HomeMy WebLinkAboutMinutes - 12/17/1990 - City CouncilREGULAR AND SPECIAL MEETING DECEMBER 17, 1990 The Regular and Special Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, December 17, 1990 at 7:30 P.M. in City Hall. At roll call the following Aldermen were present: Bolger, Donahue, Teta, Smith, McClatchey. Lieder and Patterson arrived at 7:55 P.M. Absent: Serritella. City Staff in attendance were Clerk Gilpin, City Administrator Peterson, Chief Joyce, Director of Public Works Batt, Building and Zoning Officer Halik, Parks and Recreation Director Merkel. Absent: City Attorney: Narusis. Other persons in attendance were James Althoff, President of the McHenry Township Fire Protection District; John Cunat of Cunat Brothers; Roger Gerstad of Gerstad Builders% Chris Cardomone, Chairman of the Chamber of Commerce Retail Committee; Dr. Robert Cassidy, Superintendant of School District 15; Superintendant Robert Swartzloff of School District 156; Bertha Bladen and Jerry Benes. No one signed up to speak during the ten minute public input session. Motion by Smith, seconded by Donahue, to approve the Consent Agenda as follows: - Approve partial payment to Seagren/Shales for the South Wastewater Treatment Plant in the amount of $59,811.00; - Approve final payment to the Illinois Constructor's Corporation in the amount of $13,861.15, for the Central Wastewater Treatment Plant Seawall replacement; - Authorize bid advertisement for one four-wheel drive pick-up for Wastewater Division on the condition that we purchase the pick-up truck without a radio if the radio is not considered standard equipment; - Authorize and approve payment of the November Bills as presented; - Approve the November Treasurer's Report as presented; - Approve the November Budget Report as presented; Voting Aye: Bolger, Donahue, Teta, Smith, McClatchey. Voting May: None. Absent: Lieder, Patterson, Serritella. Motion carried. Motion by Teta, seconded by McClatchey, to accept the bid from Charles Equipment Company in the amount of $24,668.00 for a portable generator to be installed at the South Riverside Sanitary Sewer Liftstation as presented. Voting Aye: Bolger, Donahue, Teta, Smith, McClatchey. Voting Nay: None. Absent: Lieder, Patterson, Serritella. Motion carried. Motion by Smith, seconded by Bolger, to concur in the recommendation of the Director of Public Works and the City Engineer to approve the relocation of the storm sewer to the center line of Prime Parkway from Miller Parkway eastward to Lot 61 of the subdivision, and that the installation be done as recommended in the letters from City Engineer Carl Moon, dated December 4 and December 11, 1990. Voting Aye: Bolger, Voting Nay: None. Absent: Lieder, Motion carried. Donahue, Teta, Smith, McClatchey. Patterson, Serritella. The purpose for calling the Special Meeting was to discuss Capital Development Fees for water and sewer and to discuss Developer Donation Fees for schools, library, parks and fire district. Mayor Busse summarized the discussion on Capital Development Fees by saying that the staff should come back with some hard numbers on what the population equivalent (P.E.) is for residential and non-residential use and also on some type of scale or number -equivalent based on diameter of pipes for water hookups. The Council also felt the existing fee structure, connection fees and permit fees should be reviewed. In addition, at was recommended that the commercial and industrial rates be reviewed since they had not been changed since 1970. Monday, December 17, 1990 Page 2 The next matter discussed was Developer Donation Fees. Attorney Narusis said that according to case law, a flat rate was arbitrary and discriminatory, and in order to justify Developer Donation Fees there has to be some requirements in order for the courts to sustain those fees. The cost must meet a uniquely and attributable test. A report submitted by Donald Meyers of Granite Builders at the last Developer Donation meeting was reviewed page by page. Mayor Busse called for a recess at 9:30 P.M. The meeting reconvened at 9:42 P.M. with everyone still in attendance. Motion by Bolger, seconded by Patterson, that the McHenry Township Fire Protection District be included in the Developer Donation Fee contribution schedule, but not to establish that fee tonight. Voting Aye: Bolger, Donahue, McClatchey. Voting Nay: None. Absent: Serritella. Motion carried. Lieder, Teta, Smith, Patterson, Alderman Lieder suggested that the City come up with a formula that can be used annually so the Council does not have to be pressured every year to spend a lot of time developing new formulas. With a set formula, developers would know what their costs for developer donation fees would be ahead of time and the schools would know how much money they would be getting. The Council agreed that a fair formula should be developed and adopted. Motion by Donahue, seconded by Smith, to change the Council meeting days in 1991 from Wednesdays to Mondays, effective February 1, 1991. Voting Aye: Bolger, Donahue, Smith. Voting Nay: Teta, Lieder, McClatchey, Patterson. Absent: Serritella. Motion did not carry. Motion by Patterson, seconded by McClatchey, to pass a resolution setting the Council meeting days in 1991 on Wednesdays. Voting Aye: Patterson, McClatchey, Lieder, Teta, Busse. Voting Nay: Smith, Donahue, Bolger. Absent: Serritella. Motion carried. Motion by Smith, seconded by McClatchey to adjourn. Voting Aye: Bolger, Lieder, Donahue, Smith, Teta, McClatchey,Patterson. Voting Nay: None. Absent: Serritella. Motion carried.
