Schmitt, Director of Public Works RE: Engine Replacement, Utility Division Backhoe ATT: McCann Industries Quote Budget Amendment Ordinance AGENDA ITEM SUMMARY: Staff requests City Council to consider accepting the attached quote from McCann Industries, Inc. for an engine replacement for the Utility Division's Case 590 Super M Backhoe. Staff further requests City Council approve a budget amendment in the amount of $14,280 from the Utility Division Repair and Maintenance Account for engine replacement of the Utility Division's Case 590 Super M Backhoe. BACKGROUND: The purpose of this request is to replace the engine of the Utility Division's backhoe as the equipment is necessary for day to day maintenance projects performed by the Utility Division. The engine failed in early August and it has been out of service since that time. This long reach backhoe is necessary for excavations of up to ten feet deep allowing the Utility Division to complete in-house underground projects unattainable by other equipment. Until this backhoe is put back into service the Utility Division would require equipment rental in the case of a deep emergency excavation. ANALYSIS: Staff received the following quote from McCann Industries, Inc. which includes materials only. The cost for the engine core is also included with this quote and will be able to be recouped upon completion of the replacement. To keep labor costs down the work to replace this motor will be performed by the City Staff. This is an unexpected repair item and, as such, was not included in the FY18/19 Budget. Therefore, a budget amendment is required. BACKGROUND: Over the years, the City of McHenry has issued a variety of bonds that pledge various funding sources for repayment backed by the full faith and credit of the municipality. A General Obligation bond that pledged MFT revenues was issued in 2010 to fund a local street improvements program. In each year since these bonds were issued, the City has abated the property taxes that would have been levied for the annual interest and principal payments because MFT revenues have been sufficient to cover the debt service requirement. ANALYSIS: To account for the use of MFT revenues, the Illinois Department of Transportation requires municipalities to approve a separate resolution acknowledging the property tax abatement and approving the appropriation of MFT funds for debt service payments. The city must approve a resolution for property tax abatements for 2017 to comply with IDOT reporting requirements. RECOMMENDATION: Therefore, if Council concurs, it is recommended that a motion be made to approve the attached IDOT Resolution appropriating Motor Fuel Tax funds in the amount of $418,105.00. Staff is seeking authority to advertise for bids for installation of holiday tree lighting in Veterans Memorial Park. Background. Annually, the city has contracted services for the installation of holiday tree lighting in Veterans Memorial Park. A total of 1)17,500 was budgeted this year for the lighting. Analysis. If approved, lighting would be installed in the park prior to the annual Downtown Christmas Walk on November I , Recommendation. GREEN STREET MCHENRY, IL 60050 BID OPENING: TUESDAY, September 24, 2018 CITY OF MCHENRY ADVERTISEMENT FOR BIDS SERVICES TO INSTALL, MAINTAIN, and REMOVE CHRISTMAS LIGHTS The City of McHenry will receive sealed bids for services to install, maintain, and remove Christmas lights on trees at Veteran's Memorial Park for the 201 &2019 season until 11 #00 a.m., Tuesday, September 24, 2018. Each proposal must be sealed and clearly identified on the outside of the envelope as a "BID FOR CHRISTMAS LIGHTS". Award of the bid will be considered at a later meeting of the McHenry City Council within at least thirty (30) days of the date of receiving bids. The City will review each properly submitted bid and will make a selection based upon price, availability, quality and other features of the bid proposals. CITY OF MCHENRY SERVICES TO INSTALL, MAINTAIN, And REMOVE CHRISTMAS LIGHTS General Specifications GENERAL DESCRIPTION OF WORK This work shall generally include all labor, fuel, supplies, vehicles, and equipment to install, maintain, and then remove Christmas lights on trees at Veteran's Park in the City of McHenry. The lights to be installed will be provided by the contractor. PERFORMANCE BOND A performance bond is not required for this contract. INSURANCE REQUIREMENTS No work under this contract shall be started or performed until the successful bidder has obtained and provided the City with proof of insurance of the following types and minimum amounts. a) Worker's compensation and employer's liability in amounts as required by the State of Illinois. b) Comprehensive General Liability in an amount of not less than $1,000,000.00. c) Property Damage in an amount not less than $1,000,000.00. d) Automobile Liability coverage to include all owned, rented, leased, or hired vehicles in an amount not less the $1,000,000.00. Each Insurance policy issued for this coverage, and the certificate of insurance issued as proof of insurance, must also name the City of McHenry as an additional insured for the period of this contract. In the event that the contractor fails to maintain or renew any insurance coverage during the period of the contract, the City may cancel the contract at that time without any prior notification. No insurance policy issued for this contract may be allowed to expire prior to the completion of this contract, without first providing the City with at least 15 days advance notice of the expiration by certified mail. The contractor shall require any and all subcontractors performing work on this contract to provide and maintain insurance coverage of the minimum amounts specified during the period of the work. Services for Christmas Lights General Specifications Page two Nothing contained in these insurance requirements is to be construed as limiting the extent of the Contractor's responsibility for payment of damages resulting from his performance and completion of this work. The contractor agrees to assume all risk of loss and to indemnify and hold harmless the City of McHenry from any and all liabilities, claims, suits, injuries, losses, damages, fines or judgments, including litigation costs and attorney's fees, arising out of the work for this contract, including to the extent allowed by law those liabilities, injuries, claims, suits, losses, damages, fines or judgments, including litigation costs and attorney's fees, arising out of or alleged to arise out of, the negligence of the City of McHenry, its officers, agents, and employees. SALES TAX Supplies, materials, and equipment used for or installed as part of this contract are exempt from retailer's occupational tax in the State of Illinois; this sales tax shall not be included as part of the bid price. All other applicable taxes and fees shall be the responsibility of the contractor. SCHEDULE The City of McHenry requests that all lights be installed and in good working order by Friday, November 16, 2018. All lights to be installed under this contract are to be completely removed after February 1, 2019, but no later than February 8, 2019. MAINTENANCE The Contractor shall be responsible for all maintenance of the lights from the time of installation to the removal, which shall include, but not be limited to, replacement of bulbs, securing loose strings of lights, and replacing strings of lights that are not operational. The contractor shall be required to inspect the lights at least one time per week to make all repairs and complete all replacements as needed. In addition, the contractor shall be required to complete all maintenance within 2 working days when reported by the City of McHenry. NUMBER and LOCATION