The Special Meeting of the McHenry City Council was called to order by Mayor Busse on Monday, December 1, 1986 at 7:30 P.M. at City Council Hall . At roll call the following Aldermen were present: Bolger, Lieder,tt McCI atchey, Nolan, Smith, Snell, Serritell a, Teta. Absent: None. City Aendance staff in attendance were Attorney Narusis, Building and Zoning Officer John Zabor and Kathy Kunzer of the City Clerk's office. Also in at- Special tendance was John Gann of Gann Associates. Mtgs. Mayor Busse announced that this was the continuation of the No- Zoning Ord. Revisions vember 24, 1986 Meeting regarding deliberations on adoption of the pro- posed City of McHenry Zoning Ordinance. Busse announced that since the last meeting, he had visited with Allen Miller of McHenry Sand & Gravel regarding the hours of operation for the gravel pit. He was informed by Miller that from time to time there are periods when the washing process does operate beyond the 5 A.M. to 9 P.M. time frame which were the hours the Council adopted at the last meeting. McHenry Sand & Gravel petitioned the County and agreed it would operate under the County hours similar to what the City adopted last year. The only difference that needed to be clarified was that the pe- tition last year was for extraction only in that area and not washing op- erations which would be subject to those hours. At the present time, the gravel pit operates a washing process 24 hours a day, six days a week. The washing operation uses a diesel water pump which creates noise. McHenry Sand and Gravel also operates an enclosed washer at the Possum Run pit on a nearly year round basis. No noise is detectable from that washer because it is enclosed. Miller told the Mayor that to enclose the present washing device at the Sherman Hill pit at this point in time didn't make economic sense since it is anticipated that the equipment would be replaced and moved to a new location at some future date. Miller did indicate willingness to convert the diesel water pump to electric next spring. The issue last week was the noise and noise abatement during the early morning hours. Busse felt it was the duty of the City to fa- cilitate some additional meaningful discussion between the Millers and the complaining residents in an effort to work out a mutual agreeable compromise between those two parties. Busse said he talked to the four Aldermen who voted in favor of the County hours last week and they fel t that if the City did look at some type of interim transitional period it could be done through the extension of the conditional use permit which is coming before the Council Wednesday night. He felt this issue has clearly divided the Council and the City in some respects in the past. He said he would do whatever it takes to seek a reasonable solution that would be a compromise to the parties involved would result in what is best for the City as a whole. Discussion was held between the Aldermen as to methods to take to get the issue resolved. Since Allen Miller of McHenry Sand & Gravel was in the audience, the Council decided to ask questions regarding some of their concerns about the washing and maintenance operations. Tom Rupp, spokesman for the residents of the Glacier Ridge and Woodcreek areas, commented from the audience that if Miller was going to speak he should also be allowed to make a statement. Mayor Busse replied that the Council established guidelines for the zoning deliberations which stated that when there were any questions, the Council would address them to a certain individual but it was not going to allow statements. Numerous questions were then asked of Miller regarding the hours of operation, the expense of enclosing the diesel water pump, the noise abatement factors, etc. Tom Rupp was then asked what type of noise most of the complaints were about, what time it was most bothersome, etc. When asked if there was any room for compromise, he replied "yes". Mayor Busse asked if Rupp and Miller could meeting Tuesday morning at City Hall at 11:30 a.m. to discuss their concerns and work out a compromise on the surface mining operations. They both agreed to attend the meeting. Motion by Nolan, seconded by Bolger, to restore the washing and maintenance operation to 24 hours a day as was previously stated. Tabled Voting Nay: Bolger, Nolan, McClatchey, Smith. Motions Absent: None. There being a tie vote Mayor Busse cast an Aye vote and declared the mo- tion carried. At the last meeting the EDC presented a proposal to increase the density by ap- proximately two persons per acre. Alderman Bolger made a motion to ac- cept the Economic Development Commission proposal but the motion failed for lack of a second. Mayor Busse felt that there was not a significant difference be- tween the EDC proposal and the density proposed in the revised Zoning Or- dinance. Other Aldermen said they had given the matter further thought and would like to reconsider the density proposal. When asked his opin- ion, John Gann stated that the EDC's proposed increment was small com- pared to what was originally proposed and that is a policy decision. He said that site plans and landscape requirements in the new ordinance would help control the aesthetics of multi -family projects. David Gelwicks of the EDC stated that the addition of one or two units per acre could make a difference of about $12,000 a year and make multi -family complexes financially feasible.. Zoning Ord. Motion by Teta, seconded by Snell, to Revisions multi -family density and retain the conditional additional density as outlined on Page 36. Voting Aye: Bolger, Lieder, Nolan, Smith, Snell, Serritella, Voting Nay: McClatchey. Absent: None. Motion carried. adopt the EDC proposal for use approval for RM-2 for Teta. The Commercial Section of Page 39 thru 45 of the Zoning Or- dinance was discussed but no changes were recommended. The Office and Commercial Section on Pages 46 thru 51 was then discussed. Motion by Bolger, seconded by Teta, that on Page 50, Group T, Section 9 - to delete all of Section 9 after the words "Performance stan- dards herein." Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Alderman Snell left the meeting at 9:00 P.M. The Off -Street Parking and Loading Section of the Ordinance, Pages 52 thru 63, were then reviewed. Motion by Teta, seconded by Serritella, on Page 60, Table 12 Residential (a) be retained as is. oti ng Aye: Lieder, McClatchey, Nolan, Smith, Serritella, Teta. Voting Nay: Bolger. Absent: Snell. Motion carried. Mayor Busse called for a recess at 9:15 P.M. The meeting re- convened at 9:27 P.M. with all Aldermen still in attendance. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Serritella. Voting Nay: None. Absent: Snell. Abstain: Teta. Motion carried. Motion by Smith, seconded by McClatchey, that on Page 55, Sec- tion 7 B. second paragraph - delete the entire second sentence. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Serritella, Teta. Voting Nay: None. Absent: Snel 1 . Motion carried. Motion by Serritella that on Page 60, Table 12 (a) to delete the last sentence which states that "No more than four spaces shall be provided per dwelling unit" on the condition that language be in- corporated into the Ordinance stating that anymore than four vehicles must be parked in a driveway or on a paved parking area of some kind. Motion failed for lack of a second. Motion by McClatchey, seconded by Nolan, not to delete the last sentence on Page 60 Table 12 (a) which stated that "No more than four spaces shall be provided per dwelling unit." Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Teta. Voting Nay: Serritella. Absent: Snell. Motion carried. Motion by Lieder, seconded by Serritella, that on Page 54, Sec- tion B, Paragraph 4 - the first phrase "Except in the case of single fam- ily detached dwelling" be deleted from the first paragraph and that lan- guage be added that any expansion of existing off-street parking must be constructed of the same material as the existing driveway surface. Voting Aye: Lieder, McClatchey, Smith, Serritella, Busse. Voting Nay: Bolger, Nolan, Teta. Absent: Snell. Motion carried. Motion by Nolan, seconded by Lieder, that on page 54, Section B., No. 4 - an additional provision shall be made that for single family residences only, approved crush gravel surfaces for driveways will be al- 1 owed. Voting Aye: Bolger, Lieder, Nolan, Serritella, Teta. Voting Nay: McClatchey, Smith. Absent: Snell. Motion carried. It was the consensus of opinion to set another meeting date for deliberation on the Zoning Ordinance to Monday, December 8, 1986 at 7:30 P.M. Motion by Smith, seconded by McClatchey, to adjourn.
