WEDNESDAY, NOVEMBER 13, 1985 7:30 P.M.
Regular Meeting of the McHenry City Council was called to order
by Mayor Busse on Wednesday, November 13, 1985 at 7:30 P.M. in city Council Mtgs.
hall. At roll call the following Aldermen were present: Bolger, Lieder, Attendance
McClatchey, Smith, Snell, Serritella, Teta. Absent: Nolan. City staff
in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Chief
Joyce, Park Director Merkel arrived at 7:40 P.M.
Motion by Smith, seconded by Serritella, to accept the minutes
of the Committee Meeting of the Whole on October 28, 1985 and the minutes
of the Regular Meeting of November 6, 1985 as presented.
Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell
Serritella, Teta.
Voting Nay: None.
Absent: Nolan.
Motion carried.
John Gann of Gann & Associates addressed the Council to
present an explanation of "Services of a contractor; schedule of work
performance and compensation" for consideration by the Council.
Gann had been retained to draft an assessment of the City of McHenry
Zoning Ordinance.
Motion by McClatchey, seconded by Snell, that the Council
enter into a contract with Gann & Associates to upgrade the City of
McHenry Zoning Ordinance from the scope of work as outlined in
Appendix A entitled Services of Contractor, as presented by Gann at a
cost of $8,865 for 10 meetings.
Voting Aye: Bolger, Lieder, McClatchey, Smith, Snell,
Serritella, Teta.

Absent: Nolan.
Motion carried.
It was the consensus of opinion that if fewer than 10
meetings are needed to complete Work Element A, the cost of the
contract would be prorated. It was also the understanding that the
Council could contract for additional work at a later date as to Work
Element B - "Presentation at Public Hearing"; Work Element C - "Ad-
ministration Procedure Study"; Work Element D - "Production of Zoning
Ordinance"; Work Element E - "Continuing Zoning Board Services". The
Mayor will appoint a committee to review the zoning revision drafts
within the next few weeks.
Motion by Smith, seconded by Snell, to accept the final
overlayment of streets in Martin Woods Unit I and Woodcreek Unit 1
subdivisions as recommended by Baxter & Woodman contingent upon the
receipt of a letter from Harding Realty that they will maintain and
repair Ojibwa Lane between Curran Road and Pin Oak Road if a problem
develops within the next year.

Serritella, Teta.

Park Director Merkel and Superintendent Batt reported that
they had received a cost estimate for storm water pumping for the
Knox Park drainange system. The system would consist of two one-half
horse power pumps with a two inch discharge. They could be easily
connected to the existing sanitary sewer lift station located east of
Public Works garage. The cost would be $2,000 plus.
Motion by Serritella, seconded by Bolger, to proceed with
installation of two pumps for storm water pumping at the Knox Park
drainage area.

October Treasurer's Report as presented.

Mayor Busse reported that Arnold May (doing business as
Hillview Farms) had applied to the Illinois Environmental Protection
Agency to renew its permit for receiving storing and land application
of sludge on their farm near Spring Grove, Illinois. The City of
McHenry has occasionally shipped dry sludge to this location. Mayor
Busse did not believe the City should take a position on the petition
because we do not know what else or who else is using the farm and we
do not know enough about the petition or the facts. He did believe
the City should support the petition of the McHenry County Department
of Health in requesting that a Public Hearing be held in McHenry
County to determine the merits of the permit application.
Motion by Teta, seconded by Serritella, to authorize the
Sewer- Mayor to send a letter supporting the petition of the McHenry County
Department of Health and request that a Public Hearing be held in
Misc. McHenry County on this matter.

Serritella, Teta.

Absent: Nolan.

Clerk Gilpin reported that a letter had been received from
the Illinois Department of Transportation concerning the Commuter
Parking Lot Project. Mr. John DeLaurentis of the Department of
Public Transportation advised that they had evaluated the circum-
stances surrounding the City of McHenry's bid opening for the
commuter parking lot project and could not concur with the City's
request to recommend that the bid be awarded to Alliance Contractors
of Woodstock. It was I.D.O.T.'s recommendation that neither of the
two bids be accepted and that the City should work with I.D.O..T.
toward the mutual goal of a successful bidding and project letting
early next spring.
Chicago & Motion by Snell, seconded by Bolger, to reject all bids on
NW Transp. the commuter parking lot project as per the recommendation of the
Co. Illinois Department of Transportation.

Council Motion by Serritella, seconded by Bolger, to establish a
Mtgs.- Special Meeting on Monday, December 2, 1985 at 7:30 P.M. to consider
Special the annexation agreement of Cunat Brothers for apartments on Green
Mtgs. Street instead of the November 5, 1985 date originally set.
Voting Aye: Bolger, Lieder, McClatchey,
Smith, Serritella, Teta.
Voting Nay: Snell.
Absent: Nolan.
Motion carried.
Parking Motion by Smith, seconded by Bolger, to eliminate one
Regula- parking space at the southeast corner of Park and Elm Streets so that

the City Council Chambers for a Police Seminar as requested by Chief
Joyce. Authorizations

Motion carried.
Clerk Gilpin reported that the 1985 summer sidewalk program
would not be done this year because Christian Construction, who was
awarded the contract, was unable to come up with a performance bond
and meet. the contract specifications which required that a per-
formance bond be submitted 15 days after the contract was awarded.
Motion by Teta, seconded by McClatchey, to reject all side-
walk bids and rebid the sidewalk project early next spring. Sidewalks

Mayor Busse instructed the Building & Zoning Committee to Cablevision
conduct a meeting in January regarding complaints about Cablevision's
failure to televise local programs that are of interest to the
community.
