The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, November 18, 1987 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Lieder, Council McClatchey, Patterson, Smith, Serritella, Teta. Absent: Nolan. City Mtg• staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Park Attendances Director Merkel, Chief Joyce. Eulogies for former City Clerk Earl R. Walsh who died November 14, 1987 were given by Alderman Bill Bolger and Ray Smith. A moment of silence was observed in tribute to Mr. Walsh who served as City Clerk for 38 years. Mayor Busse called to order a Public Hearing to consider the proposed issuance by the City of McHenry of its 13,900,000 aggregate principle amount insured Multi -Family Housing Revenue Bonds (InDeBonds- TM) (Westside Crest Apartments Project), (The "Bonds"), the proceeds of which will be loaned to McHenry State Bank, not personally, but soley as Trustee under Trust Agreement dated as of October 2, 1987 and known as Public Trust No. 4168, an Illinois land trust of which Brian G. Cunat and John Hearing C. Cunat each own a 50% beneficial interest in said trust, and Westside Industrial Crest Limited Partnership, an Illinois limited partnership of which Brian Revenue G. Cunat and John C. Cunat are general partners (collectively, the Bonds "Borrower") to be used by the Borrower to finance the costs of acquisition of a site for, consisting of approximately 5.2 acres, and the construction of a 2-story building, containing approximately 96 residential rental apartments, consisting of approximately 88,000 sq. ft., to be located at 709 Mill Street, in the City of McHenry. Brian Cunat and his Attorney, Sam Diamond, were present at the hearing. Mayor Busse asked if any written or oral comments had been presented to the City Clerk's office for presentation at this hearing. The City Clerk replied that no written or oral comments had been presented to her office. Mayor Busse asked if anyone in attendance had any written or oral comments to present regarding this project. There was no reply. Motion by McClatchey, seconded by Lieder, to adjourn the Public Hearing at 8:18 P.M. Voting Aye: Bolger, Teta, Lieder, McClatchey, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Lieder, seconded by Patterson, to accept the minutes of the November 4, 1987 Regular Meeting as presented. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Bolger, seconded by Serritella, to pass a resolution Resolutions providing for the financing by the City of McHenry of a multi -family IRB's housing project consisting of buildings, construction, equipment and related property in order that Westside Crest Limited Partnership may be Agreements provided with facilities to relieve conditions of unemployment and encourage the increase of commerce; authorize the issuance of its $3,900,000 Insured Multi -Family Housing Bonds (In DeBonds-TM), Westside Crest Apartments Project in connection therewith; authorizing the execution and delivery of a loan agreement between the City of McHenry, Illinois and Westside Crest Limited Partnership; authorizing the execution and delivery of a trust indenture securing said bonds; and authorizing the execution of a bond purchase agreement providing for the sale of said bonds to the purchaser thereof and related matters. Voting Aye: Bolger, Teta, Lieder, h1 Clatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. The question arose as to the number of street lights to be installed on Orleans in McHenry Lakes Estates Unit 4. The matter was Street Lights referred to the Street and Sidewalk Committee who are to return to the Council with their recommendation at a future meeting. Wednesday, November 18, 1987 Page 2 Motion by Teta, seconded by Patterson, to concur with the recommendation of Baxter & Woodman and approve a reduction in the Letter of Credit for Winding Creek First Addition to Unit 2, from its present Letters of value of $33,758.00 to $3,094.00 contingent upon the City's receipt of Credit "As -Built" plans and the receipt of an open-end guarantee bond in the amount of $6,132.80 warrantying the materials and workmanship of the completed work, said warranty to commence on the date of said reduction on the letter of credit and end one year after the completion and acceptance by the City of all facilities within the subdivision. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Notion carried. Motion by McClatchey, seconded by Smith, to concur with the recommendation of Baxter & Woodman and approve the reduction in the Letter of Credit for McHenry Lakes Estates Unit 2 from its present value Letters of of $41,000 to $8,062 contingent upon receipt of "As -Built" plans and the Credit receipt of an open-end guarantee bond in the amount of $6,587.60 warrantying the materials and workmanship of the completed work, said warrantee to commence on the date of said reduction on the Letter of Credit and end one year after the completion and acceptance by the City of all facilities within the subdivision. