The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, December 3, 1986 at 7:30 P.M. at City Hall . At roll call the following Aldermen were present: Bolger, Lieder, Council McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City Meeting staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Attendance Director Merkel, Chief Joyce. Attorney Jim Green, representing McHenry Sand & Gravel, addressed the Council concerning a two year extension of the existing McHenry Sand & Gravel annexation agreement which expires December 20, 1986. He explained that the Miller Family, owners of McHenry Sand & Gravel, have acquired approximately 400 acres adjacent to the present gravel operation which is now in the City. During this two year exten- sion, it is their intention to develop a plan for all the Miller owned property in that area. A new annexation agreement would then be negotiated for all the gravel pit properties. Motion by Smith, seconded by Nolan, to grant the request of McHenry Sand & Gravel and pass an ordinance approving a two year exten- sion of the existing annexation agreement which expires December 20, 1986. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta, Busse. Voting flay: None. Absent: None. Motion carried. Don Gerstad of Gerstad Builders addressed the Council regarding extension of Millstream Drive northward into McHenry Lakes Estates subdi- vision. Motion by McClatchey, seconded by Snell, not to extend Millstream Drive over Boone Creek into McHenry Lakes Subdivision and not to require the developer to construct a vehicular bridge over the Boone Creek in that area. Voting Aye: Bolger, McClatchey, Nolan, Smith, Snell. Voting Nay: Lieder, Serritella, Teta. Absent: None. Motion carried. Ordinances Annexations Bridges Streets Motion by Smith, seconded by McClatchey, to accept the recom- mendation of the Planning Commission and approve the preliminary plat of Plats McHenry Lakes Estates Unit III as presented. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snel l , Serritel1 a, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Nolan, to retain the services of Audit Yapelli & Ketchmark as City Auditors for the 1986-87 Audit and to authorize the Mayor to execute the engagement 'letter. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Nolan, to approve the reduction of the Letter of Credit for Winding Creek First Addition to Unit II as recommended by Baxter & Woodman and to authorize a reduction from Letters of $181,918 to $33,758. Motion by Lieder, seconded by Serritella, to mendation of the Zoning Board of Appeals and pass an the propert at 4611 W. Elm Street from "B-2" to "B-3". Winding Creek accept the rec om- ordinance rezoning Zoning Ords, Ordinances Wednesday, December 3 1986 Page 2 James Althoff of Althoff & Associates addressed the Council con- cerning resubdivision of his property on Front Street. Motion by Bolger, seconded by Nolan, that the Council waive the requirements of the subdivision control ordinance as it applies to the Althoff property on Front Street provided the plat is reviewed by the Tabled City Attorney to be certain that the lot lines are adequate and that the Motions parking is adequate. Motion by Serritel l a, seconded by Mc CI atchey, to table the above motion. Voting Aye: Serritel l a, Snell, Smith, Mc CI atchey. Voting Nay: Lieder, Teta, Nolan, Bolger. Absent: None. There being a tie vote, Mayor Busse cast an Aye Vote and declared the motion carried. Committees- Mayor Busse asked the Building and Zoning Committee to review Instructions the Althoff resubdivision proposal and checklist as submitted by Baxter & Woodman at their scheduled meeting on Thursday, December 4, 1986. Motion by Smith, seconded by Nolan, to authorize the Mayor and Clerk to execute an engineering design services agreement with Baxter & Agreements Woodman for engineering services required by the City for design of the Sewer Plant- south wastewater treatment plant improvements. South Voting Aye: Bolger, Lieder, Mc CI atchey, Nolan, Smith, Snell, Serritel l a, Teta. Voting Nay: None. Absent: None. Motion carried. Water Motion by Bolger, seconded by Nolan, to instruct the City Service Attorney to proceed with whatever additional relief can be given to the McHenry Shores Water Company Users and to further object to the Illinois Commerce Commission's proposed water rates for the McHenry Shores area. Voting Aye: Bolger, Lieder, Mc CI atchey, Nolan, Smith, Snell, Serritel l a, Teta. Voting Nay: None. Absent: None. Motion carried. During discussion the Council agreed to remove a handicap park - Ordinances ing place in front on 1301 N. Riverside Drive on the west side of Parking Riverside Drive and establish a new handicap parking spot on the east Regs. side of Riverside Drive in front of 1334 N. Riverside. Motion by Bolger, seconded by Snell, to pass an ordinance chang- ing the handicap parking on Riverside Drive as outlined above. Voting Aye: Bolger, :_ceder, Mc CI atchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Authorizations Motion by Teta, seconded by Snell , to authorize the Superin- Water Line tendent of Public Works to consult with Baxter & Woodman for preparation Extensions of a cost estimate for an extension of a water line from Route 120 to Brittany Park along Ringwood Road for possible inclusion in next years budget. Voting Aye: Bolger, Lieder, Mc CI atchey, Nolan, Smith, Snell, Serritell a, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Serritell a, to authorize the Public Works Superintendent of Public Works to purchase a 36 inch replacement bucket Purchases for the Case backhoe at a cost of $1,102 from George P. Freund & Son. Voting Aye: Bolger, Lieder, Mc CI atchey, Nolan, Smith, Snell, Serritel l a, Teta. Voting Nay: None. Absent: None. Motion carried. Wednesday, December 3, 1986 Page 3 Motion by McClatchey, seconded by -Teta, to authorize the Super- intendent of Public Works to purchase a rebuilt Simplex time Public clock for the Public Works department at a cost not to exceed $1 ,600. Works - Voting Aye: Lieder, McCl atchey, Nolan, Purchases Smith, Snell, Serritella, Teta. Voting Nay: Bolger. Absent: None. Motion carried. Mayor Busse called for a recess at 9:27 P.M, The meeting recon- vened at 9:43 P.M. with everyone still in attendance., Motion by Smith, seconded by Serritella, to grant a Christmas bonus to full-time and regular part-time employees of $50 and $25 to Employees part-time employees. Voting Aye: Bolger, Lieder, McCl atchey, Nolan, Smith, Srel l , Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Teta, to authorize and approve public payment to Reed Randall Tractors of Libertyville for a Ford backhoe in Works - the amount of $33,950, purchase of which was approved at a previous meet- purchases ing. Voting Aye: Bolger, Lieder, McCl atchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Snell to pass an ordinance Ordinances establishing a yield sign on westbound First Avenue at its intersection with Washington Street. Street Voting Aye: Bolger, Lieder, McCl atchey, Nolan, Signs Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Lieder, seconded by Snell , to pass an ordinance annex- ing the Lakeland Park Property, Owners Association lake bottom property as Ordinances outlined in the ordinance as presented. Voting Aye: Bolger, Lieder, McCl atchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Annexations Motion by Smith, seconded by Snell , to amend Page 107 of the Zoning Ord. proposed City of McHenry Zoning Ordinance to conform with the agreement between the residents of Glacier Ridge and McHenry Sand & Gravel for Revisions hours of operation as presented. Motion by Snell , seconded by Lieder, to go into executive Executive session at 10:21 P.M. for the purpose of discussing pending litigation Session and property acquisition.
