The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek on -Monday, November 21, 1983 at 8:00 P.M. in city hall. At roll call the following aldermen were present: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Absent: Datz. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Mayor Stanek introduced the following prominent individuals in attendance at the meeting. Senator Prescott Blume; Jim Ashbaugh, Nora O'Malley, Jeffrey Ladd, John Daily, Hank Tonyan and Donald Hudspeth, all connected with McHenry Hospital; Ralph Campbell of Ralph Campbell and Associates;and Al Jourdan, Republican State Central Committeeman and McHenry County Auditor. Motion by Snell, seconded by Serritella, to accept the minutes of the November 7, 1983 Regular Meeting as presented. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Attorney Ladd addressed the City Council regarding issuance of $2,000,000 in Industrial Revenue Bonds to finance the new medical arts building at the McHenry Hospital site. Motion by McClatchey, seconded by Nolan, to pass a resolution authorizing the execution of a memorandum of agreement for the issuance of $2,000,000 in Industrial Revenue Bonds to NIMED Corporation and to authorize the Mayor and City Clerk to sign said resolution subjectto receipt of proper documentation ardthe approval of the City Attorney. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Motion by Nolan, seconded by McClatchey, to accept a grant of an easement from NIMED Corporation for a 25 foot wide strip of land located south of andimmediately adjacent to the right-of-way of Bull Valley Road for the inst.allation,maintenance,repair and replacement of surface drainage ditches, sub -surface sanitary sewer, storm sewer and water lines, and to authorize the Mayor and Clerk to sign said agreement subject to receipt of proper documentation and the approval of the City Attorney. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Motion by Smith, seconded by Serritella, to enter into a Sewer Line Recapture Agreement with NIMED Corporation and to authorize the Mayor and City Clerk to sign said agreement subject to receipt of proper documenta- tion and the approval of the City Attorney. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Motion by Busse, seconded by Bolger, to enter into a Water Line Recapture Agreement with NIMED Corporation and to authorize the Mayor and City Clerk to sign said agreement subject to receipt of proper documen- tation and approval of the City Attorney. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Council Mtg. Attendance Guests Resolutions McH. Hospital Motion by Nolan, seconded by Bolger, to accept the dedication of Streets & Medical Center Drive, Lawrence Avenue and the adjoining utility easements Easements along with variations as listed in the agreement and to authorize the Mayor and MCH. Hospital Monday, November 21, 1983 Page 2 City Clerk to sign said agreement subject to receipt of documentation and the approval of the City Attorney. Motion carried. proper Smith, Snell, Awards George Erkenswick, President of the McHenry Police Officers Assoc. appeared before the council along with three young men to pre- sent awards for outstanding service to the community. On November 12, 1983 Shawn and Ronald Raiford along with Stanley Parlow discovered the body of a man floating in the Fox River. They immediately notified the McHenry Police Department and with the help of the Rescue Squad were able to restore breathing to the victum. Mayor Stanek expressed appreciation to the young men for the quick action on behalf of the City Council and of the citizens of McHenry. ,Sign Permits & Motion by Busse, seconded by Nolan, to grant a sign varia- Variations tion to Hillcrest Apartments for installation of two signs on their property. Area providing for the abatement of the Real Estate taxes levied in 1983, Approp & Levy payable in 1984, in the amount of $36,000.00 for principal and interest as authorized by City of McHenry Ordinance No. 0-82-298. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Water/Sewer Motion by Nolan, seconded by Bolger, to accept the following Misc. Extension improvements in Winding Creek Subdivision Unit II,Phase I as outlined & Streets in Baxter & Woodman's letter of August 12, 1983 as follows: Accept the watermains and house service lines to the lot lines; the Phase I sanitary sewer system; storm sewer systems and Phase I streets less the final surface coarse. