THURSDAY, NOVEMBER 2, 1989
The Regular Meeting of the McHenry City Council was called to
order by Mayor Busse on Thursday, November 2, 1989 at 8 P.M. at City
Hail. At roll call the following Aldermen were present: Bolger,
Donahue, Lieder, Smith, Patterson, Serritella. Absent: McClatchey,
Teta. City staff in attendance were Director of Public Works Batt,
Attorney Narusis, Clerk Gilpin, Park Director Merkel, Chief Joyce.
No one signed up for the 10 minutes allowed for public input.
Motion by Bolger, seconded by Donahue, to accept the minutes of
the September 25, 1989 Special Meeting as presented.
Voting Aye: Bolger, Donahue, Lieder, Smith,
Patterson, Serritella.
Voting Nay: None.
Absent: Teta, hlcClatcney.
Motion carried.
Bob Tonyan and Jerry Zimmerman appeared with their Attorney,
James Militello, to address the Council concerning the proposed
annexation of 20 acres of land on south Route 31 near the present Tonyan
Industrial Park. They requested permission to appear before the Zoning
Board and the Plan Commission for subdivision of the property into 13
industrial lots.
Motion by Bolger, seconded

Motion by Bolger, seconded by Donahue, to instruct the City
Attorney to draft a petition for presentation to the Zoning Board of
Appeals to amend the text of the Zoning Ordinance as it relates to the
definition of bedrooms in connection with calculation of developer
donation fees, as recommended by the Building and Zoning Committee.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Motion by Smith, seconded by Patterson, to authorize the City
Attorney to draft an ordinance stating that one rear exit door of a
residential unit must nave a minimum clearance of 30 inches, as
recommended by the Building and Zoning Committee.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Director of Public Works Batt recommended that the City Council
grant Illinois Bell Telephone (IBT) easements along the City owned
portion of a route through the Green Street Parking Lot east to Court
Street for installation of certain conduit containing IBT cables in
connection with the State improvement project to Routes 31/120 over Boone
Creek.
Motion by Bolger, seconded by Smith, to instruct the Mayor and
City Attorney to enter into an agreement with Illinois Bell Telephone and
to grant easements as needed to replace conduits containing their cables
under the condition that Illinois Bell Telephone will pay for all costs.

John Gann of Gann & Associates who is working on the update of
the McHenry Comprehensive Plan requested that the Mayor get some
direction from the Council on three issues. In answer to his first
question - Does the City wish to modify the policy regarding new
multi -family development as originally endorsed on December 1, 1988? The
answer was no. In answer to the second question - Did the City want to
distinguish between single and multi -family residential areas on the new
plan map or should the plan map reflect "Residential" development with
no reference to density or housing type? The Council chose the latter
recommendation. The third question - Did the City Council wish to
designate certain areas as "historic preservation" areas for the plan
map? The answer was no.
Mayor Busse said he would contact Mr. Gann to indicate the
Council's decision on these three issues.
Attorney Narusis presented a draft ordinance amending Sections
26-15 (Responsibility for Installation of Water Mains and Service Pipes)
and Section 26-79 (Responsibility for Installation of Sewer Mains and
Service Pipes) for the Council's consideration.
Motion by Lieder, seconded by Donahue, to pass the ordinance as
presented amending Sections 26-15 and 26-79 of the Municipal Code of the
City of McHenry.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.

Mayor Busse presented the proposed annual tax levy ordinance for
the fiscal year beginning May 1, 1989 and ending April 30, 1990. The
proposed amount to be levied was $1,182,400. This was 7.4 percent less
than last year's levy. The ordinance was presented for the City
Council's review with passage of the ordinance to be at the November 15,
1989 Council Meeting.
Motion by Smith, seconded by Patterson, to approve the low bid
of Durabilt Fence Company of Round Lake in the amount of $4,340 for
installation of chain link fence to enclose the salt storage area on
McHenry Avenue as recommended by Director Batt.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Motion by Patterson, seconded by Donahue, to enter into an
agreement with J.R. Cummings & Associates for administration of the RAE
Corporation and McHenry Corporate Center Community Development Assistance
Program (CDAP) at a fee not to exceed $12,000 which would be payable with
grant administration funds.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.

Absent: Teta, McClatcrey.
Motion carried.
Motion by Smith, seconded by Serritella, to enter into a farm
lease agreement with Backhaus and Backhaus for 1990 to farm 23 acres of
City property for a sum of $1,610 as presented.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Motion by Serritella, seconded by Lieder, to pass a Resolution
adopting a Minority Business Enterprise (MBE) plan establishing goals and
procedures for the participation of Minority and Women -Owned Businesses
and Community Development Assistance Program (CDAP) and other
grants-in-aid projects as presented for the RAE Corporation CDAP Grant.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.

Absent: Teta, McClatchey.

Mayor Busse announced the resignation of Dick Rabbitt from the
Landmark Commission. He accepted the resignation with regret.
Mayor Busse called for a recess at 9:30 P.M. The meeting
reconvened at 9:45 P.M with everyone still in attendance.
Motion by Serritella, seconded by Patterson, to authorize
Director Batt to advertise for bids on a demolition contract to demolish
the Jepsen building on Elm Street recently purchased by the City so it
can be used as a parking lot.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Motion by Smith, seconded by Patterson, to grant the request of
Wal Mart Company and allow a hookup to the Police Alarm Board.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Chief Joyce gave a report on over width trucks in the City of
McHenry. No complaints had been received from any City residents. It
was decided to defer any action on adopting an ordinance until further
information is obtained.
A Special Meeting was called for Wednesday, November 8, 1989 at
8:00 P.M. to discuss City Hall construction.
Motion by Serritella, seconded by Patterson, to allow Director
Batt to advertise for a Wastewater Treatment Plant Operator Position and
a Water Meter Serviceman position.
Voting Aye: Bolger, Donahue, Lieder, Smith, Patterson,
Serritella.
Voting Nay: None.
Absent: Teta, McClatchey.
Motion carried.
Motion by Bolger, seconded by Patterson, to go into executive
session at 10:30 P.M. to discuss personnel, property acquisition and
pending litigation.

session at 11:18 P.M.

Motion by Lieder, seconded by Bolger, to authorize the Mayor to
hire Jack Proesel of 3212 Skyway Drive and Ernest Kurucar of 1708
Pleasant Drive as Public Works Maintenance workers with their salary to
be at the entrance level of Grade 6.

Serritella.
