The regular meeting of the City Council was called to order Council by Mayor Stanek on Monday, November 1, 1982. At roll call the following Meeting aldermen were present: Smith, Serritella, Nolan, Pepping, Busse, Meurer, Wieser, Datz. Absent: None. Also in attendance were Supt. Halvensleben, Attendance Attorney Narusis, City Clerk Gilpin, Chief Pasenelli. Park Director Merkel arrived at 9:15 P.M. Motion by Datz, seconded -by Pepping, to accept the minutes of the October 18, 1982 Regular Meeting as presented with one correction. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Wieser, Meurer. Voting Nay: None. Absent: None. Motion carried. Motion by Serritella, seconded by Nolan, to renew the license for one year on the video game business known as Another Galaxy located Video at 3421 W. Pearl Street, operated by Chuck and Connie Gillum. Game Voting Aye: Smith, Serritella, Nolan, Pepping, Busse. Room Wieser. Voting Nay: Datz, Meurer. Absent: None. Motion carried. The License Committee was instructed to study the requests of Video other applicants who had submitted requests for video game licenses and Game give its recommendation to the Council. Rooms Committees' Motion by Pepping, seconded by Nolan, to authorize and approve Special payment to Northern Bank Note Company of Chicago for printing of the Water/Sewer 1982 General Obligation Bond Issue in the amount of $220.00 Service Area and printing of the Special Service Area No. One Bond Issue in the amount of $662.00, with payment to be made from each individual Bond Issue Account. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer. Voting Nay: Wieser. Absent: None. Motion carried. Motion by Datz, seconded by Busse, to authorize and approve Special payment to Chapman and Cutler for professional services rendered and Service approving legal opinions for the water/sewer 1982 General Obligation Area Bond Issue in the amount of $2,500.00 and for the Special Service Area No. One Bond Issue in the amount of $8,500.00 with payment to be made from each individual Bond Issue Account. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer. Voting Nay: Wieser. Absent: None. Motion carried. Motion by Wieser, seconded by Smith, to concur with the Ordinances recommendation of the Zoning Board of Appeals and pass an Ordinance granting a zoning reclassification of property at 5016 W. Elm Street Zoning Ords from R-3A to B-1 owned by Joseph and Maria Burrafato. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Motion by Wieser, seconded by Smith, to pass a ordinance de- Ordinances creasing the number of Glass G liquor licenses to three; increasing the number of Class A liquor licenses to nineteen; and authorize the issuance Liquor of a Class A liquor license to Busy Bee Restaurant, 4623 W. Elm Street. Licenses Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Dati, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Monday, November 1, 1982 Page 2 Fences Owner of the Busy Bee, Tom Arvanitis, said he would be will- ing to install a fence at the rear of his property whenever requested to do so by the City Council. Band Motion by y pp Smith, seconded b Serritella, to authorize and approve Payments payment of $2,400 to the Music Performance Trust Fund of Elgin as a dona- tion to that musicians union for the ten band concerts conducted during the 1982 summer band concert season. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Sludge Motion by Nolan, seconded by Datz, to authorize and approve Mngt. payment to William Ziegler & Son, Inc. in the amount of $23,703.30 for Payment Estimate No. 1 on work done for wastewater sludge treatment improvements as authorized by Baxter & Woodman. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Easements Regarding a letter from Attorney Herman J. Marino of the law firm of Seibert and Daniels of Chicago, representing Albert and Marguerita Stilling of 1612 N. Lincoln Road, McHenry, concerning alleged "Rights of Easement for property at 1331 N. Riverside Drive, McHenry", Attorney Narusis was instructed to reply to the matter and inform the complainants that there was no basis on which they could assert any claims. McCullom Lake Discussion was held on a proposed Fishery Management Agreement Agreements for McCullom Lake. The matter was turned over to the Park Committee for recommendation. Committees Motion by Smith, seconded by Serritella, to authorize and approve Park Beer issuance of a Park Beer Permit to the McHenry Area Jaycees for a hayride Permits party in Knox Park on Friday, November 19, 1982. Voting Aye: Smith, Sdrritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. The meeting was recessed at 8:48 P.M. It reconvened at 8:55 P.M. with everyone still in attendance. Authorizations Motion b Meurer seconded b Pe y y pping, to authorize and approve Purchases purchase of used Christmas decorations from the City of Elgin in the Public amount of approximately $450.00 depending upon their condition at the Property discretion of the Supt. of Public Works. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Meadow Lane Motion by Meurer, seconded by Serritella, to authorize and Const. approve payment to the Illinois Department of Transportation in the following amounts as the city's share of the Meadow Lane Construction Motor Fuel project with payment to be made from the Motor Fuel Tax Fund: Inv.00950 Tax for $54,406.84 and Inv. 01176 for $25,388.54 = total of $79,795.38. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Bond Motion by Busse, seconded by Datz, to authorize and approve Payment payment to American National Bank & Trust Company of Chicago for principal and interest due on 1956 Water/Sfwer Revenue Bonds as follows: Principal - $8,000; Interest - $1,120.00 = Total $9,120.00. Voting Aye: Smith, Serritella, Nolan, Pepping, Busse, Datz, Meurer, Wieser. Voting Nay: None. Absent: None. Motion carried. Attorney Narusis reported that he had completed arguments before Monday, November 1, 1982 Page 3 the Appelate Court on the Peter Tutera vs. the�City of McHenry Law suit re: Tutera's zoning request for Condominium Zoning which the City Council denied on February 4, 1980. Narusis said it would probably be six weeks or more before a decision would be handed down. Wieser asked that the total cost of repairing and blacktopping First Avenue be made known to the Council. He asked Supt. Halvensleben to gather all the information including manhour's spent by city laborers. Motion by Wieser, seconded by Smith, to adjourn.