OF TREES Services under this contract shall include the installation, maintenance, and removal of lights MAX (27) trees within Veteran's Park that are specified on the attached Park map. On the bid submittal page there is an additional line designated "price per 1,000 lights", this may be utilized should the city of McHenry choose to add trees to that it wishes to have lit by the contractor. Services for Christmas Lights General Specifications Page Three PROTECTION OF it The contractor shall complete all work in the best manner possible to protect the trees and to prevent any damage to the trees and tree limbs. Bucket trucks shall be kept away from the tree limbs, whenever possible. If the City determines during the installation and the removal work that excess damage is being done to the trees, the contractor shall be required to stop work immediately and to revise the means of installation and/or the means of removal in order to eliminate the damage to the trees. The City will not allow removal of the lights by pulling the strings from the trees. Instead the lights must be cut off and/or unwrapped from the trees. INSTALLATION Installation may include wrapping individual branches OR "draping" over branches to light the designated trees. Placement and design of the placement shall be reviewed with the contractor prior to installation. The contractor shall connect the lights at each tree to extension cords that carry the power from tree to tree to the power supply provided by the City in the park. Every effort should be made to suspend those cords within the trees and transfer the power to adjacent trees in the air. Laying extension cords on the ground for long runs will be unacceptable. All connections and all plugs must be completely wrapped with electricians tape, or covered with heat shrink plastic, as a moisture barrier. LIGHTS TO BE PROVIDED The contractor will be required to supply all the strings of lights in addition to any replacement bulbs that may be required throughout the season. A commercial grade outdoor light is recommended. All lights for the park are to be clear or white. The contractor is not required to salvage the lights at the end of season and will not be required to remove the lights in working order. TIMERS TO BE PROVIDED The contractor will be required to supply timers for all the strings of lights. A plug in style timer is recommended and should be of a commercial grade or such deemed to handle the electrical load for the stings of lights. Timers will be located within the sealed electrical boxes however they should be able to withstand winter temperatures. All timers should be coordinated and set appropriately for the lights to turn on at 3:00 pm and turn off at 11:00 pm daily. METHOD OF PAYMENT The City shall make two-thirds (2/3) payment of the total bid price upon completion and approval of the installation of all lights within forty-five (45) days of the receipt of invoice. The City shall pay the remaining one-third (1/3) of the total bid price following the completion of the required maintenance and after the removal of all lights from all trees within forty-five (45) days of the receipt of an invoice. The City does reserve the right to make a deduction from the final payment if the contractor fails to provide necessary maintenance after receipt of written notice from the City. The parade will conclude at the field. ANALYSIS: A The parade is brief and in past years, has had minor impact on traffic. Staff reviewed the request with Police, and Parks Department staff. Police Officers will be stationed along the parade route to provide traffic control. RECOMMENDED: If Council concurs, then it is recommended a motion is considered to approve the request as presented. The one mile fun run would begin at the First United Methodist Church on Main Street and end in Neumann Park on Green Street. The themed costume run would step -off at 11 am and would require brief street closures and intersection control along the route. BACKGROUND: Participants dressed in costumes of their choice will participate in the run along the proposed course, which is attached. It has the participants lining up on John Street and proceeding east to 3rd Street, turning north to Waukegan Road, turning east through Green Street intersection to the Uverwalk entrance between the Riverwalk Place townhomes. The route would then cross the Riverwalk Bridge and stay on the sidewalk eastbound to Miller Point before turning west through the parking lot to Venice Avenue, through the Court Street Lot and finishing in Neumann Park. The entire run will be done in less than 30 minutes. The course will require road closure of John Street between Center and 3rd and 3rd Street between John and Waukegan Road. Intersection control will also be required at Main and 31d and at Waukegan and Green. The remainder of the course will be able to completed with the use of volunteers. The City of McHenry is dedicated to providing its citizens, businesses, and visitors with the highest quality of programs and services in acustomer-oriented, efficient, and fiscal/y responsib/e manner. ANALYSIS: The proposed event should have minor impact on traffic with such a short duration. Staff reviewed the request with Police Department, Police Officers will be stationed along the aforementioned intersections to provide traffic control. This will be attempted to be managed with on street officers, however if there are overtime charges the Downtown Business Association will be responsible for any costs incurred by the City of McHenry. The new event is unique and looks to draw visitors downtown with the run ending in the middle of the Green Street business district. Green Street, McHenry, IL. Roll call Deputy Clerk Meadows called the roll. Roll call. Members present: Alderwoman Condon, Alderman Devine, Alderman Mihevc, Alderman Curry, Alderman Schaefer, Alderman Glab, Alderman Santi and Mayor Jett. Others present: Administrator Morefield, Chief of Police Birk, Engineer Strange, Director of Community Development Polerecky, Finance Director Lynch, Director of Parks and Recreations Hobson, Director of Economic Development Martin. Pledge of Allegiance Mayor Jett proceeded to lead those present in the Pledge of Allegiance. Public Hearing: Public Hearing on D.R. Horton's Request to Amend the Annexation Agreement Relative to the Oaks at Irish Prairie. Mayor Jett opened the Public Hearing at 7:02 p.m. He asked if anyone in attendance wished to comment on the matter currently under discussion. Those in attendance offered no comments at this time. Avanti Group representative Dean Edmeier addressed the Council Members. He reported that Avanti Group is the petitioner and the sole owner of the subject property. Mr. Edmeier reported that D.R. Horton which is a national homebuilder currently has 86 lots within the Oaks at Irish Prairie Subdivision under contract to purchase. He proceeded to introduce Mr. Derik Hoffman, .and Acquisitions Director for D.R. Horton, Mr. Hoffman provided the Council Members with a brief overview of D.R. Horton's history as national homebuilders. He noted that D. R. Horton has been in business for over sixteen years in over twenty-six states. They build a variety of home products, including age -targeted, age restricted and single family neighborhoods. Mr. Hoffman discussed the request to amend the annexation agreement with respect to a minor change in the architectural standards, the elimination of the clubhouse and a 50% reduction in the impact fees. City Council Meeting Minutes August 20, 2018 Page 2 Mr. Hoffman continued on to report that on August 13th he and staff met with many of the current residents of the subdivision to discuss the request to amend the annexation agreement. The residents in