The Regular Meeting of the City Council was called to order by Mayor Stanek on Monday, November 17, 1980 at 8 P.M. At roll call the following alder- men were present: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Absent: Adams. Also in attendance were City Attorney Narusis, City Clerk Gilpin, Police Chief Pasenelli, Shop Foreman Webar. Park Director Merkel arrived at 10:12 P.M. Motion by Nolan, seconded by Schooley, to accept the minutes of the November 3, 1980 Regular Meeting as read. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Mayor Stanek called to order the recessed Public Hearing on the McHenry Lakes Manor proposal for a Third Amendment to the Pre -Annexation Agreement. Attorney Narusis reported that Petitioner's Attorney Dan Curran notified him he was not ready to make his presentation tonight. Motion by Nolan, seconded by Harker, to recess the Public Hearing on the McHenry Lakes Manor Third Amendment to the Pre -Annexation Agreement to Monday, November 24, 1980 at 8 P.M. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Mr. Faigus, a representative of the Jack Jacobs Company, developers of K-Mart shopping centers,addresseidthe Council and requested the City's support for issuance of tax-free commercial revenue bonds in order to develop a shopping complex at the northeast corner of Elm Street and Ringwood Road. Faigus said that negotiations for tenancy on the site are nearly complete with the K-Mart store and a Jewel -Osco store. He estimated total cost of the development would be $7 to $7.5 million dollars. He pointed out, and Attorney Narusis agreed, that issuing the bonds would not affect the City's bonded indebtedness, nor would the City be liable for default if the bonds were not paid. Narusis Monday, November 17, 1980 Page 2 explained that a recent law allows municipalities to be, in effect, issuing agencies for the bonds, which being municipal bonds are tax free. This form of financing allows the developer to get money at substantially lower interest rates and Faigus said that any profit accruing from the low interest money was not taxable because of the municipal status. He also said there was no obligation to the city and that the use of the city's name was merely a conduit to get tax-free status. Motion by Harker, seconded by Nolan, to agree with the concept of funding tax-free commercial revenue bonds as presented by Faigus. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Motion by Schooley, seconded by Wieser, to pass an Ordinance amending the Stop Sign Ordinance by authorizing installation of a stop sign at the east exit of Hornsby's Parking Lot onto Industrial Drive. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Motion by Harker, seconded by Datz, to request that the McHenry Public Library repay the City of McHenry General Fund for $15,716.64,said debt having incurred in the Library's payroll fund in the 1977 fiscal year, and to request that the debt be repaid prior to April 30, 1981 which is the end of the present fiscal year. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Mayor Stanek nominated Richard Hoover of 1305 N. Matanuska and Earl J. Osmon of 4815 W. Shore Drive, both of McHenry, to fill unexpired terms on the Plan Commission; Hoover would fill the unexpired term of Willis Martin to April 30, 1983 and Osmon would fill the unexpired term of Carl Smith to April 30, 1981. Motion by Schooley, seconded by Meurer, to approve the October Treasurer's report as presented. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Motion by Harker, seconded by Nolan, to accept the October Clerk's report as presented. Voting Aye: Meurer, Schooley, Wieser, Datz, barker, Nolan, Pepping. Voting Nay: None. Motion by Harker, seconded by Schooley, to authorize and approve pay- ment of Estimate No. 12 to Keno and Sons Construction Company in -the amount of $30,252.60 for sewage treatment plant additions as recommended by Baxter & Woodman Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Mayor Stanek called for a recess at 9:25 P.M. The meeting reconvened at 9:43 P.M. with all aldermen still in attendance. Mrs. Fran Olsen, Executive Director of the Chamber of Commerce, read a letter to the Council expressing appreciation on behalf of the Chamber for the many recent improvements made by the city throughout the parks and business Monday, November 17, 1980 Page 6 districts. She also expressed thanks for the fine cooperation of the Mayor, City Council and various departments of city government for assisting the Chamber in its numerous functions. Motion by Harker, seconded by Meurer, to purchase a new compressor for $750 and new valve operators for $3,600 for making repairs in Wells No. 5 & 6 as recommended by Baxter & Woodman. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. The Council authorized Mayor Stanek to write a letter to the Department of Conservation and Governor James Thompson expressing the city's concern regard- ing a report that the Volo Bogs property which is situated in the path of high- way FAP 420 is being considered for purchase by the Conservation Department. Motion by Harker, seconded by Popping, to amend Ordinance #MC-7563, Article 2, Section 26-17 regarding installation of water service lines and meters and that the ordinance be published in pamphlet form. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Mayor Stanek announced that on Monday, November 24, 1980 at 8 P.M., in addition to a Public Hearing on the Third Amendment to the Pre -Annexation Agreement for McHenry Lakes Manor, a Special Meeting would also be held to conduct any and all business which might properly come before the Council. Motion by Wieser, seconded by Nolan, to adjourn. Voting Aye: Meurer, Schooley, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: Adams. Motion carried. Meeting adjourned at 10:40 P.M.
