DECEMBER 16, 1991
The Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Monday, December 16, 1991 at 8:00 P,M, in the McHenry
Municipal Center Council Chambers. At roll call the following Aldermen
were present: Bolger, Donahue, Locke, Smith, Adams, Serritella.
Patterson arrived at 8:05 P.M. Lieder arrived at 8:15 P.M. Absent:
None. City Staff in attendance: City Clerk Gilpin, City Attorney
Narusis, City Administrator Peterson, Director of Public Works Batt,
Director of Building and Zoning Halik, Director of Parks and Recreation
Merkel, Chief of Police Joyce. Absent: None.
Mayor Busse called to order a Public Hearing for the purpose of
discussing the proposed 1991-92 Property Tax Levy. Mayor Busse asked if
any oral or written comments had been received by the City Clerk's
office. City Clerk Gilpin replied that no oral or written comments had
been presented to her office. Mayor Busse asked if anyone in the
audience wished to speak on the proposed tax levy ordinance. City
Administrator Peterson reported that the 1990 Tax Levy passed by the City
Council represented a rate of .70 per $100 in Equalized Assessed
Valuation. The rate proposed for the 1991 levy in the amount of
$1,481,675.00 would also result in a .70 per $100 in Equalized Assessed
Valuation rate. There being no discussion from the audience, Mayor Busse
adjourned the public hearing at 8:07 P.M.
Motion by Smith, seconded by Serritella, to pass the annual Tax Levy
Ordinance of the City of McHenry for the fiscal year beginning May 1,
1991 and ending April 30, 1992 in the amount of $1,481,675.00.

Absent: Lieder.

No one signed up for the Ten Minute Public Input Session.
Motion by Bolger, seconded by Donahue, to approve the Consent Agenda
as follows:
- Approve December 4, 1991 Regular City Council Meeting Minutes;
- Approve the Tuition Reimbursement Request of Susan Christensen
for $100.00 towards a "Principles of Finance" course;
- Approve the Tuition Reimbursement request of Lt. Gary Wigman for
$258.00 for a "Management Crisis Intervention" course;
- Award the Bid for a Water Division cargo van to the low bidder,
Gary Lang Chevrolet of McHenry in the amount of $13,683.07;
- Approve a reduction in the letter of credit for McHenry Corporate
Center, Unit 2 from its present value of t1.411,205.60 to
$53,453.75, said reduction subject to the City's receipt of as -
built plan and the receipt of an open-end guarantee bond in the
amount of $217,240.30 warrantying the materials and workmanship of
the completed work as recommended by Baxter & Woodman;
- Approve the November Treasurer's Report as presented;
- Approve the November Budget Report as presented;
- Approve payment of the November Bills as follows:

Aldermen Lieder arrived at 8:15 P.M.
DONATION OF PARKLAND BY ALTHOFF
James L. Althoff presented the deeds and the deed releases for both
parcels of property which he has donated to the City of McHenry in memory
of his father, said property being located in back of the Brake Parts
building on Industrial Drive and along Boone Creek. Mayor Busse accepted
the property on behalf on the City of McHenry and its citizens and
thanked Althoff for his generous donation.
ZONING BOARD CHAIRMAN APPOINTMENT
Mayor Busse announced his appointment of Harry Semrow as Chairman of
the Zoning Board of Appeals. Semrow has been on the Board since 1982.
He will replace James Fouse, former Chairman of the Board. Vice -Chairman
of the Zoning Board will be Donna Tobeck.
Motion by Patterson, seconded by Adams, to approve the Mayor's
appointment of Harry Semrow as Chairman of the Zoning Board of Appeals
with his term to expire April 30, 1996.

TIME EXTENSION FOR WOODED RIDGE SUBDIVISION IMPROVEMENTS
Motion by Bolger, seconded by Patterson, to approve an extension to
Ronald Bykowski for completion of improvements in Wooded Ridge
Subdivision by granting him a 180 day extension from December 16, 1991 .

ILLLINOIS BELL TELEPHONE FRANCHISE AGREEMENT
A new Illinois Bell Telephone Franchise Agreement has been negotiated
between Illinois Bell Telephone and the Illinois Municipal League on
behalf of municipalities in Illinois . It would increase the fee for
access lines from .320 to .380 per line. The Director of Public Works
and City Administrator requested that a letter be sent with the Franchise
Agreement asking Illinois Bell to clarify certain language in the
agreement.
Motion by Bolger, seconded by Smith, to pass an ordinance approving
the Illinois Bell Telephone Franchise Agreement as presented with a
request that Illinois Bell furnish the City with a letter of
clarification on some of the language in the agreement.

