The Regular Meeting of the McHenry City Council was called to order by Mayor Busse on Wednesday, October 19, 1988 at 8 P.M. at City Hall. At roll call the following Aldermen were present: Bolger, Smith, Patterson, Serritella. Absent: Nolan, Teta, McClatchey. Lieder arrived at 8:07 P.M. City staff in attendance were Supt. Batt, Attorney Narusis, Clerk Gilpin, Finance and Personnel Administrator Vitas, Director of Development Greenwood. Absent: Park Director Merkel, Chief Joyce. Motion by Smith, seconded by Serritella, to approve the minutes of the September 29, 1988 Special Meeting, the October 5, 1988 Regular Meeting, the October 12, 1988 Regular Meeting and the October 13, 1988 Special Meeting as presented. Voting Aye: Bolger, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, Lieder, McCTatchey. Motion carried. Motion by Bolger, seconded by Smith, to pass acknowledging the contributions that Mary Vycital has Landmark Commission during her three years on that Board. Voting Aye: Bolger, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, Lieder, McClatchey. Motion carried. Council Meeting Attendance a Resolution made to the Resolutions Motion by Patterson, seconded by Bolger, to confirm the Mayor's Appointment appointment of Donnabelle Glosson Doherty of 4505 Front Royal Drive to Landmark fill the unexpired term of Mary Vycital on the Landmark Commission. Commission Voting Aye: Bolger, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, Lieder, McClatchey. Motion carried. Alderman Lieder arrived at 8:07 P.M. Mayor Busse called to order a Public Hearing to consider the request for extension of the Martin -Anderson Annexation Agreement. In Council attendance were Kenneth Glick, attorney for petitioners, and Mark Albert, Meeting developer of the property. Various paragraphs of the original Annexation Public Agreement dated October 2, 1978 were discussed. Paragraph 12 of the Hearings Annexation Agreement was discussed in detail. Mayor Busse noted that a two-thirds vote of the City Council is required for passage of annexation Annexations_ agreements. Motion by Serritella, seconded by Smith, to pass an ordinance granting a ten year extension of the Martin -Anderson Annexation Agreement Annexations contingent upon clarification of the intent of Paragraph 12 of the original Annexation Agreement. Voting Aye: Bolger, Lieder, Smith, Serritella, Busse. Voting Nay: Patterson. Absent: Nolan, Teta, McClatchey. Failed Motion carried but did not pass since two-thirds vote of the City Council Motion is required for passage of annexation agreements. Mayor Busse instructed Attorney Narusis and Attorney Glick to redraft Paragraph 12 to clarify the intent and bring the revisers Annexation Agreement back to the Council on November 2, 1988. Don Gerstad, representing the McHenry Country Club Board of Directors, addressed the Council to request a conditional use permit for enlargement of the locker room and conference room of the McHenry Country Club. Motion by Smith, seconded by Serritella, to pass an ordinance Ordinances granting the additional conditional use to McHenry Country Club for remodeling of their Club House. Zoning Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Ordinance Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Wednesday, October 19, 1988 Page 2 Superintend ent Batt presented a letter from Tom Scolaro of Garbage McHenry Woodstock Disposal stating that his operations will now be moved Disposal outside of City limits. The McHenry County Building and Zoning Rates & Department is requiring that they install a triple basin and holding tank Misc. to service the truck wash floor drains in the new garage. This waste at the McHenry Woodstock Disposal facility in the city limits is now being Sewer - flushed thru the City's sanitary sewer system. Scolaro wanted to explore Misc. the possibility of the City of McHenry Sewer Department providing treatment for this liquid. During discussion the Aldermen felt they needed more information than was presently submitted to them. Motion by Serritella, seconded by Patterson, to authorize the Superintendent of Public Works to inform Scolaro that he should establish a retained personnel account with the City to be used toward obtaining engineering consultation to decide whether it is feasible for the City to provide treatment for the truck wash floor drain liquid. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Gary Crist, who receives leaves from the City of Crystal Lake Leaf Program, contacted Superintendent Batt with a proposal to contract leaf pickup on a demonstration limited basis for $.30 per bag. Leaf Motion by Patterson, seconded by Lieder, to accept the proposal Pickup of Gary Crist for a trial period on leaf pickup at $.30 a bag with a cap of $10,000 and with the monitoring and scheduling of leaf pickup to be done by the Superintendent of Public Works. Voting Aye: Bolger, Lieder, Patterson. Voting Nay: Smith, Serritella. Absent: Nolan, Teta, McClatchey. Motion did not carry. Representatives of Amoco presented a revised landscape plan for a proposed service station on the northeast corner of Elm Street and Ringwood Road. Motion by Smith, seconded by Lieder, to approve the landscape plan as presented for the Amoco Service Station on the corner of Elm Landscape Street and Ringwood Road. Plans Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Motion by Smith, seconded by Lieder, to release the Letter of Letters of Credit for John Tyshenko (Tamara Royale Hotel) which was dated Credit November 7, 1988 contingent upon the City's receipt of "as built " plans and an appropriate maintenance bond by November 2, 1988. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Sewer Plant- Motion by Lieder, seconded by Serritella, to authorize and South approve payment of $476,724.00 to George W. Kennedy Construction Co. as partial payment for the McHenry Shores Area Sanitary Sewer Special Assessment No. 31 as recommended by Baxter & Woodman. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting % : None. Absent: Nolan, Teta, McClatchey. Motion carried. Public Purch. Motion by Lieder, seconded by Serritella, to authorize and Purchases approvement payment of $31,555.00 to Condor Construction Co. as a semi-final payment for the salt storage facility as recommended by Baxter & Woodman. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Sewer Lines Motion by Serritella, seconded by Smith, to authorize and approve payment of $42,155.75 to William Zeigler & Son for partial Repairs & payment on the John Street Sanitary Sewer replacement project subject to Ext. a waiver of lien from Concrete Specialties for materials included in the previous payment to the contractor. Motion by Patterson, seconded by Smith, to authorize and approve an interest payment to American National Bank and Trust Co. of Chicago for 1986 Wastewater and Sewer Revenue Bonds in the amount of $133,781.25. Voting Aye: Bolger, Lieder, Smith, Pattejā€¢son, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Mayor Busse called for a recess at 10:00 P.M. The meeting reconvened at 10:12 P.M. with everyone still in attendance. Motion by Patterson, seconded by Lieder, to pass a resolution Resolutions notifying the McHenry County Board that the City of McHenry objects to Zoning - the proposed reclassification of property on the northeast corner of Cty. Matters Route 31 and Bull Valley Road from B-2 to B-1 as presented. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Vot i ng Nay : None. Absent: Nolan, Teta, McClatchey. Motion carried. Proclamations Mayor Busse proclaimed the week of October 23 - 30, 1988 as "Family First Week". He also proclaimed November 13 - 19, 1988 as American Education Week and urged all citizens to affirm their support of public schools and to recognize the importance of investing in the future through education. Mayor Busse requested the Finance Committee to study salaries Committees for elected officials since any changes must be made 60 days before the Instructions April 4, 1989 General Election . Alderman Lieder, Chairman of the Finance Committee, set a Finance Committee meeting for Wednesday, November 2, 1988 at 7:00 P.M. in the Conference Room to review the McHenry Woodstock Disposal Franchise Agreement and salaries for elected officials. Motion by Smith, seconded by Lieder, to go into executive Exec. session at 10:28 P.M. to discuss property acquisition. Session Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Motion by Smith, seconded by Patterson, to go back into open session at 11:23 P.M. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. City Hall Motion by Lieder, seconded by Serritella, to notify Regional Building Properties Inc. that the City Council at the present time does not wish Program to pursue further study on their proposal and the Council should continue studying other locations Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Motion by Serritella, seconded by Smith, to authorize the Mayor City Hall to pursue studying land that the City presently owns at 1111 N. Green Building Street for development of a city hall facility by contacting architects Program or to look into what could be done with the existing site and to authorize him to incur whatever expenses are necessary for this study. Voting Aye: Bolger, Lieder, Smith, Patterson, Serritella. Voting Nay: None. Absent: Nolan, Teta, McClatchey. Motion carried. Motion by Smith, seconded by Patterson, to adjourn.