attendance were in favor of eliminating the clubhouse due to additional cost it would place on their HOA association fees. In addition, they would prefer park space instead of a splash pad or other amenities that would have an impact on their association fees. They also suggested that the parking lot space be reduced to allow for the possibility of a basketball court or some other similar use. Mr. Hoffman reported that they would like to move quickly with constructing the park improvements and have the asphalt work completed prior to the seasonal closure of the asphalt plants. Mr. Hoffman commented on the home product elevations. He noted that the only change to the architectural standards is to increase the projection of an attached garage in front of the house from eight feet to fifteen feet. In addition, they will offer both ranch and two story models with vinyl and brick siding. Mr. Hoffman discussed the reasoning behind asking fora 50% reduction in the impact fees. He reported that the recent tariffs on lumber, steel and copper have driven up the construction cost for single family homes. In addition, a slow in wage growth and an increase in property taxes has placed a burden on the potential home buyers' mortgage financing abilities. He noted that many communities have recognized the economic climate and have been pro -active in reducing the impacts fees in order to simulate residential and commercial development. Mr. Hoffman noted that McHenry is unique due to the fact that the public improvements have been completed and the vacant lots are immediately buildable. D. R. Horton is prepared and anxious to develop an attractive neighborhood and invest $20 million dollars in the site. He asked if the Council Members had any questions. Alderman Glab asked if they notified every resident in the subdivision regarding the open house meeting. Mr. Hoffman replied yes. Alderman Glab asked if Mr. Hoffman could estimate the number of residents that attended the open housing meeting. Mr. Hoffman replied 45-50 residents were in attendance. Alderman Glab asked if anyone in attendance expressed strong opposition to their park plan and the elimination of the clubhouse. He replied no, they were very supportive. Alderman Glab asked if the park space is privately owned. Mr. Hoffman replied yes, the park space will eventually be deeded to the HOA. Alderman Glab reported that he had no issue with the change in the projection of the attached garage from eight feet to fifteen feet. In fact, in his opinion the variation enhances the streetscape. Alderman Glab also complimented D.R. Horton on their craftsmanship. City Council Meeting Minutes August 20, 2018 Page 3 Alderman Glab went on to comment on the request for a 50% reduction in impact fees. He reported in the past that Council Members and Staff calculated the developers' impact on the community and the cost associated with those impacts. Alderman Curry questioned who currently oversees the Homeowners Association. Mr. Edmeier reported that currently they control the HOA and it is overseen by a management firm until a percentage of the homes are occupied, then the HOA is turned over to the residents at which time a governing HOA Board is formed. Alderman Curry inquired who would be the responsible party to construct the park amenities. Or. Hoffman replied that it would be D.R. Horton. The Avanti Group (developer) is responsible for the infrastructure and public improvements. Alderman Curry questioned why D.R. Horton is considering reducing the size of the park's parking area. Mr. Hoffman reported that many of the residents that attended the open house commented on the fact that this was a private park and a large parking lot might encourage non- residents to utilize the park space. Mr. Hoffman stated that they have considered adding additional parallel parking spaces. Alderman Schaefer reported that he had no problem with the change in elevation with respect to some of the garages. However, he questioned if two cars can fit on the driveway without blocking the sidewalk. Director Polerecky replied yes, they still comply with the setbacks. Alderwoman Condon reported that she took no issue with the extended garage elevations. In addition, she was pleased that the park space was private. She noted that the City has a sufficient amount of park space and maintenance of that park space does place a burden on the Staff. Alderwoman Condon did express concern with reducing or eliminating the parking lot. She noted reducing or eliminating the parking lot may become an issue in the future. Alderwoman Condon commented on the impact fee reduction request. She did understand that the developer is in business to make a profit. However, the City and the other taxing districts would still have to absorb the cost associate with the impact of a new development. She suggested that maybe a 30% reduction was fair. Alderman Santi asked Mr. Hoffman if they had a timeline in which the 86 lots will be built -out. Mr. Hoffman stated in 2-3 years depending on the market. City Council Meeting Minutes August 20, 2018 Page 4 Mr. Hoffman reported that D. R. Horton likes to have an inventory of 10-15 move in ready models, and their biggest competitor is existing homes that are move in ready. There was some discussion with respect to a letter of credit. Director Polerecky reported that the City does have a performance bond on file and the performance bond would not be released until final acceptance. Alderman Santi expressed concerns with impact fees being reduced by 50%. He was uncertain if the fees collected after being reduced by 50% would coverthe City's and the other taxing districts costs. Alderwoman Condon asked Director Polerecky if he was comfortable with reducing the impact fees by 50%. Director Polerecky replied yes. In his opinion having a viable community with new residential development better serves the community at large and encourages other types of development. Director Martin concurred with Director Polerecky's statement, he too believed residential development drives the local economy. Alderman Glab commented on the fact that he might consider a reduction in impact fees. However, he was against any reduction in the water and sewer tap on fees. Due to the fact that the City not long ago raised the water and sewer rates to cover the cost associated with maintenance, water treatment and the capital equipment replacement program. Administrator Morefield commented on impact fees in general. He reported that Staff and the Community Development Committee were in the process of reviewing the fees and he noted that the impact fee schedules for the various subdivisions within the City are all different as the fees were negotiated during the annexation agreement discussions. However, D.R. Horton had stepped forward with this project and staff wanted to be responsive to their request. Staff recommends tabling this matter until September 10th to allow staff time to research other similar communities' impact fee structures and other comparable factors. There was some discussion on the fact that for the last four years McHenry Fire Protection District's Board has waived their impact fees. Alderman Glab asked Staff if they were still collecting the Fire District impact fees. Staff replied no not at this time. Alderman Glab expressed concern with the fact that the fees were not being collected as it states in the Code that only the City Council has the authority to waive impact fees. Alderman Glab noted that many years ago the Council would annually distribute the impact fee contributions to the various taxing bodies. In his opinion this action demonstrated to the community that the taxing bodies were working together and supporting each other. City Council Meeting Minutes