The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek on December 17, 1984 at 7:30 P.M. in city hall. At roll call the following Aldermen were present: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella, Smith. Absent: None. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Joyce, Park Director Merkel. Motion by Nolan, seconded by Snell, to accept the minutes of the December 10, 1984 Regular Meeting as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Attorney Donald Truckenbrod addressed the Council concerning a Zoning Board recommendation regarding the Stilling/Adams/Mathews Zoning Petition. Richard Golbeck and Frank Gregory, objectors to the proposed zoning change, also addressed the Council. Motion by McClatchey, seconded by Bolger, to concur with the Zoning Board of Appeals recommendation and pass an ordinance reclas- sifying the Adams property to.,B-1 with a variation to permit use for an automobile repair shop. Voting Aye: Bolger, Busse, Datz, McClatchey, Smith, Snell, Serritella. Voting Nay: Nolan. Absent: None. Motion carried. Motion by Smith, to pass an ordinance permitting a B-1 clas- sification with a variation to permit use for an automobile repair shop to the Stilling/Mathews property. Motion failed for lack of second. Motion by Datz to grant a B-1 zoning classification to the Stilling/Mathews property. Mayor Stanek called for a recess at 7:55 P.M. The meeting reconvened at 8:07 P.M. with everyone still in attendance. Discussion continued on Datz's motion to grant B-1 zoning classification to the Stilling/Mathews property.' ' Motion by Nolan, seconded by Bolger, to table Datz's motion granting a B-1 zoning classification. Attorney Narusis checked the Roberts Rules of Orders and reported that since there was no second to Datz's motion it could not be tabled. Nolan withdrew her motion, Bolger withdrew his second to table -the motion, and Datz withdrew his motion to grant the B-1 zoning classification. Motion by Nolan, seconded by Serritella, to take no action on the Zoning Board Recommendation on the Stilling/Mathews property at this time. Voting Aye: Bolger, Busse, Nolan, Smith, Serritella. Matters Motion by Smith, seconded by Bolger, to place the zoning board recommendation regarding the Stilling/Mathews property on the next Regular Meeting agenda. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Don Gerstad, president of Residental Development Group, addressed the Council concerning a request to release a set -a -side letter of credit on Whispering Point Commercial Center at the December 3rd Council Meeting, a motion was made to call the Set -A -Side letter for $2,000.00. Gerstad presented further information to the Council concerning the matter. _etters of Motion by Smith, seconded by Nolan, authorizing the City not .redit to call the $2,000.00 set -a -side letter of credit from RDG on the Whispering Point Condo Center property. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. John Dailey, president of a Chicago Bank, and Steve Kroll, an associate with Chapman & Cutler, addressed the Council concerning the Industrial Revenue Bond Ordinance for NIMED Corporation in connection with construction of the professional arts building. Attorney Narusis reported that everything was in order. Resolutions Motion by McClatchey, seconded by Nolan, to pass a resolu- tion authorizing the issuance and sale of an Economic Development Ind. Rev. Revenue Bond (NIMED Corporation Project) in the principal amount of Bonds $2,000,000.00 to finance an economic development project for NIMED Corporation. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Park Director Merkel reported that he had received price quotes for the purchase of a gas stove for the Lakeland Park Community Center as follows: Carey Appliance $369.00, Lee & Ray Electric $298.00. He also received price quotes for installation of mirrors for the Dance Program at Parkland Junior High as follows: McHenry County Glass & Mirror $1,740.00, Jeff's Glass & Mirror $952.27. Purchases Motion by Nolan, seconded by Snell, to authorize and approve Park Dept. the purchase of a gas stove from Lee & Ray Electric at the low price quote of $298.00 and the purchase of mirrors for the Dance Programs at the low bid price of $952.27 from Jeff's Glass & Mirror of McHenry. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Parks Auth. Motion by Nolan, seconded by Datz, to authorize and approve Picnics the rules and regulations for the Lakeland Park Community Center as Requests recommended by the Park Department and presented to the Council. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Busse, seconded by Serritella, to accept the November Treasurer's Report as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by McClatchey, to accept the November Clerk's Report as presented. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Bolger, to confirm the Mayor's appointment of Ray Jemiola of 3216 Fairway Drive, McHenry to the Police Commission Board to fill the unexpired term of Anthony Pintozzi who resigned from the board at the last meeting. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Appointments officials, etc Police Comm. Owner of the McHenry Depot Hotel addressed the Council con- Committees- cerning parking problems on Main Street and in that vicinity. Mayor Auth. Instruct Stanek asked Alderman Bolger and the Street & Sidewalk Committee to study the problem and return with a recommendation at a later time. Motion by Smith, seconded by Snell, to accept the final report of the Employee Appreciation Party as presented by Alderman Employees Bolger and authorize additional payment to Al Smith for $50.00 and the West Campus Chorus for $40.00 for entertainment expense at the Employee Appreciation Party. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Monday, December 17, 1984 Page 6 Bond Motion by Snell, seconded by Busse, to authorize and approve Payments payment to Home State Bank of Crystal Lake for principal and interest on the $95,000.00 Water Works Bond Issue as follows: Principal $10,000.00, Interest $462.52, Paying Agent fee $35.00, Total $10,497.52. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. Absent: None. Motion carried. Grants Motion by Nolan, seconded by Bolger, to authorize and Water approve payment to Illinois Hydraulic Construction Company for Dept. Partial Payment No. 2 in the amount of $34,777.37 as recommended by Imprvts. Baxter & Woodman with payment to be made from Water Tower Grant Funds. Voting Aye: Bolger, Busse, Datz, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: None. .Absent: None. Motion carried. Motion by Bolger, seconded by Serritella, to authorize the LP Water use of City Funds to make payment for closing costs of the purchase Company of the Lakeland Park Water Company if it is necessary subject to reim bursement out of revenue bond proceeds when they are received.