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Teta, seconded by Smith, to concur with the recommendation of Baxter & Woodman and approve the reduction in the Letters of Letter of Credit for McHenry Lakes Estates Unit 4 from its present value Credit of $455,652 to $72,500, subject to the receipt of "As -Built" plans and the receipt of an open-end guarantee bond in the amount if $76,630 warrantying the materials and workmanship of the completed work, said warantee to commence on the date of said reduction on the Letter of Credit and end one year after the completion and acceptance by the City of all facilities within the subdivision. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Attorney Steve Cuda, representing Fairchild Estates, addressed the Council concerning a plat correction for lot dimensions. Plats Motion by Patterson, seconded by McClatchey, to approve the plat of correction as presented for Fairchild Estates for change of Lot dimensions only. Voting Aye. Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Appointments Mayor Busse announced the appointment of Loretta C. Wilhelm to the Landmark Commission for a two year term. Landmark Motion by Bolger, seconded by Teta, to approve the Mayor's Commission appointment of Loretta C. Wilhelm to the Landmark Commission with her term to expire April 30, 1989. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Sign Permits Motion by Smith, seconded by McClatchey, to approve the sign & Variations variation request of Rose Lillegard for the Some Other Nuts store at 1252 N. Green Street. Voting Aye: Bolger, McClatchey, Smith, Patterson, Serritella. Voting Nay: Teta, Lieder. Absent: Nolan. Notion carried. City Attorney Narusis was directed to start legal proceedings Building & against Harold Roy Zickafoose of 1118 Manchester Mall for violation of Zoning the zoning code. Violations A license with Chicago and North Western Transportation Company for a sewer line crossing of its right-of-way to serve Winding Creek Unit 5 was discussed. Motion by Smith, seconded by Serritella, to approve the license Chicago & with Chicago and North Western Transportation Company conditioned upon NW Transp. the City Attorney attempting to renegotiate the annual fee for the Co. railroad crossing from $180 to a lesser fee and to authorize the Mayor and Clerk to sign said license. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Lieder, seconded by Bolger, to authorize and approve payment to Wm. Zeigler & Son for partial payment in the amount of $35,280 Purchases - for work on the Wastewater Treatment Plant aerobic digester air piping Sewer Plant replacement as recommended by Baxter & Woodman. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Mayor Busse declared November 15 - 21, 1987 as American Education Week and urged all citizens to make a commitment to public Proclama- education and to the future of the City of McHenry children by visiting tions their local public schools and donating their time and talents to help make the public schools even better. Mayor Busse called for a recess at 9:26 P.M. The meeting reconvened at 9:42 P.M. with everyone still in attendance. Snowplowing Motion by Smith, seconded by McClatchey, to approve the Outside City snowplowing by the City of Fegers subdivision at a cost of $560 and for Limits Country Club Subdivision at a cost of $350 on the condition that the City will determine at the end of the season exactly how much time was spent plowing the subdivision streets and if an excess amount of time was required the subdivisions would receive a supplemental statement for charges. Parking - The matter of parking restrictions in the Green Street parking Regulations lot was referred to the Street & Sidewalk Committee for a recommendation. and Lots Motion by Smith, seconded by Bolger, to draft an ordinance Ordinances establishing 2 hour parking in the Court Street parking lot. Employees Motion by Teta, seconded by Patterson, to authorize the McHenry Police Commission to hire one additional officer for the Police Department. Motion by Smith, seconded by Serritella, to authorize the Mayor to negotiate the salary for a 'Finance/Personnel Administrator and to Employees return to the Council with his recommendation. Voting Aye: Bolger, Teta, Lieder, McClatchey Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan. Motion carried. Motion by Bolger, seconded by Serritella, to approve an expenditure of $500 but not to exceed $1,000 for repair of a grate at the Street Petals and Stem parking lot to be paid from MFT funds.
