The Regular Meeting of the McHenry City Council was called to order by Mayor Stanek on Monday, October 31, 1983 at 8:00 P.M. in city hall. At roll call the following aldermen were present: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Absent: Smith. City staff in attendance were Supt. Halvensleben, Attorney Narusis, Clerk Gilpin, Chief Pasenelli and Park Director Merkel. Motion by Serritella, seconded by Snell, to accept the minutes of the October 17, 1983 Regular Meeting as presented. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Mayor Stanek read a proclamation declaring that November 6-12 was Kiwanis Key Club International Week. Nora O'Malley, Executive Director of McHenry Hospital, addressed the council along with Hank Tonyan and Jim Brown regarding construction of a professional arts building to be located west of the new hospital. Motion by Bolger, seconded by Nolan, to inform the McHenry Hospital Board that while the City Council would prefer an individual water/sewer line for the medical arts building, the council would agree to give the hospital board the option of either hooking up the water/sewer service line to the existing McHenry Hospital lines for a period not to exceed five years or to hookup to the water/sewer lines off Medical Center Drive as is usual procedure and also that the City Council would agree to enter into a contract regarding said option. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Motion by Nolan, seconded by Datz, to pass an ordinance authori- zing the council to sell two lots in Orchard Heights Subdivision on the Fox River and to authorize a survey of both lots. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Discussion was held on whether or not to undertake snow plow- ing in subdivisions outside the city limits. It was decided to wait until the next meeting for further action. Motion by Datz,seconded by Nolan, to set a hearing date for the Hal Paul annexation agreement at a regular meeting of either November 21, 1983 or December 5, 1983. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Motion by Bolger, seconded by Snell, to authorize and approve final payment to William Tonyan & Sons for completion of the sewer improve- ment project in the amount of $941.35. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Alderman Snell, chairman of the Purchasing Committee, reported that three price proposals had been received on the 1984 Cargo Van for the Water Department as follows: Gary Lang Chevrolet $9,475.23; Mitchell Buick Olds $9,531.72; Sunnyside Company $9,400.00. Motion by Snell, seconded by McClatchey, to pass a resolu- 'Resolutions tion urging the Circuit Court to retain Branch Courts in McHenry and Crystal Lake. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Nolan, to accept the September Busse, Datz, McClatchey, Snell, ,Letter of Motion by Nolan, seconded by Datz, to grant a reduction in ,Credit the Letter of Credit for Winding Creek Unit II from $545,820.00 to $87,954.00 as recommended by Baxter & Woodman. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Citylic. Motion by Serritella, seconded by Nolan, to authorize and approve renewal for one year of Another Galaxy Video Game License as requested by Chuck and Connie Gillum, owners. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. 'Route 120 Motion by Bolger, seconded by Datz, to authorize and approve Bridge a supplemental agreement with the Illinois Department of Transportation for illumination of Route 120 Bridge over the Fox River as proposed. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Parks-Misc. Motion by Nolan, seconded by Busse, to name the park in Malibu Subdivision as the Malibu Playground. Voting Aye: Bolger, Nolan, Busse, Datz, McClatchey, Snell, Seritella. Voting Nay: None. Absent: Smith. Motion carried. Parks-Auth. Motion by Nolan, seconded by Busse, to eliminate all league Regulations baseball play on Sundays in City Parks. Voting Aye: Nolan, Busse, Datz, McClatchey, Stanek. Voting Nay: Bolger, Snell, Serritella. Absent: Smith. Motion carried. Motion by Nolan, seconded by Busse, to accept the Park Commit- teesrecommendation as stated in the Park Committee report of October 25, 1983 regarding limitation on the percentage of non-residents on ball teams. Voting Aye: Nolan, Busse, Datz, McClatchey, Stanek. Voting Nay: Bolger, Snell, Serritella. Absent: Smith. Motion carried. Monday, October 31, 1983 Page 3 Motion by Busse, seconded by Bolger, to grant a variance for two billboards as requested by Liberty Outdoor Advertising and that said specific locations be reviewed after a five year period of time. Voting Aye: McClatchey, Datz, Bolger, Stanek. Voting Nay: Serritella, Snell, Busse, Nolan. Absent: Smith. There being a tie vote the motion did not pass. Motion by Busse, seconded by Datz, to authorize the City Attorney to draw up a petition requesting the Zoning Board of Appeals to consider an increase in the square footage required for R4 from 2500 square feet per unit to 4300 square feet per unit. Voting Aye: McClatchey, Datz, Bolger, Nolan, Busse, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried. Sign Permits' & Variations Zoning Matters Motion by Busse, seconded by Snell, to pass an Ordinance amend- Ordinances ing the Fence Ordinance and increase side fence height from 5 feet to 6 feet. Voting Aye: McClatchey, Snell, Datz, Bolger, Nolan, Busse. Voting Nay: Serritella. Absent: Smith. Motion carried. Alderman Serritella, chairman of the License Committee, reported Committees -I that her committee had met to consider the dog and cat regulations but Auth, had decided to take no action at this time. Prior to renewal of the Instruct. j liquor licenses next year, the committee wants to suggest changing the Sunday opening hours for taverns from 6 A.M. to 10 or 11 A.M. The matter Liquor will be brought up in March of 1984 for final action. Control & Licenses Motion by Datz, seconded by Busse, to deny the request of the Wonder Lake Fire Department and Wonder Lake Rescue Squad to have the Police Deptl City of McHenry Police Department dispatch calls for those two agencies. Misc. - & Voting Aye: McClatchey, Datz, Bolger, Nolan, Busse, Snell, Requests- Serritella. Misc. Voting Nay: None. Absent: Smith. Motion carried. Motion by Bolger, seconded by Nolan, to accept dedication of Biscayne Drive in McHenry Shores and of Bonita from Biscayne to Forest McH. Shores in McHenry Shores. Motion by Serritella, seconded by McClatchey, to table'the matter until the next meeting. Voting Aye: Serritella, Snell, McClatchey, Datz, Busse. Voting Nay: Nolan, Bolger. Absent: Smith. Motion carried. Supt. Halvensleben was asked to contact the Illinois Depart- ment of Transportation regarding adjustment of the Traffic Signal lights IDOT on Green and Elm Street. Motion by McClatchey, seconded by Snell, to adjourn. Voting Aye: McClatchey, Datz, Bolger, Nolan, Busse, Snell, Serritella. Voting Nay: None. Absent: Smith. Motion carried.