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Parks - Motion by Smith, seconded by Busse, to authorize and approve Auth. the payment of $42,036.00 to William Tonyan & Sons Inc. for payment No. 1 on the Petersen Park garage and concession stand building and to authorize the contractor to install 5/8 inch sheet rock as a ceiling -in the building. Pavement Striping Co. in the amount of $19,740.90 for the Maint. & Slurry Seal portion of the 1983 Summer Street Maintenance Program. Motion by Nolan, seconded by Bolger, to authorize and approve Sewer Dept payment of $81,426.00 to Illinois Hydraulic Construction Co. as payment Repairs & Estimate No. 1 for installation of the centrifuge as recommended by Improvemts. Baxter & Woodman with payment to be made from the Capital Improvement Fund. Voting aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Mayor Stanek informed the Council that he had met with officials from IDOT regarding the possibility of constructing sidewalks along FAU Routes within the City of McHenry and using FAU monies. He was informed that'is was possible to use these monies for this type of project. Motion by McClatchey, seconded by Bolger, to authorize the Mayor IDOT & to pursue using FAU funds for a sidewalk program throughout the city and Sidewalks the keep the Council informed of any further progress. Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Serritella. Voting Nay: None. Absent: Datz. Motion carried. Mayor Stanek also reported that IDOT officials had advised him of proposed improvements on Route 31 from Route 120 to High Street. They felt the following was possible in this corridor, namely: 1) Build three lanes with the center lane being a turning lane; 2) Maintain parking on the west side of the highway from Route 120 to James Street; 3) Install sidewalks on both sides of the project improvement to High Street; 4) In- stall traffic signals at Lillian Street and Route 31 which are warranted. If the City agrees with this cross-section, it would be required to pay: 1) One-half' the maintenance costs on the traffic signals and all the energy costs; 2) Relocation of city -owned utilities in the area; 3) Side- walk expense - 75% could come from FAU moneys and 25%, from whatever funds the city deems fit; 4) Some costs incurred for the parking spaces. It was the Mayor's feeling that the three lanes with a turning lane is the only feasible solution because there is only a 66-foot right- of-way from James Street to Route 120. In the Overton area, only two lanes forward are presently accommodated. Drainage considerations also entered intro hisdetermination. Motion by Serritella, seconded by Bolger, to accept in concept IDOT & the proposed improvement of Route 31 from Route 120 to High Street. Street Voting Aye: Bolger, Nolan, Busse, McClatchey, Smith, Snell, Maint. & Serritella. Repair Voting Nay: None. Absent: Datz. Motion carried. A letter was presented from Thomas F. Bolger, collector of Special Assessments for the Lakeland Park Special Assessment Project, in which he suggested that since the final installmentsof the Lakeland Park Assessment accounts were due and payable as of January 1, 1983, that collection and maintenance of the remaining delinquent accounts as well as the balances in the Lakeland Park Special Assessment princi- pal and interest accounts be handled through the City Clerk -Collectors office. His reason for this request was that with both the bank and the city collecting these delinquent accounts unnecessary confusion resulted in the final accounting. The accounts could be turned over to the City Clerk —Collectors office as of December 1, 1983. Motion by Snell, seconded by Busse, to authorize transfer of, Special maintenance and collection of,the delinquent accounts in the Lakeland Assmts. Park Special Assessment principal and interest accounts;and their balances be turned over to the City Clerk —Collectors office as of December 1, 1983. Trans. ment of Transportation had advised him that the City of McHenry had been awarded a grant in the amount of $51,450.00 for land acquisition and McH. Township engineering for a commuter parking facility on the south side of Main Agreements Street west of the Chicago Northwestern Railroad tracks. Further details will be forthcoming. He also announced that an intergovernmental agreement with McHenry Township is being discussed for snowplowing, use of a road striping machine and use of an aqua -jet to assist both the City of McHenry and the McHenry Township Road district. The final draft will be presented at the December 5, 1983 Council Meeting. Mayor Stanek called for a recess at 9:30 P.M. The meeting reconvened at 9:38 P.M. with everyone still in attendance. Alderman Smith reported that he had seen raw sewerage dumped from the aqua -jet in a storage bin at the city garage. The Mayor and Supt. were authorized to look into the problem and see that the dumping was remedied immediately. Bldg. & Zoning Dept. Alderman Bolger reported on a Water/Sewer Committee meeting held recently. Discussion was held on possible increase in the water fees to finance construction of a new water tower. Problem of serious infiltra- tion into the sewer lines throughout the city was also discussed. The committee was recommending that Baxter & Woodman be authorized to work up a cost estimate to check the infiltration problem in the Country Club area to see if the city could afford to remedy the problem. Motion by Bolger, seconded by Busse, to contact Baxter & Woodman and ask for a cost estimate to remedy the infiltration problem in the Country Club area.