August 20, 2018 Page 5 Administrator Morefield asked Mr. Hoffman what his thoughts were if the City were to limit the impact fee reduction to 18 months or a year to determine what effect the loss in revenue was. Or. Hoffman thought it was worth a conversation. However, what he would not want to see happen is after 12 to 18 months, of impact fee reductions, home prices increase, the level of interest decreases, and home sales deteriorates. Administrator Morefield asked Mr. Hoffman what his thoughts were if the City asked D.R. Horton to pay all the impact fees upfront. Mr. Hoffman thought that this matter was also worth a conversation. Alderman Glab noted that Administrator Morefield brought up some good ideas. He suggested maybe consider annually reviewing the impact fee structure while comparing the number of houses sold and then adjust the impact fees as necessary. Alderwoman Condon noted that the Community Development Committee has always been the committee to review the impact fees schedule and recommend changes as needed. She noted that the Community Development Committee has a meeting scheduled for August 28th to discuss this very topic. Mayor Jett thanked Mr. Hoffman and Mr. Edmeier for their time. Mayor Jett stated that at this time he would entertain a motion to close the public hearing portion of the meeting. He strongly expressed his concerns and City Council Meeting Minutes August 20, 2018 Page 6 frustration with the City placing a referendum question on the November 6th General Election Ballot asking the voters if they would support expanding the Recreation Center that will include an indoor pool, a gymnasium and an outdoor family aquatic park and issue bonds, in an amount not to exceed $30,000,000, to construct these improvements. Engineer Strange reported that all the underground work has been completed and the sanitary sewer work will begin this week along with the concrete curb and sidewalk reconstruction. The Lincoln Bridge reconstruction should begin in September. Alderman Glab commended the Public Works Department for taking on bigger projects and doing a great job completing them. Discussion: Extension of Tolled Annexation Agreement and Conditional Use Permit, Proposed Terms and Conditions of Extension of Annexation Agreement, Noise and Dust Standards, Reclamation Plan, Letter of Credit and Bonding to Secure Reclamation, and Gravel Pit Hours of Operations. Mayor Jett opened the conversation with Meyer Material representatives by reporting that he had received a new email offer letter from Lafarge representative Mr. Mark Miller in which he agreed to cease the above ground mining operations on December 31, 2026 which allows the above ground mining operations to continue for seven years and eight months. The Council Members discussed a correction to the end date, seven years and eight months should equate to the above ground operations ceasing on December 31, 2025. The Meyer Material representatives agreed with the Council Members calculation date. A lengthy discussion ensued regarding the underground restoration operations and the reclamation process. Meyer Material representatives reported that the underground restoration operations does not require any heavy thunderous equipment. In addition, the resources extracted from the site would be wet sand and pea gravel which eliminates the dust and noise concerns. The sales center would remain open and the products would be stock piled until sold. They would continue to haul products to and from the site. The Council Members discussed their requestto have Meyer Material provide the Citywith Dust and Noise testing equipment. Having the equipment on hand allows for Staff to respond promptly to residents complainants with respect to noise and dust. The Meyer Material representatives will take this request under advisement. The City Council discussed the requirement with respect to Meyer Material obtaining a Letter of Credit upon beginning the reclamation process. The Letter of Credit protects the City if Meyer Material were to default in their obligations to restore the site. The City would have the ability to access the funds necessary to complete the site reclamation improvements. Discussion Continuation The Council Members and Meyer Material representatives continued to negotiate the extension of the Tolled Annexation Agreement terms and conditions. The Council Members provided the Meyer Material representatives with a list of conditions as follows: • An eight year plan including processing and operation site locations • A map depicting reclamation process and mining on the northern site • City ownership of dust and noise equipment • Letter of Credit • Reclamation Plan to be approved by the City Engineer • Fines • Annual reporting • Sound barriers and enclosures • Sand and gravel height restrictions The Meyer Material representatives agreed to address each of this conditions. Mayor Jett reported that the Council will conduct a special meeting on September 4th to finalize the negotiations. Motion to Approve Ordinance Petitioning the City of McHenry Planning and Zoning Commission for Amendments to the City's Comprehensive Plan and Amendments to the City's Zoning Text and Map. Staff is still in the process of gathering information and conducting analyses to be able to provide Council with as much information as possible in making an informed decision regarding the reduction of fees. No action is being requested by Council at this time. BACKGROUND/ANALYSIS: Within the last 60 days staff has been approached by two developers looking to purchase and finish out the Oaks at Irish Prairie subdivision as well as the Legend Lakes subdivision. Each of these developers have the vacant lots under contract and are in the process of performing due diligence prior to any possibility of closing. In each of these cases the overwhelming concern for these developers is the amount of impact fees/capital development fees associated with the permitting process. Each developer has stated that with the current market, recent tariffs on building supplies, updated building codes, and the actual cost of the land it is difficult to meet the financial numbers needed in order to build within the City of McHenry. While it is important to identify these specific requests, it is also important for Council to know that staff had been having internal discussions regarding impact fees prior to any developer making such a request. Unfortunately, the developer requests preceded the opportunity for a discussion of impact fees at the Council level. In researching the topic, staff has reached out to many surrounding communities to identify the status of impact fee reviews. Most of these communities are in the process of reviewing their impact fees based on renewed interest in residential development. Below is a snapshot of what has been identified to date. The Fair Market Value of property is, generally, used for the calculation of impact fees. Crystal Lake Reduced fair market value of 1 acre from $265,000 to $165,556 (37.5%) Cary Reduced annexation fees from $4,500 per lot to $1,500 per lot (66.7%) Johnsburg Having initial discussions on reductions Huntley Reduced fair market value of 1 acre from $226,000 to $126,556 (44.0%) Spring Reduced school, park, library, fire, and public works impact fee 100% in Grove 2014. Recently reactivated public works impact fee however all others reduced until 2019 Richmond Same as Spring Grove (working together) Woodstock Reduced value of 1 acre of land, reduction resulted in 30% overall reduction in fees Algonquin Reduced 1 acre value of land McHenry County also recently reduced their impact fees by 100% for one year. In addition, there are individual lots throughout the city to which "standard" impact fees apply. The