1992 DIAL -A -RIDE LOCAL SHARE AGREEMENT
Through a local share agreement, the City has participated in the
curb -to -curb Dial -A -Ride program in cooperation with PACE since October
1987. This program has been very successful in the City. The 1991
Dial -A -Ride costs to the Council were $32,638.38 in 1991. The costs for
the 1992 program would be $32,305.88.
Motion by Adams, seconded by Patterson, to enter into an agreement
with PACE for the 1992 Dial -A -Ride program and approve the 1992 local
share in the amount of $32,305.88.

FOX VIEW HIGHLANDS PUBLIC HEARING
Mayor Busse called to order a Public Hearing on the Foxview Highlands
proposed annexation hearing at 8:40 P.M. In attendance were Developer
Joseph Dieschbourg of Midwest Horizon Builders, his attorney John Roth
and Cheryl Barone, Court Reporter.
The hearing was called for the purpose of considering the annexation
and preliminary plat of the Foxview Highlands subdivision. Five people
signed up to speak during the Public Input Session of the public
hearing. The first to speak was Richard A. Knoppel of 25070 Ivy Lane,
Hawthorn Woods. He spoke as a character witness for developer Joseph
Dieschbourg. He reported on his excellent experience in working with Mr.
Dieschbourg, who built his home.
Next to speak was Christine Lawson of 1213 Capri Terrace, McHenry
Shores, who represented a group of objectors to development of the
subdivision. She read a letter into the record which objected to
development and listed numerous complaints against Dieschbourg by people
who were living in homes built by him in McHenry Shores subdivision. She
also presented a list of zoning violations that she alleged were made by
the Building and Zoning Department against Midwest Horizon Builders
Hanes.
Third to speak was Wayne Hajzl of 802 Grand, Wauconda. He spoke as a
witness for Dieschbourg and was satisfied with the work that Dieschbourg
had done on his home. Ed Ligeza of 1210 Capri Terrace, McHenry Shores,
signed up to speak, but said Mrs. Lawson was speaking in his behalf.
Another man who signed up, Gene Wetzel of 1202 Carey, McHenry Shores, did
not speak as he had left the meeting prior to the Public Hearing session.

The proposed Foxview Highlands Subdivision is located outside the
City limits, south of McHenry Shores, along Pleasant View Drive. The
proposed developer of this 14.19 acre site is Joseph Dieschbourg of
Midwest Horizon Builders. The property is proposed for an RS-2 zoning
classification with 38 lots averaging 13,105 square feet, and providing
1.37 acres of stormwater detention. Lot sizes would range from 10,920
square feet to 21,324 square feet. A significant wetlands area is
located just east of the proposed annexation and subdivision. Lots 29,
30, 31, 33 and 34 contain wetlands and are not buildable without Army
Corps of Engineers approval. Dieschbourg is seeking approval to connect
to the McHenry Shores water system. The City staff believes this
property should be serviced by the City water system. Attorney John
Roth, representing Dieschbourg, addressed the Council and said the two
main issues according to him were 1) connection to the City water system,
and 2) the undeclared wetlands which would have to be determined by the
Army Corps of Engineers. Roth said they had an estimate of $300,000 to
bring the water line from the Municipal Center to the proposed
subdivision. He asked that the City get a statement from Baxter 3
Woodman as to the City's water capacity to handle this new subdivision
and serve it with water.
Alderman Patterson felt that the developer should correct the
problems that he has with the people in that area now before going
further with any other developments. Alderman Donahue felt more
information was needed and that the hearing should be recessed to a
Special Meeting when only this matter would be discussed. It was noted
that the Zoning Board of Appeals' recommendation was 3-1 with 3 members
absent at the time of voting.
Motion by Donahue, seconded by Adams, to recess the Foxview Highlands
Annexation Public Hearing to a Special Meeting date on Monday, January
20, 1992 at 8:00 P.M.

SPEED LIMIT REDUCTION ON CRYSTAL LAKE ROAD
Alderman Locke requested consideration to reduce the speed limit on
Crystal Lake Road near the Riverwood Elementary School from 45 to 35
M.P.H. Crystal Lake Road in this area is a County road. Correspondence
was presented from County Highway Superintendent James Rakow, stating
that based on the warrants required by the State, this roadway did not
meet the warrants for a reduction in the speed limit. Without traffic
study findings to the contrary, the speed limit would be retained at the
45 M.P.H. limit. Based on this information, no action was taken.
INTERGOVERNMENTAL AGREEMENT WITH MCHENRY TOWNSHIP HIGHNAY DEPARTMENT
Motion by Smith, seconded by Serritella, to enter into an
intergovernmental agreement with McHenry Township Highway Department for
snowplowing services and pavement striping, as in previous years.

