Monday, October 19, 1981 in City Hall. At roll call the Mtg• following aldermen were present: Pepping, Nolan, Wieser, Datz, Smith, Serritella, Meurer. Absent: Harker. Attendance Also in attendance were Supt. Weber, Attorney Narusis, Clerk Gilpin, Chief Pasenelli, Park Director Merkel. Motion by Serritella, seconded by Datz, to accept the minutes of the October 5, 1981 regular meeting as read. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Motion by Pepping, seconded by Nolan, to accept the proposal of the McHenry Public Library Board and reduce its indebtedness to the City from Library $15,716.64 to $8,636.41 with repayment terms to be negotiated between the Finance Committee and the Library Board. Monday, October 19, 1981 Page 4 Sidewalks Charles Margosian, owner of the property at the northeast corner of Elm and Industrial Drive addressed the Council to request a variation on the sidewalk requirements along Elm and Industrial Drive where construction of a new Jewel-Osco store is in progress. After consideration, it was the consensus of the Council that no variations be allowed. Mayor Stanek called for a recess at 9:16 P.M. The meeting reconvened at 9:28 P.M. with everyone still in attendance. Motion by Pepping, seconded by Nolan, to pass an ordinance permit - Ordinance Street name ting a street name change from Garden Quarter Road to North Fox Lane contingent change upon payment by the people who requested the change for city attorney fees incurred in drafting and researching the ordinance as well as payment of costs incurred in the city clerk's office related to changing the records and computer programs. Voting Aye: Pepping, Nolan, Wieiser, Smith, Serritella, Meurer. Voting Nay: Datz. Absent: Harker. Motion carried. Meurer, Chairman of the Purchasing Committee, reported two bids Bid were received in connection with the purchase of five 1982 squad cars. Bid Opening opening took place on Saturday, October 17, 1981 at 10:00 A.M. in city hall as advertised. In attendance were Chairman Meurer, and Purchasing Committee members Datz and Nolan, Chief Pasenelli, Sgt. Robert Zujewski, City Clerk Gilpin. The bids were as follows: Mitchell Buick --Buick LeSabres, $52,767.75 without trade-ins and $43,965.75 with trade-ins; Buss Motor Sales --Ford LTD's $48,900.00 without trade-ins and $44,100.00 with trade-ins. Meurer reported there were no variations on the specifications from Buss Motor Sales but there were variations on the Mitchell Buick bid. He said the Committee considered the bids carefully as well as other related conditions and it was the recom- mendation of the Purchasing Committee to purchase the Buick LeSabres from Mitchell Buick. Motion by Wieser, seconded by Serritella, to purchase five 1982 squad cars from Buss Motor Sales at the bid price of $44,100.00 including trade-ins with the cars to be equiped with heavy duty split bench seats. Voting Aye: Pepping, Wieser, Smith, Serritella. Voting Nay: Nolan, Datz, Meurer, Stanek. Absent: Harker. Motion did not carry. Monday, October 19, 1981 Page 5 Motion by Smith, seconded by Pepping, to advertise for rebids with the same specifications as used before with one exception - straight heavy duty seat be substituted in the specifications in place of split bench seat. Voting Aye: Pepping, Nolan, Datz, Smith, Serritella, Meurer. Voting Nay: Wieser. Absent: Harker. Motion carried. Bid opening will be held Saturday, November 14, 1981 at 10 :00 A .M. in Bid City Hall. Authori- zation Motion by Serritella, seconded by Nolan, to authorize the use of the city's Layton Box to install blacktop on designated city streets and to utilize Street Mainte- city trucks and men for the job. nance Voting Aye: Pepping, Nolan, Smith, Serritella, Stanek. Voting Nay: Datz, Wieser, Meurer. Absent: Harker. Motion carried. Motion by Smith, seconded by Serritella, to authorize Supt. Weber to purchase blacktop mix and oil to resurface city streets from the contractor presenting the lowest cost proposal. Voting Aye: Pepping, Nolan, Smith, Serritella, Meurer. Voting Nay. Datz, Wieser. Absent: Harker. Motion carried. Motion by Meurer, seconded by Serritella, to authorize and approve pay - Street Mainte- nance ment of interest on the Water Works and Sewage Revenue Bonds, Series 1979, in Bond Pay - the amount of $31,950.00 plus a $25.00 bank fee, for a total payment of $31,975.00 ment to McHenry State Bank by the due date of November 1, 1981. Voting Aye: Pepping, Nolan, Smith, Serritella, Datz, Wieser, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Motion by Nolan, seconded by Pepping, to pass a resolution authorizing Reso- lution Phase One Preliminary Design Engineering for the Green Street FAU project with MFT payment to come from the Motor Fuel Tax Fund. Voting Aye: Pepping, Nolan, Smith, Serritella, Datz, Wieser, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Motion by Meurer, seconded by Serritella, to accept dedication of the Dedica- tion lot at the southwest corner of Prairie and Oak Streets in Lakeland Park from the Robin -Ladd Company, the Parcel number being 09-27-210-016. Mayor Stanek asked the Council to reconsider the Agreement made betwf Agree- ments the City of McHenry and McHenry Sand and Gravel Company on April 30, 1979, in Rater Dept. connection,with a Water Well on the Sand & Gravel Compan_v industrial property on the south side of Route 120. At one time, it was fel+ the Well could be of some future value to the city's water supply system. However, city engineers IT Baxter & Woodman, recently inspected the Well and advised that because of limited capacity, a history of screen clogging problems, physical condition and other significant drawbacks, the Well would be of little value if any to the City . Charles Miller, who signed the original agreement, said that in light of the ,-�ve facts, he proposed that Items 1 and 8 in the original agreeement be waived. Motion by Wieser, seconded by Datz, to accept the proposal of Charles J. Miller and waive Items 1 and 8 in the April 30, 1979 Agreement between the City of McHenry and McHenry Sand & Gravel Company, Inc. Voting Aye: Pepping, Nolan, Datz, Wieser, Smith, Serritella, Meurer. Voting Nay: None. Absent: Harker. Motion carried. Executive Motion by Nolan, seconded by Serritella, to go into Executive Session Session at 10:45 P.M. for the purpose of discussing pending litigation.