number of lots affected by a standard reduction is minimal but would give an individual wanting to build on an empty lot in a well -established subdivision the same benefits of that in a subdivision that is partially complete. It can be anticipated that if impact fees are reduced for any individual subdivision (such as the request for Oaks at Irish Prairie) or the "standard" impact fees, that other requests will follow. Staff is currently in the process of developing a comparison of impact fees for all active annexation agreements in the community, along with the city's standard impact fees; developing an analysis of an overall financial impact for reducing impact fees by 50%; developing a comparison of standard impact fees for the communities previously identified; and, as it relates to water and sewer impact fees, identifying what impact a buildout of subdivisions would have on the city's water and sewer systems and what a reduction of fees would have on the city's ability to increase future capacity, if needed. This information will be provided for the September 24, 2018 City Council meeting. Attached to this supplement is a review of impact fees for single family homes that the city has received over the past 4 years. The draft minutes from this meeting are attached for your review. In summary, the Committee forwarded a recommendation to reduce impact fees by 50% to the full City Council for consideration. This recommendation can be a part of the discussions on September 10tn At this time, staff is seeking confirmation from the City Council that the information being gathered and analyzed will sufficiently meet their needs for future decision -making related to any changes to impact fees. DRAFT Community Development Committee Meeting Minutes August 29, 2018 Call to Order Alderwoman Condon called the meeting to order at 7:00 p.m. Deputy Clerk Meadows called the roll. Roll call: Members present: Alderman Santi, Alderman Devine and Alderwoman Condon. Others present: Mayor Jett and Director of Community Development Polerecky, Public Comment Alderwoman Condon asked those in attendance if they had any questions or comments regarding any topic that is not listed on the agenda. Those in the audience offered no comments. A Motion to approve the June 11, 2018 Committee Development Meeting Report A Motion was made by Alderman Santi and seconded by Alderman Devine to approve the minutes as presented. Roll call: Vote: 3-ayes by unanimous voice vote. 0-nays, 0-abstained. Motion carried. Impact fee reduction discussion Director Polerecky reported that the guests in audience had a vested interest in the topic under discussion as they are the potential developer and builder of a certain partially completed subdivision in town. Alderwoman Condon stated that this meeting is open and informal and they are welcome to speak after the Committee Members discussion has concluded. Director Polerecky discussed the past decline in the economy and the halt impact the slowdown had on the housing market which left several uncompleted subdivisions in town. The City is fortunate that the majority of the uncompleted subdivisions have the infrastructure improvements in place which makes the lots buildable and desirable to developers. He continued on to report now there are developers expressing interest in the empty lots. However, their biggest concern is the City's impact fee structure so Staff has taken on the task of reviewing the existing fee structures. Director Polerecky commented on a recent City Council meeting in which D.R. Horton was presenting a development proposal when a conservation arose with respect to reducing impact fees and the Council Members questioned what was the methodology used in calculating impact fees. Director Polerecky reported that the impact fees are based on the fair market home value of a home on a one acre lot. However, the City does not have any one acre lots so the City's fair market home value is based on a acre lot. In addition, the annexation agreements impact fees vary due to separate negotiations. He recommends Council along with Staff review the fair market value trends every two years. Director Polerecky reported that interested developers have expressed concerns regarding the feasibility of developing a single family home community due to recent tariffs on building supplies, updated building codes and the actual cost of land. The potential developers' agree that these negative impacts makes it difficult for home builders to generate a profit. Director Polerecky continued on to report that the School Districts' enrollment number are down by 10%. In addition, McHenry County, Sugar Grove and Richmond have reduced their impact fees by 100%. Alderwoman Condon asked what the surrounding communities' position was such as Woodstock, Crystal Lake, Johnsburg and Cary. Director Polerecky reported that Woodstock had reduced their impact fees by 30%. However, he was uncertain about the other communities. Alderman Santi asked if Staff was aware of what Huntley's position was regarding impact fees. Mr. Hoffman (D.R. Horton representative) reported that he believed Huntley is considering reducing their impact fees by 30%-35%. Alderwoman Condon suggested Staff draft a list of all the surrounding communities' impact fees and any reductions of those fees prior to bringing this matter before the full Council. Alderwoman Condon noted that although what the other communities' positions are will have no impact on the outcome. It would be beneficial to know their position prior to voting on this matter. Director Polerecky stated that his concern if the City is not proactive regarding the impact fee reduction the City may lose out on residential growth which in his opinion drives the local economy. Director Polerecky discussed in detail his proposal regarding the reduction in impact fees. He is recommending a 50% reduction in impacts fees for a two year period with an option to pay the impact fees upfront. Which would allow for the developer to extend the completion date of the build -out if necessary. In addition, if the developer chooses not to pay the impact fees upfront after two years the impact fees for that particular development would be subject to review. He noted that this reduction only applies to active annexation agreements consisting of platted lots. Director Polerecky reported that his recommendation is for the Committee and the Council to annually review the impact fees and the housing market trends. Alderwoman Condon inquired at what point in the process are the impact fees paid. Director Polerecky reported that the impact fees are paid at time of permit. Alderman Devine asked if this impact fee incentive would also apply to stand alone lots. Director Polerecky reported yes, the proposed impact fee reduction would also applied to the standard impact fees. Director Polerecky reported that currently the City has 350 empty platted residential lots which would be sufficiently supported by the current infrastructure systems. In fact, the current water and waste infrastructure systems has more than enough capacity to support these additional residential homes and the benefits to the City includes additional system users along with an increase in the tax rolls. Alderman Santi asked if the permit fees would also be reduced. Director Polerecky reported that the permit fees will remain the same. Alderwoman Condon commented on the fact that she would like to see the residential developments completed. Director Polerecky noted that the undeveloped lots drives existing property values down. In addition, the current housing market trends shows new housing is attracting the empty nesters which would have very little impact on the school districts. Mayoriett stated that he supported