TUESDAY, NOVEMBER 20, 1990
A Special Meeting of the McHenry City Council was called to
order by Mayor Busse on Tuesday, November 20, 1990 at 7:30 P.M. in City
Hall. At roll call the following Aldermen were present: Bolger,
Donahue, Teta, Lieder, Smith, McClatchey, Patterson, Serritella.
Absent: None. City Staff in attendance were: City Clerk Gilpin, City
Administrator Peterson, Director of Public Works Batt, Parks and
Recreation Director Merkel, Building and Zoning Officer Halik. Absent:
Chief Joyce, Attorney Narusis. Also in attendance was Cheryl Barone,
court reporter.
Mayor Busse announced that the purpose of the Special Meeting
was to consider extension of the Annexation Agreement for the Backhaus -
Brackmann property including a new planned unit development concept plan
for that property, and also to discuss Developer Donation Fees and
Capital Improvement Fees.
Representing the petitioners for the Backhaus - Brackmann
property were owner/developer David Backhaus, his attorney Richard
Curran, and his land planner Theodore Johnson of Thompson, Dyke and
Associates. Backhaus said that they planned to annex an additional 8.5
acres on Crystal Lake Road and 15 acres on Curran Road in addition to the
original 385 acres which was annexed into the City in July of 1979.
Parcel 1, on the corner of Crystal Lake and Bull Valley Roads,
contains approximately 44 acres and is proposed to be developed with
mixed uses including 85,000 square feet for commercial, 40,000 square
feet for office, 160 units for multi -family apartments, and 116 units for
multi -family four-plex townhomes. Parcel 2, which fronts on Curran Road,
contains approximately 182 acres or 205 acres, depending on the alternate
plan. Two plans were presented: Alternate A and Alternate B. The
proposals included single family homes, multi -family townhouses, and park
open space.
Land planner Johnson reviewed the concept plans in detail.
Backhaus said that he would be stepping into the roll of developer for
this entire project.
Busse noted that previous commitments in the original Annexation
Agreement had not been adhered to such as the construction of a bridge on
Dartmoor Drive to connect Crystal Lake Road and Curran Road. Also, the
performance of certain other items in the Annexation Agreement had not
been done. Attorney Curran said they would accept the responsibilities
for those commitments in the Annexation Agreement.
Busse said that he felt before anything could be developed in
either parcel, the Council should receive a commitment on the
construction of that bridge. He also said the issue of the bridge
construction should be settled before the first building permit is
issued. Attorney Curran said that could be put into the Agreement.
Motion by Serritella, seconded by Donahue, to grant a six month
extension on the Back haus-Brackmann Annexation Agreement effective from
November 5, 1990.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Serritella.
Voting Nagy: Patterson.
Absent: None.
Motion carried.
Mayor Busse called for a recess at 8:53 P.M. The meeting
reconvened at 9:06 P.M. with everyone still in attendance.
Discussion was then held on Developer Donation Fees for
schools. Alderman Lieder, Chairman of the Finance Committee, presented a
Developer Donation plan which represented his ideas for developing a
formula to be used in fuvlre years. It was his suggestion that
computations to determine r:,sts be updated every other year, beginning
with the Developer Fees to be -;tablished to start on February 1, 1991.
It was also his reccnr:endation to eliminate the four and five
bedroom categories and treat. :ell new homes as having three bedrooms. He
felt all apartments should h: LTeated as having two bedrooms.

He then presented his Developer Donation/Cost-Revenue
Methodology. The present three bedroom fees are $2,400.00 for school
donations. He proposed a 1991 fee of $2,700.00. Lieder urged the
Council to adopt a plan that goes beyond 1991 and establish a formula to
determine ongoing Developer Donation Fees.
Discussion on the new charges has been going on for a long
period of time and the Council needed to move forward on this matter. He
urged the Council to make a decision on what 1s best for the whole
community, and come up with a formula that doesn't have to be
renegotiated every year.
Developers at the meeting were Don Meyer of Granite Builders,
John Cunat of Cunat Brothers, and Roger Gerstad of Gerstad Builders.
Mrs. Bertha Bladen was also in attendance.
Meyer addressed the Council and presented his calculations for
school Developer Donation Fees. He disagreed with Lieder's figure that
an acre of improved property was valued at $35,000.00. His figure was
$23,000.00 per acre. Under his formula, developer donations for schools
on a three bedroom home would be $1,700.00 instead of the $2,700.00
proposed by Lieder. He presented a 13 page document to back up his
computations.
Some Aldermen felt that developers should also be required to
make same donation to the City when development takes place. Right now
consideration is given to schools, parks and libraries, but none for the
City toward equipment, improvements, etc.
Meyer felt that the formula method was the way to go and it
would be beneficial to everyone. Every year the schools would know what
receipts to plan for, and the developer would know how to adjust his
prices. He felt the idea was a valid one, however he disagreed with some
of the numbers in the formula.
Following lengthy discussion, it was decided to schedule a
Special Meeting on Monday, December 17, 1990 at 7:30 P.M. to continue
discussion on the Developer Donations and the Capital Development Fees.
Motion by Smith, seconded by McClatchey, to adjourn.
Voting Aye: Bolger, Donahue, Lieder, Teta, Smith,
McClatchey, Patterson, Serritella.
Voting Nay: None.
Absent: None.
Motion carried.
