The regular meeting of the City Council was called to order by Mayor Stanek on Monday, November 29, 1982 at 8 P.M. At roll call the follow- ing aldermen were present: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Absent: Pepping. Other city personn 1 in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Police Chief Pasenelli, Park Director Merkel. Motion by Datz, seconded by Meurer, November 15, 1982 Regular Meeting as presented Voting Aye: Nolan, Busse, Datz, Wie Voting Nay: None. Absent: Pepping. Motion carried. Motion by Datz, seconded by Wieser, to pass an ordinance providing for the annexation of the Gradishar property located at 616 S. Rt. 31. Motion by Nolan, seconded by Busse, to pass an ordinance zoning the Gradishar property as B-1 Commercial Retail District (except as to residential use which will not be allowed on the subject premises). Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella,Meurer. Voting Nay: None. Absent: Pepping. Motion carried. Council Meeting Attendance Motion by Wieser, seconded by Serritella, to accept the recommenda- tion of the Zoning Board of Appeals and pass an ordinance granting the variations requested by petitioner Thomas P. Mathews for property at 4102 and 4104 W. Elm Street. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping. MRtion carried. Motion by Nolan, seconded by Busse, to approve the agreement with Elgin Federal Savings regarding development of McHenry Lakes Estates as presented and to authorize the Mayor and Clerk to sign said agreement. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping. Motion carried. Motion by Smith, seconded by Meurer, to pass an ordinance amend- ing the Municipal Vehicle Code and establish the speed limit on Elm Street from Park Lane to the West City limits from 40 to 45 m.p.h.as designated by the State. Voting Aye: Nolan, Busse, Datz, Wiser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping. Motion carried. Motion by Wieser, seconded by Datz, to authorize and approve payment to Baxter & Woodman for $66.50 for work done on Modine Company sludge treatment with reimbursement to be made by Mo ine Company to the City. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping Motion carried. Monday, November 29, 1982 Page 2 Annexations The Mayor authorized the Special Committee he set up some time ago for review of forced annexations of islands of land in the Committees city,to again look at the situation and come back with a recommenda- tion as to annexation of said islands. Employees Motion by Datz, seconded by Serritella, to authorize and approve the payment of Christmas checks to full-time employees at $25 Authorizations and part-time employees at $10. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None.l Absent: Pepping. Motion carried. Parks Motion by Nolan, s conded by Serritella, to install pay phones about March 1, 1983 outside the storage and washroom building at Petersen Park, outside the bathhouse at Knox Park and at the bandshell in Pearl Street Park. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping. Motion carried. Authorizations Motion by Nolan, seconded by Busse, to authorize the City Attorney to draft an agreement for presentation to the State of Illinois McCullom Lk. Conservation Department regarding fish management of McCullom Lake whereby the city would delegate enforcement of horsepower licensing and other regulations on the lake to the McCullom Lake Conservation Club. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None.l Absent: Pepping. Motion carried. The Mayor declared a recess at 10:03 P.M. The meeting reconvened at 10:14 P.M. with all aldermen still in attendance except Pepping. Motion by Smith, seconded by Datz, to authorize and approve Authorizations payment of $500 to the Forum Insurance Co. which was the deductible due under the McHenry Shores Insurance Policy relating to the lawsuit Lawsuits entitled Norbert Sauers vs. the Village of McHenry Shores. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Aye: None. Absent: Pepping.) Motion carried. Motion by Nolan, seconded by Datz, to authorize and approve Employees payment of $390 to Sgt. Patrick Joyce as reimbursement for one semester credit hour of work at Aurora College in a course study of "Procedural Law for Criminal Justice Management". Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping. Motion carried. Executive Motion by Nolan, seconded by Meurer, to go into executive Session session at 10:32 P.M. for the purpose of discussing personnel matters. Voting Aye: Nolan, Busse, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Pepping. Motion carried. Monday, November 29, 1982 Page 3 Motion by Smith, seconded by Wieser to deny the request of Police McCullom Lake Police Chief Earl Murray for us of McHenry Police officers Misc. to administer breathalizer tests to persons a rested by the McCullom Lake Police Department.