the impact fee reduction incentive. In his opinion, the incentive would spark residential development which in turn would have a positive impact on commercial growth. Alderman $ants discussed in length his uncertainty if a 5076 reduction was the correct percentage to offer developers. Alderwoman Condo opened the discussion to member of the audience. Avanti Group representative Dean Edmeier addressed the Committee. Mr. Edmeier reported that he supported the impact fee reduction limited to a two year period along with the optional prepayment incentive. Mr. Roger Gerstad (Gerstad Builders) reported that he is an owner of a small local home construction company and in today's housing market the actual home construction cost and the home's appraised value leaves a small profit margin. He supported the impact fee reduction and commended the Council Members for taking a leadership role regarding this matter. Mr. Hoffman (D.R. Horton representative) also commented on the proposed impact fee reduction. He stated that he appreciates the thoughtful conversation regarding this matter. If the City Council approves the annexation agreement amendments D.R. Horton would complete the Oak at Irish Prairie Subdivision which in return would increase the property values and enhance the neighborhoods within that subdivision including an improved park site and other amenities. Director Polerecky provided the Committee Members with an overview of the annexation amendment process. He reported on September ILY the Council would conduct a public hearing on all the existing annexation agreements. After the public hearing is concluded the Council Members will consider the annexation amendments by ordinance. Alderman Santi once again expressed his concerns with the proposed impact fee reduction percentage. He reported that he would abstain from a formal Committee vote recommending bringing this matter to the full City Council for discussion. Alderwoman Condon noted that she also would prefer a 30% reduction. However, when you compare the positions of the surrounding communities and the current economic trends the 50% appears to be a reasonable percentage and will spark local economic growth. A Motion was made by Alderman Devine and seconded by Alderman Santi to recommend to the full City Council approval of a 50% impact fee reduction for all platted lots within the City Limits for a period A two years with an option to prepay the impact fees. Roll call: Vote: 2-ayes: Alderwoman Condon and Alderman Devine, 1-abstained: Alderman Santi. 0-nays. Motion carried. Department Updates Director Polerecky provided the Committee Members with an update of the Community Development Department's activities. He reported that Centegra Hospital complex expansion is proceeding as planned. Jexal's exterior walls have been constructed and they still intend on opening within 60 days. He continued on to report that Moe's On Main has completed the facade improvements and will be adding a new addition to the back of the building. Cuant Builders continue to construct single family homes. The Community Development Department continues to make big strides with property maintenance compliance by knocking on doors and educating the community. Director Polerecky commented on other developments. He reported that 1.A. Frate is in the process of constructing a 40,000' expansion and a new Butcher/Deli will be opening by the theater. In addition, the Hidden Pear's remodeling project is moving slowly and Plant Fitness will be opening in a portion of what was once Best Buy. Director Polerecky finished updates by reporting that Ricky Rockets is still in negations with Thornton's. Alderwoman Condon ask if there was any progress regarding the implementation of a Community Involvement Program. Director Polerecky reported that he has been working with the City's Attorney on how to proceed with this matter. Alderman Devine asked how the newly established restaurant Unrooted was doing. Director Polerecky reported that they are having a hard time staffing the restaurant. Alderman Santi asked if the Community Development Department could investigate the front porch furniture on some of the properties located along Front Street. Director Polerecky will investigate this matter. The donor has partnered with a reputable landscape design firm with the desire to complete the improvements via a design build concept. The improvements include a brick paver pathway, improved seating and significant landscape plantings, as well as the removal of the concrete seawall and the installation of a new steel seawall. The design build would have an overall budget of $140,000. The proposal is for the City to match the private donation amount of $70,000. This would come from the Developer Donations Fund, requiring an amendment to the FYI 8/19 Budget, BACKGROUND: A donor has come forward with a proposal to redesign Walsh Park and up to a $70,000 contribution toward the efforts. A map of the designs are included. The concept would include a paver path that would match the Riverwalk design and materials. The path would traverse the park, significantly widening in the middle and create the unique setting of an "art park". The art portion would feature a sculpture and wall mural to be introduced later, completely funded through private donations. The art park has been a combined effort of the McHenry Riverwalk Foundation and members of the Downtown Business Association. Improved seating would be installed in the central area before again narrowing and connecting to the parking behind the movie theater. In order to stabilize the entire property and prepare for the potential dredging efforts of Boone Creek in the future, the concrete seawall that is falling over would need to be replaced with a new steel seawall. The City of McHenry is dedicated to providing its citizens, businesses, aa:td visitors with the highest quality of programs and services in a customer -oriented, efficient, and fiscal/y responsible manner. The design is consistent with the recent plans that were compiled by the Riverwalk Foundation. These have also been attached for review. The donor, who wishes to remain anonymous at this point, has partnered with a reputable landscape design firm and would like construct the improvements utilizing a design build concept. In a design build concept a budget is set as are the basic concepts for the improvements, but full construction plans are not assembled. In this instance, the City has illustrations of the improvements as well as design cross sections from the existing Riverwalk and, finally, conceptual plans from the Hitchcock Design Group that were commissioned by the McHenry Riverwalk Foundation. Using this information, the entire design can be completed. There are two items that need to be addressed that the City would be responsible for as part of the project. First, the difference in standard wage costs versus the prevailing wage costs for Walsh Park (since this public property, prevailing wage applies). This difference is estimated at $1215000 The second item is the seawall cost and prevailing wage for installation. With the completion of this project, and prior to potential dredging in 2019, this would be a logical time to replace the existing failing concrete seawall, with steel. For the approximately 115 feet, the cost estimate including prevailing wage was $53,428.42. Costs for this project would be completely covered by the City, but managed as a component of the overall design build and improvement project. It would consolidate construction, alleviate any concerns of failure in conjunction with the improvements or dredging, and set the base if others ever desired to install cantilevered composite boat docksiboardwalk in the future. All of the improvements