Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, December 16, 1985 at 7:30 P.M. in city hall. Council At roll call the following Aldermen were present: Bolger, Lieder, Meetings- McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City Attendance staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel. Absent: Chief Joyce. Motion by Nolan, seconded by Serritella, to accept the minutes of the December 11, 1985 Regular Meeting as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Nolan, to accept the recom- mendation of the Zoning Board of Appeals and grant the request of James Althoff & Associates Inc. to reclassify property in question on Mill Street from R-3 single family district to R-4 multi -family district with the condition that the premises not be allowed ingress or egress from or onto Sioux Lane or Logan Street. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded variaton request of James Althoff in the density to provide for 64 question instead of 52.3 dwelling by the City Ordinance. by Teta, to defer action on the & Associates Inc. for an increase dwelling units on the property in units which are presently allowed Motion by Smith, seconded by Snell, to amend the original motion by adding "with a decision to be made on the variation request no later than January 29, 1986". Voting on the Amendment: Voting Aye: Bolger, Smith, Snell. Voting Nay: Nolan, Teta, Lieder, McClatchey, Serritella. Absent: None. Motion on the amendment did not pass. Voting on the original motion: Voting Aye: Bolger, Nolan, Smith, Snell. Voting Nay: Teta, Lieder, McClatchey, Serritella. There being a tie vote Mayor Busse cast a nay vote and declared the motion did not carry. Motion by Lieder, seconded by Serritella, to grant the variation request of J. Althoff & Associates Inc. to allow an increase in the number of dwelling units on the property in question from 52 to 64 dwelling units on the condition that one-half of the units be one bedroom apartments, one-half be two bedroom apartments and that 50 percent of the units have garages. Voting Aye: Bolger, Lieder, Smith, Snell, Serritella, Busse. Voting Nay: Nolan, Teta, McClatchey. Absent: None. Motion did not carry because the 2/3 vote required by Illinois Revised Statutes Chap. 24, Sec. 11-13-10 was not satisfied. Motion by Bolger, seconded by Nolan, to authorize and approve the transfer of a Class "A" liquor license from Elmer Steinsdoerfer, also known as Steiny's House of Prager, to Haberdasher Ltd. at 3421 W. Elm Street. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Zoning Ords. Ordinances Zoning Matters Failed Motions Liquor Control & Licenses Motion by Snell, seconded by McClatchey, to authorize and Water Dept. approve Partial Payment Request No. 5 to Dreissen Construction Improvements Company for Well No. 7 iron removal work in the amount of $29,725 as recommended by Baxter & Woodman. Motion by McClatchey, seconded by Snell, to concur in the Environ- Mayor's appointments of Donna Tobeck, Joseph Petrie and Donna mental Schaefer to the City of McHenry Environmental Advisory Committee with Advisory the terms to expire April 30, 1988. Ctte. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Bolger, to concur in the Mayor's appointments of Aldermen Nolan, Teta, McClatchey and Serritella to serve on the City of McHenry Environmental Advisory Committee and to appoint Nolan as Chairman of the Committee with terms to expire as follows: Nolan and Serritella April 30, 1988, McClatchey and Teta April 30, 1987. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by McClatchey, seconded by Serritella, to accept the November Treasurer's Report as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Serritella, to accept the November Clerk's Report as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Snell, seconded by Nolan, to authorize and approve Bond payment to Home State Bank of Crystal Lake for Storm Sewer Bonds as Payment follows: Principal $10,000, Interest $231.26, Bank Fee $35, total $10,266.25. Voting Aye: Bolger, Lieder, Mc Clatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Serritella, to authorize and Water Dept. approve payment to Joseph Huemann & Sons for final Payment Request Improve. No. 2 in the amount of $2,396 for well pump installation at Well No. 7 as recommended by Baxter & Woodman. Voting Aye: Bolger, Lieder, Mc Clatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Smith, to authorize and approve Water Dept. payment to Henry Boysen Co. for final Payment Request No. 3 in the Improve. amount of $8,895.20 for Well No. 8 Improvements as recommended by Baxter & Woodman. Voting Aye: Bolger, Lieder, Mc Clatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Mc Clatchey, to adjourn. Voting Aye: Smith, Teta, Nolan, Bolger, Voting Nay: Serritella, Mc Clatchey, Snell, Lieder. Absent: None. There being tie vote, Mayor Busse cast an aye vote and declared the motion carried. The meeting adjourned at 9:05 P.M.