Smith, Adams, Patterson, Serritella.

1991 MFT RECONSTRUCTION WORK IN WHISPERING OAKS
Additional reconstruction work was required on Chesterfield,
Cumberland, and Hampton Courts during the 1991 summer work program. The
work resulted in additional expense of $5,907.95.
Motion by Patterson, seconded by Serritella, to pass a supplemental
resolution for Motor Fuel Funds in the amount of $5,907.95 for additional
work on Chesterfield, Cumberland, and Hampton Courts.

POLICE DEPARTMENT OPERATIONS MANUAL
The Police Department has been preparing changes to their Operations
Manual for approximately 18 months. The review has been conducted with
the City Attorney and the use of guidelines established by the Commission
on Accredidation for Law Enforcement Agencies. The Chapter of the
Operations Manual entitled, "Regulations Manual" needs to be reviewed and
approved by the City Council.
Motion by Patterson, seconded by Donahue, to approve the Regulations
Manual and its regulations as presented.

Smith, Adams, Patterson, Serritella.

RESOLUTION FOR 1992 REGULAR CITY COUNCIL MEETINGS SCHEDULE
Motion by Donahue, seconded by Locke, to pass a resolution
establishing the 1992 Regular City Council Meetings for the calendar
year, as presented.
Voting Aye: Bolger, Donahue, Lieder, Locke,
Smith, Adams, Patterson, Serritella.
Voting Nay: None.
Absent: None.

MAYOR'S STATEMENT AND REPORTS
The Mayor received a letter from a citizen requesting that the City
consider establishing a pedestrian crossing from the north side of Route
120 to the south side of Route 120 near Sullivan Food Store. The
Director of Public Works was instructed to look into the matter.
The McHenry Area Youth Commission requested that the City put two
people from that commission onto the City payroll with full reimbursement
to be made by the Youth Commission. It was suggested that a one-year
trial basis be implemented. The matter will be presented for action at
the next Council meeting.
COMMITTEE REPORTS
Alderman Lieder reported that the Finance Committee had met at 10:00
A.M. on December 16, 1991, but no formal vote was taken on the Caruso
Revolving Loan Fund matter. Further information is being presented and
will be taken under consideration, with a recommendation to be made
later.
DEPARTMENT HEAD REPORTS
City Administrator Peterson reported that the McHenry County Court
Administrator had requested that an additional 10-foot platform be built
onto the judge's bench for the courtroom.
Motion by Adams, seconded by Smith, to approve the Court's request,
with the total cost to be paid by the Court and with approval of the
design to be made by the City Council prior to construction.

Director of Public Works Batt reported that Bill McCarron, developer
of Malibu Subdivision, had requested an extension of time to complete the
final asphalt coat on Malibu Trail. He also asked that his letter of
credit be reduced from $30,000 to $10,000.

Motion by Smith, seconded by Serritella, not to approve the request
for reduction of the Letter of Credit from $30,000 to $10,000; but that
he be given a reasonable amount of time to complete the final coat of
asphalt, with the determination on the extension of time to be made by
the Public Works Director.

City Clerk Gilpin reported she had received a request from the
McHenry State Bank to hook-up their fire alarm system to the City of
McHenry Police Alarm panel.
Motion by Donahue, seconded by Smith, to approve the McHenry State
Bank's request and authorize the fire alarm hook-up.

Mayor Busse called for a recess at 10:00 P.M. The meeting reconvened
at 10:15 P.M. with everyone still in attendance.
NEW BUSINESS
Alderman Serritella requested that the staff obtain cost figures on
what it would cost to get the City Council Chambers equipped with display
boards, maps or wallhangings so that presentations could be made in the
Council Chambers.
Alderman Locke announced that a Ward 2 meeting for constituents would
be held at 7:00 P.M. on January 16, 1992 in the Municipal Center Council
Room.
Aldermen Serritella and Patterson announced that a Ward 4 meeting
would be held sometime in April for their constituents.
EXECUTIVE SESSION
Motion by Smith, seconded by Adams, to go into Executive Session at
10:18 P.M. to discuss personnel.

of Joan E. Lunsmann of 5201 Home Avenue, as a Junior Records Clerk, at a
Grade 2, Minimum Step Salary of $16,442.00, effective January 6, 1992.