that are the responsibility of the City would be funded through the Parks Developer Donations Fund (Fund 280) and would require a budget amendment of $70,000, ANALYSIS: The donation presents a unique opportunity to completely redesign Walsh Park, in the heart of our Green Street business district, for a fraction of the cost. The total project budget of $140,000 includes a contingency of 7% on both the seawall and the landscape project. This contingency allows for any unknowns and creates that exposure cap for both parties a very firm number. In contrast, the latest price estimates compiled with the Hitchcock Designs for similar improvements exceeded $340,000. The design build concept allows us to set that budget and work with concepts that are already in place, yet it is only as good as the firm chosen to complete the work. In this case, the identified contractor Nierman Landscape Design (NLD) has a reputation that is well known in the area and in the industry. Mr. Nierman has ties to McHenry and has previously worked on a project donation that was associated with the McHenry Riverwalk. Staff and the Committee has a great deal of confidence in his firm. They will be partnering with Signature Seawall and Piers to complete the seawall. Signature has been to the site numerous times and provided quotes on various options for the project. They were approached by the donor to partner with NLD and coordinate the work to ensure that both are successful. The donor sought out these two contractors due to his confidence in them. Additional quotes on the either aspects of the work were not sought out to the knowledge of staff. There is a great deal of private interest and investment that is looking to transform Walsh Park into something special. The park is in need of attention and this avenue provides the city a very attractive option to complete the renovations both economically and programmatically. The "Art Park" concept is a popular one that invites community engagement as is evident by the private donation and by the interest of the McHenry Riverwalk Foundation and Downtown Business Association to continue to add to the proposed base amenities. The improvements could also lead to additional potential investment in the form of a boardwalk along the water. The attached unapproved minutes from the Parks and Recreation Committee support the improvements to Walsh Park and the design build concept so long as the city's exposure was capped at $70,000, which is also the exposure of the private donor. The Committee made the motion to present to the full City Council a proposal for the Walsh Park redesign including the Ctty's portion of the prevailing wage cost and the reconstruction of the seawall not to exceed $70,000 along with acceptance of a donor's matching contribution contingent upon obtaining additional quotes. It is important to note once again that the donor had the utmost confidence in the firms that were selected as a part of the design build team and did not wish to alter either of those firms, which is why this item is presented without additional seawall quotes. July 30, 2018 Chairman Schaefer asked if any of the Committee Members had any comments on any of the past Park and Recreation Committee minutes. The Committee Members offered no comments. Walsh Park Donation Update Director Hobson provided the Committee Members with an update on the redesign of Walsh Park. He reported that he had meet with the donor and discussed the possibility of entering into a license agreement or having the City donate the land to him then he would be the responsible party to completed and pay for all the improvements associated with the redesign of Walsh Park. However, the donor declined the offer. Director Hobson thene discussed the new proposal for the reconstruction of the seawall which includes prevailing wage. The new proposal increased by $20,000but the other improvement Park & Recreation Meeting Minutes August 20, 2018 Page 2 costs remained consistent with the original proposal bringing the total cost of the project to $139,890. The new proposal contains two contingencies one for the seawall itself in the amount of $3,700 and the second for the plantings and brick pavers in the amount of $5,412, Director Hobson reported that he had informed the donor that since the project cost had increased he still thought it was only fair that the City's exposure cost matches the donor's exposure cost. Alderman Schaefer asked if Director Hobson could clarify the differences related to Phase I and Phase II improvements. Director Hobson reported that the Phase I improvements are located on City owned property and the Phase II is located on privately owned property (other than a small section) and will be paid for solely by the donor. Alderman Schaefer commented on the fact that there is only one quote for the project. Director Hobson noted that due to the fact that this project is a design/build, the donor more than likely has a relationship with the chosen contractor. Alderman Schaefer thought that it might be problematic to present the proposal to the City Council with only one quote. The Committee discussed the need to obtain other quotes prior to presenting this matter to the full City Council, A Motion was made by Alderman Devine and seconded by Alderwoman Codon to amend their original motion dated July 30th to reflect the following language as recorded in the set forth minutes. A Motion to present to the full City Council a proposal for the Walsh Park redesign including the City's portion of the prevailing wage cost and the reconstruction of the seawall not to exceed $70,000 along with acceptance of a donor's matching contribution contingent upon obtaining additional quotes. Petersen Farm Draft Market Study Presentation Ms. Diane Williams provided the Committee with a presentation on the Petersen Farm Market Study. She discussed the current demographics of the City of McHenry and the demographics of the surrounding communities within a 10-minute and 20-minute drive times. Ms. Williams discussed the "A Day at Petersen Farm" event. She noted that the visitors interviewed learned about the event with traditional media campaigns such as flyers, word of mouth and newspapers. Ms. Williams recommended in the future increasing the use of technology, particularly mobile phones used to identify entertainment options. Park & Recreation Meeting Minutes August 20, 2018 Page 3 Ms. Williams commented on typical farm programming activities which consist of historical demonstrations, receptions and reunions, gardening classes, a music festival, and community garden plots. Ms. Williams reported on common interview themes. She stated that the "A Day at Petersen Farm" is regarded by all stakeholders as a great event, well organized and well attended. Ms. Williams commented on the maintenance of the grounds particularly the barn and other outbuildings. In her opinion there needs to be a more pro -active approach. She suggested developing a capital plan or mid -tern strategy plan to stabilize and preserve the farm buildings. Ms. Williams discussed the peer site assessments. She reported that that there were four similar sites that were identified as peers for Petersen Farm. All four sites are dealing with limited funds and staff resources. Ms. Williams explored the expansion of partnership options. She recommended partnering with the McHenry's school district and 4H clubs. A lengthy discussion ensued that explored ways to improve the farm grounds, expand programming activities, and generate revenue streams. The Committee Members along with Staff thanked Ms. Williams for her hard work and her time. Department Updates Director Hobson reported on the Rotary Club's Blues, Brews and BBQ event. He noted that the event