The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, November 20, 1985 at 7:30 p.m. in City Council Hall. At: roll call the following Aldermen were present: Bolger, Lieder, Mtg. McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. City Attendance staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce. Motion minutes of the Voting by Serritella, seconded by McClatchey, to accept November 13, 1985 Regular Meeting as presented. Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. the Mayor Busse called to order a Public Hearing for the purpose of conducting a TEFRA Hearing on the Tyshenko Hotel Industrial Rev- enue Bond. At roll call the following Aldermen were present: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Absent: None. The Mayor reported that notice of a Public Hearing to be held at this meeting by the City Council on a proposed financing of an industrial project had been given by publication of an appro- priate notice on November 5, 1985 in the McHenry Plaindealer-Northwest newspapers, a newspaper having a general circulation within the City of McHenry. The Mayor announced that any tax payer, resident or other interested person would be given an opportunity to express their views orally or in writing for or against a proposed financing and the location and nature of the industrial project and the proposal for the City to issue its Industrial Development Revenue Bonds in a principal amount not exceeding $2,500,000 for the purpose of financing costs of an Indus- trial Project for McHenry State Bank as trustee under Trust No. 3428 for the benefit of John Tyshenko and Tamara Tyshenko, residents of Lake Geneva, Wisconsin. Attorney Samuel Diamond, representing McHenry State Bank and John and Tamara Tyshenko, described the proposed industrial project which consists of the acquisition, construction and equipping of a 55 to 58 unit motel with a banquet hall for up to 400 people, indoor swimming pool, whirlpool, restaurant and cocktail lounge on an approximate 10 acre tract of land located on the west side of Illinois State Route 31 approximately 1,650 feet south of Bull Valley Road and abutting the present Northern Illinois Medical Center pro- perty in the City of McHenry and which project is to be leased to and operated by Tyshenko Inc., an Illinois Corporation as a motel and related facilities. Mayor Busse asked if there were any comments from persons in attendance in the audience. There was no reply. The Mayor asked if any written comments had been submitted at the Office of the City Clerk prior to the meeting. She replied that none had been received at her office. After all taxpayers, residents and other interested persons who desire to do so had expressed their views orally or in writing for against the proposed financing and the location and nature of the industrial project, the Mayor directed that the Public Hearing be closed. Voting Nay: None. Absent: None. Motion carried. John Durkin, of Arthur Gallagher & Co. addressed the Council concerning renewal of property, liability, automobile and crime coverage insurance. Durkin reported that International Insurance Company was offering the City a complete and competitive renewal program with a risk management approach. Alderman Lieder, Chairman of the Finance Committee reported that the Finance Committee recommended acceptance of the proposal as presented by Gallagher. Basic cost of the insurance would be $61,421 which was a 42 percent increase over last year. Using the 1985 loss figures, the premium would be $73,679 for a 71 percent increase. If the City experiences maximum losses of $85,000, the cost of insurance premiums could be $146,421 or a 340 percent increase. Alderman Teta asked that he be allowed to check the figures with his constituents at Allstate Insurance Company. Motion by Lieder, seconded by Bolger, to accept the Insurance insurance proposal as presented by Gallagher and if additional information is received from Alderman Teta after he reviews the policy program a Special Meeting would be called to reconsider the matter. Wednesday, November 20, 1985 page 5 Motion by Bolger, seconded by Serritella, to pass a resolution providing for the financing by the City of McHenry, McHenry County, Illinois, of an Industrial Project, authorizing the issuance of a $1,750,000 Industrial Development Revenue Bond, Series 1985 (McHenry Motel Project) and confirming the sale thereof; and authorizing the execution and delivery of a loan agreement, a mortgage and security agreement, and indenture of trust, a bond purchasing agreement and related documents. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse reported that the total cost of oversizing the sanitary lines at the J.B. & Clara subdivision (Tyshenko Motel Project) was $46,745. Attorney Diamond said that Tyshenko had entered into a contract with Gluth Brothers Construction for subdivision improvements and the oversizing of the lines. Tyshenko would enter into an agreement with the City to pay their share for oversizing of the lines. Motion by Nolan, seconded by Bolger, to enter into an agreement with Tyshenko for oversizing the lines at an approximate cost of $46,745 subject to review of the improvement by City Engineers Baxter & Woodman. Motion by Bolger, seconded by Snell, to change the Regular City Council Meeting of Wednesday, December 18, 1985 to Monday, December 16, 1985. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella. Voting Nay: Teta. Absent: None. Motion carried. Motion by McClatchey, seconded by Serritella, to call a Special Meeting on Monday, December 9, 1985 at 8:00 P.M. for the purpose of discussing the review of the Zoning Ordinance with consultant John Gann & Associates. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Mayor Busse announced that he was appointing Aldermen Serritella, McClatchey, Nolan and Teta to the Environmental Advisory Committee with Alderman Nolan to serve as Chairman. He asked that interested persons submit applications to also serve on this committee. Motion by Serritella, seconded by McClatchey, to accept the low bid of Flowerwood of Crystal Lake to draft a landscape plan for Pearl Street Park at a cost of $2,500 with payment to be made from the Developer Donations Fund. Voting Aye: McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: Bolger, Lieder. Absent: None. Motion carried. Motion by Serritella, seconded by McClatchey, to instruct the Park Director to actively pursue construction of the Gazebo in Pearl Street Park so that it could be completed by June 15, 1986. Sewer Line Motion by Bolger, seconded by Smith, to grant the request of Repairs Superintendent Batt and authorize the expenditure of up to $2,000 for televising the sewer line between Elm and Pearl Streets on Riverside Drive. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None. Motion carried. Motion by Bolger, seconded by Nolan, to authorize the Mayor to sign an engagement letter with Yapelli & Ketchmark of Crystal Lake Audits for audit of the Green Street Lift Station and Pioneer Center Grant at a cost of $1,200 with payment to be made from the Grant Fund and to authorize the Mayor to sign an engagement letter with Yapelli & Ketchmark for an audit of the Revenue Sharing Funds at a cost of $1,000 to be paid from the Revenue Sharing Fund so as to be in compliance with the Federal Revenue Act and Regulations. City Clerk announced that a letter had been received Council November 18, 1985 from Sam Diamond, Attorney for Cunat Brothers, Mtgs.- requesting that they be allowed to withdraw their petitions for Special annexation and zoning for multi -family housing on property located on Mtgs. Green Street abutting the south side of Knox Park. A notice was published for a Special Council Meeting to be held December 2, 1985 at 7:30 P.M. for a proposed annexation agreement. This meeting would be cancelled. Motion by Smith, seconded by McClatchey, to adjourn. Voting Aye: Bolger, Lieder, McClatchey, Nolan, Smith, Snell, Serritella, Teta. Voting Nay: None. Absent: None.
