchasing Committee to purchase two additional filing Police Dept. cabinets and a typewriter for the Police Department. Letter of Motion by Busse, seconded by Datz, to authorize the calling of Credit a set aside letter from RDG for $2,000.00 in connection with the Whispering Point Condo development if a replacement set aside letter is not received before December 31, 1983. Voting Aye: McClatchey, Smith, Snell, Serritella, Busse, Datz, Bolger. Voting Nay: None. Absent: Nolan. Motion carried. Committees- Chairman Serritella of the License Committee announced that a Auth, Instrct. meeting would be held of that committee to study the request of McHenry Woodstock Disposal for an increase in disposal fees. The Street and Sidewalk Committee was instructed to consider a suggestion that -the No Right Turn sign at the northwest corner of Green and Elm Street be restored. C & NW The City Clerk was instructed to contact the Chicago Northwestern Trans. Co. train depot about the problem of commuter train traffic which triggers the railroad traffic signals causing a backup on the state highway. Motion by Smith, seconded by McClatchey, to adjourn.