was well received and well attended. Athletic &Aquatic Supervisor Thompson provided the Committee Members with updates on the season's aquatic programs and the beach and pool attendance numbers which had increased from last year. Director of Economic Development Martin stated that they do have a hardship as garage already protrudes, he opined that they have a large lot for the area and further stated that staff does not have any concerns. Director of Economic Development Martins stated staff recommends approval of a Variance to allow a six-foot protrusion in the corner side yard. Chairman Strach invited questions and/or comments from the Commission. Commissioner Miller inquired if they were planning to eliminate either of the wood decks? Mr. Crandall stated they would be removing the smaller deck because that is where the service door would be. Commissioner Thacker asked for clarification on the drainage plan. Mr. Crandall stated the house is called the "flood house" Cl"d that eighty percent %J the property was under water with monsoon rain last year. He stated that the water does recede except to the west but that most of water sits between his and the neighbor's property. This occurred in 1996, as part of the East of the Fox River annexation. They have included a covered patio which extends directly into their building at the far southern end, which leads to more outdoor seating. Since the VFW is expanding their conditional use permit they are required to obtain an additional conditional use permit. Therefore they are requesting a conditional use permit to allow a recreation institution, outdoor amusement, restaurant serving alcohol, live entertainment and dancing and outdoor seating/with alcohol and food. ANALYSIS: The VFW is home to numerous baseball games (see attached survey) and events within their building and have a full bar and serve food. This request would permit patrons to eat/drink outside, within the outdoor seating area, and staff would recommend all the rules of outdoor seating in the zoning ordinance be followed if this request is approved, with a few exceptions outlined in the recommendation (see attached). Generally, there will be no service of food or alcohol outside at the VFW. Patrons may bring it outside but must remain within the seating area delineated on the included plan. This would also include consumption of alcohol. Additionally, Staff is recommending that the main access to and from the outdoor seating area be from the inside bar area and not from the parking lot. The outdoor seating area will definitely be an enhancement to the property and draw more people to the site. With the outdoor seating regulations. time restriction and other rules and regulations, Staff believes there will be no adverse land use impacts on adjacent properties. Illinois 120. Chairman Strach stated Notice of the Public Hearing was published in the Northwest Herald on July 29, 2018. Notices were mailed to all abutting property owners of record as required by ordinance. The subject property was posted. A Certificate of Publication and Affidavit of Compliance with notice requirements are on file in the City Clerk's Office. Director of Economic Development Martin stated the VFW is requesting a conditional use permit to allow a recreation institution, outdoor amusement, restaurant serving alcohol, live entertainment and dancing and outdoor seating/with alcohol and food. He stated that the VFW is host to numerous baseball games and events and that they have a full bar and serve food. Director of Economic Development Martin stated they currently do not serve food or alcohol outside and that this is not the intent, they want people to have ability to drink/eat outside within a specific area, he further stated staff would recommend all the rules of outdoor seating in the zoning ordinance be followed if this request is approved, with a few exceptions outlined in the recommendation. He further stated generally, there will be no service of food or alcohol outside at the VFW. People may bring it outside but must remain within the outside seating area delineated on the plan -with the alcohol. Director of Economic Development Martin stated staff would also recommend that the main access to and from the outdoor seating area be from the inside bar area and not from the parking lot. He opined that the outdoor seating area will definitely be an enhancement to the property and draw more people to the site. He stated that with the outdoor seating regulations and time restriction and other rules and regulations staff believes the requirements of Table 31 for Conditional Use Permits has been met. Director of Economic Development Martin does not believe this will adversely impact the neighboring residential properties as it is located on the south side of the building and the residential is to the north and west. He further stated staff supports the request as presented with the recommendations included in the staff report. Mr. Keefe responded that would not be an issue and stated they would obtain a special permit to expand the time if needed for special events. Chairman Strach invited questions and/or comments from the Commission. Commission Sobotta inquired if the addition would affect parking. Director of Economic Development Martin opined that the additional impact would not be significant. He stated that the VFW is planning to add parking. Chairman Strach inquired about the current number of parking spots. Mr. Keefe stated he did not know the number but stated that they are in the planning stages to add a significant amount of parking and opined that would be completed before the addition. Commissioner Thacker inquired if the entrance to the new patio at the far south is for emergency use only. Mr. Keefe answered affirmatively and stated they were looking into having an alarmed gate and that it would be posted as an emergency exit only. Commissioner Miller inquired about the surface under the picnic tables and the fencing materials. Mr. Keefe stated that under the tables would either be concrete or brick and that there would be brick pillars with wrought iron fencing between the pillars. Commissioner Miller offered her congratulations on the success of the VFW and she stated she did have concern regarding the limited parking area and inquired about the parking plan. Mr. Keefe restated the hope that the parking lot area would be completed before the addition and stated the expansion would be to the grassy area to the east. Commissioner Miller inquired if the beer garden would have outside alcohol sales. Mr. Keefe stated the intent is not to have any alcohol service outside but stated they may have outdoor sales for special events. Horton AGENDA ITEM SUMMARY: National homebuilder D.R. Horton currently has 86 lots at the Oaks at Irish Prairie Subdivision under contract to purchase. Council is being asked to consider an amendment to the current annexation agreement for the Oaks at Irish Prairie subdivision to include, a minor change in architectural standards, the elimination of a clubhouse element to be replaced with a park and the reduction of impact fees by 50%. At the August 20, 2018 City Council meeting, a motion was approved to table consideration of this request to the September 10, 2018 meeting, with referral of a discussion of impact fees to the Community Development Committee. This has occurred and staff continues to gather information related to impact fees for further consideration by Council. RECOMMENDATION: It is recommended that a motion be made to table consideration of this time until the September 24, 2018 Regular City Council Meeting to continue to provide Council and Staff with an opportunity to gather information and develop recommendations on revisions to impact fees.
